I. Legal and background information on Pilot projects and Preparatory actions

1. Pilot projects (PP) and Preparatory Actions (PA) are important tools for the formulation of political priorities and the introduction of new initiatives that might turn into standing EU activities and programmes (having their own budget lines). The sustainability and durability of the results produced by a PP-PA, therefore, are key elements for assessing the success of a pilot project or a preparatory action. After the initial analysis, the process requires constant monitoring over the lifetime of the PP-PAs.

2. Any EU expenditure requires a dual legal basis: entry in the EU budget and, as a general rule, prior adoption of an act of secondary legislation authorizing the expenditure in question. PP-PAs are an exception to this rule.

Article 54 (2) of the Financial Regulation provides for their legal basis, i.e. a derogation to the principle under which appropriations can only be entered in the EU budget if a legal act has been adopted previously; in the case of PP-PAs, and by way of exception, a budgetary decision is, therefore, taken prior to any legislative decision.

3. The Financial Regulation explicitly defines the nature and the purpose of these two instruments in Article 54 (2) a) and b) according to which:

A pilot project is an initiative ‘of an experimental nature designed to test the feasibility of an action and its usefulness’ and permits appropriations for it to be entered in the EU budget for not more than two consecutive financial years.

A Preparatory action - normally the successor of a successful pilot project on the same matter - is designed to prepare proposals with a view to the adoption of actions like EU policies, legislation, programmes etc. with funding for not more than three (further) years during which time a legal base needs to be established in secondary legislation, if the action is to continue beyond the three years.

4. Furthermore the Interinstitutional Agreement of 20 December 2013 introduced some procedural elements for smoother adoption of PP-PAs. Point D of the Annex to the IIA provides that: A trilogue shall be convened in good time before the Council's reading, to allow the institutions to have an exchange of views on the draft budget. In order for the Commission to be able to assess in due time the implementability of amendments, envisaged by the European Parliament and the Council, which create new preparatory actions or pilot projects or which prolong existing ones, the European Parliament and the Council shall inform the Commission of their intentions in this regard, so that a first discussion may already take place at that trilogue.

5. As regards the ceilings, the Financial Regulation (Article 54 (2) a) and b) stipulates that the institutions agree to limit the total amount of appropriations for pilot schemes to 40 million in any budget year. They also agree to limit to 50 million the total

amount of appropriations for new preparatory actions in any budgetary year, and to 100 million the total amount of appropriations actually committed for preparatory actions.

6. As any other expenditure item in the EU Budget, PP-PAs also have to fit within the annual ceiling in commitments per heading set in the Multiannual Financial Framework for each budgetary year. Parliament's new and prolonged PP-PAs have, therefore, to be financed in commitments from the margin left available under the ceiling by the Commission in its draft budget. To a certain extent, there is, thus, choices of strategy and priorities to be made by the EP between amending appropriations for existing programmes and actions (e.g. multi annual programmes, decentralised agencies, etc.) and creating or extending PP-PAs.

II. Pilot projects and preparatory actions in Budget 2017: facts, figures and implementability

7. For the 2017 budget, among the 457 PP-PAs proposed initially, the EP compromise package consisted of 78 new and prolonged PP-PAs (52 PPs and 26 PAs). PP-PAs are not the exclusive prerogative of Parliament only. The Council and the Commission also have the right to propose PP-PAs. During the 2017 budgetary procedure the Commission proposed one PA on Defence Research (see the table below and Annex 1).

8. The budgetary allocation of new and extended PP-PAs included in the EP compromise package ranges from EUR 200 000 to EUR 2.6 million in commitment appropriations and from EUR 150 000 to EUR 1.7 million in payment appropriations. Their breakdown per heading of the MFF is presented below.

