Your rights as a funeral consumer

Funeral services are regulated at both the national and state levels. At the federal level, the Federal Trade Com-mission provides for price disclosure and consumer protection through the “Funeral Rule.” Some of the primary consumer rights that the Funeral Rule ensures are:

Upon request, you will be provided funeral price information over the tele-phone.

You will receive a copy of the funer-al home’s General Price List, for your retention, when making an in-person inquiry about funeral products and/or funeral services.

You will receive an itemized “State-ment of Funeral Goods and Services Se-lected” once all of your selections have been completed at the conclusion of the funeral arrangement conference.

Laws regulating funeral service are state specific. There is usually a state-level agency that regulates the activities of funeral establishments and funeral directors. Questions re-garding the practice of funeral ser-vice in your state or a particular state law may be directed to your funeral director or to the appropriate state agency.

In Illinois, the Department of Profes-sional Regulation governs funeral ser-vice providers.

Veteran’s burial benefitsThe family of a veteran who was dis-

charged under conditions other than dishonorable may be eligible for cer-tain benefits at the time of his or her death. This may include:• Burial in a national cemetery• A Government headstone or marker• A burial flag• A Presidential Memorial Certificate • A burial allowance

Since gravesites in a national cem-etery cannot be arranged in advance, you should communicate your wishes to family or the person that would be responsible for your funeral arrange-ments. It is also important that this person know the location of your dis-charge papers (DD-214).

Burial benefits available for spous-es and dependents buried in a national cemetery include burial with the Vet-eran, perpetual care, and the spouse or dependent’s name and date of birth and death inscribed on the Veteran’s head-stone, at no cost to the family.  Honoring Those Who ServedThe Department of Defense is re-

sponsible for providing military fu-neral honors. “Honoring Those Who Served” is the title of the program for providing dignified military funeral honors to veterans who have defended

our nation.Upon the family’s request, Public

Law 106-65 requires that every eligi-ble Veteran receive a military funeral honors ceremony, to include folding and presenting the United States burial flag and the playing of “Taps.” The law defines a military funeral honors detail as consisting of two or more uniformed military persons, with at least one be-ing a member of the Veteran’s parent service of the armed forces. The pro-gram calls for funeral home directors to request military funeral honors on behalf of the Veteran’s family. Howev-er, the Department of Veterans Affairs National Cemetery Administration cemetery staff can also assist with ar-ranging military funeral honors at VA national cemeteries. Veterans organi-zations may assist in providing mili-tary funeral honors. When military fu-neral honors at a national cemetery are desired, they are arranged prior to the committal service by the funeral home.

Where to begin the funeral processIt can be hard to know where to begin when planning

a funeral. Many questions may run through your mind. Who should I contact first? Who contacts the clergy? Who contacts the cemetery? What are my options for funeral services? How much does a funeral cost?

Know that you are not alone.When you need to make funeral arrangements, know

that your funeral director is prepared to help you with all of the important details. He or she will outline the

entire funeral arrangement process for you, explain your options, contact all of the parties involved in the arrangements on your behalf and will make sure that everything is coordinated to your specifications.

Making ArrangementsThere are many services that your funeral director

can provide for you. First and foremost, they want to make this time as easy as possible. The following is a partial list of the items your funeral director can assist

you with:Creating a personalized and meaningful funeral hon-

oring your loved one’s lifeExplaining your full range of service and merchan-

dise options• Coordinating a newspaper or online obituary• Preparing and filing the death certificate• Coordinating with the clergy and/or your church• Arranging for a funeral celebrant or clergy if you do not have one• Coordinating cemetery arrangements• Coordinating crematory arrangements• Securing musicians• Securing flowers• Coordinating memorial contributions to your favorite charity• Notifying the Social Security Administration of your loved one’s death• Providing information on Veterans benefits and military honors• Arranging or assisting with meals and receptions

Prior to your making any decisions regarding funer-al services or merchandise, your funeral director will provide you with a copy of the funeral home's General Price List. This document will help you understand all of your options with regard to funeral services and re-lated merchandise. He or she will provide guidance and assist you in making decisions that are most appropriate for you and your family.

Planning the funeral luncheon

One way many families get through the grieving pro-cess after losing a loved one is to gather with friends and family after the funeral service for a funeral lunch.

Although this is obviously not a traditional family gathering, the funeral luncheon can be a time of great celebration.

