§2 Spatial and temporal scope

1. The spatial scope of these House Rules covers the facilities in their entirety.

2. The House Rules apply to all persons at all times, that is 24 hours a day, as soon as the area cover-ed is entered, as explained in §1, section 1

3. The buildings and outdoor areas of the THERMEN & BADEWELT are not open to the public; the bus stop in the parking area is there for public use.

§3 Buildings of the THERMEN & BADEWELT as well as outdoor areas

1. Outside of business hours, persons are only allowed on the facilities and on their outdoor areas, including the natural lake, with the written permission of BSG. BSG is authorised to levy a fine of 50.00 euros on anyone who, contrary to this regulation, enters the facilities and/or uses them. Other measures, such as a ban on entering the facilities, remain unaffected.

2. Throughout the facilities, any take-off or landing of unmanned aviation systems of whatever type and size (drones) will be prohibited unless BSG has granted written permission. BSG has the right to undertake preventive measures against drones. BSG has the right to undertake specific measures against drones, such as frequency detection, with or without targeted crashing of the drones on the grounds of BSG, if there is an infringement of §3, section 2.

§4 Instructions

1. Instructions given by BSG and other individuals authorised to enforce domiciliary rights, as well instructions from assigned security authorities, must be followed promptly throughout the facilities. Security authorities include all inspection, security and administrative staff, whatever their contrac-tual relationship to BSG is, as well as employees of the Police and other regulatory authorities.

2. Individuals who violate one or more points of the House Rules, may be excluded from access to the facilities or expelled from them. The same applies to individuals who do not follow directives given by BSG or assigned inspection, security and administrative staff.

§5 Entry conditions, opening and admission

1. An admission fee must be paid in order to access the buildings and their adjacent outdoor areas. The facilities may thus only be entered after payment of an admission fee with a valid transponder or a valid identification badge within the times determined for. Transponders and identification badges are not transferable.

2. Admission to the buildings and outdoor areas is permitted only to individuals allowed access by BSG or the operator involved.

By entering the facilities covered by the House Rules for use of the bathing facilities, users, guests, accompanying persons as well as other visitors and others persons authorised to enter the facilities acknowledge the validity of the House Rules and usage regulations of the THERMEN & BADEWELT SINSHEIM. Entry to the facilities is granted upon payment of the admission fee and the distribution of a transponder. Transponders are storage media. They permit services to be recorded, especially for food and beverages.

If the use of the facilities is based a contract entered into with Badewelt Sinsheim GmbH, such as a commercial lease agreement, work contract or the like – subject to individual contractual arran-gements – compliance with the following rules shall be assured. The contractual users mentioned above agree to inform their employees and other persons whom they engage to fulfil the contract of the House Rules and their applicability and to require them to be responsible for compliance with these rules.

If the facilities are used for a school event, such as swimming lessons, school sports or a club event, then the school director or the management of the association will require all students and/or all event participants as well as other accompanying parties to be responsible for compliance with these House Rules.

§1 Subject Matter

1. Badewelt Sinsheim GmbH (hereinafter called ‘BSG’) has the right to enforce the House Rules and supervisory regulations throughout the entire area of the THERMEN & BADEWELT SINSHEIM, inclu-ding all local buildings, outdoor areas, the natural lake, entries and exits as well as parking facilities (hereinafter called ‘facilities’).

2. The House Rules apply to all persons who, for whatever reason, are at the facilities.

3. BSG is entitled to make use of its domiciliary rights if there is a violation of the House Rules or if the domiciliary rights of BSG are violated in another manner.

4. The regulations and conditions in effect for the facilities, especially those established by the ope-rator, are also binding in their current version.

3. A stay is only permitted during the opening hours of the buildings, parts of buildings or access areas as determined by the admission fee or identification badge. In the event of misuse or unau-thorised transfer of tickets, vouchers, transponders or other identity documents, these may be con-fiscated without replacement by BSG or the relevant organiser or their representatives. Further rights of BSG to a ban on entering the facilities remain unaffected.

4. The making of photo, audio, video or other media recordings in the buildings of the facilities and adjacent outdoor areas, including the natural lake, is prohibited to all guests as well as their accom-panying persons and other visitors and users without the written prior consent of BSG.

