Pope Francis’ Motu Proprio
Many of you have heard over the news Pope Francis’ Motu Proprio, on Catholic
Annulments. Because it has only been in Latin and Italian, there are great chances that the
media has altered or exaggerated this message while translating it into English. The Holy
Father's Motu Proprio, "Mitis Iudex Dominus Iesus" has substantially changed the
annulment landscape. Here is what is stated: 1. The changes in the document will be effective December 8, 2015 and the changes are
not retroactive. 2. The document completely reorders the Code of canon Law on "Matrimonial
Processes", presently canons 1671 to 1691; more on specific changes later. 3. The most attention has been given to the "abbreviated process" in which the diocesan
Bishop serves as judge; one hears a lot about this (alleged) "45-day process", even to the
point we're talking about 45 work days not calendar days; however, what is not said is
how extraordinary the use of this process would be, restricted to certain kinds of cases
and certain forms of proof. The grounds are related to matters of fraud, or error, or
constant infidelity, any of which must be proven from evidence admitting of little
contradiction. A good example would be constant physical violence of one party against
the other in which police reports and court records would be submitted proving the
allegation. In cases of fraud in the realm of sterility, medical records would be needed.
You get the picture: neither common nor easily proven. 4. More important are the myriad changes which would touch every case. These include: a. Every case would be heard by either three judges, or one judge and two assessors; the
days of the single, unassisted judge (except where the bishop exercises his office as chief
judge) seem to be at an end (revision c. 1673 §§3-4); b. Competence only requires that the wedding took place in the diocese, or that
either one party or both parties live in the diocese (new c. 1672). Gone is the need for
us to obtain the right to hear a case from the diocese in which the respondent lives (old c.
1673, 3°-4°). In itself, this will save about a month off the process in cases where the
wedding took place elsewhere and the respondent lived elsewhere. c. The judicial vicar is to review every case, set the grounds, determine the
process (ordinary or abbreviated) to be used, and (in the former instance) constitute
the court (cc. 1675-1676). d. The declarations of the parties have been given greater weight, and the testimony of
one knowledgeable witness may be all that's needed for proof. e. The need for experts in medical and psychological cases remains, as does the role of
the Defender of the Bond; f. Perhaps the biggest change for every tribunal of second instance is the elimination of
the mandatory review of affirmative decisions; this will shave roughly 9 to 11 weeks
off each process. Additionally, there will now be only two courts of appeal: the
metropolitan tribunal of each ecclesiastical province (Baltimore for us), and the Roman
Rota.

Women Christmas Gift Ministry As Christmas approaches, we are called to think of
those in need, under not so pleasant circumstances,
and to excise generosity with the less fortunate. The
Women Christmas Gift Ministry for the Fluvanna
Correctional is now joyfully accepting donations of
allowed items. Our doing will help Will Kulick on his
endeavors to bring some joy and encouragement to
our sisters in Christ.
