का.आ. 1700(अ).—िन िलिखत ारूप अिधसूचना, िजसे केन् ीय सरकार, पयार्वरण (संरक्षण) अिधिनयम, 1986 (1986 का 29) की धारा 3 की उपधारा (2) के खंड (v) और खंड (xiv) तथा उपधारा (3) के साथ पिठत उपधारा (1) ारा द शि य का योग करते हुए, जारी करने का स्ताव करती ह,ै पयार्वरण (संरक्षण) िनयम, 1986 के िनयम 5 के उपिनयम (3) की अपेक्षानुसार, जनसाधारण की जानकारी के िलए कािशत की जाती है; िजनके उसस े भािवत होने की संभावना ह ै ; और यह सूचना दी जाती ह ै िक उ ारूप अिधसूचना पर, उस तारीख स,े िजसको इस अिधसूचना वाले भारत के राजप की ितयां जनसाधारण को उपलब्ध करा दी जाती ह, साठ िदन की अविध की समाि पर या उसके प ात् िवचार िकया जाएगा ;

ऐसा कोई ि , जो ारूप अिधसूचना म अंतिवर् स्ताव के सबंंध म कोई आक्षेप या सझुाव दनेे म िहतब ह,ै इस कार िविन दर् अविध के भीतर, केन् ीय सरकार ारा िवचार िकए जाने के िलए, आक्षेप या सुझाव सिचव, पयार्वरण, वन और जलवायु पिरवतर्न मं ालय, इंिदरा पयार्वरण भवन, जोर बाग रोड, अलीगंज, नई िदल्ली-110003 या ई-मेल पते: [email protected] पर िलिखत रूप म भेज सकेगा ।

ओरछा वन्यजीव अभयारण्य, मध्य दशे राज्य के टीकमगढ़ िजले म िस्थत ह ैऔर यह 45.36 वगर् िकलोमीटर तक फैला हुआ ह।ै ओरछा वन्यजीव अभयारण्य ओरछा राज्यक्षे ीय रज और उ र दशे म बबीना रज के साथ जुड़ा हुआ ह;ै

और, ओरछा वन्यजीव अभयारण्य म वनस्पित और जीवजन्तु अत्यंत समृ ह।ै ओरछा वन्यजीव अभयारण्य जैव िविवधता म समृ ह;ै

और, ओरछा वन्यजीव अभयारण्य म कछुएं की 4 जाितयां, मछली की 16 जाितयां, पिक्षय की 97 जाितयां और 4 िग की जाितयाँ भी सिम्मिलत ह। वनस्पितय और जीवजन्तु का िववरण इस कार ह:ै

और, पािरिस्थितक, पयार्वरणीय और जैव िविवधता की दिृ से पािरिस्थितक संवेदी जोन के रुप म ओरछा वन्यजीव अभयारण्य के संरिक्षत क्षे के चार ओर के क्षे को, िजसका िवस्तार अिधसूचना के पैरा 1 म िविन दर् ह, िवस्तार और सीमा के के्ष को सुरिक्षत और संरिक्षत करना आवश्यक ह ैतथा उ पािरिस्थितक संवेदी जोन म उ ोग या उ ोग के वग के चालन तथा संस्करण करने को ितिष करना आवश्यक ह;ै

अतः, अब, केन् ीय सरकार, पयार्वरण (संरक्षण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ पिठत पयार्वरण (संरक्षण) अिधिनयम, 1986 (1986 का 29) की धारा 3 की उपधारा (3) और उपधारा (2) के खंड (v) और खंड (xiv) और उपधारा (1) ारा द शि य का योग करते हुए, मध्य दशे राज् य म ओरछा वन् यजीव अभयारण्य की सीमा के चार ओर 2 िकलोमीटर पिरिध, ओरछा शहर के आवासीय क्षे (100 मीटर पिरिध) पर और उ र दशे के के्ष को छोड़कर ओरछा वन्यजीव अभयारण्य पािरिस्थितक संवेदी जोन (िजसे इसम इसके पश् चात् पािरिस्थितक संवेदी जोन कहा गया ह)ै के रूप म अिधसूिचत करती ह,ै िजसका िववरण िन ानुसार ह,ै अथार्त् :--

