FINANCE BROKERS CONTROL ACT, 1975.(Section 44 (1) and (2) .)

THE FINANCE BROKERS SUPERVISORYBOARD has fixed the following schedule to be themaximum amounts of remuneration for servicesrendered by persons carrying on the business of aFinance Broker . The schedule shall apply in thecase of contracts made on or after the 1st dayof May, 1977:-

Schedule .1. Application Fee :

$25 .00 for requested loans up to $50 000.00 andan additional $25.00 for each additional$50000.00 or part thereof .

The Application Fee is a Deposit againstBroker's own inspection fee and eventualBrokerage charge .

If an independent qualified valuation is re-quired this is chargeable separately at cost .

2. Inspection Fees :Initial inspections :

Up to 30 kilometres radius-$25.00 .

(d) Conditions of Brokerage Charges :(1) Brokerage should NOT be charged

by a selling Agent where a Con-tract of Sale or Mortgage toVendor is arranged . The AgentBroker may, however, charge ona time basis for consultations andwork done (see MiscellaneousCharges) .

(2) Where the selling Agent is alsothe broker a separate written LoanApplication is also required beforebrokerage can be charged .

(3) Where a broker arranges a loanfrom a Building Society, Bank,Insurance Company or other Fin-ance Institution, and where theapplicant would not otherwisehave been able to obtain that loanfrom that source, brokerage atone half normal rates may becharged. This applies whether thebroker is also the selling Agent ornot, and is subject to clause 4 (d)2 hereof .

5 . Transfer of Mortgage Between InvestorClients: Standard scale of fees plus out of pockets,payable by the Transferor .

6 . Extension of Mortgages : One quarter standardbrokerage inclusive of any re-inspection, but soli-citors costs, stamp duty, and registration shouldbe in addition .

7. Finalisation Fee (Discharges) : Flat fee of$25.00 to include all services required of a broker,in addition to legal costs, out of pockets, and settle-ment fees .

8 . Commission on Interest Collections : 6% in-clusive of postages, cheque duty and bank charges .

9 . Miscellaneous Charges :(a) Production of Titles-Standard Fee $15 .00 .(b) Titles Office Searches-$2 .00 plus Titles

The possession of, or progress towards, an appropriate tertiary level academic qualification will be considered a factor,increasing in importance with the level of classification, when determining efficiency of applicants in the Clerical Division .(a) Applications also called outside the Service under section 24 .(c) Appointment to this position is conditional on the item being vacated by the present occupant .

(1) Junior or Achievement Certificate (or equivalent), essential including Maths and English with preference for LeavingCertificate . Progress towards a Diploma of a recognised Agricultural College (completion of at least first year), or ap-proved equivalent academic qualification with some experience in handling livestock ;

ORany of the above academic qualifications together with at least 5 years' practical experience in handling livestock .

(2) Must be eligible for registration as a Medical Practitioner with the Medical Board of W.A. and possess a Diplomain Psychological Medicine from a recognised body, or be a Member of the Royal College of Psychiatrists (Eng) or ofthe Australian and New Zealand College of Psychiatrists .

Schedule .TOWN OF CANNING TOWN PLANNING SCHEME

No. 29-BURTON STREET GUIDED DE-VELOPMENT SCHEME.

THE Town of Canning under and by virtue of thepowers conferred upon it in that behalf by theTown Planning and Development Act, 1928, asamended, hereby makes the following Town Plan-nig Scheme :-

SCHEME TEXT.Citation .

1. This Town Planning Scheme may be citedas Town of Canning Town Planning Scheme No .29-Burton Street Guided Development Scheme(hereinafter called "the Scheme") .

Responsible Authority .2. The Authority responsible for enforcing the

observance of the Scheme is the Town of Canning(hereinafter referred to as "the Council") .

Maps.3. The following maps are attached to and form

part of the Scheme :-Land Use Map .Scheme Map .

Scheme Area .4 . The Scheme shall apply to the land con-

tained within the inner edge of a broken blackline on the Land Use Map and on the Scheme Map .

General Objects .5 . The general objects of the Scheme are:-

(a) To facilitate and encourage the develop-ment of land within the Scheme Area .

(b) To control development within the SchemeArea according to the proposed uses shownon the Scheme Map and detailed in thisText .

(c) To facilitate traffic movement by the al-teration of road junctions and the creationof rights-of-way.

(d) To set aside lands for public open space .

Scheme Works .6 . The following works shall be carried out

within the Scheme Area :-(a) The surveys of-

(i) the proposed alteration to ChapmanRoad as shown on the Scheme Map .

