Late Applications

Cancer Australia will only accept your Application, if it is late, as a direct result of mishandling by Cancer Australia. In all other circumstances, in the interests of fairness, Cancer Australia reserves the right not to accept late Applications. In considering whether it would be fair to accept a late Application, Cancer Australia will take into account the degree of lateness, whether the cause of the lateness was beyond the Applicant's control and such other facts as it considers relevant. Cancer Australia may also ask the Applicant to provide evidence to support its claims regarding the reasons for late submittal. If the Applicant considers that their Application will be late they should notify the Contact Officer prior to the Closing Time, advising of the circumstances for the lateness. The Chair of the assessment committee will take these reasons into consideration when deciding whether or not to accept the late Application.

Part A - General information for Applicants

1 Background The Australian Government through its Agency, Cancer Australia, is seeking funding applications from the 13 National Cancer Cooperative Trials Groups currently funded under the Support for Cancer Clinical Trials program. Cancer Australia will provide direct funding to each National Cancer Cooperative Trials Group of up to $460,000 GST exclusive ($506,000 GST inclusive) per financial year, up to a maximum of $1,380,000 million GST exclusive ($1,518,000 GST inclusive) over a maximum three years. Cancer Australia will also provide access to National Technical Services of up to $75,000 per annum per Group. The funding will be provided to support the development of industry-independent cancer clinical trials protocols over a period of up to three years from 1 July 2013 to 30 June 2016.

2 Policy contextClinical trials benefit the community by improving the survival of people affected by cancer, and contribute to a reduction in premature death and disability. Clinical trials are fundamental to establishing whether new cancer treatments, diagnostic tests or preventive interventions are effective and they help generate evidence for best-practice cancer care.The funding is being provided as part of the Support for Cancer Clinical Trials Program to support Australia’s 13 National Cancer Cooperative Trials Groups develop industry-independent cancer clinical trials to guide scientific improvements in cancer prevention, treatment and care and in doing so build the evidence-base for best practice cancer care to improve health outcomes for Australian’s affected by cancer. 3 Funding objectivesThe funding is being provided to support the development of industry-independent cancer clinical trials and in doing so:a) Increase the participation in clinical trials by people affected by

d) Increase the professional capacity to conduct clinical trials within Australia

4 What will be funded?The Agency expects that the funding will be awarded for staffing, administrative, and minor assets costs (up to $5,000 (GST exclusive)) that support existing National Cancer Cooperative Trials Groups to develop industry-independent cancer clinical trials protocols to the stage of applying for grant funding. Funding will be considered for activities such as those listed in the Table below:

Salaries for Scientific, Clinical and/ or Administrative personnel to support trials design and protocol development to the stage of submission of a grant application

Activities include: Literature reviews Peer review and approval of concept Protocol development including:

o Identification of sponsoro Identification of potential sites

for patient recruitmento Statistical evaluation of

concept including: Sample size and other

relevant statistical calculation

Design of data fields Design of CRF Data management

evaluation processo Financial Evaluation and

Education and training in clinical trials design

Funding support for: training within Australia, of National

Cancer Cooperative Trials Groups members in clinical trials design and management

Such funding support would include attendance at workshops offered by groups like ACCORD and can include associated travel costs to attend training within Australia

5 What will not be funded?The Agency will not provide funds for the following:

Activities associated with the conduct of specific cancer clinical trials. It is expected that competitive grant funding will be applied for to support conduct and management of specific cancer clinical trials and associated activities such as site activation, ethics applications, and quality assurance activities.

Overseas sites, international members or the conduct of specific cancer clinical trials outside Australia.

The support of health professionals from other countries. Clinical service delivery or infrastructure for clinical services. The management of this grant/ Funding Agreement, in particular:

o bank fees;o legal costs;o University overheads;o time taken to manage the Funding Agreement/ prepare

progress/ final reports for Cancer Australia in relation to the grant/ Funding Agreement; and

o indemnity and insurance costs The development or printing of corporate sponsorship material. Fundraising activities or staff salaries to support fundraising

activities. Assets over $5,000 (GST exclusive).

