    Uses identified with a "P" are permitted by-right in the subiect zoning: district,subiect to compliance with all other applicable standards of this ZoningOrdinance.

    2. The Applicant or its successors , assignees or grantees sha ll obtain allapplicable official reviews, approvals or permits which are necessary toimplement this Planned Development. Any dedication or vacation ofstreets, alleys or easements or any adjustment of rights-of-way shallrequire a separate submittal on behalf of the Applicant or its successors,assignees or grantees, and approval by the City Council.

    3. The requirements, obligations a nd conditions contained within thisPlanned Development shall be binding upon the Applicant, its successorsan d ass ignees and, if different than the Applicant, the legal titleholdersand any ground lessors except as provided herein. All rights grantedhereunder to the Applicant shall inure to the benefit of the Applicant'ssuccessors and assignees and, if different than the Applicant, the legaltitleholders and any ground lessors an d their respective successors andassignees. Furthermore, pursuant to the requirements of Section 17-8-0400 of the Chicago Zoning Ordinance, the Property, at the timeapplications for amendments, modifications or changes (administrative,legislative or otherwise) to this Planned Development are made, sha ll beunder single ownership or under single designated control. Singledesignated control for purposes of this statement shall mean that anyapplication to the City for any amendment to this Planned Development orany other modification or change thereto (administrative, legislative orotherwise), sha ll be made or authorized by all the owners of the Propertyan d an y ground lessors of the Property subject, however, to th e followingexceptions and conditions: (a) any changes or modifications to th isPlanned Development applicable to or in a given subarea designatedpursuant to sta tement number 10 below need only be made or authorizedby the owners and /or ground lessors of su ch subarea; provided, however,tha t for so long as the Applicant or any affiliate thereof owns or controlsany part of the Property, any application to the City for any such changesor modifications (administrative, legislative or otherwise) must in allcases be authorized by the Applicant; and (b) where portions of theimprovements located on the Property have been submitted to the IllinoisCondominium Property Act, the term "owner" shall be deemed to refersolely to the condominium association of the owners of suc h portions ofthe improvements and not to the individual unit owners therein. Nothingherein shall prohibit or in any way restrict the alienation, sale or any o thertransfer of all or any portion of the Property or any rights, interests orobligations therein. Upon any alienation, sale or any other transfer of allor any portion of the Property or the rights therein (other than anassignment or transfer of rights pursuan t to a mortgage or otherwise ascollateral for any indebtedness) and solely with respect to the portion ofthe Property so transferred, the term "the Applicant" shall be deemedamended to apply to the transferee thereof (and its beneficiaries if suchtransferee is a land trus t) and the seller or transferor thereof (and its

    4. This plan of development consists of these sixteen (16) statements; a BulkRegulations and Data Table; and the following documents prepared byFitzgerald Associates Architects, dated November 3,2004 (collectively, he"Plans"): an Existing Zoning Map; an Existing Land-Use Map; a PlannedDevelopment Property Line and Boundary Map; a Site Plan; a LandscapePlan; and Building Elevations. Full-sized copies of the Plans are on filewith the Department of Planning and Development. These and no otherzoning controls shall apply to the Property. This Planned Developmentconforms to the intent and purpose of the Chicago Zoning Ordinance,Title 17 of the Municipal Code of Chicago, and all requirements thereof,and satisfies the established criteria for approval as a planneddevelopment.5. The following uses of the Property shall be permitted: dwelling units andother household living uses; eating and drinking establishments;

    entertainment; food and beverage sales; office; retail sales; theaters; publictransportation operations and maintenance uses; accessory and non-accessory parking; temporary buildings for construction purposes;accessory uses; and all other uses permitted in the C2-5 Motor Vehicle-Related Commercial District.6 . Signs shall be permitted within the Planned Development in accordancewith the requirements of the C2-5 Motor Vehicle-Related CommercialDistrict; provided that the Maximum Total Sign Area permitted in thePlanned Development shall be six thousand five hundred (6,500)squarefeet. No approvals shall be required for any signage located in anddesigned to be viewed solely from the interior of any improvements on the

    Property.7. The improvements of the Property shall be designed, constructed andmaintained in substantial conformance with the Plans described inStatement 4 above, and in accordance with the parkway tree and parkinglot landscaping provisions of the Chicago Zoning Ordinance.
