Today, law enforcement is behind the curve………….

Law enforcement is busy gathering data to be utilized in: traffic crashes and various property crime analysis – to better manage resources

Law enforcement struggles with the gathering and utilization of statistical data to predict and prevent domestic violence and stalking related high-lethality events

HIGH-LETHALITY EVENT

Defined as: an event that is likely to result in; GBH or death – such as: aggravated assault with a deadly weapon, strangulation, sexual assault and or kidnapping

If a real terminator arrived in 2011

No need for a phone book!!!

With one smart phone today’s terminator will easily:

1. Access facebook and immediately know who your current family and friends are

2. Current photos of you and your children

3. Current detailed information about your lifestyle

4. Names of acquaintances and animals you own

5. Layout information about you place of work and residence……… with all this information a high-lethality threat ―terminator‖ will then begin the hunt!!! But wait….. There is more

If a real terminator arrived in 2011

This modern day terminator will closely examine each photo you have posted…. Many modern day devices place a GPS stamp on the photo……. So

Each photo with the GPS stamp has now given this predator the exact position of your home, your place of work, your mom’s house, your sister’s house and all places you have vacationed

This is scary …. But there is more…..

If a real terminator arrived in 2011

This predator will now go to Google Earth and map out all GPS positions

With satellite images and EVEN curb view 360 degree video of most, if not all locations

If that’s not enough… they could lower themselves to paying $20.00 to immediately gain access to every piece of publicly mined data

Wait….. It even gets better ….

If a real terminator arrived in 2011

If this terminator is your ex-spouse or significant other….. Then they not only have all of the previous information… they also know what NO ONE ELSE KNOWS…

Your tendencies, your resources, your pattern of activities, and your most private and intimate secrets ……

Behind the curve? At this point you can see that law enforcement is

not even in the game

Just like a terminator, a high-lethality offender has NO interest in negotiating, most often they have but ONE objective….. All of which are bad for the victim and community

Either LE stops them or the high-lethality event happens

Dynamic InterventionThe old vs. the new

Historically LE has investigated stalking as random harassment, with the end result being a generated report.

The old LE approach is reactive (report after report without follow-up investigation).

The old LE approach only became proactive once the offender committed a ―serious crime.‖

Is a DV/stalking homicide random?

NIJ statistics clearly show 4 out of 5 females who are murdered are FIRST stalked, PRIOR to their murder

Does that seem random? Clearly NO, but why does law enforcement take the wait and see approach with stalkers?

A: a lack of clarity – DSI applies the needed clarity prior to the high-lethality event

Dynamic InterventionThe old vs. the new

The dynamic intervention approach allows for a proactive LE response once a case has been identified as a ―high lethality case‖ by the DV/Stalking Unit.

Dynamic Intervention affords LE the BEST opportunity to place themselves between victim and the stalker, via aggressive investigation utilizing all available resources.

Peggy Klinke Video Introduction The Peggy Klinke case clearly demonstrates the

need for Dynamic Intervention in stalking cases involving identified high lethality indicators.

LE may or may not have been able to alter the final outcome of this case, although Dynamic Intervention allows the best opportunity to do so.

Lethality indicators

allow law enforcement the best opportunity to combine past offender conduct, with current offender conduct and thereby attempt to predict future lethality. This is a proactive thought process that assists in the identification of offenders, who are becoming increasingly more violent towards the victim.

Law enforcement should pay close attention during ―high-lethality windows‖ when violence is on the rise, combinedwith the loss of conduct inhibitors such as: loss of employment, divorce filing, restraining order service, change in parental rights or any other substantial change, that limits the offender’s access to the victim.

a loss of behavioral inhibitors, YOU ARE IN A HIGH-LETHALITY WINDOW of time and both law enforcement and the victim needs to recognize that fact.

Call it what it is ―this is a high-lethality offender with an 8 out of 10 score indicating increasing lethality‖ DOCUMENT THIS FACT – tag the TA into evidence.

We have been desensitized to this type of predator and that is this guys greatest advantage

Why do we need DSI

How would you react if this note fell from the purse of

your daughter, wife, or sister?

2005 the victim was battered into a coma by Clawson.

He was sentenced to 3 years in Santa Rosa Prison.

Mar 28, 2008- released from prison.

Apr 23, 2008- Clawson began calling the victim.

Apr 23, 2008- Victim obtained a TRO.

0930hrs. Apr 23, 2008- the victim’s cousin called and told her that Clawson had just been at her house looking for her. Clawson then went to a neighbor’s house and looked in the windows while calling the victim’s name. (her modernday terminator)

1000hrs. Apr 24, 2008- Clawson went to the victim’s place of work.

