RESOLUTION NO. 147-19

APPROVING THE INSERTION OF AN ITEM OF REVENUE

WHEREAS, N.J.S.A. 40A: 4-87 provides that the Director of the Division of Local Government

Services may approve the insertion of any special item of revenue in the budget of any county or

municipality, when such item shall have been made available by law, and the amount thereof was not

determined at the time of the adoption of the budget; and

WHEREAS, said Director may also approve the insertion of any item of appropriation for an

equal amount;

NOW, THEREFORE, BE IT RESOLVED, that the Mayor and Township Committee of the

Township of Voorhees, do hereby request the Director of the Division of Local Government Services to

approve the insertion of an item of revenue in the budget of the year 2019 in the sum of $65,767.77,

which is now available as a revenue from the State of NJ Clean Communities Fund;

BE IT FURTHER RESOLVED that the sum of $3,288.39 is hereby appropriated under the title

“Clean Communities Grant – Salaries & Wages,” and $62,479.38 is hereby appropriated under the title

“Clean Communities Grant – Other Expenses,” pursuant to the provisions of the statute.

RESOLUTION NO. 151-19

RESOLUTION OF THE TOWNSHIP OF VOORHEES, COUNTY OF CAMDEN AND STATE OF NEW JERSEY AUTHORIZING AND APPROVING AN EXTENSION TO

TRANSPORT AGREEMENT WITH VIRTUA HEALTH, INC.

WHEREAS, Virtua and the Voorhees Township Fire Department (“Voorhees”) entered

into a Transport Agreement, dated May 7, 1998 (“Agreement”) and had extended the term of the

Agreement through March 31, 2019; and

WHEREAS, it is the desire of the Parties to extend the Agreement for a one-year period,

effective April 1, 2019 and ending March 31, 2020; and

WHEREAS, after examination and consideration, the Mayor and Township Committee

have determined that it is in the best interest of the Township and its residents to enter into an

Amendment and Extension of the Transport Agreement with Virtua Health, Inc.

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Township Committee of

the Township of Voorhees, County of Camden and State of New Jersey that the Township

hereby approves and authorizes an Amendment and Extension to the Transport Agreement

between the Township of Voorhees and Virtua Health, Inc. attached hereto as Exhibit “A”; and

BE IT FURTHER RESOLVED that the Mayor is hereby authorized to execute the

Amendment and Extension to Transport Agreement and take any other action necessary to

effectuate this Resolution; and

BE IT FURTHER RESOLVED the Township Clerk is hereby authorized to publish

notice of this Resolution as required by law.

RESOLUTION NO. 152-19

RESOLUTION AUTHORIZING THE EXECUTION OF AN INTER-MUNICIPAL AGREEMENT BY AND BETWEEN THE TOWNSHIP OF VOORHEES, THE TOWNSHIP OF

CHERRY HILL AND THE CHERRY HILL CARE GROUP, LLC CONCERNING THE DEVELOPMENT OF THE PROPERTY LOCATED AT 840 EVESHAM ROAD, DESIGNATED AS BLOCK 519.11, LOT 2.01, AS SET FORTH ON THE TAX MAP OF THE TOWNSHIP OF

CHERRY HILL, TO CONNECT TO THEVOORHEES TOWNSHIP SEWER SYSTEM

WHEREAS, the Township of Cherry Hill, County of Camden, State of New Jersey, is a

Municipal Corporation in the State of New Jersey (also known as "Sending Township"); and

WHEREAS, the Township of Voorhees, County of Camden, State of New Jersey, is a Municipal

Corporation in the State of New Jersey (also known as "Receiving Township"); and

WHEREAS, on May 21, 2018, the Cherry Hill Township Planning Board granted preliminary

and final major site plan and variance approval, as well as minor subdivision approval (Application # l 8-

P- 0009) to Cherry Hill Care Group, LLC (hereinafter referred to as the "Developer"), as the applicant

and developer, to subdivide an existing 25 acre parcel into two (2) lots to construct a 66-bed licensed

dementia care facility on 3.88 acres (hereinafter referred to as the "Development"), where an existing

synagogue (M'Kor Shalom) shall remain on the remaining 21.22 acre parcel for the property located at

840 Evesham Road, Cherry Hill, New Jersey 08003 also known as Block 519.l l, Lot 2.01 (formerly

known as Lot 2), as designated on the Tax Map of the Township of Cherry Hill; and

WHEREAS, the Development is located on the north side of Evesham Road and the municipal

boundary line between Cherry Hill Township and Voorhees Township is the centerline of Evesham Road;

and

WHEREAS, the existing synagogue is currently serviced by a two inch (2") sanitary force main

that is connected to the Voorhees Township sanitary sewer pump station on the south side of Evesham

