ENDORSE BOUNDARY CHANGE PROPOSAL WA-0109 FOR ANNEXATION TO CLEAN WATER SERVICES' SERVICE DISTRICT

Presented by: Bill Gaffi, General Manager (nmc) SUMMARY (Attach Supporting Documents if Necessary) After the 1997 Legislature abolished the Boundary Commission and shifted the boundary change function back to the local level, Washington County (County) became responsible for district boundary changes within its jurisdiction. The governing bodies of county districts, such as Clean Water Services (District), must endorse proposed annexations to their boundaries. The County has received the following request to annex property to the District:

WA-0109: The properties to be annexed consist of three tax lots encompassing approximately 71.32 acres. The western portion of Tax Lot 3800 is approximately 11.43 acres and is located north of the Washington County/Yamhill County line. This parcel is within Washington County. The eastern portion of Tax Lot 1100 is approximately 53.19 acres and Tax Lot 1000 is approximately 6.70 acres. Tax Lots 1100 and 1000 are both located south of the Washington County/Yamhill County line and north of Olson Road. Both parcels are within Yamhill County. The properties are further depicted in Exhibit A. On May 14, 2008 and March 11, 2009, the City of Gaston approved the annexations of the properties into the city through Ordinance Nos. 2008-02 and 2009-02.

District staff has reviewed the request and recommends endorsing the annexation. County staff has scheduled a public hearing for the proposed annexation on April 21, 2009.

Presented by: Bill Gaffi, General Manager (tml) SUMMARY (Attach Supporting Documents if Necessary) The Locust Street Sanitary Improvement Project No. 6335 (Project) is located in the City of Portland, the unincorporated Metzger area, and within the City of Tigard, Oregon. The Project extends from SW Dickinson Street at SW 65th Avenue in Portland along SW Locust Street to the intersection of SW Locust Street and SW Hall Blvd. in Tigard. The Project involves constructing approximately 5,832 linear feet of 18 inch diameter sanitary piping, 21 manholes, and reinstating approximately 48 house services. Approximately 1,154 linear feet of line shall be vitrified clay pipe installed by pilot-tube micro-tunneling technology utilizing a guided boring machine. The remaining 4,678 feet of pipe shall be 18 inch I.D. PVC pipe installed by conventional open trench construction.

The engineer’s estimate for the Project is $2,105,000. Bids for construction of the Project will be received on April 9, 2009. Staff will report the company names and subcontractors, bid amounts for the three lowest bids and provide award recommendation as soon as possible after bid opening. The Project is funded with available funds from Construction Fund 112.

APPROVE THIRTEENTH AMENDMENT TO MASTER CONTRACT FOR PROFESSIONAL SERVICES WITH CH2M HILL, INC. FOR PREDESIGN SERVICES FOR NATURAL TREATMENT SYSTEMS AT THE FOREST GROVE AND HILLSBORO TREATMENT PLANTS

Presented by: Bill Gaffi, General Manager (cl) SUMMARY (Attach Supporting Documents if Necessary) Clean Water Services (District) is considering the development of a natural treatment system (NTS) consisting of treatment and polishing wetlands in conjunction with hyporheic discharge as generally described in District’s 2008 NPDES permit renewal application package. The NTS would be developed in two locations consisting of one or more parcels near both the Hillsboro Wastewater Treatment Facility (WWTF) and the Forest Grove WWTF. The proposed NTS facilities will include reuse pump stations, if necessary, as well as conveyance pipelines to each NTS site, treatment wetlands, restoration of polishing wetland areas, and development of hyporheic discharge.

To develop the NTS, certain site characterization tasks need to be performed including hydrogeologic investigations, soils investigations, geotechnical investigations, and flooding analysis. Supplemental surveying, wetlands water balance analysis, wetlands water quality modeling, and wetlands temperature modeling will need to be conducted. The environmental investigations will be used to define an overall permitting strategy, minimize impacts to threatened and endangered species, and minimize impacts to cultural resources in keeping with anticipated permitting requirements for the project. Using design criteria and site characteristics, a (CONTINUED)

Results of the review and discussion will be used to guide the preparation of a full set of preliminary design drawings, which will be incorporated into a predesign report documenting the results of the predesign effort. CH2M Hill, Inc. was awarded a Master Contract for Professional Services by the District’s Board of Directors (Board) on December 20, 2005 by Minute Order No. 05-82 (Master Contract). Under the Request for Qualifications establishing the Master Contract and as set forth in Minute Order No. 05-82, when the District needs assistance, it may select a consultant from among the firms with Master Contracts, develop a scope of work, and enter into an Amendment specifying the scope of work, price and schedule for the specific project. Under District’s Purchasing Rules, District staff are required to consider factors that promote efficient use of public resources and do not diminish competition when making a project-specific selection decision. District staff selected CH2M Hill, Inc. to perform this work because they have considerable specialized knowledge in developing this type of system within Oregon and are currently involved in District’s NPDES permit renewal efforts and work to revise the Total Maximum Daily Loads of which the NTS work is a significant part. District staff recommends the Board approve the Thirteenth Amendment with CH2M Hill, Inc. for the work described herein in the not to exceed amount of $753,829.

District approved subsequent Change Orders that increased the contract in the amount of $74,763.18, resulting in an actual Project cost of $467,763.18. The cost items in the Change Orders were due to a change in conditions and additional stormwater modifications at the Durham Advanced Wastewater Treatment Facility. There are no outstanding claims or other issues in connection with this Project that are not resolved. Staff recommends the Board accept the Project as complete and authorize final release of retainage in the amount of $23,388.

