Researchers from Sherman College of Chiropractic have found preliminary evidence that regular chiropractic care reduced blood pressure in middle-aged African Americans. Earlier research has suggested that chiropractic adjustments can decrease blood pressure in patients with cervical spine dysfunction or anxiety. However there have been no age and racial-specific studies on the effects of chiropractic on blood pressure. Researchers conducted a non- randomized, non-controlled pragmatic study to evaluate the feasibility of a future clinical trial. The results are still considered preliminary, but since they support earlier findings, they are highly suggestive as to the potential effects chiropractic can have on blood pressure. The study included 58 hypertensive patients of African American descent who were over the age of 40. Patients received one year of chiropractic care for various spinal conditions, and their blood pressure was taken three times throughout the course of the study. The researchers discovered that in patients with a BMI lower than 50, diastolic blood pressure significantly decreased over the course of treatment. Patients with a BMI higher than 50 (considered severely obese), did not experience the same drops in blood pressure. This led researchers to suggest that obese patients may be “more resistant” to blood pressure reductions than non-obese patients when it came to chiropractic care. Chiropractic care isn’t the only hands-on therapy that may help with hypertension. A study published earlier this year showed that massage decreased blood pressure in pre- hypertensive women. Nearly a third of Americans have high blood pressure, putting them at risk

for heart disease, stroke, and number of health conditions. While medication is the primary treatment for hypertension, there are several non-pharmaceutical ways to manage high blood pressure including stress reduction, weight loss, and diet changes. Now, a growing body of research suggests that chiropractic care could help. Most people use the word “consult” in an incorrect manner as it pertains to our professional services

under the CPT code rules. Part of the initial evaluation and management service DCs’ provide is face-to-face time reviewing the history of the present complaint/illness. We often have referred to that as a “consultation”. It is perfectly fine, if your appointment with a patient stops there, to not charge because you have not completed the whole E&M service. There is no CPT code that covers “reviewing the history only”. So, with that in mind, my answers to the member’s questions appear below.1. Is a consultation a service or a prelude to a service?

A consultation involves a referral, an examination and a written report to the referring doctor so this is not a consultation. You could call the time that you are only speaking to the patient about the history of their present illness as a “pre-service interview”. There is no code for that so you wouldn’t be able to bill it to a carrier and

PQRS has changed again for 2014. A few of the most significant changes are listed below.

• There is now a THIRD measure on which you can report (#317).

• There is a new code for measure #182, AND the thresholds have been changed.

• Some of the existing code definitions have been altered.• PQRS reporting is part of other CMS programs which

currently affect you (e.g., Physician Compare) and will affect you in the near future (e.g., Value Based Modifier).

Note that this is the last year you can earn incentive money for satisfactorily and successfully participating in PQRS, and it is the second year where non-participation will cause you to suffer a penalty. In addition, penalties will increase over time and are cumulative. It is highly recommended that you start participating now to avoid future loss of income due to penalties. you should make a policy that you never charge anyone for that.

2. If it is a service, does the regulation only pertain when it is advertised as such? It isn’t a bonafide service as to CPT code guidelines. Why would you use this as an advertising campaign? Just always state that you never charge for a pre-service interview.

3. If it is not advertised as such, would mentioning it during the initial telephone contact be considered advertising? No, unless you’re cold-calling prospective patients.

4. If it would be, would it still be qualified as such if the patient asks the charge of the consultation and only then is it mentioned that there is no charge? It doesn’t qualify at all, really. It’s a portion of a service not complete. You do have to inform the patient the moment the charge will begin. For example: “This office never charges for a pre-service interview, meaning when you just are reviewing the history of your case face-to-face with the doctor. If, during that interview, you and the doctor agree that you would like further evaluation for this problem which would include a completed physical examination, a charge would then occur.” This is not bait-and-switch, it’s as if you see Medicare patients who have transitioned to a maintenance/wellness state, offer them the ABN, they choose Option 3 and leave. You don’t charge them for the adjustment because you didn’t perform it.

