Newsletter 2015-16 April 24, 2015 WEST VIRGINIA KEEPS 51 st RANKING IN CONSTRUCTION JOB EMPLOYMENT West Virginia continues to lead the nation in the percentage of construction jobs lost between March 2014 and March 2015. In an analysis of Labor Department data by the AGC of America, construction firms added jobs in 41 states and the District of Columbia. Nine states shed construction jobs during the past 12 months. West Virginia lost the highest percentage (-7.2%, - 2,400 jobs). Other states that lost a high percentage of jobs include Mississippi (-4.7%, -2,400 jobs), Indiana (-1.6%, -1,900 jobs) and Nebraska (-1.3%, -1,900 jobs). To view the states that added and lost construction jobs in 2014, click here. WEST VIRGINIA PREVAILING WAGE LAW UPDATE S.B. 361 made a number of changes to the state’s prevailing wage statute. The first significant modification occurred on Monday, April 13. After that date, state prevailing wage requirements will only apply on state of West Virginia, and its political subdivisions, projects valued at more than $500,000. The current threshold was $25,000. Private projects that get public grants will require prevailing wages only if the amount of the grant is more than $500,000 regardless of the size of the project. The WV Division of Highways and other public owners have placed in documents for upcoming bid openings information on the new law. Bidders should note that the new law does not apply when federal funding is part of the project. S.B. 361 moves the authority for determining wage rates from the Division of Labor to Work Force West Virginia. Work Force, in cooperation with both WVU and Marshall University, is charged with creating a new methodology by June 1, 2015 to determine what rates prevail. New rates must be out by July 1 but could be extended to September 30 if more time is needed to determine rates. Attached with this Newsletter is an information sheet to answer to some of the frequently asked questions that have been posed by public owners, architects, engineers and contractors. CRACKER PLANT GOING TO OHIO, WOOD COUNTY PROJECT ON HOLD An ethane cracker plant that was hoping to be located in Mason County is now expected to be built in Ohio. PTT Global Chemical informed state officials last week the Ohio site was a better fit. Gov. Tomblin’s spokesman said the problem was the site they liked in West Virginia was too far from where the natural gas was being produced. Company officials said they would build the plant near Shadyside, Ohio, across the river from West Virginia’s Northern Panhandle. It could be 12 - 18 months before engineering design and permitting is complete. Meanwhile, West Virginia’s ethane cracker plant in Wood County is currently on hold due to energy prices and worldwide conditions. The governor’s office said plummeting oil prices making it cheaper to process ethane from oil than natural gas have forced Braskem, and its partner Odebrecht, to re-evaluate the Wood County ASCENT project. consistent with the company’s overall approach,” said Chris Stadelman, the governor’s communications chief. GOVERNOR RACE SHAPING UP FOR 2016 Joe Manchin will not be a candidate for governor in 2016. He announced Sunday that he will stay in the U.S. Senate. There was speculation he might run for his former seat since his office released a poll days before showing him with a commanding lead over potential gubernatorial candidates, including Attorney General Patrick Morrisey and Senate President Bill Cole. Jim Justice, owner of The Greenbrier, surprised people this week when he said he was considering a run for the office. He said he would be making a decision in two to three weeks. He joins others who have stated they are either running or considering a run. They include Sen. Jeff Kessler, D-Ohio, First District Congressman David McKinley, President Cole and General Morrisey. U.S. Attorney Booth Goodwin’s name has been mentioned as a possible candidate. PRESIDENT FLESHER ANNOUNCES BOARD OF DIRECTORS MEETING CAWV President Dan Flesher has called a Board of Directors meeting for Thursday, May 14, at 10:00 a.m. It will be held in the CAWV Conference Room at 2114 Kanawha Boulevard, East, Charleston. The annual CAWV Scholarship Golf Outing will be held on Friday, June 5, at Berry Hills Country Club. Over 300 CAWV members and guests played in last year’s event, which sold out very early. Due to the tremendous number of golfers in recent years, we are limited to 20 "Sixsomes" for both the 7:30 a.m. and 1:30 p.m. starting times. For morning golfers, an awards luncheon will be held immediately after play. For the afternoon golfers, an awards dinner will be held immediately after play. All proceeds from the Golf Outing benefit the CAWV Scholarship Foundation. Anyone interested in participating is encouraged to fill out the reservation form and return it to the CAWV office. Frequently Asked Questions and Answers for SB 361

Question 1: When does the new prevailing wage law go into effect?