(ii) the rights-of-way shown on theScheme Map,

shall be carried out .(b) Chapman Road shall be constructed in its

new position at the junction of ManningRoad .

(c) The lands shown as rights-of-way on theScheme Map may from time to time beresumed or otherwise acquired by theCouncil and set aside as rights-of-way .

(d) The said rights-of-way may from time totime be constructed and drained .

Scheme Costs and Payment Thereof .7 . (1) The costs of the survey of and the acqui-

sition of the land for and the construction anddrainage of the rights-of-way shown on theScheme Map shall be paid in the first instance bythe Council and such costs shall be repaid to theCouncil by the persons who, at the date of the giv-ing of the notice hereinafter mentioned, are theowners of the privately owned land abutting suchrights-of-way . Such owners shall pay the costsequally regardless of lot size . Each such ownershall at the expiration of three months' noticefrom the Council specifying his proportion of thesaid costs pay the amount thereof to the Council .

(2) The following costs, namely-(a) The administration costs of the Scheme

including an amount to reimburse theCouncil for such overhead and manage-ment costs as may be incurred in the im-plementation of the Scheme and includinglegal costs, planning costs and paymentsto planning and other professional consul-tants ; and

(b) All other costs and expenses which theCouncil shall be required to meet in orderto complete the Scheme ;

shall be paid to the Council by the owners of theland within Areas A to F inclusive in the propor-tion that the area of each owner's land bears tothe total area of land within Areas A to F inclu-sive. Each such owner shall pay his proportion ofScheme Costs upon the re-zoning of his land inaccordance with the Scheme .

(3) If any of the items of Scheme Costs havenot been paid or ascertained at the time of re-zoning or at the time of the giving of a notice bythe Council as aforesaid the Council may estimatethe costs thereof. An estimate may be revised fromtime to time .

Zoning and Permitted Uses .8 . It is intended that each of the parcels of

land within the areas identified on the Scheme Mapby the letters A, B, C, D, E and F be from timeto time as required by the owners thereof, zonedso as to permit any of the following uses only :-

Areas A and D-Private recreation, publicamusement, public exhibition, health cen-tre, office, public utility, canteen or amen-ity building (which is incidental to thepredominant use of the land), veterinaryclinic, restaurant, social club .

Area B-Tavern .Area C-Reception lodge, private recreation,

public amusement, public exhibition, pub-lic utility, canteen or amenity building(which is incidental to the predominentuse of the land) .

Areas E and F-Public utility, canteen oramenity building (which is incidental tothe predominant use of the land) show-room, office, car sales premises .

Development .9 . No development shall take place within any

of Areas A to F unless for one of the uses andpurposes specified in the preceding clause .

10 . The Council may refuse to grant approvalor may grant approval subject to such conditionsas it thinks fit to any development of land withinAreas A to F in any of the following circum-stances:-

(a) if the lot or lots upon which the develop-ment is proposed is, in the opinion of theCouncil, of insufficient size to accommodatethe development or use ;

(b) if an approval to such development would,in the opinion of the Council, render anyother lot or lots in the Scheme Area in-capable of being efficiently or safely de-veloped for the purpose for which such lotor lots are or are to be zoned ;

(c) if the development proposed would, in theopinion of the Council, adversely affect theamenity of the Scheme Area or adverselyaffect the safety, health or well being ofthe occupiers thereof ;

(d) in the case of a tavern, the Council maylimit its size .

Powers of the Council.11 . The Council in the conduct and management

of the Scheme shall in addition to the powers andauthorities hereinbefore mentioned have the fol-lowing powers :-

(a) To enter and inspect the land within theScheme Area .

(b) To enter into agreements with owners ofland within the Scheme Area .

(c) To enter into agreements and arrange-ments with the Crown, the Public WorksDepartment, the Main Roads Department,the Metropolitan Water Supply Sewerageand Drainage Board or any other Gov-ernment instrumentality or statutory auth-ority as may seem proper to the Councilfor any purposes connected with theScheme or the carrying out of any workswithin the Scheme Area .

(d) To acquire by purchase or otherwise anyland or buildings within the Scheme Area .

(e) To postpone the implementation of theScheme for such period as the Councilthinks fit or to implement the Scheme instages dealing with portions of the SchemeArea from time to time as the Councilconsiders proper in the circumstances.

(f) To make minor variations to the surveydesign where necessary or desirable .

(g) To extend the time within which anymoneys due to the Council may be paidand to agree to the payment by instal-ments and if so required by the Councilto take security for the payment of suchmoneys .

Claims for Compensation .12. Claims for compensation by reason of the

operation of this Scheme shall be made within six(6) months of the coming into operation of theScheme.
