SMOKE FREE WA TET NEW YEAR FESTIVAL

Application to Operate a Food Stall - Terms and Conditions

(Form F)

1. No alcohol shall be sold or consumed during the event;

2. The Organising Committee shall designate the location of stalls as appropriate. The Committee may consider

any stall holders’ requests but reserves the right to make the final decision;

3. Stall holders selling FOOD and/or DRINKS are required to attend a meeting to go over the Terms and

Conditions and to determine the location of the stalls. (A representative from the Organising Committee will

contact you to advise of the date and time);

4. All stall holders providing food need to complete the Application for Special Events Permit -Food Vehicles

and Temporary Food Outlets;

5. All stall holders providing food are to be supplied with a hand wash facility in accordance with the

Compliance Services- Information Sheet 1;

6. All stall holders providing food are required to have a Fire Extinguishers within their stall;

7. All gas cookers and BBQs must meet the standards of the relevant authority in WA;

8. All stall holders providing food are required to have a fridge or a facility to store food at below 5 C as stated

in the Environmental Health Requirements Food Handling At Temporary Functions guidelines (attached

below)

9. All stall holders providing food are to adhere to the requirements set out in the Environmental Health

Requirements Food Handling At Temporary Functions and Guidelines – Barbecue Cooking –Sausage Sizzles

(attached below);

10. Stall holders must clear all materials from their stalls and perform a thorough clean-up in and around their

own stalls on the closing night of the event, 08/02/2014;

11. The Organising Committee reserves the right to assess and refuse any application(s) that is deemed not to be

in accordance with the theme of the Tet Festival, and/or does not comply with these Terms and Conditions.

The Committee's decision shall be final.

12. The Organising Committee shall not be directly or indirectly liable for any loss, damage or injury to any

person or property as a result of any act or omissions by any stall holder during the duration of the festival.

13. Tet Festival is communal and family social event operated by the Vietnamese Community in WA for the

celebration of the traditional Vietnamese New Year. No charitable, religious or political fundraising activity

be allowed within the festival showgrounds.

ĐIỀU KIỆN Áp Dụng Cho Các Lều Hội Chợ Tết 2014 Tại Wannerro Showgrounds

1. Không được bán hay uống rượu, bia trong khuôn viên hội chợ

2. Vì số gian hàng ghi danh ngày càng nhiều, Ban Tổ Chức dành toàn quyền sắp xếp vị trí của các gian hàng để đạt được kết quả tốt nhứt cho các gian hàng và người đến tham dự HCT

3. Mỗi gian hàng ghi danh bán thức ăn trong hội chợ, được yêu cầu tham dự một buổi họp để được hướng dẫn về những điều kiện bán thức. Đại diện ban tổ chức hội chợ sẽ liên lạc quý vị về thời gian và điạ điểm họp nội trong tháng 1 năm 2014

4. Tất cả gian hàng nào bán thực phẩm phải điền vào bản mẫu (Application for Special Events Permit: Food Vehicles and Temporary Food Outlets)

5. Tất cả những gian hàng bán thực phẩm phải cung cấp phương tiện rửa tay theo luật định đính kèm (Compliance Services Information Sheet 1), đính kèm

6. Tất cả những gian hàng bán thực phẩm phải có bình chữa lửa tại lều của mình

7. Tất cả lò nấu bằng gas và lò BBQ phải đúng tiêu chuẩn an toàn theo luật định của cơ quan thẩm quyền tại Western Australia

8. Tất cả những gian hàng bán thực phẩm phải có tủ lạnh để giữ thực phẩm duới 5 độ C theo như GUIDELINE FOR TEMPORARY FOOD PREMISES (đính kèm)

9. Tất cả mọi gian hàng bán đồ ăn phải chấp hành đúng yêu trong tờ hướng dẫn đính kèm Envirronment Health Requirements Food Handling At Temporary Function and Guidelines – Barbecue Cooking – Sausage Sizzles. Tất cả rác thải phải cho vào thùng rác cung cấp sẵn. Xin vui lòng dọn dẹp sạch sẽ chung quanh lều của mình mỗi tối trong hội chợ

10. Tất cả những đồ đạc, dụng cụ, rác thải phải được dọn dẹp sạch sẽ trong đêm chấm dứt hội chợ Thứ Bảy 8/02/2014

11. Ban Tổ Chức Hội Chợ Tết có quyền cứu xét và dứt khoát từ chối những đơn xin không phù hợp với chủ đích của Hội Mừng Tết, hay không theo đúng những điều lệ trên.