Answer 1: April 13, 2015.

Question 2: What is the West Virginia Code section for the new law?

Answer 2: West Virginia Code §21-5A-1, §21-5A-2, §21-5A-3, §21-5A-5, §21-5A-6, §21-5A-8, §21-5A-10, §21-5A-11 and §21-5A-12. Question 3: Does the change in the West Virginia state Prevailing Wage law effect the West Virginia Public bidding statute?

Answer 3: No. The state of West Virginia, every political subdivision thereof, every administrative entity including all municipalities and all county board must solicit competitive bids for every construction project exceeding $25,000.00 in total cost with a few exception such as emergency work.

Question 4. Does the new prevailing wage law apply to all publicly bid construction projects?

Answer 4: Yes.

Question 5. Is there a prevailing wage requirements on publicly bid construction projects with a total project value of $500,000.00 or less?

Answer 5. There is no prevailing wage requirement on solely state funded construction projects of total value of $500,000.00 or less. (State and federal minimum wage laws still apply). However, projects that are paid for with federal money, either partially or fully, fall under the Federal Davis-Bacon Act. Therefore, on jobs with federal money whose project value is $2,000 or more, the higher of the federal prevailing wage rates or the state prevailing wage rates will apply.

Question 6. Where can I find the current prevailing wage rates?

Answer 6. The current prevailing wage rates, as well as several previous years of rates are posted on the West Virginia Secretary of State’s web page. The following is a web address for the posting: http://www.sos.wv.gov/administrative-law/wagerates/Pages/default.aspx

Question 7. Will the West Virginia Secretary of State continue to post the current prevailing wage rates?

Answer 7. Yes.

Question 8. Does the $500,000.00 threshold apply to the total cost of the project?

Answer 8. Yes. The total project cost, or in the case of a grant to a private entity, the total grant. A project that may have two or more contracts still requires prevailing wage rates if the total cost of the project is greater than $500,000 regardless of the cost of the individual contracts.

Question 9. When are the rules related to the Prevailing Wage Act prior to the amendment from the 2015 legislative session repealed?

Answer 9. April 13, 2015.

Question 10. On April 13, 2015, when the rules are repealed, does this mean there is no prevailing wage rates until new rates are determined?

Answer 10. No. Current prevailing wage rates are in place by statute until new rates are established or September 30, 2015 whichever date is earlier.

Question 11. Who will be determining the prevailing wage rates under the new law?

Answer 11. Workforce West Virginia will ultimately decide on the methodology to be used to gather information for the prevailing wage rates. Workforce will work in conjunction with the West Virginia University Bureau of Business and Economic Research and the Center for Business and Economic Research at Marshall University to set the methodology procedure.

Question 12. Is there a cutoff date as to when the methodology must be set?

Answer 12. Yes. June 1, 2015.

Question 13. Is there a review process for the methodology procedure?

Answer 13. Yes. The legislative Joint Committee on Government and Finance will review the methodology being used to determine the prevailing wage rate and will give recommendations to the legislature of any statutory changes needed to clarify the method for determining prevailing wages. Question 14. Will Workforce West Virginia collect the data necessary to set the prevailing wage?

Answer 14. Yes.

Question 15. Will information that I provide for purposes of calculation of the prevailing wage rate remain confidential?

Answer 15. Yes.