5. BSG is opposed to any racist, violent, anti-Semitic, nationalist, xenophobic, sexist as well as right and/or left-wing extremist tendencies of all kinds, including political agitation and expression. Therefore, BSG reserves the right to make use of its domiciliary rights and to ban from entering the facilities – even in advance – any individuals who (a) belong to left and/or right-wing parties, associ-ations or organisations, and/or (b) are clearly identifiable as belonging to the left and/or right scene, and/or (c) in the past have participated in racist, nationalist, anti-Semitic, discriminatory, violent, defamatory or other inhumane expressions.

For this reason, BSG specifically prohibits:

a) any clothing, flags, banners, badges or similar items to be worn or carried if they contain messa-ges intended to defame people because of skin colour, religion, national origin, gender or sexual orientation or if they display symbols that are unconstitutional or are recognised as belonging to the extreme right or xenophobic tendencies; the same applies for visible writing of this kind on the body.

b) wearing or carrying garments for which the manufacturer, distributor or target group is recognised as belonging to right-wing extremist or xenophobic tendencies.

c) bringing onto the premises propaganda materials of a racist, xenophobic nature that incites violen-ce or is of a discriminatory nature, whether of the extreme right or left.

d) showing or uttering expressions, gestures or slogans that are intended by their nature or content to discriminate against individuals because of their skin colour, religion, national origin, gender or sexual orientation.

6. a. Business hours are determined by BSG and will be posted in the lobby. The facilities may be used by guests and their companions only during these business hours. Bathing hours will depend on the fees paid. If the usage period paid for is exceeded, a cash payment must be made to cover this. The closing times of the facilities refer to the time of departure from the building. Bathing hours in the Palm Paradise, the Vitaltherme & Sauna and the swimming pool will end 20 minutes before closing, that means that at this time these areas are to be left for the changing rooms. The final ad-mission will be 1½ hours before the end of bathing hours.

b. The use of the facilities outside business hours or contractually agreed use or lease times requires the written consent of BSG.

c. BSG reserves the right to close the facilities temporarily for the purpose of maintenance and repair work or for other events. Contractual users of the facilities must follow the contractual rules in this context. Entering the facilities during this period will be prohibited.

d. If use of sections of the facilities is restricted due to film and/or sound recordings, events, courses and the like, guests and their accompanying persons tare not entitled to a refund or a reduction of the admission fee. BSG has the right at any time to limit in whole or in part the use of the facilities and the services offered, such as in the event of operational malfunctions, refurbishing or renova-tions. Claims against BSG on these grounds are excluded.

e. Tickets already purchased, vouchers, ThermenCard and time credits may not be returned and may not be refunded. For vouchers that are lost or are not honoured, no compensation will be paid nor money refunded. Change given must be verified immediately. Subsequent complaints will not be accepted. When purchasing a ThermenCard (cash card), a deposit of 10 euros will be charged, which will be refunded upon return of the card. In the event of loss, ThermenCards will be replaced exclusi-vely to the cardholder and only on presentation of an ID card and proof of purchase as well as payment of a processing fee of 15 euros (10 euros deposit for a new ThermenCard + 5 euros for processing). A representative of the cardholder is excluded.

7. Individuals who violate any of the provisions of §5 will be denied access to the facilities or escor-ted off the premises. They will forfeit any existing right to a refund of the admission fee as well as to payment of any claims for damages. BSG reserves all other rights, including a ban on entering the facilities.

§6 Time spent at the bathing facilities and use of specific facility areas

1. Staying and bathing in the entire facility

a. The purchase of an admission ticket does not guarantee a place to sit or lie down. Reserving seats and areas to lie down is prohibited, particularly by placing towels, bags, or other items on them. Areas for sitting or reclining that are reserved for other guest or that are made permanently unusab-le in any other way may be made available by BSG at any time. At its own discretion, BSG may thus remove the item used for a reservation of areas for sitting or reclining and move it to or place it for example in a nearby area.

b. Each visitor must be aware of the increased risk in bathing areas of accidents caused by wet floor surfaces. Therefore, running, jumping and bouncing around are prohibited in the entire bathing and sauna area. All guests and other visitors are encouraged to wear slip-proof bathing shoes outside the pools for their own safety.