The American Chiropractic Association (ACA) achieved a surge of advocacy accomplishments on behalf of the

chiropractic profession in 2013. From increased Medicare reimbursement for chiropractic services, to fighting managed care abuses and increasing veterans’ access to the services provided by doctors of chiropractic (DCs), ACA’s strong advocacy record remains intact and will grow stronger in the year ahead following the upcoming 2014 National Chiropractic Legislative Conference (NCLC), February 26–March 2 in Washington, DC. ACA’s more significant achievements in 2013 include: • $60 Million Medicare Reimbursement Increase:

Medicare payments to DCs will increase by an estimated $60 million, and the value of Chiropractic Manipulative Treatment CPT® codes will increase up to 10 percent in 2014.

• BCBS Federal Employees Plan Defines DCs as Physicians Without Limitation: DCs will no longer have any limitations attached to their definition as physicians under the 2014 Blue Cross and Blue Shield (BCBS) Service Benefit Plan.

• VA Expansion: The Department of Veterans Affairs (VA) began pilot chiropractic residency programs; and provisions in the Veterans’ Educational Transition Act of 2013 that would significantly increase the numbers of DCs serving at VA facilities, along

Chiropractic Organizations Unite Behind Public Position on Chiropractic as a Drugless Approach to Health Care: November 21, 2013 -- In an historic and profoundly significant unanimous position statement, the more than 40 organizations that comprise The Chiropractic Summit have adopted a clear and concise public position on chiropractic science and practice as a drug-free approach to health care. At a meeting of the Summit organizations in Seattle, Washington on November 7, 2013, the Summit adopted the following statement: The drug issue is a non-issue because no chiropractic organization in the Summit promotes the inclusion of prescription drug rights and all chiropractic organizations in the Summit support the drug-free approach to health care. “This definitive and unequivocal position statement puts to rest any question as to position of all of the credible organizations within the chiropractic profession on the issue of drugs,” said ICA President Dr. Continued on page 5 Continued on page 7

• Aetna Reverses Policy Denying Same Day Payment for 97140 and CMT: Aetna reversed a policy that denied separate payment for 97140 when billed with CMT, even when the two procedures were performed to separate regions and when modifiers 25 and 59 were used appropriately.

• Standing Firm Against Managed Care Abuses: A federal judge

ruled that a DC may pursue overpay-ment allegations against United

Healthcare (UHC) even though his or her patients may no longer be insured by them—a favorable decision in ACA and related plaintiffs’ class action suit against UHC and Optum Health.

• Medicare Coverage of DC Evalu-ation and Management Services Advances: The Department of Health and Human Services is considering reimbursing DCs for evaluation and management services, which would be the biggest potential breakthrough for the profession since chiropractic

services were included in Medicare in the early 1970s.

• Challenge to DC Physician Status Repelled but Further Action Required: ACA was a key part of a coalition effort that retained DC physician status in the Senate version of a Sustainable Growth Rate (SGR) reform package. ACA has made great strides toward ensuring DC physician status in the House version of the bill, but profession-wide advocacy is still needed.

“On behalf of ACA’s leadership and management team, I extend a heartfelt thank you to the dedicated DCs, CAs and student volunteers who helped make these crucial advocacy victories possible,” said ACA President Keith Overland, DC. “However, the profession will again be tested in early 2014 as anti-chiropractic lobbyists align to attempt to remove DC physician status under Medicare and to reverse other recent gains.” ACA and its allies will meet with legislators on Capitol Hill Thursday, February 27 during NCLC 2014 (and they’ll stay in Washington for the more than 20 hours of chiropractic continuing education and professional development).