Presented by: Bill Gaffi, General Manager ( nmc ) SUMMARY (Attach Supporting Documents if Necessary) In November 2006, following a series of sanitary sewer overflows in the Turner Creek drainage basin within the City of Hillsboro, Clean Water Services (District) and City of Hillsboro (City) entered into an Intergovernmental Agreement (IGA) for the immediate investigation and repair of the system (MO 06-98). All work elements included in that IGA have been completed. While the system has performed within the parameters of the District’s NPDES permit, there were overflows during the January 1, 2009 storm, and Hillsboro City Council wishes to explore alternatives which would reduce the frequency and likelihood of future overflows. Hillsboro City Council was apprised of the current status of the Turner Creek system by staff report during a February 17, 2009 Council worksession. The report included 16 specific recommendations regarding the further investigation and analysis of alternatives for consideration by District's Board of Directors (Board) and Hillsboro City Council. This IGA outlines the City’s and District’s roles and cost-sharing provisions for implementing the recommendations contained in the February 17, 2009 staff report. An initial action item is the execution of an engineering consulting services contract to perform additional computer modeling and analysis of various capital and inflow and infiltration control strategies to reduce the likelihood of overflows. The cost of the engineering services contract is approximately $100,000 and is to be shared equally between the City and District. Additional possible capital costs resulting from the analysis are not known at this time. Staff recommends that the Board approve the Intergovernmental Agreement with the City of Hillsboro.

District, along with Washington County and the Housing Authority jointly issued a Request for Proposals (RFP) for financial audit services on February 11, 2009, with proposals due on March 10, 2009. The selection process includes the evaluation of proposals by a joint District/County staff evaluation committee, consisting of four County staff members and two District staff members, as well as a review of the joint staff recommendation by the Audit Committee. The Audit Committee is charged with the responsibility of providing an opinion on the professional acceptability of the recommended firm. Four firms submitted proposals: Moss Adams and Talbot, Korvola & Warwick submitted proposals for both District and the County. Merina & Company and Van Beek & Company proposed for District only. Van Beek & Company did not meet the requirements to be considered as qualified for this contract. Evaluation criteria set forth in the RFP include qualifications of the firm, expertise of staff, work plan / approach and cost, as well as oral interviews and reference checks. A contract award recommendation will be submitted to the Board as soon as reasonably possible, in an amount not to exceed $219,000 for the five year contract period.

These upgrades will provide additional capacity for future growth within the station’s service area, minimize operational and performance problems related to poor hydraulic conditions in the wet well, and increase the overall station reliability. The Sherwood Pump Station Expansion Project No. 6338 (Project) is scheduled to be bid this summer. A major component of the Project involves the contractor removing and replacing the existing pumps with higher capacity pumps. The overall reliability of the pump station is considered diminished by the potential risk of flooding. The pump station site is located on the edge of the Tualatin River floodplain. A permanent marker located on the site shows the high water mark of the February 1996 flood to be nearly a foot above the pump station floor elevation. The pump station is a dry-pit type, with the pump equipment located nearly 40 feet below grade. (CONTINUED)

Page 2 The dry pit has a single sump pump, and is prone to flooding if water enters the dry pit at a rate greater than the sump pump’s capacity. Because the existing pump motors are standard open-style motors, they would be rendered inoperable if submerged. Repair or replacement could potentially require several weeks of lead time. Analysis has shown that replacing the existing motors and electrical cables with submersible-style motors would allow continuous operation under full submergence. This would maximize reliability in an unlikely but feasible flood situation. Submersible pumps are easily adapted for installation in dry pit configurations, and therefore it has been recommended that dry-pit submersible pumps be installed at the Sherwood Pump Station. Additionally, occurrences of pump clogging and ragging have become increasingly prevalent over the past several years. Research in submersible pump technologies suggests a specific type of pump impeller would enhance performance and reduce the need for emergency maintenance activities. The specific pump impeller provides for a cutting action that breaks apart rags, stringy material, and small diameter solid debris such as sticks that are the most common cause of pump clogging with any inlet conditions. In addition to a specific style of pump and type of impeller, additional essential features of the sewage pumps at this particular pump station have been identified. These features include the following:

• Improved motor insulation (Type H), to increase motor longevity while operating under a fill and draw mode which requires numerous starts and stops.

• Improved motor cable disconnect feature, to improve maintenance access and removal of pump equipment.

• Proximity and responsiveness of local service facilities for providing replacement parts and local repair in an expeditious manner.

• Familiarity of the product by District maintenance staff to improve maintenance productivity and reduce staff training requirements.

An evaluation of major pump manufacturers determined that the Flygt N-impeller style pump was the best and only option to provide the highest likelihood for long term reliability of the pumping equipment and to meet those criteria determined to be critical to the successful and cost effective operation of the Sherwood Pump Station. Pursuant to District Purchasing Rule 15-060, District’s Board of Directors (Board) may waive the competitive purchasing requirements and award a contract if there is only one manufacturer or seller of the product of the quality or performance required. District requests its Board approve District’s finding that only one manufacturer is capable of meeting all of the requirements determined to be essential for providing a pump with the quality, performance and functionality required for this pump station. Based on this finding, District further requests that the Board waive the competitive purchasing requirements for this purchase and approve a contract for the purchase of Flygt N-impeller style dry pit submersible pumps from ITT Water & Wastewater U.S.A., Inc. in the amount of $156,024.