This is an ideal time to share happy memories and funny stories of the deceased, and to play music he or she loved. If you have had a chance to funeral preplan because of a terminal illness, you might even be able to incorporate the direct wishes of the deceased, who might have helped to select the venue or events.

No one is expecting a five-course, sit-down meal, and there is no wrong way to host a funeral luncheon. But there are some necessary arrangements that have to be made.

The biggest arrangement is to decide on a venue. There are three traditional choices: the home of the de-ceased or another family member; a restaurant or ban-quet hall; the church community room. You can also bring food into most funeral homes, which usually have rooms set aside for food and beverages. Each has its own pluses and minuses.

Holding the lunch at a home is often the least expen-sive option. A family member can cook, you can hire a caterer or ask family members and friends to bring a dish potluck-style. This option can often ensure left-overs for the family and is the most intimate setting that has no time limit. The gathering can go on as long as family and friends want to remember the loved one. You could also make sure that a special favorite of the loved one is available, in his or her honor.

A restaurant or banquet hall is more expensive and you may be limited to what food options are available. But many establishments are located close to funeral homes and cemeteries, so the location is more conve-nient to those who attended the funeral. Many estab-lishments also have funeral luncheon packages avail-able for the family.

Depending on your faith, the loved one may have be-longed to a church that has a community or social room and it may offer a funeral package. The food at a church luncheon is often home-made by members of the con-gregation but catering is also an option.

The funeral luncheon is less about the food and more about the companionship of friends and family gather-ing together to memorialize the loved one.

at their permanent resting place is a time-honored tradition. Whether it was the ancient Egyptians constructing the pyramids, the erection of a grand private mausoleum, the Tomb of the Unknown Soldier at Arlington Cemetery, or a sim-ple burial space with a marker, the idea of a dignified burial and remembering our deceased loved ones is an important tradition. We care for these places and visit them to remember and feel connect-ed to this special person in our lives. A cemetery provides a peaceful environ-ment for our loved ones to rest and for us to honor their memory.

Cemetery Property OptionsLike funeral homes, cemeteries can

provide many dignified options for a family, depending on their personal taste and budget. You can select individual burial spaces for a casket or urn (if se-lecting cremation) or a group of spac-es for multiple family members. The options are varied and will depend on the individual cemetery’s offerings and available inventory.

When selecting a cemetery, you may want to seek personal recommendations from friends, business associates, your clergy or a funeral director. Be sure to inquire with the cemetery representative as to their maintenance practices, wheth-er it is a “perpetual care” cemetery (a

portion of the purchase price is placed into a fund for the upkeep of the cem-etery) and any other pertinent rules or regulations regarding: flower placement, allowing upright monument and/or flat markers, special seasonal decorations on graves, etc.

Depending on the individual ceme-tery’s design and availability, some of your property options may include:

Single-Depth Burial Space  – Uti-lized for one person. The cemetery will have a policy regarding the type of grave marker (flat, or upright) that can be placed to identify the grave.

Double-Depth Buri-al Space  – Utilized for two persons. The space appears to be the same size as a single buri-al space, but the grave is deeper than normal. The first person is placed at a deeper than normal depth and the second per-son is buried at a normal depth on top of the first.

Family Lot – An area designat-ed for multiple family members. The cemetery can provide options as to the number of burial spaces con-tained within the family lot.

Lawn Crypt – This is similar to a typ-ical burial space and may be single or double depth. There is a concrete grave liner (crypt) already placed in the ground

where the casket will rest.Mausoleum  – A building designed

for above-ground placement of the cas-ket. The casket is placed into a crypt that may be designed for one or two persons. The mausoleum may be outdoors or in-side a climate-controlled building.

Private Estates – Available in a wide variety of offerings, depending on the cemetery. This would typically be a pri-

vate mausoleum building or a private grouping of burial spaces contained within a designated area. Some ceme-teries offer custom-designed family estates built to your specifications.

Casket OptionsCaskets are typically

crafted of either wood or metal. The cost of a casket is

most influenced by the type of ma-terial used in construction and the grade of interior fabric. There are many dig-nified options available in a broad price spectrum to suit your individual needs.

The selection of casket is a very per-sonal one and will be determined based on the deceased’s wishes, economic considerations and personal taste. There are many options because each family’s needs are different.

