Have you put your- self on the receiving end of all that comes from your REALTOR® Association? If you have, you probably have a pretty good sense of why being a REALTOR® and paying your dues every year makes good sense for your profession. VPAR understands that in this economy a smaller payment might be easier. And to help our members, VPAR is offering a monthly installment payment option. REALTORS® from across the coun-try converged in Washington, D.C., May 15th during the National Association of REALTORS® 2012 Mid-year Legislative Meet-ings & Trade Expo and Pamela McKinney Lew-is, VPAR President-Elect and Dana R. Holben, VPAR CEO and myself were among them. We also joined an estimated 14,000 Realtors® and members of Congress at the Washington Monument to rally on be-half of homeowners, real estate investors, and those who aspire to homeownership. A highlight of this year’s meetings, the Rally to Protect the American Dream, took place on Thursday. REALTORS® from ev-ery state in the country joined invited mem-bers of Congress to highlight the important role housing plays in the American econ-omy, as well as advocate for policies that are supportive of homeownership. Among the speakers were Sen. Johnny Isakson (R-Ga.) and Rep. Steny Hoyer (D-Md.). The year’s meetings focused on a number of pressing issues that affect the real es-tate market, the nation’s 75 million home-owners and aspiring homeowners. Various sessions focused on the need for afford-able fi nancing, secondary mortgage mar-ket reform, and economic issues impacting the residential and commercial markets. While in Washington, we along with Chan-dra Patterson, Federal Political Coordina-tor met with Senator Bobby Scott on Capi-tol Hill to address critical issues related to today’s housing market, particularly the need to streamline short sales, preserve tax benefi ts for homeownership, and bol-ster liquidity in the commercial market. They also urged Sen. Scott to reauthorize the National Flood Insurance Program,

which is currently set to expire on May 31.Throughout the week REALTORS® partici-pated in sessions with a number of govern-ment offi cials and industry experts, including representatives from the Federal Housing Administration, Mortgage Bankers Associa-tion of America, Federal Housing Finance Agency, Federal Reserve Board, National Economic Council, and the U.S. Treasury.

During the meetings, former Republican Na-tional Committee Chairman Michael Steele, leading Democratic strategist Celinda Lake, and National Economic Council Director Gene Sperling participated in a panel discus-sion about how the 2012 elections will impact the real estate industry. Federal Reserve Board Governor Elizabeth Duke spoke during the joint Real Estate Services and Regulato-ry Issues Forum – Prescriptions for Housing Recovery. Duke discussed how a full hous-ing market recovery could not happen until policymakers move forward with the diffi cult decisions regarding that future of the mort-gage market. A panel of industry experts and representatives including FHFA Acting Direc-tor Ed DeMarco, FHA Commissioner and As-sistant Secretary for Housing Carol Galante, Moody’s Analytics Mark Zandi, and Wharton School of Business Professor Susan Watch-er discussed housing policy, specifi cally the mortgage interest deduction, government sponsored entities, and the government’s role in promoting homeownership.

We had an opportunity to explore the latest industry innovations and stay up to date on how new products are transforming the real estate business, as more than 100 exhibitors showcased the newest real estate products and services for the industry during the Trade Expo.

Legal Case Summaries from NAR

Folds v. Barber: Broker Loses Boyfriend, Referral Fees

Georgia’s highest court has considered whether a real estate licensee who referred clients to her lover who was also a licensee could later claim referral fees when the lovers’ relationship came to an end.

Carolyn Folds (“Folds”) and Donald Barber (“Barber”) were real estate professionals who began a romantic relationship with each other. The lovers purchased a home together, with Folds making a downpayment of $10,000 and Barber paying approximately $18,000 at closing, with Barber taking title to the property. The couple agreed to set-up a checking account into which they would both deposit funds to pay for the mortgage and other expenses.

During the course of their relationship, Folds referred a number of sellers to her paramour, causing him to earn $77,000 in commissions. Barber did not pay Folds a referral fee nor did the parties negotiate such a fee, as Folds expected Barber to marry her.