SW PARMELE ROAD LOCAL IMPROVEMENT DISTRICT

FEASIBILITY REPORT

Project Background A petition requesting formation of a Local Improvement District (LID) signed by 15 of the 20 property owners (75%) of the 22 parcels within the proposed LID boundary was presented to the Washington County Board of County Commissioners on February 17, 2009. The Board accepted the petition and directed the preparation of a feasibility report. Classification of LID In accordance with Washington County Code 3.20.40.A (Classification), this Local Improvement District qualifies as a Rural Local Improvement District by meeting the following minimum requirements of 3.20.320:

A. The proposed public improvements are of a type and scale primarily benefiting the local needs of established neighborhoods outside the Urban Growth Boundary.

B. The district shall include no fewer than two benefited parcels, and no fewer than two benefited property owners.

C. The value of 50% of the lots or parcels outside the Urban Growth Boundary to be assessed divided by the proposed assessment equals or exceeds a ratio of 4:1.

Rural Resource Impact No potential resource impacts are anticipated. No aggregate reserves are adjacent to the proposed LID. There is some marketable timber on lots within the limits of the proposed LID. These lots are small and the proposed chip seal surface is suitable for this small amount of timber and local truck traffic typical of rural residential uses. Project Description and Estimated Cost The purpose of the LID is to construct a chip seal surface on SW Parmele Road from SW Laurelwood Road to the end of the County maintenance. The total project length is approximately 0.22 miles. This road is a County Local Road with an unknown construction date. The existing road is an aggregate surface which is subject to problems typical of this type of surfacing (washboarding, rutting, etc.). The proposed improvements include vegetation management, drainage improvements, surface shaping and compacting, and a chip seal surface. The estimated project cost to be funded by the LID, and not funded by the County Road Fund, is $21,880.32. The County agrees to maintain the hard surface (chip seal) of the roadway for seven years.

Proposed Method of Assessment The proposed method of assessment is as shown on the assessment roll. Developed properties (or those with significant improvements) will be assessed a full share of the development and construction cost due to their increased benefit from the improvement. Undeveloped properties will be assessed one half share of the development and construction cost. Properties that develop, or have an active residential building permit, prior to the assessments being levied will be assessed a full share of the development and construction costs. If properties are partitioned prior to assessments being levied, each parcel will be assessed the full or half share dependent upon the development status of the property at the time of assessment as outlined above. If parcel consolidation occurs, the parcel will be assessed in accordance with the development status as listed above. Estimated Assessment The estimated assessment per parcel is as shown on the Assessment Roll. List of Parcels, Owners, and Assessments In accordance with Washington County Code Section 2.20.030, the attached proposed assessment roll contains the following: 1. The names of owners or reputed owners in the Local Improvement District. 2. A description of each parcel to be assessed in the Local Improvement District. 3. The estimated assessment for each parcel in the Local Improvement District. It appearing to the Board that Policy 21 of the Washington County Transportation Plan

directs that road maintenance and reconstruction expenditures be prioritized each year; and

It appearing to the Board that the voters of the urban unincorporated areas of Washington

County have voted to provide funding for the Urban Road Maintenance District; and

It appearing to the Board that Policy 21 of the Transportation Plan, including Table 12,

the Road Maintenance Priority Matrix, serves as a guide for determining the most cost-effective

and efficient provision of services so as to further the public safety and welfare; and

It appearing to the Board that on June 17, 2008, this Board adopted Resolution and Order

No. 08-73, the 2008-2009 Annual Road Maintenance Work Program, and that Program is now in

need of amendment to include additional projects needed in preparation for next year’s work

program and to remove projects in order to meet current fiscal year mid-term budget constraints;

now, therefore, it is

RESOLVED AND ORDERED that Resolution and Order No 08-73 is amended as follows:

the 2009 URMD Overlay Contract (Exhibit 1), the 2009 URMD Slurry Seal Contract (Exhibit 2),

and the Mid-year adjustments to the Work Program (Exhibit 3) attached hereto, are hereby added

of Land Use and Transportation, including maintenance to be provided using Urban Road

Maintenance funds, subject to further revision by this board through adoption of the complete

Work Program and Budget for the 2009-10 fiscal year; and it is further

Agenda Category: Consent – County Administrative Office Agenda Title: ADOPT THE FISCAL YEAR 2009-10 BUDGET POLICY Presented by: Robert Davis, County Administrator SUMMARY (Attach Supporting Documents if Necessary) Each year your Board adopts a Budget Policy to guide the development of the annual budget. The 2009-10 policy focuses on the need to balance the availability of discretionary resources with maintenance of basic services and funding of the MSTIP transportation program and Cooperative Library system. The policy provides for an ending fund balance goal of 20%, with a minimum of 15% of General Fund resources. Due to the challenging economic environment and in consideration of the established minimum fund balance requirement, the Budget Policy emphasizes discretionary spending remain at or below current year levels. Special fund budgets are directed to hold General Fund contributions to no more than the amount provided in the current (2008-09) fiscal year. In addition, losses in dedicated revenues (e.g., local option levies, state funds, grants, and user fees) are not to be replaced with discretionary resources, unless approved by your Board. Staff will be available to answer questions.

2009-10 BUDGET POLICY 1. POLICY OVERVIEW

The County Strategic Plan provides the framework for budget preparation in terms of services, funding mechanisms and priorities for the allocation of discretionary resources. The Plan emphasizes the need to direct the County’s General Fund resources toward programs that provide a County-wide benefit. Consistent with past practices, the 2009-10 budget focuses on long-term stability for core services. Maintaining an ending fund balance of 15 – 20% of resources in the General Fund is a priority.