Apr 24, 2008- Detectives obtained a Misdemeanor Arrest Warrant for stalking. $10k cash only.

Apr 24-28, 2008- Detectives placed a ―Welfare Check‖ on the victim’s home and work.

Apr 28, 2008- Clawson (was pulled through a window) and arrested on our recently obtained aggravated stalking warrant). He was served with the TRO while in custody.

Clawson continued to telephone the victim from MDC. (Violating the TRO) including 3rd party callers.

Detectives obtained phone records from MDC.

Detectives contacted MDC and had his telephone privileges revoked.

May 18, 2008- Clawson punched another inmate in the face and placed into restrictive detention.

May 21, 2008- Clawson beat another inmate who stated ―I don’t know why he attacked me!‖ and again placed into restrictive detention.

Plead guilty to stalking and restraining order violation sentenced to 15 months at MDC.

Jan 9, 2009- Clawson was found to be in possession of controlled substance and Battered a Corrections Officer.

A promise was made It’s understood that you will eventually be

released from prison… therefore ….

When you are released we will follow you to ensure you do not reacquire your victim

We will do all in our power to focus on you as a high-lethality threat

No longer will LE be confused about your intentions – and we will respond accordingly

Clawson case conclusion

NENAHNEZAD — A Fruitland man was shot late Sunday afternoon after a verbal altercation between family members, authorities said. Leonard Clawson, 39, was airlifted to University of New Mexico Hospital after he was wounded by a shotgun near the Nenahnezad Chapter House, FBI Special Agent Darrin Jones said. Clawson died Monday. An autopsy will be conducted today to determine the exact cause of death, Jones said. Alcohol might be a factor in the incident. Navajo Nation Police and the FBI continue to investigate.

LE has ONE central collection point for high-lethality offenders (put the pieces together)

LE conducts a ―Lethality Assessment.‖

A Lethality Assessment is analyzing data of risk factors, past history, previous TRO’s, prior use of weapons, etc.

Involve Victim’s Advocates.

Obtain an Order of Protection.

Design and implement a Safety Plan.

Safety Planning

The victim knows the stalker better than the detective.

The detective and the victim must work together to insure the victim’s safety.

Victim has the responsibility to be an active participant in their own case!

Victim and Detective will work together to design the best course of action for the victim’s safety.

Safety Planning NO CONTACT WITH STALKER

Change phone numbers; If possible, get an additional unlisted number and

keep original number connected to an answering machine to record messages from stalker

Alter work hours, travel routes, and other predictable patterns.

Inform employers, co-workers, neighbors,

and Security about the stalking problem and provide a copy of the TRO.

Restraining OrdersOrders of Protection

Advantages Of Protection Orders An effective tool for law enforcement for

immediate apprehension

Criminal prosecution may take months, whereas an Order of Protection can be issued immediately

Can be used to enhance a stalking investigation

But wait… what about a high-lethality offender?

An order of protection often has little effect on a high-lethality offender

It is a piece of paper, without enforcement of the order by LE, if remains a piece of paper – that’s it!

High-lethality offenders are in a class by themselves, do not be confused about what they really want….

Example: If an identified high-lethality offender says to you: ―If I can’t have you - no one else will. I will kill you before I let you take my kids and live with that other man!!‖ ***take them at their word!!!

Remember … No order can assure a victim’s safety.

An order may provoke rather than deter a stalker.

Obtaining an order can sometimes give a victim a falsesense of safety, especially when high-lethality offenders are involved!

Orders are only effective when they are enforced.

DSI phase II

DSI phase II LE must quickly identify the offender and begin

to formulate a plan of action.

One case agent is assigned as the primary investigator (ownership)

Intelligence gathering for immediate surveillance Tact Plan (bring all known information together)

Obtain an arrest warrant for known offenders whenever possible – assists in clarity

Surveillance to establish PC for arrest and or to locate the offender for apprehension

DSI phase II Surveillance of victim location and or locate

suspect location, if possible.

Surveillance is the core of Dynamic Intervention because it is ground zero

If LE pays no attention or misses high-lethality windows of time, high-lethality offenders will be completely unabated to their targets

Conclusion

LE MUST have one centralized collection point for information

Stalking cases must be screened for lethality

All resources must be focused on a result oriented intervention, providing for a new proactive approach

Surveillance, warrants and restraining orders must be the core of any LE Dynamic Intervention