Eventually, the nectar of love turned sour and the relationship came to an end. Folds fi led a lawsuit against Barber, alleging breach of promise to marry, fraud, and specifi c performance. Barber fi led a counterclaim, seeking an equitable partition, or dividing, of the coupler’s property. The trial court ordered that the jointly purchased home be sold, with the parties collecting the amounts they had contributed towards the purchase of the home and thereafter splitting the excess proceeds. Folds appealed the trial court’s ruling.

The Supreme Court of Georgia affi rmed the ruling of the trial court. On appeal, Folds argued that she should receive compensation for the referrals she made to Barber. Thus, she challenged the court’s partition of the property, arguing that it failed to account for these fees.

The court rejected these arguments, fi nding that there was no evidence showing that Folds and Barber had attempted to negotiate referral fees. Since parties have to reach some type of agreement before a referral fee agreement can be enforced, the court ruled the trial court had property rejected this argument.

Next, Folds argued that she had conferred a benefi t upon Barber by referring clients to him and so should be compensated for this benefi t. The court found that in order to receive recovery for unjust enrichment, Folds would need to prove the value of the benefi t she allegedly conferred upon Barber. Since Folds had failed to offer any evidence to the trial court on the value of the benefi t conferred upon Barber, the court rejected her unjust enrichment theory as well. Thus, the trial court was affi rmed.

Rangel, Pelosi Comment about Tax Credit Ex-tension - At a press conference on October 8,

House Speaker Pelosi (D-CA) responded favorably when asked about the likelihood of extending the first-time homebuyer tax credit. When asked about the possibility of further housing legislation, she re-sponded “Yes, there is under consideration whether we extend the first time homeowners credit. And the question is, would that be just first time homeown-ers or would you open it up to other purchasers of homes?” She shed no further light on whether the credit would be expanded, but did note that the cost of an expansion would be the major consideration in the decision process.

When asked for comment, Bloomberg Wire Ser-vices reports that Chairman Rangel (D-NY)

said, “There’s no question that I think it should be extended; for how long, we should discuss.” As yet, no formal action has been announced.

House Extends Credit for Military, Intelligence and Diplomatic Personnel - The House has

voted 416 - 0 to extend through 2010 the benefits

the first-time homebuyer tax credit to military, intelli-gence and diplomatic personnel. To be eligible, pin 2009. The measure (H.R. 3590) now goes to the Senate. Timing and process for its consideration of are unknown.

IVPI Interim Complaint Process Available in No-vember 2009 - The Independent Valuation Pro-

tection Institute (IVPI) was announced as an inte-gral part of the Home Valuation Code of Conduct (HVCC). The purpose of the IVPI is to receive complaints from appraisers and users of appraisal services on the improper influence or attempted im-proper influence of appraisers. The IVPI has not yet been established but an interim web site is currently under development.

Fannie Mae and Freddie Mac announced a complaint form that will appear on the interim

Independent Valuation Protection Institute (IVPI) Complaint Web site. The complaint form is for dem-onstration purposes only and is not available for fil-ing a complaint until the Web site is publicly avail-able in November 2009. The Web site, http://www.ivpicomplaint.org, will collect complaints from any party about non-compliance with the HVCC or at-tempted improper influencing of appraisers or the appraisal process.

FHA May Further Delay Implementation of New Condominium Rules - The new condominium

approval process under Mortgagee Letter 2009-19 was to be effective for all case numbers assigned on or after October 1, 2009. While the new effec-tive date is for case numbers assigned on or after November 2, 2009, NAR understands that the new effective date may be delayed even further. The site condo and manufactured housing condo project changes that have already taken effect are not af-fected by this delay. However, all other rules of the condominium program remain in effect. For exam-ple, lenders are permitted to offer spot loans until the new condominium rules go into effect.

Governmental Affairs Update Continued!