Question 16. Will Workforce West Virginia set the new prevailing wage rates?

Answer 16. Yes.

Question 17. When will the new prevailing wage rates be set?

Answer 17. July 1, 2015. However, if the prevailing wage rates are not set by July 1, 2015, the legislative Joint Committee on Government and Finance may extent the time period for when the prevailing wages are to be set until September 30, 2015. If the extension is given, the wage rates as of January 1, 2015 will remain in effect.

Questions 18. What if the prevailing wage rates are not set by September 30, 2015?

Answer 18. There will be no prevailing wage rates after September 30, 2015 and until new prevailing wage rates are set.

Question 19. What state agency will be enforcing the prevailing wage laws?

Answer 19. The West Virginia Department of Labor. The WV DOL is responsible for all wage enforcement on prevailing wage and other areas of the code such as overtime, minimum wage, etc. The new law also gives WorkForce authority to review payroll documents.

Question 20. Does the new law apply to projects awarded before April 13, 2015?

Answer 20. No.

Question 21. If a project is awarded to a bidder whose bid is less than $500,000.00, and later a change order makes the project value over $500,000.00, will the entity awarded the bid be required to pay prevailing wage rates?

Answer 21. No. The $500,000.00 threshold applies to the total project value before the bid is awarded.

Question 22. Must a project of total value of $500,000.00 or less be publicly bid?

Answer 22. Yes unless the total project value is less than $25,000.00.

CAWV MEMBER FIRMS CHOSEN TO LEAD $75 MILLION CIVIC CENTER PROJECT BBL Carlton and ZMM Architects and Engineers, both located in Charleston, were announced in a Charleston City Council Finance Committee meeting as the winning firms to complete the Charleston Civic Center renovation/expansion project. The selection was based on price, design, energy usage, phasing and scheduling. The firms came in with the best design and lowest bid of $75 million, with the two other plans submitted at $82 and $92 million. A $100,000 “honorarium”, however, will be given to the second and third place finishers whose plans will become owned by the city. Construction will be done in four phases, with the first part beginning in the front of the building, including the lobby. The project is expected to be completed by January 2017 and work is to begin this summer. EPA EXTENDS LEAD PAINT RECERTIFICATION FOR RENOVATORS

The U.S. Environmental Protection Agency (EPA) has finalized a rule to extend certifications for thousands of renovators under the Lead Renovation, Repair and Painting (LRRP) rule, effective April 16. The extension will allow as many people as possible to take advantage of pending cost-saving revisions to the federal requirements for refresher training – a course which certified renovators must complete to maintain their “lead-safe certified renovator” status.

AGC reported on and strongly supported this extension, along with a proposal still in the works to eliminate the requirement that the renovator refresher training have a hands-on component, thereby allowing renovators to complete their recertification classes entirely online.

Under the final rule:

Individual renovators who received LRRP certification on or before March 31, 2010 now have until March 31, 2016, to get recertified.

Individual renovators who received LRRP certification between April 1, 2010 and March 31, 2011 will have one year added to their five-year certification.

Subsequent LRRP certifications for renovators receiving the extension will be five years.

Any CAWV member affected by this extension rule already should have received an email from EPA announcing that their LRRP certification is being extended so make sure it did not get stuck in your spam filter. Individual renovators should hold on to EPA’s email because you may need it in the future as proof that your LRRP certification is still valid, as EPA will not be issuing any formal certificates. April 24, 2015 HURRY UP CAN HURT

Sports cars competing over race courses marked with racing stripes. People who race on the job are marked with cuts, bruises, and bandages. There are places to race and places not to race. Speed belongs on the race course, not in the workplace. Almost everyone has been guilty of speeding through a job. We forget, until it's too late, that "hurry up can hurt." In just about every instance, hurrying on the job does not do much to increase productivity. Usually it is simply an easy way to get a job done, get a tough job out of the way or try to get off the job as soon as possible. When we hurry on the job, we accomplish little more than to increase our chances of an unsafe act happening. Let's look at some hurry up acts. Which ones have you caught yourself doing?