6 Who can apply for the funding?6.1 The following Groups are eligible to apply for funding:

Australasian Gastro-Intestinal Trials Group; Australasian Leukaemia and Lymphoma Group; Australasian Lung Cancer Trials Group; Australasian Sarcoma Study Group; Australia and New Zealand Melanoma Trials Group; Australia New Zealand Gynaecological Oncology Group; Australian and New Zealand Children’s Haematology and

Oncology Group; Australian and New Zealand Urogenital and Prostate Cancer

Trials Group; Australian New Zealand Breast Cancer Trials Group; Cooperative Trials Group for Neuro-Oncology; Psycho-Oncology Co-operative Research Group; Trans-Tasman Radiation Oncology Group; and Primary Care Collaborative Cancer Clinical Trials Group

For legal and accountability reasons, only incorporated bodies can enter into a Funding Agreement with the Australian Government. It is not necessary for the National Cancer Cooperative Trials Group to become a company limited by guarantee nor a separately incorporated body. The Group can administer its Funding Agreement through an incorporated body who can receive funding payments from Cancer Australia and make these available to the National Cancer Cooperative Trials Group.

7 How much funding is available?7.1 Cancer Australia reserves the right to negotiate the level of funding

and the timeframe of funding with each Applicant. Each National Cancer Cooperative Trials Group may apply for direct funding of up to $460,000 GST exclusive ($506,000 GST inclusive) per annum of funding which will be distributed to the successful Applicants for activities during 1 July 2013 to 30 June 2016. Cancer Australia anticipates that the first payment of funding to the successful Applicants will occur on execution of the Funding Agreement and by 1 July 2013.

7.2 The maximum grant is up to $1,380,000 million GST exclusive ($1,518,000 GST inclusive) over a maximum three years. (NB – if an individual is not registered for GST, or an organisation is a Government-Related Entity, value will be GST exclusive).

8 Timeframes8.1 Cancer Australia anticipates that it will select the successful funding

Applicants by 24 May 2013 and Letters of Offer and Funding Agreements will be sent to successful Applicants by 31 May 2013.

8.2 Cancer Australia may not notify unsuccessful Applicants until it has executed Funding Agreements with the successful Applicants.

9 Funding agreement9.1 The successful Applicants for funding will be required to sign a

Funding Agreement with the Commonwealth, represented by Cancer Australia, before receiving any funding.

9.2 The Schedule attached to the Funding Agreement will provide a detailed description of the project based on the Application. The funding may be paid in instalments throughout the project. The payment of funding is generally based on the funding recipient's achievement of outcomes and provision of deliverables (such as progress reports) and the demonstration of need for the instalment.

9.3 Applicants should note that, if they are successful, some details of their project (including a project outline, their name and the amount of funding awarded) will be posted on the Agency’s website as part of Cancer Australia’s legislative reporting obligations.

10 Insurance All Applicants should ensure that they have in place, or if successful are able to obtain, sufficient insurance to comply with the requirements for insurance specified below. Workers Compensation to an amount required by law, $10,000,000 Public Liability, and $20,000,000 Professional Indemnity.

10.1 A Funding Agreement with a short listed Applicant will not be executed until the required insurances have been obtained and copies of certificates of currency for the required insurances provided to the Agency.

Part B - Assessment of Applications

1 How will the Applications for funding be assessed?1.1 An assessment committee will be established by Cancer Australia to

assess Applications against the assessment criteria and select the successful Applicants. The assessment committee will consist of officers from Cancer Australia, representatives with expertise in funding cancer clinical trials and community representatives. The assessment committee will make recommendations to Cancer Australia’s Funding Approver regarding the applications to be supported and the recommended levels of funding.

1.2 The Contact Officer will undertake an initial screening of Applications received against Part D, Section 1 to ensure Applicants meet the minimum requirements such as Legal Entity, required insurance levels or willingness to obtain, and completion of Sections 3 and 4.

2 Assessment criteria2.1 When assessing the Applications for funding, the assessment

committee will use the assessment criteria in Part D, Section 2.2.2 The assessment criteria are not listed in any particular order and all

assessment criteria will be equally weighted. 2.3 In assessing an Application against the assessment criteria, the

assessment committee may consider the Applicant's financial viability and the risk of the Application.

2.4 In assessing an Application, the committee may use material included in response to one assessment criterion in the assessment of other criteria.

2.5 The assessment committee may also seek information about any Applicant from any other source, including from within the Commonwealth, whether or not the individuals or organisations contacted are nominated as referees by the Applicant.

Part C - How to apply for funding

1 Complete the Application form1.1 You must submit your Application for funding on the Application form

in Part D. 1.2 The Declaration in the Application form must be signed by a person

authorised to act on behalf of the National Cancer Cooperative Trials Group and the incorporated body through which the grant will be administered.