Contributions are not deductivle for Federal income tax purposes. RPAC contributions are voluntary and used for political purposes. The amount suggested is merely a guideline and you may contribute more or less than the suggested amount. You may refuse to contribute without reprisal or otherwise affecting your membership rights. Seventy percent of your contribution goes to your State Association to support state and local political candidates. Thirty percent is sent to National RPAC to support Federal candidates against your limits under 2 U.S.C. 441a; after the state PAC reaches it RPAC goal, it may elect to retain your entire contribution for use in supporting state and local candidates.

LocalHAMPTONIn late April, the Su-preme Court of Virginia rendered its opinion in the case of the Commit-tee of Petitioners of the Buckroe Beach Bayfront Park Petition vs. the City of Hampton. The Court ruled that the Committee lacked standing based on the limited authority granted to it by the City Charter. The Committee disputed the City and the developer of the Parade of Homes to develop a residential subdivision in Buckroe Beach. As a result of the ruling, the case now is dismissed. VPAR submitted a “friend of the Court” brief on the issue supporting the City and the Parade of Homes.

Work on revisions to the City’s Zoning Ordinance continue! Current focus remains on the small wind turbine permits and the language necessary to allow property owners to install those systems under specifi c conditions. VPAR is providing details to the City on best practices from other regions of Virginia and the nation.

NEWPORT NEWSThe Newport News Regulations Committee met on May 2nd. On the agenda were amendments to the zoning ordinance, including provisions allowing for parking and loading for what will be the new joint Newport News/Hampton animal shelter; provisions allowing for temporary sea-sonal land uses and activities, and provisions al-lowing for micro-breweries, micro-distilleries and micro-wineries. VPAR has suggested that micro-breweries and similar uses with commercial and/or retail implications not be allowed in

residential zoning districts without a conditional or special use permit.

YORK COUNTY

The Planning Commissions from York County, James City County and the City of Williamsburg held a joint work session on April 30th to discuss the coordinated comprehensive plans. A variety of topics were discussed: workforce housing across the three jurisdictions, adaptive re-use of properties, economic development, land use and zoning and transportation. As this was not a public hearing, no comments were taken.

Specifi cally to the County’s Comprehensive Plan, which is under review, two public meetings to discuss and receive input from citizens have been scheduled. Each meeting will include an informational presentation and an opportunity for residents to review planning maps and talk one-on-one with Planning Commission members and staff about York County planning issues such as land use, housing, transportation, community facilities, economic development, historic re-sources, and the environment. Both meetings run from 7:00 to 9:00 p.m. Dates and locations are below:

Fannie Mae and Freddie Mac announced a complaint form that will appear on the interim

Independent Valuation Protection Institute (IVPI) Complaint Web site. The complaint form is for dem-onstration purposes only and is not available for fil-ing a complaint until the Web site is publicly avail-able in November 2009. The Web site, http://www.ivpicomplaint.org, will collect complaints from any party about non-compliance with the HVCC or at-tempted improper influencing of appraisers or the appraisal process.

FHA May Further Delay Implementation of New Condominium Rules - The new condominium

approval process under Mortgagee Letter 2009-19 was to be effective for all case numbers assigned on or after October 1, 2009. While the new effec-tive date is for case numbers assigned on or after November 2, 2009, NAR understands that the new effective date may be delayed even further. The site condo and manufactured housing condo project changes that have already taken effect are not af-fected by this delay. However, all other rules of the condominium program remain in effect. For exam-ple, lenders are permitted to offer spot loans until the new condominium rules go into effect.

Regional On May 17th, VPAR endorsed and participated in the Hampton Roads Urban Land Institute’s REALI-TY CHECK HAMPTON ROADS. Along with nearly 300 other representatives of local government, businesses, advocacy groups and non-profits, VPAR took part in this active, hands-on land use and planning exercise. With nearly 350,000 people predicted to move into Hampton Roads in the next 23 years, the region must plan for that growth, which is sure to stretch municipal resources and the region’s transportation systems. As action items emerge from the session, VPAR will advise the membership.