Interior fabric used in casket construc-tion can range from simple crepe fabric to

a more luxurious look using plush velvet. In addition, some caskets are designed to be “protective,” meaning they are designed to withstand the entrance of outside ele-ments and other gravesite substances.

Outer Burial Container OptionsMany cemeteries have a requirement

that an outer burial container be placed around the casket in the ground. The pri-mary reason for this is that the casket is not designed to withstand the weight of the grave and the heavy equipment used in routine maintenance of the cemetery. An outer burial container helps support the weight of the grave, helps protect the integ-rity of the casket and can aid in keeping the grave level, which contributes to the over-all positive appearance of the cemetery.

Like caskets, there are options in out-er burial containers from which you can choose based on your personal needs, taste and budget. Some of the materials that are commonly utilized in manufac-turing outer burial containers include concrete and various types of metal.

Your funeral director will advise you as to the outer burial container options that are available in your area and are most widely utilized in the cemetery of your choice.

Advance Funeral Planning

Many people are confused as to what is involved in a ‘prearranged’ or advance funeral plan. Moreover, different funeral homes may vary in their opinions and approaches when discussing prearranged funerals. At the Wolniak Funeral Home, our staff discuss advance funeral planning by explaining the following two parts:Part One includes:Recording biographical information;Discussing the types and costs of services and merchandise;Listing relatives and legal representatives; andDocumenting all requests and instructions.

Part Two includes:Determining whether or not the funeral should be funded in

advance;Explaining the contents of the Illinois Consumers Guide to Preneed

Funeral and Burial Purchases;Presenting the funding options available; andDispersiment of the documents.

It is important to emphasize that funeral plans can be kept on file at the funeral home without paying for them in advance. If you have sufficient assets available, (i.e. personal insurance, trust funds, etc.) and most essential, good communication between family members, then it may not be necessary to pre-fund your funeral. The non-funded funeral plan’s purpose then serves as a guideline to the family and/or legal representative at the time of death; however, it would be up to them whether or not to proceed with the requests on file.There are circumstances when paying for the funeral in advance is definitely the right decision. The following are some examples where funding in advance make sense:If a person is applying for state assistance, as in the case of nursing

home care; (If properly funded, the State of Illinois allows such prepayment for a long-term care patient.)

If a person does not have any family member able to handle funeral decisions;

If a person does not want to burden a family member with financial decisions;

If a person is concerned with the inflationary rise of costs.Each person’s funeral plan should be considered on an individual basis, especially when determining if the funeral will be pre-funded. It is important to plan with a qualified person. The plan should be coordinated and overseen by a certified preplanning consultant or funeral director with preplanning experience. A funeral home must be licensed by the State of Illinois, Office of the Comptroller, to do advance funeral planning. All legal requirements by the state and federal government should be discussed. If you have a prearranged funeral, it is important for your family to know. Your plan will be of no assistance to your loved ones or legal representative if they are not aware that you have a plan in place. Palos Hospice provides peace and dignity at end of life

Receiving a diagnosis of end-stage illness is never easy. A range of varying emotions are involved at a time when important decisions need to be made, not the least of which is how you or a loved one will obtain care. Hospice pro-grams have helped many patients face the end of life in a comfortable and meaningful way in the warmth and pri-vacy of a home or care facility.

“Hospice is designed to focus on the comfort and care of the patient,” said Maureen Fitzgibbons, Hospice Director for Palos Home Health. “We not only provide medical support during the fi-nal phase of a terminal illness, but also emotional and spiritual support to pa-tients and their families.”

In fact, hospice care usually in-volves an entire team devoted to en-suring the patient enjoys days that are as full and pain-free as possible. At Palos Hospital, the hospice team is overseen by the medical director and may include the patient’s prima-ry physician, registered nurses, cer-tified nurse aides, social workers, dietitians, a chaplain and a bereave-ment coordinator as well as physical, occupational and speech therapists. This team is responsive to the special needs of each individual and family, coordinating all services, including

obtaining medications and medical equipment and supplies, assistance with nursing and personal care, pro-cessing paperwork, respite for family members and grief support. The en-tire support system is designed to be there every step of the way, helping to ease the journey.

“Hospice should not be looked at as a

last resort,” said Michele Glenn, Hospice Manager at Palos, “but as a wonderful opportunity to surround themselves with the people they love and the things that bring them joy at the end of life. Often reduced emotional and physical pain helps to enhance those experiences for everyone involved.”