ICA’s Landmark Lawsuits Against Major Insurance Companies Moving Forward: ICA continues to press forward on two major lawsuits against insurance carriers alleging violations of ERISA law in their conduct of post-payment review and recovery procedures. ICA’s major goal in these proceedings is to secure significant changes in insurance company procedures and establish fair and reasonable review and appeal policies. Repeal of McCarran-Ferguson Act A Top Priority for ICA in 2014: Health insurance companies remain outside the anti-trust laws and are thus able to engage in the kind of predatory and discriminatory behavior, collusion and price-fixing activities that would land any other industry in serious federal trouble. The repeal of the MacCarran-Fergusion Act, passed in 1946 giving the “business of insurance” an exemption from federal anti-trust laws, needs to be aggressively pursued. The repeal of the MacCarran-Fergusion Act, passed in 1946 giving the “business of insurance” an exemption from federal anti-trust laws, needs to be aggressively pursued and will be one of ICA’s top federal policy priorities in 2014 and beyond. ICA is in discussions with Members of Congress from both Houses on this key objective.

Ariya Family Chiropractic Center Rallies Patients, Together Donating

More than $6,000 to Community

Dr. Minesh Patel and Dr. Nisha Saggar, both VCA Members, are pleased to announce that their

recent funding efforts were a big success. They were able to contribute more than $6,000 to local charitable organizations. The money was raised by offering patients of their three practices the opportunity to receive free adjustments, but make a donation to a local charitable organization. Patients of their Richmond office contributed more than $800 to Safe Harbor, a local organization with a mission to empower survivors of sexual and domestic violence to transform their lives and promote healthy relationships for all. Ariya matched the $800. The donation was especially remarkable given that the office had been open for less than one month when the fund-raising event occurred in December. Combined, the Petersburg and Colonial Heights practices contributed $5,000 for The Fort Lee Holiday Helper Association. Ariya patients raised $3,200 for the charitable organization, exceeding the 2012 gift. Since 2000 the military and civilian communities around Fort Lee, Virginia have banded together to ensure that the children of local service members have holiday gifts.

travelled to Las Vegas last month to help launch the Athletic TIPS™ certification seminar. The doctors’ participation in this inaugural event was sponsored by the VCA. They were selected by the VCA Board of Directors for their interest and experience in sports chiropractic. “TIPS”, the acronym for Towards Injury Prevention in Sports, is a program driven by the need to raise awareness and ensure the protection and safety of youth participants in sports, especially those sports that put players at risk for collisions and traumatic brain injury. Modules include Concussion, Dehydration, Sports Nutrition and Sports Injury Prevention. VCA’s Dr. Jay Greenstein has been a key player in development of this program, along with Dr. Alan Sokoloff (team chiropractor for the Baltimore Ravens) and Dr. Spencer Baron (team chiropractor for the Miami Dolphins) -- aka “The Three Amigos.” Athletic TIPS™ seminars are training DCs on how to conduct community workshops on a variety of topics in their local community. Member PerspectivesHerded Toward Extinction?

Maybe you’ll think I’m crazy. Maybe I’m the only one who feels this way. Maybe it’s mindless paranoia, but

it’s the way at least one chiropractor feels. When sheep are herded, they don’t know where they’re going or what they’re headed for. They may think they are headed for greener pastures. The herders may have a different idea. The sheep fail to understand the herders’ motives. PQRS, ICD-10, EHR/ Meaningful use are all based strictly and unequivocally upon a medical model of health care. They force us to identify, “diagnose”, “treat” and report on pathology, disease, sickness, or infirmity -- which have very little to do with the chiropractic model of helping people to get well and stay well; of being pro-active rather that reactive; of assisting rather than “treating”. The velvet trap has been laid for us to become absorbed, integrated and trapped into being reporters and “treaters” answerable to and part of the medical empire. . . Pawns on the path to a continuation of the type of care that has earned the dubious accolade of ranking 46th in the world in health care effectiveness. We will become their little helpers. They’ll throw us some crumbs at below-market wages and tell us to be happy with it. What a deal. Trading our identity to become part of their “team”. Is this what our forefathers went to jail for? We’re being herded toward a loss of identity; toward extinction. Here are some examples of diagnostic codes that I found in the ICD-10 Manual for Chiropractic: • Non-venomous insect bite of the left ear, • Injury of the left carotid artery,• Oculomandibular Dysostosis,• Malignant Necrotizing Syndrome,• Sub acute Necrotizing Myelitis,• Spondyloepiphyseal Dysplasia. Chiropractic Codes? I know what the voice in your head is saying, “But what choice do we have?” What would happen if 50,000 chiropractors stood up and said “No. We’re not going to submit ourselves to the egregious and pejorative downgrading of our mission. We refuse to be a part of the counter productive perpetuation of this type of care.” To quote George Bernard Shaw, ‘Most people see things as they are and ask “WHY”. I see things as they could be and ask “why not”?’ The government and insurance companies would have to establish a framework of care and reporting that reflects our profession’s uniqueness and value... Care that incentivizes improved functional ability, wellness and a better quality of life... One that demonstrates and documents the difference between merely existing and living a full and active life... One that follows the road that the founding fathers of our profession hoped, dreamed and mapped for us to follow. What if we all demanded nothing less? What would happen? Would they take away our license? Would they fire us? They’ve all but fired us already. Would they refuse to reimburse us? Good. They’re doing that now.