c. Changing rooms must always be used by only one person. The use of changing rooms by more than one person is thus strictly prohibited. Infants under the age of 10 are allowed to use changing rooms only if accompanied by their parents. If more than one person uses a changing room, the inspection, security and administrative staff of BSG are directed and authorised to inspect the changing rooms. Inspection of the changing rooms serves the purpose of preventing or stopping misconduct for the

Sitting on the diving platforms, as well as on the stairs and ladders leading to the diving platforms, is strictly for-bidden due to the risk of accidents. Before diving, care must be taken to make sure the diving area is clear. The diving area must be vacated immediately after diving. Remaining in the diving area for swimming or snorkelling is prohibited and is extremely dangerous. Also, swimming beneath the diving platforms is prohibited. Depending on the crowd volume, the lifeguard (guest supervisor) will decide whether or not to allow the diving facilities to be used. The diving boards may be used by only by one person at a time. Others waiting to use the diving boards should wait until the previous per-son has finished diving. Use of diving boards is always at your own risk. The duty of BSG to maintain safety of the premises is unaffected.

c. Use of the toddlers’ pool

Use of the toddlers’ pool and attractions in and around this pool as well as playground equipment is at your own risk and is only allowed for children 6 years of age and under. For hygienic reasons, swimwear must be worn in this pool. In the toddlers’ pool, parents are solely responsible for supervi-sion. The instructions of the guest supervisor must also be followed without exception.

3. Persons who violate any provisions of section 6 will not be permitted to continue using the facili-ties or will be escorted off the premises. They will forfeit any existing right to a refund of the admissi-on fee as well as to payment of any claims for damages. BSG reserves all other rights including a ban on entering the facilities.

§7 Admission and other access controls

1. All persons entering the facilities will be required to show, without being asked, their admission transponder or other identification to BSG, the inspection, security and administrative staff, or offici-als of the Police and other regulatory authorities, and if requested to allow their identification to be checked. Persons using the facilities will be required to furnish identification if requested to do so by inspection, security and administrative staff or officials of the Police or other regulatory authorities. No reason need be given for this requirement.

People who are unable to furnish identification will be escorted from the premises by inspection, security and administrative staff or by officials of the police or other regulatory authorities.

2. All persons at or in the facilities who in BSG‘s opinion or in the opinion of the security services used by BSG (= all inspection, security and administrative staff) or in the opinion of officials of the Police or other regulatory authorities are under suspicion based on their behaviour or other evidence that:

a. they are under the influence of alcohol and/or drugs,

b. they are carrying weapons or dangerous objects within the meaning of §5 of the Firearms Act or any other by items prohibited by the House Rules,

c. they have violated the privacy other persons or have injured them,

purposes of the House Rules and protection of life, limb and property. For the inspection of changing rooms, suspected misconduct and/or a suspected risk is sufficient. This will be determined solely at discretion of BSG. Inspection of the changing rooms involves in particular a view from the outside of the room of the foot and lower leg area in the interior of the room, listening to the interior of the room, and opening of the room by individuals inside the changing room. If despite a request the changing room is not opened, BSG and the services mentioned above may open the changing room – even by using force and/or by technical means.

d. Before entering the Palm Paradise, the Vitaltherme & Sauna and the swimming pool, each guest is required to wash thoroughly after changing and before entering these areas by taking a full-body shower using a body cleanser. Soap or other body cleansers and creams may not be used outside the shower facilities.

e. Ventilation shafts at the window facings are to be kept free of objects of any type and size, especi-ally bags and towels.

f. In order to maintain a quiet atmosphere for the guests of the facility and other visitors, everyone is requested to avoid making noise, especially in the Palm Paradise and in the Vitaltherme & Sauna.

2. Use of certain areas of the facilities

a. Palm Paradise and Vitaltherme & Sauna

Admission to the Palm Paradise and the Vitaltherme & Sauna is permitted only to those 16 and abo-ve. On Family Saturday, children and teenagers under 16 years may be admitted to the Palm Paradise. Small children up to the age of four may visit the Palm Paradise under permanent supervision of their parents. Admission to the Vitaltherme & Sauna for small children is prohibited.