Residents of Will, DuPage, Cook

and Kendall counties are eligible for hospice through Palos Hospital. In order to enter the Palos program, the patient must have a life expectancy of six months or less as determined by the attending physician and the hos-pice medical director. At this time the patient, along with his or her family, must agree that the focus of medical care will shift from curative to pal-liative. “Everyone is involved in the decision process,” said Fitzgibbons. “Medical interventions are no longer used to cure the disease, but rather all efforts are focused on managing the patient’s symptoms for optimal well-being.”

Palos Hospital’s hospice program is accredited by the Joint Commission, the nation’s largest health care ac-crediting agency, which means it has undergone rigorous scrutiny. State-li-censed and Medicare-certified, all staff members have received special

Zarzycki urges having the Talk of a Lifetime

In a recent study by the National Fu-neral Directors Association, 46 percent of adults over the age of 40 have had conversations with family or friends about how they want to be remembered during their funeral or memorial ser-vice. So, less than half of people sur-veyed have had that important discus-sion. And yet, in that same survey, 89 percent indicated that they feel a dis-cussion about their end-of-life wishes would be meaningful.

At Zarzycki Manor Chapels, we see

Cremation gains acceptance and comes with choices

Persons selecting cremation for themselves or a loved one have the same options for

services and merchandise as those who select casket burial.

What many people do not realize is that crema-tion is a process and is not the final disposition of the human remains. A determi-

nation will need to be made as to the person’s final resting

place. This important place will be used to memorialize the life lived and will serve as a place for family and friends to

visit and honor the memory of their loved one.Some of the most commonly chosen options for the

final resting place for cremated remains include:Earth Burial  – Some cemeteries have a designated

area with burial spaces specifically designed for the placement of cremated remains. In addition, arrange-ments can sometimes be made to place an urn in the family lot where other persons in caskets may have their final resting place.

Indoor/Outdoor Columbarium  – A columbari-um is similar to a mausoleum for caskets. The small-er spaces or niches are used to place the urn and may have a glass or a granite front. Some niches may have additional room for personal items to be placed with the urn. Like a mausoleum, a columbarium may be out-doors or within a climate-controlled building.

Scattering – Some people choose to scatter all or a portion of their loved one’s cremated remains in a spe-cial location. It is important to check with your funeral director to ensure that this act is permitted in the loca-tion of your choosing. Caution should also be exercised when scattering as it is a final irrevocable act. Be cer-tain that this is what you want to do before proceeding.

Other Options – Determining the final resting place of your loved one is a personal decision. Some people chose to keep the urn at their home for a period of time. This is ultimately your decision but it is recommended that you give consideration as to your long-term plans for the urn or multiple urns you have in your home. A trusted advisor or family member should have clear in-structions as to what should happen to the urn or urns after your death.

Selecting a Cremation Casket or ContainerThe crematory that is utilized will usually have a re-

quirement that the deceased be placed in a rigid con-tainer for the cremation process. Either a cremation cas-ket or container will fulfill this requirement.

Cremation caskets and containers are both typically made of wood, fiberboard or a composite of materials. A cremation casket has a finished interior and closely resembles a casket used for earth burial. A cremation container is designed to fulfill the crematories’ mini-mum requirements and typically does not have an inte-rior lining or has a minimally finished interior.

A person who chooses to have viewing, visitation and/or funeral services in their church or funeral home prior to cremation will typically select a cremation cas-ket. Some funeral directors also have a ceremonial or rental cremation caskets available as an option.

Your funeral director can assist you in making a se-lection of a cremation casket or container that is appro-priate for the arrangements you have chosen.

Selecting an UrnThere are many urn options available in a broad price

spectrum. Metal, glass, wood, granite, marble and oth-er materials are commonly utilized in urn construction. There are also specialty urns available that reflect a per-sonal statement on a person’s life, hobbies, etc.

Your funeral director will explain all of your urn op-tions and any special considerations at the final resting place you have selected that should be part of your de-

cision making process.

Selecting an Outer Burial ContainerShould you select earth burial for a final resting place

for your loved one, the cemetery may require an outer

burial container to surround the urn or container in the ground. This would be a smaller version of those uti-lized for caskets.

Your funeral director will inform you if this ceme-tery requirement exists and describe your options.

