You could be for- given for thinking that fights occur only over the estates of the rich and famous. But you’d be, ahem, dead wrong. For every Michael Jackson, Brooke Astor and Anna Nicole Smith, there are countless average families argu- ing over a loved one’s legacy. And there are many reasons this occurs. First, what you consider an insignificant amount of money may be a very big deal for one of your heirs. These days especially, people are more likely to go to the mats for what they consider to be their piece of the pie, however thin the piece. Second, families battle overmore than money . They argue over who has control of the estate; how and when the monies are being dis- tributed, etc. They argue over objects, also. In my practice, I have seen siblings furious over furniture, photos, and funeral arrangements. Andlet’s not forget Cain and Abel. Many families have siblings that get along marvelously, always have and always will. Most don’t. When you add the stress of a parent’s passing to sibling rivalry, it’s an even more volatile mix. If you are planning your estate, you can eliminate (or at least mini- mize) family dissension by choosing your Trustee and Personal Represen- tative wisely. An experienced estate planning/elder law attorney can provide you sound guidance in this matter. If, for example, you want as und er sta ndi ng as you would have been. If you can’t find a relative suitable or willing to serve, consider retain- ing a third party to do so, like a l awyer, CPA or bank trust department. There will be a fee for those service s, but you know the job will be done properly. (At least if your family is going to hate anyone, it won’t be another family member!) If you yourself are a Personal Rep- resenta ti ve or Trustee, make sure you cross every “t” and dot every “i” this will go a long way to preserving family harmony. Consult with an attorney experienced in probate and trust administration, who will advise you of your le ga l obli ga tions and help you fulfill them. If you are a Personal Representa- tive or Trust ee who has to defend the legitimacy of an estate plan, be sure to seek legal help.