The Vitaltherme & Sauna is a clothes-free zone. This area, however, is not considered an establish-ment for nudism. After finishing with the sauna, including the necessary cooling-off period, a bathro-be or a towel must be put on. This also applies to food-service areas. Before using the sauna facili-ties, guests must thoroughly wash and dry off. For reasons of hygiene, sufficiently large bath towels and beach towels should be used in the saunas in order to avoid soiling the seating areas. Personal infusion agents are not allowed and should not be used. Infusions will be made by trained BSG staff members. As part of the guest programme, a variety of body scrubs and beauty masks will be distri-buted to guests by BSG staff. All guests should take into account personal compatibility when accept-ing the products or services dispensed. For these additional services, including infusions, no liability is accepted for any skin irritation that might result. This disclaimer also applies to any soiling of cloth materials that might be caused. Customarily, there are special conditions in saunas and other hot rooms, such as a higher room temperature, low lighting, tiered seating and a variety of heat sources. These require guests to be extra careful and exercise caution. There is also a disclaimer of liability for the use of health pools containing brine, selenium and calcium/lithium. BSG assumes no liability for any skin irritation or impurities or discoloration of cloth materials.

d. they have engaged in personal injury, a threat, an insult, damage to property, theft, or have com-mitted or are committing fraud,

e. they perform sexual acts with themselves or others or have done so with themselves or others,intend to do so or have or intend to allow others to do so,

f. they are a danger to the health of others due to a contagious disease, as defined in the Federal Law on Infectious Diseases, due to an intrinsic infestation of pests,

g. they threaten the security of the premises and/or fail to comply with these House Rules in any other way. If any of the above are suspected, BSG is entitled, using its inspection, security and administrative staff and/or officials of the Police or other regulatory authorities, both at the entry of the person to the facilities (= initial inspection) as well as after entry and during their stay at or in the facilities (= subsequent inspection) to search such persons as well as their clothing and belongings in order to clarify the situation, and to do this by using technical methods, and then to seize and con-fiscate any prohibited items. Searches may also be made for items that suspicious persons carry into the changing rooms and/or place in lockers. Alcohol or drug consumption may also be determined. To determine a possibly existing ban on entering the facilities, identity documents may be checked.

Anyone who refuses to submit to a search will forfeit admission rights or be forbidden further use of the facilities. Admission ticket fees in such cases are non-refundable.

Inspection, security and administrative staff or law enforcement officers will keep confiscated items in a secure place and return them to legitimate owners if requested to do so. Guests, visitors or users who refuse to surrender the items referred to in §8 will be refused admission with no refund of the admission fee and will be prohibited from further use of the facilities. In such cases, admission fees will be non-refundable.

3. Guests, accompanying persons, users and/or any other visitors will be denied admission to the facilities or prohibited from further use especially if they

a. are under the influence of alcohol and/or drugs or if this appears to BSG to be the case,

b. are carrying weapons or other dangerous items,

c. are suspected of having of an infectious disease according to the Federal Law on Infectious Disea-ses or have a similar dangerous disease,

d. in the view of BSG they are in need of assistance because of severe physical and/or mental disabi-lities and wish to use the facilities without the assistance of a chaperone of age,

– a severe physical disability is in particular a missing limb (arm/leg), deafness or blindness regard-less of the level or an inclination to have epileptic seizures,

e. are non-swimmers and wish to use BSG facilities without an chaperone of age who can swim,

f. are children under 10 years of age who wish to use to the facilities unaccompanied by their parents,

g. are children 10 to 12 years old who wish to use the Palm Paradise area without the written consent of one of their parents.

Any of the above reasons is sufficient to bar admission to the facilities. Further rights of BSG remain unaffected

4. The inspection, security and administrative staff of BSG as well as the Police are entitled to detain and search individuals – even by using technical means – to determine whether they are in compli-ance with the prohibitions of §7 of the House Rules and/or whether or not they pose a security risk due to alcohol or drug use or because they are carrying weapons or dangerous or flammable items. The search will in particular cover upper and lower apparel, footwear, belongings (such as bags) as well as changing rooms and lockers that have been used.

5. In and on the premises, BSG may inspect individual persons and bags by using monitoring sys-tems and technical means, in particular metal detectors and body scanners in the access area. Such inspection may also be carried out several times. Searching an individual covers especially upper and lower clothing, footwear, as well as any belongings such as backpacks and containers of any type or size. These security inspections will determine whether a person has prohibited items on their person, as explained in §8 of the House Rules. If metal detectors are used, the individual invol-ved must inform the staff at the inspection site in advance as to whether they are pregnant, have a pacemaker, etc.