Several service options now availableWhether you select casket

burial, placement in a mausole-um or cremation, your options for funeral services and merchandise selections are very similar. Ulti-mately, after receiving informa-tion regarding your options, you can determine the type of funeral arrangements that are most ap-propriate.

Here are some of the most common elements of a funeral service:

Visitation or viewing: A viewing or visitation typically at the funeral home, is a gathering with or without the casket pres-ent. Generally, this event is less formal than a funeral service and is time for the family and friends to come together, express their grief and draw support from one another. There may or may not be viewing of the deceased, de-pending upon the circumstances or personal wishes. Viewing is encouraged by grief experts as it presents an opportunity to con-front the reality of death and begin the healing process.

Funeral or Memorial service: While many persons may use these terms inter-changeably, the term “funeral service” is usually used to indicate a gathering with the casket of the deceased present, con-ducted prior to burial or cremation. The casket will be open or closed depending on the venue for the services and/or the

family’s wishes. The term “memorial service” is typi-

cally used to describe a service where the casket is not present. As this service is “in memory” of the person, there may be a focal point such as an urn, a picture or a floral arrangement in place of the casket. A memorial service can take place at any time prior to or after the burial, crema-tion or other form of disposition.

There are considerations to be made when determining the type of funeral service that would be most appropriate to honor your loved one. For many peo-ple, their religious preference may be the most important factor. If this is the case, your priest, rabbi or minister will be a good source of information for how the ritual should be followed.

Some persons may desire a religious

service but do not currently be-long to a church. Your funeral director can assist you by helping you locate a clergy or lay person of your preferred denomination to officiate at the service.

Just because a person did not belong to an organized religion does not mean they should not have a funeral. The most import-ant component of the funeral is to honor the life lived and for friends and family to have their opportunity to mourn and draw strength from one another.

A non-religious funeral ser-vice can be a very formal or in-formal event and can be held in a funeral home or other venue the family finds appropriate. A friend or close acquaintance who is familiar with the deceased and is comfortable functioning as the master of ceremonies can be chosen to lead the service.

In addition, many persons have received training as a fu-neral celebrant, including some

members of funeral home staffs. Your funeral director may be familiar with someone in your community.

The Committal or Graveside Ser-vice: This type of funeral service is held at the final resting place. It typically follows the funeral service held at the church or funeral home. In some instanc-es, a family may elect to have the entire funeral service at the place of committal.

Central Chapel, new but still old-fashioned

Central Chapel - Funeral & Cre-mation, having been built in 1985 is, in fact, the newest funeral home on the southwest side of Chicago. Yet, it was intentionally founded to be old, old-fashioned, that is, a throwback to a time when neighborhood funer-al parlors only served one family at a time.

Donald Feeley founded Central Fu-neral Chapel in 1985 and operated it with his wife and daughter. Feeley died in 2004. In 2010, his wife, Regina, sold the funeral home to Robert Moynihan, who grew up in Evergreen Park. Moynihan knew a thing or two about the neighborhood funeral parlor concept, having owned the Kelly-Carroll Funeral Home in Brighton Park for years. He had also managed Lain-Sullivan Funeral Homes for years just prior to his purchase of

Central Funeral Chapel.The first thing Moynihan did when

he bought Central was to slightly edit the name to Central Chapel -Funeral & Cremation, a nod to the increasing trend toward cremation. The second

thing he did, on the second day, was to hire longtime Garfield Ridge resident, Ann Jedlowski, as Office Administra-tor and Tribute Coordinator. Ann is a friendly and familiar face in the com-munity.

Central Chapel has been complete-ly renovated and redecorated on the inside over the last 5 ½ years, includ-ing an greatly expanded lounge and reception center. At present, an exte-rior renovation project, including new doors, windows, awnings and a cano-py, is almost finished.

Moynihan acknowledges that the biggest change is that Central Chap-el now serves approximately 140 families each year, which is about 3 ½ times the number of families pri-or to 2010. While Feeley’s concept was ONE FAMILY AT A TIME, Moynihan believes that ONE FAM-ILY TELLS ANOTHER. He attri-butes the growth of the firm to the best kind of advertising: word of mouth. And the story Bob Moyni-han and Ann Jedlowski tell is that their service is unique because it is both DISTINCTIVE AND AF-FORDABLE. While Central Chapel
