Weekly Halacha ‐ Parshas Beha’aloscha R’ Mordechai Torczyner – [email protected]
When is the earliest time I may daven maariv?
In the popular mind, halachic daytime ends with sunset, and so maariv should be recited after sunset. However, the Talmud (Berachot 26b) also identifies another system for calculating the end of the day; dividing the period between sunrise and sunset into 12 equal “hours”, daytime ends when only 1.25 of those hours remain. This moment is called plag haminchah. [Others calculate plag haminchah differently, dividing the period between dawn and the emergence of the stars into 12 equal “hours”.] In this system, one may use plag haminchah as the divider between day and night, davening minchah before plag and maariv after plag.
Certainly, one should avoid taking advantage of leniencies of both systems on the same day, davening both minchah and maariv between plag and sunset. Some are lenient in situations of necessity, such as where communal prayer is only available at this time. (Mishneh Berurah 233:6, 233:11‐12)
Because we normally daven minchah until sunset, the Shulchan Aruch (Orach Chaim 233:1) is uncomfortable with the idea of davening maariv after plag haminchah on a particular day for convenience; we should stick with one system. However, some are lenient regarding switching for Friday night (Mishneh Berurah 267:6), and others are lenient even regarding switching for weekdays as needed (Piskei Teshuvos 233 [14]).
One should always be careful to recite Shema again, after the stars emerge.

QUESTIONS FOR PARSHAS BEHAR BEHA’ALOSCHA BY: THE RAV
First Aliyah: (8:3) Why does the Torah state the obvious, that Aharon lit the Menorah just as Hashem commanded Moshe? Second Aliyah: (8:24) How old is a Levi when he begins his service – 25 years old (as written here), or 30 years old (as written in 4:3)? Third Aliyah: (9:1) Why is the “desert Sinai” referenced here as the location in connection with the mitzvah of Pesach Sheni? Fourth Aliyah: (9:17‐23) Why is the Torah so verbose in saying a simple idea, that Bnei Yisrael traveled according to the movement of the cloud? Fifth Aliyah: (10:32) Moshe tried to prevail upon his father‐in‐law to stay with them, but why doesn’t the Torah tell us if his father‐in‐law listened to him or not? Sixth Aliyah: (10:35‐36) Why the backward “nun” letters? Seventh Aliyah: (12:10) Why was only Miriam afflicted with tazara’as and not Aharon – weren’t they both complicit in speaking lashon hara?