9. Considering all PP-PAs (not only the new and extended ones but also those in a completion phase or initiated by the EP in previous years i.e. those with no commitment but only payment appropriations), the total amount adopted for the PPs in

2017 Budget is EUR 39.990 million in commitment appropriations (below the ceiling of EUR 40 million foreseen in the IIA) and EUR 58.240 million in payment appropriations (no limitation foreseen by the IIA); the PAs have been financed up to EUR 61.950 million in commitments (from which EUR 25 million for PA on defence research proposed by the Commission) (below the ceiling of EUR 100 million), and EUR 48.518 million in payments (from which EUR 10 million on PA on Defence Research), see annex 2.1 and 2.2.

10. The Commission sent its interim report on the implementation of PP-PAs to the Parliament on 1st March 2016. The interim report as well as this Working Document will be discussed at the meeting of the Committee on Budgets on 6 March and will serve as the basis for an overview of the progress of new and on-going projects. The Rapporteurs also expect to discuss these documents in the specialized committees.

11. Out of the 79 pilot projects and preparatory actions voted under the 2017 budget both in commitments and payments, the report sets out the main elements for the implementation of 70 projects/actions totalling EUR 93.8 million in commitment appropriations. For 5 pilot projects / preparatory actions (representing a total amount of EUR 4.9 million in commitment appropriations), the Commission considers, in line with the position expressed in the letter of executability of 28 October 2016, that the proposed actions can be covered by an existing legal base or other existing actions, and therefore proposes where applicable to transfer the appropriations to the relevant legal base’s budget lines. Finally for 4 pilot projects / preparatory actions, representing an amount of EUR 3.25 million in commitment appropriations, the Commission is at this stage still examining the possible options for the implementation of the action.

12. The report from the Commission (working document IV, which is expected together with the draft budget 2018) will be more detailed, and will also provide information on pilot projects and preparatory actions which are in the completion stage, i.e. for which there are no new commitments foreseen in 2017, but which still have payment appropriations.

III. Upcoming steps of budgetary procedure 2018

13. Until 3 May 2017, any Member, committee or group has the right to submit proposals for new pilot projects and preparatory actions or proposals for prolongation of existing ones for pre-assessment to the Commission. Members can choose to submit their proposals directly to the budget committee and/or via specialised committees (respecting the procedure and deadlines set by the respective committee). The Commission evaluates the implementability of all proposals and publishes its findings by end June.

14. Members, committees and groups should use the standard template presented in Annex 3 when sending in their proposals for pre-assessment1. The Commission will issue its assessment reports on this basis.

15. Your rapporteurs wish to highlight that careful attention should be given to those PPs and PAs in their last year of implementation since:

PPs that are now in their 2nd year (PP2 in the table in Annex 2.1) in 2017 can only be extended as PA in Budget 2018 or be transformed into a new legal basis at the initiative of the Commission,

PAs in their 3rd year (PA3 in the table in Annex 2.2) cannot be extended any more. In such cases, a legislative procedure must be concluded in order for the action to continue.

16. Your rapporteurs recall that if the proposals for pilot projects and preparatory actions are to become part of the budget and thereby finally authorized, they must also be tabled as budgetary amendments to the draft budget in August / September 2. On the basis of all amendments, the Rapporteur of the annual budget drafts a compromise package of pilot projects and preparatory actions which contains those proposals that received a favourable evaluation by the Commission in the pre-assessment. The rapporteurs recall that in order to be continued in the next budgetary year, the existing PP-PAs should be equally sent to pre-assessment. The package ambitions to ensure a balance between new and on-going projects and actions, budget headings, thematic issues, supporting committees and authors of projects. The compromise package is put to a vote in the BUDG committee and is afterwards part of the overall budget negotiations in the conciliation committee.

17. Finally, it should be underlined that in the upcoming budgetary procedure, priority will be given to PP-PAs which will aim at strengthening growth, jobs creation and security in the EU. In addition a positive pre-assessment from the Commission should be one of the main pre-conditions for adopting PP-PAs. Thus projects with a positive pre-assessment grade, in particular grades A and B, will be favoured.

18. The various steps could be summarised in the following tentative calendar setting up the main milestones for the adoption of PP-PAs in the 2017 budgetary procedure:
