WHAT IS HIPAA?HIPAA- Health Insurance Portability and Accountability Act
A comprehensive law that establishes:
• Standards around the use of patient healthcare info• Rules about healthcare portability and billing fraud and abuse• Assurance that patient’s right to privacy is protected and info is only
used for appropriate and necessary purposes.
• No different than confidentiality- just adds additional requirements

HIPAA & HELPLINEHelpLine is required to: • protect against reasonably foreseeable threats and
hazards to security and integrity of individually identifiable healthcare info
• Protect against unauthorized uses or disclosure of that info.

PROTECTED HEALTH INFO (PHI)• Individually identifiable health info• Relates to past, present, or future physical or mental health or condition of an individual; the provision of health care; or payment for healthcare

HOW DOES HIPAA APPLY TO YOU?
As SARN advocates: • Be aware of who is around in hospital or law enforcement settings: nurse,
family, law enforcement, victim- lots of people in and out.• Do not share detailed info about victims served with anyone outside of
SARN program/ HelpLine• Any notes on name, phone number, situation, etc. need to be destroyed
after passing on to SARN staff. • Do not email identifying information via email, always leave that info over
confidential voicemail system• Also be aware of posting on social media (location services), text
messages, etc.

WHY COMPLY WITH HIPAA?• Required by federal law• Stiff financial penalties if found in violation• Raises the bar for protecting people’s privacy• Reduces our risk of confidentiality violations

• Law Enforcement purposes• Victims of abuse, neglect, or DV (especially children)• Avert serious threat to health or safety (harm to self) • Emergency treatment• Other misc. reasons