§8 Prohibited items

Users, guests and other visitors of the facilities are forbidden to have on their person or bring into the facilities the following items:

1) items and/or media containing material that is racist, xenophobic, incites violence, discriminatory, sexist and right and/or contains leftist-radical content, even if it is not of a criminal nature; the same applies in particular for clothes, for example, with lettering and/or symbols, such as Thor Steinar;

2) weapons of any kind and any items that are suitable to be used for hitting, pushing or stabbing and any illicit weapons of any kind;

3) items that can be used as weapons or missiles;

4) gas spray cans and bottles, corrosive, flammable substances, dyestuffs or other containers with substances that adversely affect health;

5) glass containers, bottles (including PET bottles), mugs, jugs, boxes or other articles made of fragi-

3) not climbing on or over buildings and facilities not intended for general use, particularly outer surfaces of buildings, fences, walls, enclosures of the amusement areas, barriers, lighting systems, camera platforms, trees, columns of any kind and roofs;

4) entering or remaining in areas that are not approved for visitors, such as offices and technical spa-ces belonging to BSG;

5) not throwing items or liquid of any kind; igniting or shooting off of fires, fireworks, flares and/or other pyrotechnic devices;

6) writing on, painting on or affixing items to buildings, facilities or thoroughfares;

7) relieving oneself outside the toilets or otherwise soiling the premises, in particular by discarding items. In the event of an infringement, a lump sum cleaning fee of 50.00 euros will be charged;

8) using roads and areas without special permission;

9) The no-smoking policy also covers electronic cigarettes (‘e-cigarettes’). For smokers, there are areas inside and outside the facilities where smoking is permitted.

10) interfering with activities during performances,

11) disturbing other guests and/or their companions by operating technical devices, especially using mobile phones, iPhones, iPads, tablets,

12) consuming drugs and/or – in BSG’s opinion – being intoxicated.

13) carrying and/or using weapons or dangerous items for the purposes of §5 of the Firearms Act,

14) violating the personal and/or private space of another person, in particular by voyeurism, sexual approaches, sexual, harassment, stalking.

15) causing personal injury, making a threat or insult or causing damage to property, committing theft or fraud,

16) performing sexual acts on oneself or another person, alone or with another person,

17) committing a criminal offence, alone or with others, or supporting such activity, in particular per-sonal injury, a threat, an offence, damage to property, theft.

18) otherwise jeopardising safety and order on the premises and/or compliance with these House Rules.

19) running, jumping or bouncing on the premises, particularly in wet areas,

le, splintering or particularly hard materials;

6) any substances that are hazardous to life or limb regardless of type and physical state;

7) bulky items, such as folding chairs;

8) torches, sparklers, fireworks, flares;

9) mechanically or electrically operated sound instruments, and musical instruments of all kinds;

10) beverages and food of all kinds not purchased on the premises;

11) drugs;

12) animals of any kind and size;

13) laser pointers, in-line skates, scooters, footballs, badminton games, skateboards and the like;

14) cameras, video cameras or other audio, film and/or video recording equipment;

15) telecommunication devices, particularly cell phones, iPhones, iPads and laptops. Individuals in possession of such items must check them in during their stay at the facilities using a safe deposit box. If a safe deposit box is not available, the items must be stored in a locker;

16) any consumables (food and drink). Exceptions apply for guests who need the food and drinks because of an illness upon presentation of a medical certificate or valid identification. Also excluded is food for babies and toddlers. Toddlers are defined as those who are younger than seven years old. §9 Prohibited behaviour throughout the facilities:

1. Throughout the facilities, the following are forbidden or prohibited:

1) displaying or wearing of generally visible expressions, gestures and/or external appearance, which are objectively intended in nature and content to defame third parties, in particular due to skin co-lour, religion, sex, sexual orientation, descent or ethnic origin; this includes, in particular, a prohibi-tion on expressing or disseminating racist, xenophobic, violence-inciting, discriminatory, and right-wing and/or left-radical slogans, or tattoos and/or body art, lettering or symbols with a clear racist, xenophobic, violence-inciting, discriminatory, and right and/or left-radical tendency;

2) wearing of intimate jewellery of any type design, size and material, in particular for sexual organs. Intimate jewellery includes in particular terminals, plugs, rings, balls, chains, tubes, electrical stimu-lators and piercing;

20) wearing street shoes in areas where they are not permitted, such as changing areas and the shower area, bathing areas and/ or the saunas, unless BGA has provided protective shoe covering. Contractual users, such as workers, must check independently (in particular with a professional as-sociation) to find out whether they are prohibited from wearing protective footwear with a protective film, regardless of the legal reason,

21) intentionally contaminating the bathing areas and the pools,

22) entering or leaving the pools without using the stairs and entry ladders; jumping into the water at the edge of a pool, playing around on the entry ladders or supports, wearing slippers or swimming fins in the water or the natural lake.