2. GENERAL AND SPECIAL FUND PROGRAMS

A. Staffing levels are not expected to exceed the current 2008-09 levels with the exception of positions funded by dedicated revenues. In all cases, staffing levels must be commensurate to available resources and approved service levels. Requests for additional positions funded by dedicated resources will be reviewed on a case-by-case basis along with the sustainability of the revenue source. Temporary staffing will be used when funding cannot be assured beyond the first year. Requests for additional positions funded by discretionary revenues will be evaluated on a case-by-case basis taking into consideration service demands, financial wherewithal, and Board priorities.

B. Operating expenditures will be budgeted at a level required to maintain adequate support for current service levels. Whenever possible, expenditures will be reduced or remain at no more than the 2008-09 budget.

C. Revenue Estimates: Departments will budget revenues based on the best information available at the time the budget is prepared. Limited or no growth in revenues should generally be accompanied by adjustments in the requested expenditure level.

D. New Revenue Sources: Departments will continue to pursue revenue sources to the fullest extent

possible. E. Expenditure Reductions: Reduced revenues, declining fund balance or other factors may require a

decrease in expenditures. Should such reductions be required, the County will be guided by the Resource Reduction Strategy.

F. Discretionary Funding: Allocation of discretionary resources by organization units will be based on the amount received in the current fiscal year. Discretionary resources that are not required to maintain current base services will revert to the General Fund’s balance for future use.

G. Programs Previously Supported by Serial Levies: Prior to the passage of Ballot Measures 47 and 50, the Washington County Cooperative Library System (WCCLS) and Major Streets Transportation Improvement Program (MSTIP), were supported by revenues from serial levies. Measure 50 eliminated these levies by combining them with the County tax base levy. These programs continue to be funded via transfers from the General Fund and are based on: • MSTIP 3: Board action in 1998 called for completion of all projects included in the original

MSTIP 3 serial levy approved by the voters in 1995. Subsequent Board actions have extended

the transportation improvement capital program and continuation of the annual transfer. The budget provides a 4% annual increase.

• WCCLS: The budget provides a 4% annual increase.

H. Internal Cost Recovery: In order to clearly define the true cost of each direct service the County prepares a Cost Allocation Plan. Departments provide input and review the annual plan. A second Cost Allocation Plan is prepared for Federal Grant compliance purposes.

I. Budget Modifications: The County Administrator may recommend modifications when appropriate in order to continue effective operations, provide adequate service levels, achieve cost savings or cost avoidance, and implement Board priorities.

3. LOCAL OPTION LEVIES Local option levies are considered a special revenue funding source and expenditures must conform with the language presented to the voters.

4. STRATEGIC INVESTMENTS

The County will continue to seek opportunities to make strategic investments in training, technology and other infrastructure aimed at modernizing or enhancing the efficiency of County services as resources allow.

5. RESERVES, CONTINGENCIES AND FUND BALANCES A. General Fund Reserve/Contingency/Fund Balance: The General Fund Reserve (beginning fund

balance) and the Revenue Stabilization Reserve fund are a critical and core element of the County’s financial planning and fiscal stability. These reserves contribute to the preservation of the County’s bond rating, meet cash flow requirements, accommodate cyclical variations in revenues, provide for unanticipated, intermittent or future planned expenditures, and minimize the need to rely on General Fund local operating levies for the long-term sustainability of programs and services. The goal is to maintain a reserve that is 20% or greater and no less than 15% of General Fund revenues. The reserve will be allocated in the annual budget as follows: a) approximately 5% will reside within departmental budget appropriations based on the assumption that departmental expenditures will be approximately 95% of budget, with 5% being unspent and a part of the fund balance at year-end, and b) the remainder of the reserve will be distributed between the General Fund and the Revenue Stabilization Fund contingency. A portion of the reserve may be unappropriated.

B. Special Fund Reserves/Contingencies: The need for a reserve and/or contingency is dependent on

the purpose of each fund. For many capital and non-operating funds it is necessary to maintain a reserve (fund balance) to meet long-term liabilities and construction or replacement schedules. Reserves for capital and non-operating funds may be appropriated or unappropriated depending on the individual fund’s requirements. Operating funds may require reserves to meet operating obligations, emergency requirements or other unanticipated needs. Reserves for operating funds should be appropriated in the fund’s contingency.

6. STATE PROGRAMS

A. Current State Funding: State programs operated by the County will reflect the level of service attainable given the amount of funding provided. If State funding is reduced, there will be no increase in County resources unless mandated. When an increase is required, the department will

make every effort to minimize the increase by considering alternate service delivery systems, and/or a return of the program to the State. Where there are existing contributions being made to State programs, the impact of reducing the contribution to the lowest allowed by State/Federal mandates will be considered. Reductions will be incorporated into the department’s requested budget whenever feasible.

B. New State Funding: New or increased State funding for existing or proposed programs will be considered based on local needs and requirements placed on the County by accepting the funding. Whenever possible, additional funding will first be used to reduce the General Fund contribution to existing programs. The ability of the State to commit to long-term funding that meets the County’s full cost requirements will be an important consideration in any decision to accept additional funding for expansion of existing programs and/or initiation of new programs.

C. System Balance: This policy is not intended to preclude the use of County resources when the

Board determines it necessary in order to provide a balanced service delivery system or meet other Board policies and priorities.