Then we’d have to do three things:1. Educate our patients to the value of our service.2. Ask them to pay for it.3. Tell the insurance companies to (put it nicely) go their

own way. This would result in:1. A vastly improved standard of health care.2. Vindication for our profession.3. A better quality of life for our citizens. To quote Kalil Gibran “The lust for comfort murders the passion of the soul and walks grinning at the funeral.”

VCA Launches Dry Needling Forum

The Unified VCA has established a Dry Needling Forum for doctors who are interested in dry needling and those who already perform the procedure. The purpose of the forum is to share information with one another about patient experiences, treatment outcomes, education and certification, coding and reimbursement issues with insurance companies, and anything generally pertaining to dry needling. It is also a forum for the VCA to use in keeping members updated on current dry needling issues and events. Dr. Jeremy Busch, co-chair of the Insurance Committee, who is certified in the dry needling technique, will be the forum’s moderator. Dr. Busch says, “we have at our disposal an immediate resource of a growing population of dry needling physicians in the state of Virginia. Regardless of where the individual training was obtained, we all have become interested in the dry needling benefits that our patients have become reliant upon. Our challenge is for us to learn from each other in a way that we can be an example to our fellow practitioners”. The State of EBM

Evidence based medicine (EBM) wrong-footed the drug industry for a while in the 1990s. We could fend off the army of pharmaceutical representatives

because often their promotional material was devoid of evidence. But the drug industry came to realize that EBM was an opportunity rather than a threat. Research, especially when published in a prestigious journal, was worth more than thousands of sales representatives. Today EBM is a loaded gun at clinicians’ heads. “You better do as the evidence says,” it hisses, leaving no room for discretion or judgment. EBM is now the problem, fueling over-diagnosis and over-treatment. You see, without so called “evidence” there is no seat at the guideline table. This is the fundamental “commissioning bias,” the elephant in the room, because the drug industry controls and funds most research. So the drug industry and EBM have set about legitimizing illegitimate diagnoses and then widening drug indications, and now doctors can prescribe a pill for every ill. The billion prescriptions a year in England in 2012, up 66% in one decade, do not reflect a true increased burden of illness nor an ageing population, just poly-pharmacy -- supposedly based on evidence. The drug industry’s corporate mission is to make us all sick however well we feel. As for EBM screening programs, these are the combine harvester of wellbeing, producing bails of over-diagnosis and misery. Corruption in clinical research is sponsored by billion dollar marketing razzmatazz and promotion passed off as postgraduate education. By contrast, the disorganized protesters have but placards and a couple of felt tip pens to promote their message, and no one wants to listen to tiresome naysayers, anyway. How many people care that the research pond is polluted with fraud, sham diagnosis, short term data, poor regulation, surrogate ends, questionnaires that can’t be validated, and statistically significant but clinically irrelevant outcomes? Medical experts who should be providing oversight are on the take. Even the National Institute for Health and Care Excellence and the Cochrane Collaboration do not exclude authors with conflicts of interest, who therefore have predetermined agendas. The current incarnation of EBM is corrupted, let down by academics and regulators alike. What do we do? We must first recognize that we have a problem. Research should focus on what we don’t know. We should study the natural history of disease, research non-drug based interventions, question diagnostic criteria, tighten the definition of competing interests, and research the actual long term benefits of drugs while promoting intellectual skepticism. If we don’t tackle the flaws of EBM there will be a disaster, but I fear it will take a disaster before anyone will listen.Reference: http://www.biosyntrx.com/articles.php?id=1343