23) collecting money of any kind on the premises.

24) carrying on commercial activities without the approval of BSG.

2. A violation of the prohibitions listed in section 9 of the House Rules would also take place if a guest or visitor abets or incites another bather/visitor to perform a prohibited act and offers support for it.

3. It is also forbidden to assemble on the premises with several persons, having the intention to dis-turb the peace by collective action.

4. Commercial activity, distribution or sale of newspapers, magazines, stationery, advertising bro-chures as well as collections or the storage of items is only allowed on the premises, particularly in buildings, with the prior express written permission of BSG.

§10 Measures taken by BSG in the event that the House Rules are not observed

1. Persons who are in breach of a provision of the House rules may, without compensation, be refu-sed access to the facilities, and in particular, in spite of a valid admission ticket, to the exclusion of any reimbursement claims, not allowed entry to the buildings or facilities. If such a person is already present at the facilities, they may be escorted off the premises, especially from the buildings, with no claim for reimbursement.

2. If someone alone or in the company of others should violate a provision of the House Rules th-rough their actions or by omission, BSG may ban them without compensation from entering the facili-ties. The ban may be permanent or temporary.

3. In such cases, inspection, security and administrative staff of BSG are instructed and authorised to escort off the premises any users, guests, companions of guests and other visitors who violate the House Rules.

4. In such cases, inspection, security and administrative staff of BSG are instructed and authorised to check the personal identity of users, guests, companions of guests and other visitors who violate the House Rules or are suspected of doing so, in particular by accessing identity documents such as identity cards, passports, driving licenses. If such ID information is not shown, staff are instructed

and entitled to detain the individual involved until the arrival of Police officers. BSG has the right to make copies of identity papers obtained in this manner.

5. Other rights, particularly to claims for damages, an injunction or other contractual and tortious claims are expressly reserved by BSG.

6. For any breach of a prohibition of §8 of the House Rules and/or §9 of the House Rules, the offen-der shall be liable, while waiving the objection of the continuation of offence, to pay BSG a contrac-tual penalty in the amount of up to €2,500 (in words two thousand five hundred euros), which will be determined and fixed according to principles of proportionality. In this case, the offender is entitled to have the amount of the contractual penalty reviewed by the local court and the court competent for the domicile of BSG.

§11 Use of the facilities

1. The facilities may be used only in the context of the activities arising from contractual agreements with the operator, tenants and other users. The use of the facilities is limited to the group of persons defined in the respective contract or the confirmation, or to the number of persons determined and the intended use stated there.

2. Within the facilities, everyone must behave in a manner that causes no harm or hazard to others or – insofar as possible – does not annoy or bother others

3. The parking of motor vehicles and bicycles or other means of transport is allowed only in the desig-nated spaces. All entrances and exits as well as escape routes are to be kept free from obstructions.

4. For security reasons and to avert danger, visitors are obliged to follow the instructions of BSG or of the inspection, security and administrative staff of BSG or of the Police and other regulatory authori-ties to use other spaces.

5. All functional and technical areas belonging to BSG may be entered only by BSG personnel who have access permission.

6. The use by third parties of offices and ancillary rooms belonging to BSG without written permission from BSG is not allowed. The use of technical equipment such as telephones, computers, copiers and the like also requires the written approval of BSG. The furnishings of BSG must be handled with care and not removed from the rooms.

§12 Cleanliness

All users, guests and other visitors to the facilities are obliged to treat the facilities and equipment with care and to leave them in a clean condition. Damage should be avoided and, if it occurs, should be reported immediately to BSG in writing. No waste, ashes, harmful liquids and the like should be poured or thrown into toilets, flushing systems and utility sinks. Waste must be disposed of in the appropriate containers or waste receptacles.