12. Ban Tổ Chức Hội Chợ Tết sẽ không trực tiếp hay gián tiếp chịu trách nhiệm về các thiệt hại xảy ra cho con người hay vật sở hữu của bất cứ một người nào, do hành động bất cẩn hay sơ xuất của người muớn gian hàng hoặc nhân viên của người mướn gian hàng trong thời gian Hội Chợ Tết.

13. Hội Chợ Tết 2014 là một sinh hoạt Văn Hóa Chung mang đặc tính Gia đình, do Ban Chấp Hành Cộng Đồng Người Việt Tự Do Tây Úc tổ chức để Mừng Ngày Tết truyền thống Việt Nam. Đây không phải là một dịp để gây quỹ quyên góp từ thiện, vì thế không cá nhân nào được quyên tiền hay hay phẩm vật trong khu vực hội chợ cho những mục đích kể trên. Những tổ chức nào muốn mở gian hàng gây quỹ cho từ thiện phải có sự đồng ý trước của Ban tổ Chức HCT và phải ghi vào đơn dăng ký gian hàng.

ENVIROMENTAL HEALTH REQUIREMENTSFOOD HANDLING AT TEMPORARY FUNCTIONS

SPECIAL EVENTS PERMIT

No food handling is permitted until the premises have been issued with a Special Events Permit by the Council.

Permits will only be issued to premises officially authorised by the event organiser and approved by the Council prior to the event, subject to compliance with any requirements imposed for the event.

In the event of the permit being withdrawn, all food handling in the premises will cease forthwith (i.e. immediately)

2. FOOD STAFF2.1 To be clean and free from infectious disease.2.2 To wear clean washable protective clothing, i.e. uniform, aprons or ethnic costumes.2.3 To have head adequately covered, i.e. hat, net, cap, scarf.2.4 To wear disposable or use utensils for food handling where practical.2.5 To have access to a wash hand basin, soap nailbrush and disposable towels.2.6 To have access to an approved sanity facility.

3. FOOD HYGIENE3.1 All food to be protected from dust, flies, sunlight, human breath and touch. (The public must

not be permitted to service themselves with unwrapped food).3.2 Potentially hazardous food, i.e. meat, egg products, dairy products, poultry and rice to be

maintained at temperature below 5C or above 60C. Cold food to be reheated on a stove or microwave oven prior to placement in Bain Maries.

3.3 Raw food and cooked food to be stored and handled separately to prevent cross contamination.

3.4 All food to be stored clear of the floor or ground covering.3.5 Food is to be delivered to temporary functions in approved food handling vehicles or

containers. The delivery of unprotected food in private cars or wagons is not permitted.3.6 All rubbish from temporary and food premises is to be removed frequently and not allowed

to accumulate.3.7 All food and drink to be dispensed in disposable containers or disposable plates with

disposable utensils as required.3.8 All food to be prepared or cooked in approved food handling premises, a domestic kitchen is

not approved.

GUIDELINESBARBECUE COOKING – SAUSAGE SIZZLES

These guidelines only apply to small scale, short term charity, club or promotional barbecues of a non-commercial nature.

1. APPROVAL1.1 Events which are held on Council controlled property require

approval from the Council prior to the event.1.2 Events help on private property do not require Council

approval.Special event permits are not required for these events.

2. FACILITIES2.1 Barbecue facilities should be clean and well maintained and

isolated from the public using barricades or ropes.2.2 An adequate number of tables, storage units and insulated

containers to be provided2.3 A suitable shelter or shade to protect food from the direct rays

of the sun is required.2.4 A supply of clean water for hand washing to be provided if

facilities are not available within 50 meters of the cooking area.2.5 Waste bins to be provided adjacent to the barbecue area.

3. FOOD HANDLING3.1 All food should be covered and not stored on the ground.3.2 Meat products must not be a stored below 5C in an insulated

container.3.3 Food handlers should use utensils and gloves where practical,

and wear clean washable protective clothing.3.4 Food should be fully cooked and served immediately. Serving

undercooked meat at such events or holding products hot without the proper facilities is potentially hazardous and must be avoided.

3.5 Rolls or similar products should only be handled on clean surfaces. Wooden trestle or tables should be covered with clean clothes or plastic sheets.