Didn't wear safety glasses because the job would only take a few minutes. Used the wrong ladder because the proper one was too far away. Didn't use proper lockout procedures because you could fix it yourself and wouldn't have

to bother anyone else. Took a short cut between machinery or stockpiles of materials. Used a wrench instead of a hammer because your hammer was in your toolbox on the

other side of the room. Climbed a ladder with tools stuck in your pocket, or in your hand, because you didn't

have a tool belt. Cut the grounding prong off a three-way ground wire plug because you didn't have an

adapter. Removed a guard to repair your machine, or for a special run, but haven't got around to

putting it back yet. Reached "just-a-little-bit-further" on the ladder so you didn't have to get down and move

it. Didn't unplug a power tool before making adjustments because you would only have to

plug it in again. Used a dull saw blade for just one more cut. Gave the fork lift truck just a little more "pedal" so you could get one more load in before

HIGHWAY AUTHORIZATION EXPIRES IN FIVE WEEKS In just five weeks, on May 31, highway and transit program authorization ends. Even with an extension of authorization, additional revenue is needed in the Highway Trust Fund by mid-summer or the U.S. Department of Transportation will have to implement “cash management” practices which will result in slow or reduced reimbursements to states for on-going construction projects. Several states have cancelled contract lettings or reduced the number of projects in the lettings because of this uncertainty. CAWV highway members will recall last year when this occurred. Contractors working on WVDOH projects were given the option of pulling off their projects and sending their employees home or accept 50 cents on the dollar. Congress extended the bill until May 31, 2015 to keep the program going. CAWV members, during the April 15 CAWV Congressional Fly-In to Washington, told West Virginia’s congressional delegation that Congress must pass legislation before the deadline or another short-term extension will be necessary – the thirteenth short-term extension in the past five years. Transportation Secretary Anthony Foxx chided lawmakers this week for settling for temporary infrastructure funding measures. Foxx said during a trip to Pennsylvania that the short-term transportation funding measures should be an “outrage” to U.S. residents, the Pittsburgh Tribune-Review reported. “How can you plan, as a researcher or a civil engineer in a transportation department, if you don’t have long-term certainty,” the secretary said. “I think the American people are going to have to say at some point, ‘This is enough. We can’t keep driving on these potholes.’” HIGHWAY FUNDING OUTLOOK The 18.4-cents-per-gallon gas tax brings in about $34 billion per year, leaving lawmakers with an approximately $16 billion annual hole to fill. The Obama administration has proposed a four-year, $478 billion transportation bill that would be paid for largely with revenue from taxing corporate profits overseas to pay for the new round of infrastructure spending. The DOT has said that it will have to start cutting off payments to states in July if Congress does not pass a funding fix because its Highway Trust Fund will run out of money. House Transportation and Infrastructure Committee Chairman Bill Shuster said it will cost about $10 billion just to extend the law until the end of the calendar year. It will cost some $89 billion to authorize the same level of funding for five or six years. Finding the money to pay for a long-term highway bill is the problem. There is no readily available money in the Treasury to pay for it. Chairman Shuster said his committee is ready to tackle the highway bill but the most crucial policy decision is out of the committee’s hands: How much can the government afford to spend. “We could have done the bill three months ago if we had the dollars. I think everybody wants it,” Chairman Shuster said. “It’s driven by the dollars.” The Transportation Committee is waiting for House Ways and Means Committee Chairman Paul Ryan to figure out a tax package that will raise enough money to cover the costs of a long-term bill.

Significant damage to the roads resulted after severe storms in March, which triggered landslides, mudslides and road slippage in more than half of the state. Funding will pay for repairs to damaged culverts, pavement and similar work in about 150 locations around the state. State officials estimate the damage at nearly $15 million.