According to a recent report from the Hampton Roads Planning District Commission, the level of building permitting remains depressed in the Hampton Roads market, particularly with respect to single family permits. The jump in permits in February proved to be a short-lived phenomenon, with permits dropping to 225 units for the region in March, half the typical level of permitting in Hamp-ton Roads. While the level of multi-family permits has been noted as an area for optimism (304 permits in March), multi-family permits typically represent a small percentage of overall permitting, and are far more volatile than single family hous-ing. Construction employment in the region has fallen by a third over the past 5 years, down by 16,200 jobs

State Need a change to the state code to accomplish a eal estate or housing objective? Know of an issue that should be updated to conform policy to cur-rent practice? We are working on is-sues to submit to VAR for consideration into the 2013 Legislative Package, and your input is vital.

The issue regarding false advertising and potential liability for real estate licensees in civil actions has been added to the 2013 work agenda for the Vir-ginia Housing Commission. The Commission was supposed to have met May 14th but the meeting was cancelled due to the special session held to ap-prove the state budget. This issue was covered in legislation from Del. David Yancey (R-94th, Newport News), with whom VPAR continues to work to find a solution agreeable to all stakeholders.

VDOT has advised of aggressive enforcement of ex-isting law to remove any and all signs from VDOT rights of way throughout the Commonwealth. Real estate and “weight loss” signs are specifically sched-uled for target. VPAR advises its members to be dili-gent of all local sign ordinances and especially aware of state regulations which do not allow any signs to be placed in the VDOT rights of ways. VDOT has the authority to remove signs, and while the agency may confiscate signs on weekends as well as weekdays, there are no plans to enforce the regulations as strictly on the weekends. PLEASE USE CAUTION IN YOUR SIGN PLACEMENT!

NAR simultaneously ran ads, co-sponsored by nearly 20 coalition partners, in all

App Recap

Somehow or another over the past few months I was coerced into 3 different app presentations for mobile devices. Each varied slightly as audiences changed and I didn’t want to share the same apps over and over. But for those of you that didn’t make any of them, I thought it would be worth the time to share some of these apps here.

Disclaimer: this is by no means a defi nitive list of apps. There are literally thousands and thousands of apps available for smartphones and tablets. Multiple apps available for any intended use as well. This is just a very small list of some of the most popular and better reviewed apps available. But new apps are available all the time. If you have a need not served by the apps here do what I do. Google it! Many apps are free and many of the ones that cost a few dollars have free trials so you can test them out.

One of the fi rst things I would suggest is getting familiar with installing and moving apps on your device. These video tutorials will get you started. Apple devices. Android devices.

Recovering a lost device if stolen, fi nding it if you misplace it or wiping data from your device if you are unable to recover it is invaluable. Find My iPhone. WatchDroid. Similar to those two apps but also adding virus and malware protection is Lookout Mobile Security.

More for tablets then phones, photo editing software can be very useful. I just don’t think many of us will be trying to edit photos on a screen as small as a smartphone. Available for Apple devices and PC desktops, SnapSeed is a great program. A version for Android devices is in the works. Until then if you need something now Adobe makes Photoshop Express.

NAR also offers a number of apps to suit various needs. A listing of them with descriptions can be found here: Stay Connected.

PC, Laptop, tablet, phone, how can you keep your fi les available all the time? Dropbox, Skydrive or Google Drive allows access from all your devices so your fi les are always accessible. An excellent article that discusses nearly every option available with defi nitions to better understand the process can be found here: Cloud Sync Storage

Want a better browser for your device? Give Dolphin HD Browser a try. Gesture and voice control browsing, tabbed browsing, a sidebar , just lots of features to suit the way you choose to browse.

Capture, save and organize nearly anything. Evernote lets you make notes, clip web pages, take screenshots. A quick and easy way to get organized.

Last but not least, take a look at OnLive Desktop if you want mobile access to a Windows desktop which will also allow you to use the MLS from your tablet.

This is just a drop in the app bucket but hopefully you will fi nd something useful! Be curious, look, search and most likely you will fi nd apps you didn’t even know you needed!