7. LOBBYING AND GRANT APPLICATIONS A. Approval to Pursue: CAO approval is required before appointed County representatives and

employees pursue lobbying efforts on matters having budget implications, and before grant applications are submitted to the granting agency. Elected department heads should advise the County Administrative Office before official positions are taken on matters that might affect the County’s budget or financial status. Board approval is required to accept grants of $75,000 or more.

B. In-kind Contribution: Where matching funds are required for grant purposes, the priority is to use as much “in-kind” contributions as allowed rather than hard-dollar matches.

8. REIMBURSEMENT FOR DUES AND CONTINUING EDUCATION REQUIREMENTS A. Dues and Licensing Costs: Any costs incurred for positions that require a specific license or dues

in order for the employee to perform assigned duties will be paid by the County. Examples include attorney bar dues, sanitarian and nursing dues, etc.

B. Continuing Education: Any costs incurred for positions that require continuing education in order for an employee to maintain the required license in 8.A. above will be paid by the County. Examples include State Bar classes for attorneys, nurse practitioner continuing education requirements, etc.

C. Reimbursements: Items A and B above are not intended to preclude the funding of dues, licensing and/or continuing education that are not specifically required by a job classification, but rather to affirm the funding of these costs when such a job classification requirement exists.

9. MID-YEAR REQUESTS, GENERAL FUND CONTINGENCY A. Non-Emergency Requests: In those cases where a department is faced with an unanticipated cost of

a non-emergency nature that is beyond its control, every effort will first be made to use departmental resources prior to a transfer from General Fund contingency. The budgetary impact of any cost-of-living salary adjustments approved by the Board of Commissioners will be reviewed to determine the need for and timing of a transfer from the General Fund contingency. Departmental budgets will be reviewed during the fiscal year for compliance with budget law. A

transfer from contingency will be made to cover unavoidable costs that cannot be absorbed in the existing budget.

B. Emergency Requests: Emergency requests during the fiscal year will be submitted to the County Administrative Office for recommendation and forwarded to the Board of Commissioners for consideration.

10. BUDGET CONTROLS A. Legal Compliance: Expenditure appropriations will be adopted at the organization unit level. In

order to comply with local budget law, actual year-end expenditures cannot exceed appropriations for each organization unit.

B. Administrative Compliance is at the program and expenditure category level. County Administrative Office approval is required if actual expenditures are projected to exceed appropriations at this level.

11. CONTRIBUTIONS TO OUTSIDE AGENCIES A. Funding to Outside Agencies will be considered by the Budget Committee/Board if adequate

resources are available, the use of funds for this purpose will not adversely impact County programs, and the allocation of resources is consistent with the Strategic Plan and other Board policies and priorities. Consideration of funding requests from an outside agency requires the submittal of written justification in advance of the budget hearings.

Should reductions in expenditures be necessary at any time in the future, consistent with the resource reduction strategy, funding to outside agencies will be considered prior to reductions in County programs.

The grant funds of $161,219 are available April 1, 2009 through March 31, 2010, with the option of a one year renewal at the same funding level. Funds of $40,305 are included in the 2008-09 budget and the remaining $120,914 are included in the 2009-10 budget, pending Board approval. The grant will provide service to male and female state prison offenders being released to Washington County. The service will be provided by Bridges to Change, an agency on contract with the County. The program will include prison “reach-in” recovery focused mentoring, employment search assistance, job coaching, alcohol and drug free housing, participation in a cognitive restructuring program and referral to alcohol and drug free treatment as needed.

The recent Charter revision made several changes to how county candidates are elected and vacancies filled. State law also has changed since the last update. After consulting with the Elections Manager, I am asking for authorization to file a general update ordinance, including: 1. Consolidate all the elections provisions into one code chapter, and eliminate the service district formation article. 2. Add provisions required by state law to qualify the county to use the state voters’ pamphlet in the future. This includes a process for challenging a ballot title or explanatory statement. 3. Add a provision authorizing the Board to draft an explanatory statement for citizen initiated or referred measures. Absent such a provision, no explanatory statement is permitted. 4. Delete references to an assembly to nominate candidates – no longer provided for by statute. 5. Conform the process, for filling a vacancy, to the new charter provisions. 6. Conform the election provisions to the new charter, e.g. candidate receiving 50%+ of the vote at the primary is deemed elected. 7. Add various state law provisions regarding candidate verifications so that the key provisions are available in one location for both staff and candidate convenience. DEPARTMENT’S REQUESTED ACTION:Authorize the filing of a general update to the Code regarding elections matters.

Presented by: Rod Branyan, Director SUMMARY (Attach Supporting Documents if Necessary) Funding through the Mental Health Organization Agreement between Washington County and the State of Oregon supports the provision of mental health services. This includes funding for Psychiatric Residential Treatment Services (PRTS) to support some of our most vulnerable youth with complex and acute mental health needs. The Department is requesting your Board grant a waiver from the RFP process to contract with Trillium Family Services for the period of April 1, 2009 through December 31, 2012 in an amount not to exceed $450,000 per year for psychiatric residential treatment services. The information necessary to grant the waiver is attached. In 2006 the Department issued a Request for Proposals for PRTS and awarded contracts to four providers. Since that time two of the four providers have closed their facilities, and a third provider shifted to a community based model that greatly reduced capacity. With these reductions in available capacity, the Department has not been able to meet our demand for services within our contracted provider system. Trillium Family Services is the only remaining provider in the metro area that we do not already contract with. With the reduction in availability of services through contracted providers, the Department, at this time, must contract with Trillium Family Services in order to ensure adequate capacity to meet the mental health treatment needs of youth in our local system of care. Please see attached additional information. DEPARTMENT’S REQUESTED ACTION: Grant waiver to the RFP process and authority to contract with Trillium Family Services for the period of April 1, 2009 through December 31, 2012 in an amount not to exceed $450,000 per year for psychiatric residential treatment services.