- an intentional or grossly negligent breach of duty or

- a breach of a duty that is essential for the achievement of the purpose of the contract.

c. In the case of a minor breach of a material contractual obligation (major obligation) liability is limi-ted to predictable, typical damages as provided by the House Rules.

d. BSG and its employees are liable for property damage and resultant consequential loss of assets up to an amount of 10 million euros, simply limited per insurance year, provided that the damage is due to BSG or its employees.

2. Liability of guests

Guests must take care not to lose tickets or access authorisations, clothes closet or locker keys, sto-rage media for the payment system or other items provided on loan. They must especially take care to have these items on their person in the bathing areas and not to leave them unattended. In the case of loss, failure to comply with these requirements will be regarded as the fault of the guests. In the event of a dispute, the burden of proof for maintaining the aforementioned proper care is the res-ponsibility of guests. In the event of culpable loss of access authorisation, closet keys or locker keys, storage media for the payment system or other items provided on loan, a lump sum will be charged which does not exceed the expected damage in the normal course of events. The amounts involved are listed in the current price list. In the event of loss of access authorisation, closet keys or locker keys, storage media for the payment system or other items provided on loan, a lump sum currently amounting to 45.00 euros (keys with transponder) and a deposit of 40.00 euros or 20.00 euros (ren-tal linens) will be charged in the normal course of events, not to exceed the expected damage. If a key is subsequently found, the amount will be refunded. Visitors are expressly allowed to prove that BSG has not incurred any damages at all or that the amount is significantly lower than the flat-rate amount charged.

§16 Lost and found

Lost items should be turned in to the BSG Cashier’s desk with an explanation of where the item was found and the personal details of the person who found it. Lost items will only be kept for 1 month after they are found if they are not picked up or it is believed that the owner has abandoned posses-sion of the items with the intention of abandoning the property permanently. BSG may ascertain the value of the item and donate it to a charitable institution.

§17 Parking

The lawn area, corridors and other traffic areas may not be used as parking areas unless there is a contractual entitlement to do so.

§18 Emergency exits and escape routes

Marked escape routes and doors must not be adjusted or interfered within any way that alters their function. All escape routes must be kept clear

It is forbidden to relieve oneself outside the toilets or to otherwise soil the facilities in other ways, especially by discarding items or spitting on the floor.

§13 Advertising & decorations

1. Advertising of any kind as well as the placing of decorations and other items are strictly prohibited on the premises if they are not: permissible according to contractually arranged agreements of BSG and within the framework of this agreement there is an obligation to restore the original condition after the end of the contract, or by written permission from BSG in individual cases.

Promotional activities also include any activities carried out without payment of separate remune-ration but which – for whatever reason – nevertheless serve to promote a company or a brand and therefore may be particularly in breach of any advertising regulations.

BSG or its inspection, security and/or administrative staff may prohibit promotional activitiesand, where applicable, promotional materials.

2. The distributing of leaflets, promotional materials, magazines and the like everywhere in the facili-ties may be done only with the permission of BSG, regardless of other official regulations.

3. Decorations and other items that have been used at events with permission must be removed immediately after the event. The hammering in of nails, hooks, etc., and the applying of adhesive materials to floors, walls, ceilings and furniture are strictly prohibited.

§14 Sale of goods, food and beverages

The offering and sale of goods of all kinds, the distribution of printed matter or carrying out collec-tions and putting up sales opportunities and the like on the premises are strictly prohibited, unless there is a contractual authorisation and if necessary a required official permit.

Offering food services to users, guests, companions of guests and of other visitors is only allowed by service providers or caterers designated by BSG.

§15 Liability of BSG and of the visitors

1. Liability of BSG:

a. The liability of BSG, another operator and/or organiser, its legal representatives and agents for damage resulting from injury to life, limb or health as well as liability under the Product Liability Act remains unrestricted by these House Rules.

b. The liability of BSG, another operator and/or organiser, its legal representatives and agents for other damages not mentioned in §15.1 shall be ruled out unless the damages are based on:

at all times. Emergency exit doors may only be opened in the event of an emergency.

§19 Driving on the premises

In principle, all vehicular traffic on the premises should be avoided.