The chiropractic profession, which is expected to grow 28 percent by 2020, will play a critical role

in addressing the health conditions of the aging Baby Boomer generation. Significantly, the majority of people 75 and older develop some form of musculoskeletal disorder. While most of these disorders are not devastatingly disabling, they are the cause of more mobility disorders than any other disorder. In particular, arthritis is common and affects at least one in five adults in every state. According to the state-level Behavioral Risk Factor Surveillance System’s latest findings, prevalence estimates by gender found women reporting a higher prevalence of arthritis than men in every state. In Virginia, the prevalence of arthritis is above the national average, affecting: • 26 percent of adults (29 percent women/23 percent

men)• 54 percent of adults over 65 • 68 percent of overweight/obese adults• 18 percent of physically inactive adults

The percentage of adults in Virginia with arthritis is projected to reach 50 percent by 2030. The most recent stats show that 22.5 percent of adults in Virginia reported doing no physical activity or exercise (such as running, calisthenics, golf, gardening or walking) other than their regular job, and 27.4 percent are obese.

Laser Treatment: An Advanced Tool

As the care of acute and chronic pain syndromes for older Americans increases and grows more complex, chiropractors will need a tool designed to eliminate self-perpetuating cycles of swelling and muscle spasms. Laser treatments represent the latest advanced technology for addressing these issues, with research continuing to show that combining laser treatment with manual manipulation is most advantageous. Super pulsed lasers, in particular, are superior to ultrasound, shockwave therapy and other modalities for reducing muscle stiffness and pain. They also improve poor blood flow associated with degenerative disorders like spinal stenosis. While super pulsed lasers offer more power and higher energy density than most lasers, they are not all about the power. More is not always better in therapy. Just like in chiropractic, the force applied during manipulation is less important than the mechanism delivering the energy. Super pulsing offers the most optimal high density of energy, depth of penetration and safety. What’s more, laser treatment is a natural solution to pain relief, and provides a drug-free, non-invasive approach – with no side effects. • produce significant outcomes by reducing pain and muscle stiffness

• provide a hands-free treatment option – with the addition of unattended treatment armatures

• be delegated to an assistant or therapist (based on scope of practice and state regulations) without concern about the buildup of thermal effect or burns

• become a significant source of revenue growth Chiropractors do double duty as clinical professionals and small business owners. Therefore, every tool must be both effective and economical. Given its effectiveness and appeal among patients as an adjunct to their physical treatment program, laser treatment costs can be easily recouped, often within a few months of use.

Optimizing Clinical Results

Maximizing laser light to relieve certain disease symptoms has been the subject of research from NASA to European scientists for many years, yielding advances and critical improvements in the technology. When a laser-light beam is super pulsed, it delivers intense concentration of photons to cells without damaging thermal effects, which increases its therapeutic value. In comparison, continuous wave or pulse lasers are limited in their ability to deliver high power due to the increase in heat-related tissue damage that accompanies a higher power output. Super pulsing of the beam breaks through the thermal barrier and is able to deliver laser power in tens of thousands of milliwatts with no damaging thermal effects to the tissue. Super pulsing lasers deliver up to 2,000 times the peak power of continuous wave lasers and up to 1,000 times the peak power of pulse lasers without any related damaging thermal effects. Increasing peak power maximizes the photon density and improves depth of penetration – reducing treatment time, and optimizing clinical results and efficiency.