ADDITIONAL INFORMATION REQUIRED TO GRANT WAIVER Per Rule #10-130, the request for waiver shall contain the following:

A) The nature of the Agreement: Psychiatric residential treatment services are twenty-four hour, seven days per week structured treatment services that are designed to improve a child’s functioning and reintegrate them into the community at the earliest possible time. Washington County intends to contract with an additional PRTS provider in order to ensure adequate capacity for members that require this level of care. B) The cost of the program:

Expenditures for this request are currently in the Oregon Health Plan budget and paid through revenue from capitation payments under the MHO Agreement with the State of Oregon The anticipated annual expenditures for Trillium Family Services PRTS are not expected to exceed $450,000 per year. C) A narrative description of the basis for the waiver and reason an RFP process

would be inappropriate: The Department issued a Request for Proposals in 2006 and evaluated all regional PRTS providers at that time, awarding contracts to four of the five providers. At this time, with the reduction in available providers, it is not necessary to issue an additional RFP as the County is contracting with all available providers in the area. D) Alternative selection process that will be used:

The County, the Housing Authority and Clean Water Services jointly issued a Request for Proposals (RFP) for financial audit services on February 11, 2009. The selection process included the evaluation of proposals by a staff committee and review of staff’s recommendation by the Audit Committee, which is charged with the responsibility of providing an opinion on the professional acceptability of the recommended firm. Both the staff recommendation and the opinion of the Audit Committee are then forwarded to your Board for final approval. Four firms submitted proposals: Talbot Korvola & Warwick and Moss Adams, LLP submitted proposals for both the County and Clean Water Services. Merina & Company, LLP and Van Beek & Co., LLC proposed just for Clean Water Services. The proposals were scored in accordance with the criteria established in the RFP, which included qualifications of the firm, expertise of staff, approach to scope of work and cost. After thorough evaluation of the criteria, reference checks and oral interviews, staff recommended the firm of Talbot Korvola & Warwick as best suited to perform the required financial services for the County. See attached Scoring Summary. The Audit Committee supports staff’s recommendation.

DEPARTMENT’S REQUESTED ACTION:Accept the proposal of Talbot Korvola & Warwick to perform audit services for the County and its component units and award a five year contract through December 31, 2013 in the amount of $1,123,920.

The dollar amount for 2009-2010 is estimated at $1,455,124. The contract will be contingent on the availability of funds, continued need for the service relative to other community needs, and contract performance and compliance. The required legal advertisement and Request for Proposals was issued January 16, 2009. Two proposals were received by the due date and time of 3:00 p.m., February 26, 2009. Staff and community partners evaluated the proposals based on the following criteria: (1) program services, (2) capacity and reporting, and (3) budget. The evaluation committee gave a score of 194 for TNT and 161 for Acumen Fiscal Agent (out of a possible of 205 points). The scope of work for this contract requires the contractor to act as the fiscal intermediary to people with developmental disabilities or their families. The contractor will implement monthly payroll and vendor services for support workers and pay all employment related taxes.

Staff is requesting the authority to issue purchase orders up to the amount budgeted for this purpose. The budget for fiscal year 2008-09 includes $100,000 for such purchases. This purchase will use a State of Oregon price agreement issued to Cisco Systems, which is a contract that has already been competitively bid and awarded by the State of Oregon. The County Purchasing Supervisor is authorized to issue purchase orders up to $75,000. However, because the total expenditure for these materials exceed this threshold, delegated signature authority by your Board is required. WCCLS is implementing a project to provide standards-based, enterprise level secure public wireless access for the public at WCCLS member libraries. The project goal is 100% coverage in all libraries, meaning that a patron with a laptop or mobile device, such as an iPhone, can access the network from anywhere in the library.

It will also provide public wireless access in a more secure and robust fashion than individual libraries would be able to manage locally. The implementation is modeled on a Broadband Users’ Group approved design. The software application will be implemented on a single central server that will be managed by WCCLS automation staff. The annual maintenance cost of the hardware, equipment and software will be part of the WCCLS budget. The victims’ services providers in Washington County include the District Attorney’s Victim Assistance Program, Community Corrections’ Center for Victims’ Services, the Juvenile Department, the Elder Safe Program, the Domestic Violence Resource Center, the Sexual Assault Resource Center, and Beaverton and Hillsboro Police Agencies. Representatives from these programs work to assist victims through the criminal justice system, inform them of their rights as a victim and to enforce those rights. Victims’ services providers also network to fill service gaps and seek out opportunities to educate citizens about crime victims’ rights. In addition to the attached proclamation, on behalf of the county’s victims’ services providers, the District Attorney would like to present to the Board of Commissioners a fifteen minute presentation highlighting the activities and events of Crime Victims’ Rights Week as well as the activism and advocacy efforts of the our community partners. DEPARTMENT’S REQUESTED ACTION:At your April 21, 2009 work session and/or the open session, the District Attorney requests reading of the proclamation and a 10-15 minute review of victims’ services in Washington County.