Road; and

WHEREAS, there is no public sewer along Evesham Road for the proposed 66-bed licensed

dementia care facility to connect to and the closest Cherry Hill Township sewer connection point is 1,500

LF west of the site at the intersection of Brick Road and Evesham Road; and

WHEREAS, the Developer is proposing to service the Development by connecting to the

Voorhees Township sewer main within Brendenwood Drive across Evesham Road; and

WHEREAS, the Development will generate approximately 6,600 gallons per day (GPO) in

accordance with the New Jersey Department of Environmental Protection (NJDEP) Projected Flow

Criteria (N.J.A.C. 7:14-23.3), which is based on the use classification for an assisted living facility; and

WHEREAS, the Development will propose a six inch (6") sewer lateral be extended from the

proposed building to the curb line of Evesham Road and a jack and bore will then be performed to cross

Evesham Road and received on the south side of Evesham Road, to which the six inch (6") sewer lateral

will then extend along the west side of Brendenwood Drive within an existing landscape area until it

crosses Brendenwood Drive at the receiving manhole ultimately connecting to the Voorhees Township

sewer system; and

WHEREAS, the greement for such services shall be predicated upon the approved engineered

drawings to permit such sewer connections and service to the Development through the Voorhees

Township sewer system via terms and conditions as approved by the Township of Voorhees and

Township Solicitor in a form on file with the Clerk of the Township of Voorhees; and

WHEREAS, all terms and conditions set forth in the March 13, 2019 correspondence prepared

by Churchill Consulting Engineers, Luis I. Garcia, P.E., the Township Sewer Engineer are incorporated

herein by reference.

NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Township Committee of the

Township of Voorhees, County of Camden and State of New Jersey as follows:

1. The provisions of the WHEREAS clauses set forth above are incorporated herein by reference and made a part hereof.

2. The Mayor, Deputy Mayors and Township Clerk are hereby authorized and directed to execute an Inter-Municipal Agreement by and between the Township of Voorhees, the Township of Cherry Hill and Cherry Hill Care Center, LLC concerning the development of the property located at 840 Evesham Road, Cherry Hill, New Jersey 08003 also known as Block 519.11, Lot 2.01, as designated on the Tax Map of the Township of Cherry Hill to connect to the Voorhees Township sewer system expressly subject to the terms and conditions set forth in the March 13, 2019 correspondence prepared by Luis I. Garcia, P.E., Churchill Consulting Engineers, the Township Sewer Engineer.

3. The Mayor, Deputy Mayors or their respective designee are hereby authorized to take any all steps necessary to effectuate the purpose of this Resolution.

RESOLUTION NO. 153-19

ENCOURAGE THE USE OF REUSABLE BAGS INSTEAD OF SINGLE-USE PLASTIC AND PAPER BAGS

WHEREAS, single-use plastic and paper checkout or carryout bags create significant litter

problems in the neighborhoods of the Township of Voorhees (“Township” and/or “Voorhees”) and have

been found in our trees, streets, parks and stormwater and sewer systems; and

WHEREAS, single-use plastic and paper checkout or carryout bags are considered trash, not a

recyclable item and therefore pose a contamination risk to clean recyclables encouraged by the Township

and mandated by State Law and accordingly, such single-use plastic and paper checkout or carryout bags

should be disposed of in our residents’ trash containers; and

WHEREAS, the broad use of single-use plastic and paper carryout bags and their typical

disposal is an impediment to the achievement of the environmental goals of the Township to maintain a

clean community that is not hazardous to wildlife; and

WHEREAS, the production and disposal of single-use plastic and paper carryout bags have

significant environmental impacts, including the contamination of the environment, the depletion of our

natural resources, the unnecessary use of non-renewable and polluting fossil fuels, and increased litter

disposal costs; and

WHEREAS, the reduction in the use of single-use plastic and paper carryout bags helps to

protect the environment, advance solid waste reduction, reduce greenhouse gas emissions and keep

waterways clean; and

WHEREAS, studies document that discouraging the use of single-use plastic and paper carryout

bags will reduce the use of plastic and paper bags, and increase customers’ use of reusable bags; and

WHEREAS, the Mayor and Township Committee of the Township of Voorhees finds that the

reduction in the use of single-use plastic and paper carryout bags by food and retail establishments in the

Township is a public benefit.

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Township Committee of the

Township of Voorhees, County of Camden and State of New Jersey as follows:

1. The provisions of the WHEREAS clauses set forth above are incorporated herein by reference and made a part hereof.

2. The Mayor and Township Committee of the Township of Voorhees, County of Camden, State of New Jersey support all efforts to encourage residents and retail establishments to use reusable bags instead of single-use plastic and paper bags and dispose of single-use plastic checkout or carryout bags in the trash, rather than recycling containers.