1.3 The Application form must be completed in English. 1.4 If you are from a non-government or private sector organisation, you

must include in your Application: 1.4.1 one (1) copy of the organisation's Certificate of

Incorporation; and 1.4.2 one (1) copy of the organisation's previous financial year's

audited financial statements. Cancer Australia may ask for further information about the Applicant's financial viability.

1.5 If the National Cancer Cooperative Trials Groups is administering its Funding Agreement through an incorporated body which is a University, then Clause 1.4 does not apply.

3.3 You may not alter the substance of your Application following its submission, except if you discover an error in your Application you should inform the Contact Officer immediately in writing. Cancer Australia may seek information from you to clarify any aspect of your Application, but it is not required to do so.

3.4 Prior to the closure of the Invitation to Apply for Funding, if the Applicant discovers an error in their submission, you should inform the contact officer immediately in writing.

3.5 Cancer Australia reserves the right to reject incomplete or faxed applications.

4 Retain a copy of your Application4.1 It is suggested that you retain a copy of your Application for your

Assessment criterion 3 – Budget and Value for Money Guidance for completing the Budget

Staffing costs: Provide a separate line item for each person to be employed. Include their title, Name, FTE, award rate (if applicable) and all on-costs (workers' compensation, superannuation, leave).

Part E – Frequently asked questions

In this Part we have included some sample answers to frequently asked questions.

Will late Applications be accepted?

Cancer Australia will only accept your Application if it is late as a direct result of mishandling by Cancer Australia.

In all other circumstances, in the interests of fairness, Cancer Australia reserves the right not to accept late Applications. In considering whether it would be fair to accept a late Application, Cancer Australia will take into account the degree of lateness, whether the cause of the lateness was beyond the Applicant's control and such other facts as it considers relevant. Cancer Australia may also ask the Applicant to provide evidence to support its claims regarding the reasons for late submittal.

If the Applicant considers that their Application will be late they should notify the Contact Officer prior to the Closing Time, advising of the circumstances for the lateness. The Chair of the assessment committee will take these reasons into consideration when deciding whether or not to accept the late Application.

When will my Group find out if my Application has been successful?

It is anticipated that Applicants will be notified of the outcome by 31 May 2013.

Why does the Funding Agreement need to be administered through an incorporated body? For legal and accountability reasons, only incorporated bodies can

enter into a Funding Agreement with the Australian Government. It is not necessary for the National Cancer Collaborative Trials Group to become a company limited by guarantee or a separately incorporated body. The Group can administer their Funding Agreement through an incorporated body who can receive funding payments from Cancer Australia and make these available to the National Cancer Collaborative Trials Group.

If the National Cancer Cooperative Trials Group is not an incorporated body the Group must identify an incorporated body which is able to enter into the Funding Agreement. The incorporated body will, if your Application is successful, sign the Funding Agreement, receive the funding and assume legal responsibility for performing the Funding Agreement.

Are there any GST or income tax-related issues involved in receiving funding?

Yes. Clause 4 of the Standard Funding Agreement outlines the taxes (including GST), duties and government charges for which successful funding Applicants will be responsible.

We recommend that you seek independent advice regarding the income tax implications of receiving funding.

When will my Group receive the funding?

If your Application for funding is successful, an initial payment may be made after the Funding Agreement has been signed by the nominated incorporated body and by Cancer Australia. All other payments of the funding may be based on deliverables (i.e. progress reports) as set out in the Funding Agreement.

Who should I contact if I need more information?

If you have any other questions or you need more information, you can contact the Contact Officer identified on the cover page of this Invitation to Apply for Funding.

Please ensure that you allow sufficient time for the Contact Officer to answer your query and for your organisation to complete its Application before the closing date. Queries should be received up to and no later than five business days before the closing date.

Will my Group have to spend the funding by a particular date? Yes. All funding must be expended by the Project Period end date

specified in the Funding Agreement. For three-year Funding Agreements funding must be expended by 30 June 2016.

Can my Group be offered less funding than it asked for? Yes. The Assessment Committee will review the parameters for

funding, budget, and value for money. The amount of funding offered will be based on demonstration of value for money and available funding.

Funding approval is at the discretion of Cancer Australia’s Funding Approver. Cancer Australia reserves the right to negotiate the level of funding and timeframe of funding with each Applicant.

Can costs associated with conducting specific cancer clinical trials be included in this grant application?

No. It is expected that National Cancer Cooperative Trials Groups will seek funding for the conduct and management of clinical trials from competitive grant sources.