Whereas, more than 33 million Americans are victims of crime each year, Whereas, victims may suffer emotional, physical, psychological and financial harm as a result of crime; Whereas, victim assistance and compensation programs across the country provide vital and supportive services

for victims that help individuals, families and communities cope with the impact of crime; Whereas, the Victims of Crime Act (VOCA), passed by Congress in 1984, affirmed a national commitment to helping victims rebuild their lives by establishing the Crime Victims Fund, a major source of funding

for services and compensation to victims of crime throughout the United States; Whereas, the Fund comprises fines and penalties levied on offenders and affirms the principle that those who commit crimes should be held accountable for their actions; Whereas, the Crime Victims Fund provides support to states for victim assistance and victim compensation programs, as well as support for federal victims of crime, child abuse prosecution, emergency reserve

Presented by: Brent Curtis, Planning Manager SUMMARY: The county received a request to annex three parcels to the Clean Water Services District (District), the western part of Tax Lot 3800, the eastern part of Tax Lot 1100, and all of Tax Lot 1000. The properties are located north and south of the Washington County and Yamhill County line, north of Olson Road, in the City of Gaston. They are further identified as tax map and lot number 1S4W35 / 3800, 2S4W2 / 1100 and 1000 (see Exhibit B). Two of the three parcels (TL 1000 and TL 1100) are within Yamhill County. ORS 198 dictates that the decision-maker for the annexation to a special service district is the county board of the county within which the largest portion of the assessed value of the district lies. The largest portion of the District’s assessed value lies within Washington County; therefore the Washington County Board is the authority to consider this request. The western portion of Tax Lot 3800 was brought into the City of Gaston on May 14, 2008 (Ordinance No. 2008-02). The eastern portion of Tax Lot 1100 and all of Tax Lot 1000 were brought into the City of Gaston on March 11, 2009 (Ordinance No. 2009-02). Annexation of the properties into the City serves as the City’s endorsement of this request. Notice of today’s hearing has been made in accordance with state statutory requirements. The staff report will be provided to you prior to the hearing and it will also be available at the clerk’s desk. A Resolution and Order approving the annexation is attached to the agenda. FINDINGS Based on the study and the public hearing, the Board of County Commissioners (Board) finds: 1. The proposed annexation was initiated by a consent petition of the property owners. The

petition meets the requirement for initiation set forth in ORS 198.855 (3) (double majority annexation law) and ORS 198.750 (section of statute which specifies contents of petition).

2. The properties to be annexed consist of three tax lots encompassing approximately 71.32

acres. The western portion of Tax Lot 3800 is approximately 11.43 acres and is located north of the Washington County/Yamhill County line. This parcel is within Washington County. The eastern portion of Tax Lot 1100 is approximately 53.19 acres and Tax Lot 1000 is approximately 6.70 acres. Tax Lots 1100 and 1000 are both located south of the Washington County/Yamhill County line and north of Olson Road. Both parcels are within Yamhill County.

3. Oregon Revised Statute 198.852 directs the Board to consider the local comprehensive plan

for the area and any service agreement executed between a local government and the affected district. The criteria in the Metro Code do not apply outside Metro’s jurisdictional boundary.

4. The properties are outside of Metro's jurisdictional boundary and outside the regional Urban

Growth Boundary (UGB). The City of Gaston maintains its own urban growth boundary. 5. The properties were annexed into the City of Gaston on May 14 2008 and March 11, 2009.

Consequently, the properties are no longer subject to the Washington and Yamhill Counties Comprehensive Plans, but are subject to the city’s comprehensive plan policies governing the provision of urban services.

City of Gaston, Comprehensive Plan, Chapter III Public Facilities and Transportation, Policy III.1 states “The city shall develop and maintain public facility systems master plans for all primary facilities designed to ensure the availability of adequate water, sanitary sewer, storm drainage, and transportation facilities necessary to sustain the existing and future population and economic growth within the city’s urban growth boundary...” Clean Water Services is the sewer provider for the City of Gaston. The city’s sanitary sewer system has been operated by Clean Water Services since 1972.

6. Subsection 4(b)(5) of the Yamhill County Urban Area Management Agreement,

adopted by Yamhill County Board Order 79-245, requires notification of the extension of public sewer, water or storm drainage system. Yamhill County was notified and has reviewed this request. They have no objection to this proposed minor boundary annexation.

7. The City of Gaston-Washington County UPAA does not contain any provisions directly

addressing service district annexations, such as being proposed by the applicant. Therefore, staff finds that the proposed annexation is not inconsistent with the adopted Washington County-Gaston UPAA. In addition, the County notified the City of the proposed minor boundary change as required by Section II.C.1.a of the UPAA.

The property is in the City of Gaston UGB and was annexed into the city on May 14, 2008 and March 11, 2009.

8. The City of Gaston storm water lines are available in Hedin Terrace and 6th Street and can

service the properties. 9. The area to be annexed is served by the Gaston Rural Fire District. 10. The bulk of the City of Gaston (but not this site) is within the Clean Water Services District.

An 8-inch sanitary sewer line is available in Cottonwood Street to serve the northern half of the territory. At the time of development, a 12-inch sanitary sewer line is available in Olson Road for the southern half of the territory.

11. The property is served by Olson Road. Street access can also be obtained through a planned

extension of Trail Street and 6th Street from Hedin Terrace. The extension is anticipated with the development of Gaston Heights Phase I Subdivision.

12. The City of Gaston provides police service to the area. 13. The City of Gaston provides parks and recreation services. 14. The District supports the proposed annexation to its boundary. The Board of County

Commissioners has endorsed this as the Board of Directors of Clean Water Services District. 15. A necessary party has not contested this boundary change. Therefore, the change may

become effective immediately upon adoption by the Board. CONCLUSIONS AND REASONS FOR DECISION Based on the Findings, the Commission concludes: 1. ORS 198 calls for consistency between the Board decision and any "specific directly applicable

standards or criteria for boundary changes contained in comprehensive plans, public facilities plans . . .” The Washington County Comprehensive Plan is no longer applicable since the properties was annexed to the City of Gaston on May 14, 2008 and March 11, 2009. Annexation of these properties to the District is consistent with the City of Gaston’s Comprehensive Plan.

