TIA – Transfer course from SIMATIC S7 to the TIA Portal

Target Group You are a commissioning engineer, programmer and / or design engineer and already using the SIMATIC S7, and you also want to continue to be able to ma-nage your technological advances while at the same time transitioning to the Siemens TIA portal. 1. Geltungsbereich:Sämtliche Trainings laut QTE-Trainings-Katalog und individuell vereinbar-te Trainings der QTE GmbH erfolgen ausschließlich zu den Allgemeinen Ge-schäftsbedingungen. Davon abweichende Bedingungen mit dem Kunden gelten nur mit der ausdrücklichen Zustimmung der QTE GmbH.2. Leistungsumfang:Der Leistungsumfang der Trainings beinhaltet die Abhaltung der jeweiligen Trainings am vereinbarten Ort, die Bereitstellung der Hardware, Trainingsun-terlagen und eine Teilnahmebestätigung. Die Description der Trainingsinhalte entspricht dem Standard des Kataloges der QTE GmbH zum Zeitpunkt der Aus-gabe des Kataloges. Inhaltliche Änderungen oder Anpassungen während des Trainings behält sich die QTE GmbH ausdrücklich vor. Für individuell auf den Kunden abgestimmte Trainings ist der jeweilige Leistungsumfang entspre-chend zu definieren. Ein Anspruch auf eine Teilnahmebestätigung besteht bei einer Teilnahme von mehr als 80 % des für das Training festgesetzten Zeit-raumes. Der Kunde garantiert, dass der Leistungsumfang ausschließlich zum unmittelbaren Zwecke des Kunden und nicht für Dritte verwendet wird, soweit hier schriftlich keine andere Vereinbarung getroffen wurde.3. Anmeldung, Datenverarbeitung:Anmeldungen erfolgen schriftlich unter Verwendung des Anmeldeformulars auf der Website oder nach schriftlicher Beauftragung. Der Kunde erhält nach Auftragseingang eine Auftragsbestätigung über das bestellte Training, den Ort, Termin und den Preis. Der Kunde erteilt des Weiteren seine Zustimmung , dass die in der Anmeldung enthaltenen personenbezogenen Daten seitens der QTE GmbH gespeichert und verarbeitet werden dürfen.4. Preise und Zahlungsbedingungen:Die Preise für die Trainings sind im Kataloganhang – aktueller Stand- aufge-führt bzw. für individuelle Trainings zu vereinbaren. Grundsätzlich erhält der Kunde vorab ein entsprechendes Angebot. Aufenthalts,- Übernachtungs- und Reisekosten sind (soweit im Angebot nicht anders vereinbart) vom Kunden zu tragen. Die Preise verstehen sich, soweit nicht anders vereinbart, in Euro ex-klusive Umsatzsteuer und sonstiger Gebühren oder Spesen und sind freiblei-bend. Der Kunde erhält nach Anmeldung eine Rechnung, die innerhalb von 14 days ab Fakturadatum, netto, spesen-und abzugsfrei zahlbar ist, spätestens jedoch zum Trainingsbeginn.5. Stornierung:Der Kunde hat das Recht, vor dem Trainingsbeginn Ersatzteilnehmer/innen zu benennen, soweit von der QTE GmbH keine begründeten Einwände bestehen. Für vereinbarte, aber nicht in Anspruch genommene Trainings verrechnet die QTE GmbH wie folgt:Eine schriftliche Stornierung bis 4 Wochen vor Schulungsbeginn ist kostenfrei. Bei Absage bis 3 Wochen vor Schulungsbeginn werden 50% und bei Absage bis 2 Wochen vor Schulungsbeginn 70% der Kursgebühren erhoben. Nach Ablauf einer Frist von bis zu 2 Wochen ist die Kursgebühr in voller Höhe zu entrichten. Sollte ein Teilnehmer durch Krankheit, oder vergleichsweise schwerwiegenden Gründen an der Teilnahme gehindert sein und ist eine kostenlose Absage nicht mehr möglich, kann die QTE GmbH einen Gutschein ausstellen, der zur Teilnah-me an einem späteren, von der QTE GmbH festgelegtem Zeitpunkt berechtigt.6. Die QTE GmbH garantiert aber nicht, dass diese Informati-onen stets fehlerfrei sind. Für den Kunden im Rahmen möglicher zugefügter Schäden haftet die QTE GmbH im Rahmen ihrer Betriebshaftpflichtversiche-rung, insgesamt bis zum Nettobetrag des Trainingspreises. Weiterhin haftet die QTE GmbH für Schäden bei Vorsatz bzw. grober Fahrlässigkeit. Die Haftung für leichte Fahrlässigkeit, der Ersatz von Folgeschäden, reine Vermögensschä-den, entgangenem Gewinn und Schäden aus Ansprüchen gegenüber Dritten gegen den Kunden sind ausgeschlossen, ebenso eine Haftung für den Trai-ningserfolg. Bei Beschädigung von Datenträgermaterial des Kunden umfasst die Ersatzpflicht nicht den Aufwand für die Wiederbeschaffung verloren gegan-gener Daten. Weitergehende Schadensersatzansprüche , gleich aus welchem Rechtsgrund, sind ausgeschlossen. Soweit die Training in Räumlichkeiten und Gelände des Kunden stattfinden, haftet die QTE GmbH nicht bei Unfällen, Ver-lust oder Beschädigung des Kundeneigentums, es sei denn, der Schaden wurde vorsätzlich und grob fahrlässig verursacht.9. Copyright, Urheberschutz und Geheimhaltung:Alle von der QTE GmbH bereitgestellten Unterlagen sind als geistiges Eigentum schützenswertes Know-How der QTE GmbH und/oder Dritten. Eine Weitergabe oder Vervielfältigung ist ohne ausdrückliche Genehmigung von der QTE GmbH nicht gestattet. Die von der QTE GmbH zum Zweck des Trainings bereit gestellte Software darf weder entnommen, noch ganz oder teilweise kopiert werden. Der Kunde haftet für jedes Zuwiderhandeln.10. Sonstige Bestimmungen:Sollten einzelne Bestimmungen ganz oder teilweise unwirksam und/oder un-durchsetzbar sein oder werden, so bleiben alle übrigen Bestimmungen wirk-sam. Das gleiche gilt für entsprechende, nicht genannten Regelungslücken.11. Anzuwendendes Recht/Gerichtsstand:Gerichtsstand für alle Rechtstreitigkeiten, die sich aus dem Vertragsverhältnis ergeben oder in diesem Zusammenhang stehen, ist für den Kunden ausschließ-lich das sachlich für die QTE GmbH zuständige Gericht in Kassel. Die QTE GmbH ist jedoch berechtigt, an jedem anderen Gericht zu klagen, das nach nationalem oder internationalem Recht zuständig sein kann. Auf sämtliche, insbesondere diesen Trainingsbedingungen zugrunde liegenden Rechtsgeschäften ist aus-schließlich deutsches Recht anzuwenden. Ausgenommen sind Verweisungs-normen, insbesondere jene des internationalem Privatrechts, soweit diese auf die Anwendung des ausländischen Rechts verweisen. Sieht das deutsche Recht bei Auslandsberührung die Anwendung spezieller, auch in Deutschland geltender internationaler Sachnormen- wie z.B. das UN-Kaufrecht- vor, so sind diese nicht anzuwenden.