1. During events, vehicular traffic is permitted on routes intended for visitors to the facility only in exceptional cases, for loading and unloading. Written authorisation may only be granted by BSG. Exceptions will be made for vehicles used by the Police, medical services and the fire brigade or avai-lable as a standby.

2. Driving in outdoor areas, especially areas designated for sunbathing, areas with greenery and lawns is prohibited unless there is a written waiver or in the event of in imminent danger,

4. Temporary stationing and parking of vehicles is only allowed in designated marked areas and ones designated as parking spaces. No parking is allowed on streets and roads on the premises.

5. Vehicles illegally parked will be towed subject to charges.

6. Violations of the above provisions will result in withdrawal of the admission permit. In the event of repeated violations, the driver or owner of the vehicle will be banned from entering the premises or issued a citation.

7. BSG reserves the right to make special arrangements.

§20 Parking spaces and parking areas

The use of the parking spaces and parking areas is reserved for guests and users as well as the staff of BSG. When using all assigned vehicle parking spaces, all users agree to respect the rules listed below:

1. Vehicles must be driven at a walking pace. Instructions from inspection and administrative staff as well as markings and signs must be followed. Vehicles may be parked only within the marked or designated parking areas. Apart from this, the rules of the Highway Code (StVO) apply.

2. Contamination resulting from oil, gasoline, battery acid or other substances should be avoided and reported if necessary to BSG. The costs for any required removal/disposal will be paid by the perpetrator of the problem.

3. Only approved, operational and registered vehicles may be parked. Car trailers, boats, caravans, etc., may not be parked.

4. Staying overnight or camping in vehicles is strictly prohibited.

5. In parking spaces, the following are especially prohibited:

• making an open fire or light,• smoking,• flammable, burnable or polluting objects/substances such as gasoline, oil, paints, storing, drai-ning or filling of fuel containers and the like• opening and closing ventilation systems,• allowing engines to run longer than the time needed for arrival or departure,• carrying out repairs and maintenance of vehicles,• washing vehicles,• operating electrical devices.

6. BSG may move or remove vehicles from parking areas at the expense and risk of visitors and users, in particular if: (a) authorisation to use the facilities has expired along with authorisation to use the parking area (b) an immobilised vehicle is a hazard due to leaky tank or carburettor or other defects; (c) a parked vehicle is not authorised by the police or is operated during the duration of the contract after authorities have withdrawn authorisation from circulation; (d) the vehicle was left wi-thout permission, in particular in traffic areas or mistaken parking areas. The right to use the parking area according to item (6) ordinarily ends 30 minutes after the authorised visit or end of the period when the facilities may be used.

7. Guests, visitors and users of the parking area are liable to BSG and/or third parties for any dama-ges they or their accompanying person culpably cause. This includes culpable pollution of the par-king space by behaviour that is contrary to permissible general use. This includes in particular the depositing of garbage and other debris.

8. Liability of BSG for damages caused by guests or other third parties is, however, excluded. This is especially true for criminal damage, theft of valuables from the vehicle (such as a car radio, telepho-ne, personal valuables, computers, photographic equipment, sports equipment and the like) or any items mounted on the vehicle to the degree that BSG is not at fault for the purposes of the House Rules.

9. BSG is not responsible for guarding, protecting or monitoring the vehicle or its contents nor for providing vehicle-specific insurance coverage.

§21 Video surveillance

To ensure safety and order on the premises and/or for purposes of security and/or for law enforce-ment purposes and/or to ensure compliance with these House Rules, the premises are under video surveillance. Corresponding recordings are kept under lock and key to serve as evidence for the occurrence of criminal offences or legal violations and will be made available to officials and/or law enforcement authorities. §22 Final provisions

1. These House Rules for use of the bathing facilities (HR) are effective as of 28 July 2017. The previ-ous House rules, dated December of 2012, are no longer valid.

2. Appeal against the House Rules as such or against individual provisions of these House Rules are ruled out unless there is another other legal basis.

3. Should any provision of these House Rules be or in the future become completely and/or partially invalid, the validity of the remaining provisions will not be affected. The ineffective provision or inef-fective portion of such a provision is to be replaced by a valid provision that comes as close as pos-sible in its economic effects to the provision to be replaced. The same applies to the filling of gaps.

4. These House Rules can be changed by BSG at any time without giving reasons. Each new version of the House Rules automatically replaces any older version and thereby renders previous versions invalid.