2. The District supports the proposed annexation to its boundary. The Board of County

Commissioners has endorsed this as the Board of Directors of Clean Water Services District. 3. A necessary party has not contested this boundary change. Therefore, the change may become

effective immediately upon adoption by the Board.

ORAL COMMUNICATION ( 2 MINUTE OPPORTUNITY) Tom Black, 870 NW Garibaldi Street, Hillsboro, Oregon, thanked the Board for having a Commissioner presence at the last Fair Board Meeting; Commissioner Duyck attended that meeting on behalf of the Board. Mr. Black suggested that it might be a good idea to continue this presence during this interim period while things are still in flux relative to management. His main reason for appearing today was to let the Board know that one recommendation made by the Fair Board was to postpone the filling of the Executive Director position until the end of this year. Mr. Black stated that there is an opportunity in the current economy to draw from an overqualified pool of people to fill this position. He did not want to lose momentum and asked that, if possible, the Board urge that search to be continued. Mr. Black said that it would not be necessary to fill it immediately but that it would be good to get candidates who could fill that position at a moment’s notice. He explained that the purpose of finding that individual is to have him/her begin to get money coming in from the private sector.

Chair Duyck remarked that it is clearly within the jurisdiction or authority of the Fair Board to choose whether or not they will have an Executive Director. He reviewed that at the last meeting, the Fair Board chose not to do so at this time. As to whether or not this is a good opportunity to fill that position, Chair Duyck said that the County has found that many people of that caliber at that level are not prepared to move from one area of the country to here because they cannot sell their homes. Mr. Black responded: “If nothing changes, nothing changes.” 3. PROCLAMATION 3.a. MO 09-63 Proclaim April 12 – April 18, 2009 as National Community Development Week in Washington County (All CPOs) The Clerk of the Board read the proclamation into the record. Having served on the Board of the Community Development Block Grant in the past (Commissioner Schouten currently serves in this capacity), Chair Duyck was aware of how many good things this program can do for communities. He said that it does everything from building libraries and senior centers to upgrading water facilities for small cities and a variety of great projects that have helped the community. Commissioner Schouten noted that so many of those decisions do get made at the local level, which is a good place for them to be made. It was moved to authorize the Chairman to execute the proclamation to recognize National Community Development Week and to authorize copies to be sent to the County’s congressional delegation. Motion – Schouten 2nd – Rogers Vote – 4-0 4. BOARDS AND COMMISSIONS 4.a. MO 09-64 Announce Vacancies on Boards and Commissions (All CPOs) Chair Duyck announced vacancies on the following Boards and Commissions:

5. PUBLIC HEARING – LAND USE AND TRANSPORTATION 5.a. RO 09-18 Transfer Jurisdiction of Certain County Roads (Portions of SW Old Highway 99W and SW Middleton Road) to the City of Sherwood (CPO 5) Kathy Lehtola reported that the City of Sherwood has asked the County to transfer jurisdiction of portions of two roads from the County to the City. She identified the roads as SW Old Highway 99W (a collector) and SW Middleton Road (local road). Ms. Lehtola reviewed that the Board set today as the time and date for the public hearing on this matter. She said that notices were posted as required by State law. Ms. Lehtola told the Board that no information has been received from the public on this matter. She stated that both roads are located entirely within the City of Sherwood. The public hearing was opened. No public testimony was given. The public hearing was closed. It was moved to transfer jurisdiction to the City of Sherwood (CR No. 3263 T/J). Motion – Rogers 2nd – Schouten Vote – 4-0 OFF DOCKET – COUNTY COUNSEL MO 09-71 Settlement of Mead v. Washington County; WCCC No. C087496CV Dan Olsen stated that this was one of the few Measure 37 cases that continued on beyond the repeal of Measure 37. He reviewed that Ms. Mead got both a State and a County waiver. Mr. Olsen went on to say that Ms. Mead got a complete development review and permit approval and then proceeded in good faith to do some infrastructure and other types of improvements. He reported that the Hearings Officer determined that Ms. Mead had in fact achieved a vested right for a 23-lot subdivision located along NW Green Mountain Road. Mr. Olsen explained that in reliance on the development approval, Ms. Mead made some improvements. He indicated that the only outstanding issue was whether the vested right is transferable. Mr. Olsen clarified that it has been the County’s position that once you achieve a vested right, you are governed exclusively under the vested right statutes; those do provide for transferability. He stated that this settlement language would take care of that situation and would resolve the lawsuit in Circuit Court with no costs or attorney fees to any party. Mr. Olsen recommended that the Board approve this today.

It was moved to approve stipulated judgment removing the condition of approval as a means of settlement. Motion – Schouten 2nd – Strader Vote – 4-0 Commissioner Schouten stated that this is one of a small number of post-Measure 37 claims that are out there. He believed there are about four of them. Commissioner Schouten felt that these will have little impact on the practical operations of the County and how we deal with land use. 6. ORAL COMMUNICATION (5 MINUTE OPPORTUNITY) None. 7. BOARD ANNOUNCEMENTS Commissioner Schouten announced that Chairman Tom Brian is at Metro this morning looking out for the County’s interests on some important tax issues. 8.