Advice on food handling is available from the Council’s Environmental Health Officers.

LOCAL GOVERNMENT ACT 1995TRADING IN PUBLIC PLACES LOCAL LAW 1999

PART 5—STREET TRADING

Prohibition

28. A person shall not carry on trading in any street or public place—(a) Unless that person is the holder of a valid and current street trading license or assistant specified in

the license; and(b) Otherwise than in accordance with—(i) The terms and conditions of the license; and(ii) The provisions of this local law.

Licence Restrictions

29. (1) A Street trading licence is only transferable with the approval of the local government and on payment of the transfer fee.(2) A licensee shall not permit any trading activity to extend beyond the specified portion of public place

detailed in the plan approved as part of the license.(3) The issue of a street trading licence does not confer exclusive possession or use of that portion of the street, or

public place subject of the licence.

License Application

30. (1) Applications shall be in the form provided for the purpose and shall be forwarded to the local government together with the—

(a) Application and license fee;(b) Number of assistants to be employed in the trading at any one time;(c) plans of the proposed location, plus days and hours of operation;(d) Proposed goods, wares, merchandise or services for which trading will be carried on;(e) Detailed, accurate plan and description of any proposed stall, stand, table, structure or vehicle to be

used for trading; and

(f) Name and address of the person responsible for complying with any conditions imposed by the license, where the applicant is a corporation.

Street Trading License

31. A street trading license shall—(a) Be issued on the form used for the purpose;(b) Include the location, days and hours of operation and for mobile traders may include a predetermined

approved route or area;(c) Detail the goods, wares, merchandise or services for which trading are approved under the license;(d) Limit the number of persons that may carry on trading at any time; and(e) Detail any other terms and conditions imposed with the license.

Term and Validity of License32. Subject to clause 12 and except where otherwise stated in this local law, a street trading license remains valid until—

(a) The expiry date stated in the license is reached;(b) Approved changes are made to an existing license, including an increase or reduction in area subject

of the license, or conditions under which the license was granted;(c) the public liability insurance policy, where required in accordance with clause 47 lapses, is cancelled

or is no longer in operation; or

(d) The license is cancelled by the local government;And in any of these events an application must first be made and a new license issued before any trading can

continue or proposed changes can be made, as the case may be.

Responsibilities of Licensee33. (1) the licensee shall—

(a) Display a copy of the Street Trading License;(b) Ensure that the licensed area is attended either by the licensee or an assistant, at all times when

trading is being undertaken;(c) Keep any stall, stand, table, structure or vehicle specified in the license in a clean, safe condition and

in good repair;(d) Keep the location specified in the license free from refuse and rubbish;(e) Have the license available at all operation times and produce the license to any authorized person or

any police officer when requested; and(f) Remove any stall, merchandise and signs from the location to which the license applies and leave

that location clean and vacant—(i) At the conclusion of the permitted hours of operation specified in the license; and(ii) Whenever trading is not taking place on the location to which the license applies.(2) The licensee shall not—(a) Engage in or permit any trading in any goods, wares, merchandise or services other than those

specified in the license;(b) Cause, permit or suffer any nuisance to exist, arise or continue on or from the location to which the

license applies;(C) Deposit, place or store any goods, wares or merchandise on any street or public place, other than on

the location to which the license applies;(d) Obstruct the free passage of pedestrians on any footpath or pedestrian access way;(e) use or display or permit to be used or displayed any advertisement, placard, poster, streamer, sign or

signboard on or about the location specified in the license other than price tickets or labels on the permitted place not exceeding a total of 0.25 square metres of the licensed area;

(f) Erect and maintain any signs in accordance with sub clause (f) so as to obscure any other signage on or adjacent to the licensed area;

(g) Cry out or shout about or permit any other person to cry out or shout about any goods, wares, merchandise or services in any street or other public place;

(h) use or permit to be used any loud hailer, microphone, amplifier or other apparatus for making or transmitting sound, on or from the permitted place specified in the license, unless approved by the local government;

(i) use or permit to be used any record, tape, radio, bell, musical instrument or other instrument or device capable of being heard beyond the boundaries of the permitted place specified in the license unless approved by the local government;

(j) Use or permit to be used any flashing or intermittent lighting apparatus or device on or from the permitted place specified in the licence; or

(k) Use or permit to be used apparatus or device including flap or shelf whereby the dimensions of the stall are increased beyond that specified in the license.