3. The Mayor and Township Committee of the Township of Voorhees further request that all retail establishments train their employees to “Ask before Bagging” to give all shoppers an opportunity to save a bag.

4. A copy of this Resolution shall be posted in all public building and prominent areas throughout the Township.

RESOLUTION NO. 154-19

APPOINTING DOMINIQUE DECKERAS PART-TIME CLERK

WHEREAS, a vacancy exists for the position of part-time clerk in the

Police Department of the Township of Voorhees; and

WHEREAS, Dominique Decker possesses the skills and knowledge to

perform the duties of clerk; and

WHEREAS, Police Chief Lou Bordi is recommending that Dominique

Decker be hired to fill the vacancy, as she has the qualification to fill the position;

and

WHEREAS, Dominique Decker has passed the background investigation.

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Township

Committee of the Township of Voorhees, County of Camden, State of New Jersey

that DOMINIQUE DECKER be appointed to the position of PART-TIME

CLERK in the Police Department of the Township of Voorhees effective June 10,

2019.

APPOINTING PART TIME EMERGENCY MEDICAL TECHNICIANS

WHEREAS, there is a need to hire additional part time Emergency Medical Technicians

in the Township of Voorhees; and

Mr. Platt thanked Township Committee and Township CFO Dean Ciminera for all the work they did on this year’s budget. He believes we are serving all the needs of the Voorhees residents. He added that he is very happy with the Jake’s Place inclusion in the budget.

Mr. Friedman voted No for the budget and although he felt committee did a very good job with the budget but feels that there is more that can be done. He is happy with Jake’s Place, a great idea and thanked Mr. Ravitz, he is happy with the road program. There is a good balance on the public safety initiatives. He feels the professionals are still overpaid and feels that public safety overtime can be reduced. He has asked the chief to look at Monmouth Township’s volunteer program for ideas to help rebuild our firefighter volunteer program.

Mr. Friedman added that there are still un-capped allowances in the budget for payments to members of Township Committee above $3,000.00. He would like to see these expenses capped.

Mr. Friedman stated that we can help ease the tax burden on the residents by initiating revenue streams. We passed a naming rights ordinance several years ago, but we haven’t gotten one agreement in seven years that we passed the ordinance.

He added that he doesn’t want to see anymore tax increases, including the potential rain tax being all by municipalities by Governor Murphy and stated that he hopes Township Committee does not pass the rain tax.

Mr. Ravitz thanked the township employees who participated in budget process. He added that Voorhees Township has not had a tax increase in the past two years and this year’s increase is marginal. It is always good to have a marginal increase locally. It helps with rising costs of health care and other expenses. Putting more money to programs and a budget surplus is a healthy thing to do. Very excited for the Jake’s Place project and will work very hard to get private funds to help eliviate the costs. I appreciate Committeeman Friedman’s comments. He added that this township has been financially frugal that have prevented us from drastic measures. He added that we absorbed the fire district and all of it’s debt and problems and we have only had one small tax increase.

Mrs. Nocito thanked the residents for their trust and confidence in Township Committee and the employees. Voorhees Township is the place where we all love.

COMMENTS FROM COMMITTEE

Mr. Ravitz asked Solicitor Long if action needs to be taken to authorizing the forming of a Residents’ Committee for input, design and fundraising?

Mr. Long suggested that interested members should fill out the volunteer form on the website and we can do some advertising to alert residents of the form and need for volunteers. A liaison should be appointed and we should move from there.

Mr. Friedman agreed to help with fundraising.

Mr. Ravitz added that Township Committee put $100,000.00 aside for an opioid diversion program. He stated that other towns have also done this and we should look to those towns to help further our programs.

Ms. Nocito thanked everyone who came out to the car show and thanked the police and fire departments for their help.

Ms. Nocito also thanked Sgt. Charles Fowler for his many years of service as he is retiring.

Ms. Nocito thanked Moms In Action who are here tonight for their hard work.

Mayor Mignogna thanked Ms. Nocito for her hard work with the car show and wished Charles Fowler well on his retirement.

Mr. Chenier thanked Township Committee for the Veteran’s Wall of Honor and presented Township Committee with a plaque to be added to the display.

Ms. Gibbs asked what was is being done to stop the car break-ins at Connolly Park.

Chief Lou Bordi said his department is diligently working on catching those responsible and will continue to conduct their investigations. He reminded patrons to hide their valuables while at the park.

Ms. Gibbs stated that she had been reading past minutes and reflected on a public comment regarding reimbursement of tuition and a policy to eliminate that reimbursement. Mayor Mignogna said that a policy is in place. Mr. Friedman stated that he has requested changes to the policy through the adoption of amendments to the current policy.

Discussion continued between Township Committee regarding potential ordinance changes or the creation of a new ordinance.
