ACTIVITY REPORT (activities during 2020)

1. Revision (jointly with MDB WG) of FIDIC Green Book as Friendly Reviewers2. Strengthening lines of communication with FIDIC 3. Re-design of the WG

1. Revision of FIDIC Green Book as Friendly Reviewers

• During June 2020 the WG worked jointly with MDB WG in the revision of theFIDIC Green Book

• The procedure was introducing comments to the draft provided by FIDIC• The revision was made in 2 weeks (and CICA responded to the challenge) • CICA comments were issued to FIDIC on June 22th, after consultation to the

members• FIDIC informed that the revision of CICA comments would be issued most likely

on October 2020

• In July the 9th the Chairman of the WG participated in a meeting CICA-FIDIC, where the agenda was around mainly to pick up the opinion of FIDIC about someconcerns raised by CICA

• In July the 14th the Chairman of the WG held a meeting with the Chairman of theContract Committee of FIDIC, Mr. Vincent Leloup, agreeing on the participation of CICA in the following tasks forces that probably will end in new books:• PPPs• Collaborative contracts• Offshore windfarms

• CICA accepted the invitation on 3rd August, expressing the availability to participate in the upcoming meetings of each task force

• CICA´s President asked the Chairman to re-think the operation of the WG, involving more participants, with availability to carry on the tasks required

• With this positive input, the Chairman invited the following proffesionals to be part of the WG:• Elisa Figueroa (South America) – Senior lawyer of NPG Law Firm, with broad

experience in NEC Contracts• Augusto Barros (Brazil) – Representative of DRBF and Leader of the

implementation of Dispute Boards in the Olimpic Games Rio 2016• Roberto Hernandez (Mexico) – One of the most outansding specialists in

Construction Law in Latin America and very close to ICC• Christian Diaz (Central America) – Specialist with broad experience in

contracts financed by IDB and President of ALDEC • Additionally, the WG was previously reinforced with Mrs. Yasmine Cetinel, on

behalf of the DRBF

3. Re-design of the WG

• With this new structure, the members of the WG, in a meeting held in July the10th, with the relevant participation of Mrs. Manuel Vallarino and Mrs. Denise Soares, agreed the following :

• Short-term (2 months)• Elaboration of a Position Paper related to lessons learned about the

performance of the construction contracts, and the parties, under thenew normal

• Webinar (most likely on September 2020) to present this Position Paperby the CICA´s President and other topics related

• Long-term – Creation of subgroups with the following tasks:• Enable lines of communication with NEC and ICC• Making contacts with Universities and Academy (KCL, Melbourne,

Stuttgart)• Good practices: Contact with leaders of collaborative contracts

initiatives (PPC 200 – FAC) and remarked specialists in BIM