1. पािरिस्थितक सवंदेी जोन का िवस्तार और उसकी सीमाएं.—(1) पािरिस्थितक संवेदी जोन ओरछा वन्यजीव अभयारण्य की सीमा 2 िकलोमीटर तक िवस्तािरत ह,ै ओरछा शहर के आवासीय क्षे (100 मीटर पिरिध) और

उ र दशे के क्षे को छोड़कर और पािरिस्थितक संवेदी जोन का क्षे फल 24.84 वगर् िकलोमीटर ह।ै पािरिस्थितक संवेदी जोन की सीमा का वणर्न उपाबंध-I म िदया गया ह।ै

(2) वन्यजीव अभयारण्य और पािरिस्थितक संवेदी जोन के िनदशांक मश: उपाबंध-II और उपाबंध-III म िदए गए ह।

(3) पािरिस्थितक संवेदी जोन के अधीन आने वाले 17 ाम की सूची और उनके िनदशांक उपाबंध- IV के रुप म ह।ै

(4) सीमा के ब्यौरे और अक्षांश और दशेान्तर के साथ पािरिस्थितक संवेदी जोन का मानिच उपाबंध-V के रुप म संल ह ै।

2. पािरिस्थितक सवंदेी जोन के िलए आंचिलक महायोजना.—(1) राज्य सरकार, पािरिस्थितक संवेदी जोन योजन के िलए राजप म इस अिधसूचना के अंितम काशन की तारीख स ेदो वषर् की अविध के भीतर, स्थानीय ि य के परामशर् से और इस अिधसूचना म संलग् न अनुबंध के सामंजस् य से आंचिलक महायोजना तैयार करेगी ।

(2) आंचिलक महायोजना राज्य सरकार म सक्षम ािधकारी ारा अनुमोिदत होगी ।

(3) राज्य सरकार ारा पािरिस् थितक संवेदी जोन के िलए आचंिलक महायोजना इस तरह, इस अिधसूचना म िविन दर्ष् ट रीितयाँ तथा सुसगंत क ीय और राज् य िविधय के सामंजस् य और क ीय सरकार ारा जारी मागर्िनदश , यिद कोई ह , ारा तैयार होगी ।

(4) आंचिलक महायोजना, पयार्वरणीय और पािरिस्थितक िवचार को समाकिलत करने के िलए राज् य सरकार के सभी संब िवभाग के परामशर् से तैयार होगी, अथार्त्:--

(i) पयार्वरण; (ii) वन और वन्यजीव; (iii) कृिष ; (iv) राजस् व; (v) नगर िवकास; (vi) पयर्टन; (vii) ामीण िवकास; (viii) िसंचाई और बाढ़ िनयं ण; (ix) नगरपािलका; (x) पंचायती राज; और (xi) लोक िन मार्ण िव भाग।

(5) आंचिलक महायोजना अनुमोिदत िव मान भू-उपयोग, अवसंरचना और ि याकलाप पर कोई िनबधन अिधरोिपत नह करेगी जब तक िक इस अिधसूचना म िविन दर्ष् ट न हो और उ योजना सभी अवसंरचना और ि याकलाप म और अिधक दक्षता और पािरिस्थितक अनुकूलता का संवधर्न करेगी ।

(6) आंचिलक महायोजना म अनाच्छािदत क्षे के जीण ार, िव मान जल िनकाय के संरक्षण, आवाह क्षे के बंधन, जल-संभर के बंधन, भूतल जल के बंधन, मृदा और नमी संरक्षण, स्थानीय समुदाय की आवश्यकता तथा पािरिस्थितक और पयार्वरण स ेसबंंिधत ऐस ेअन्य पहलू , िजन पर ध्यान दनेा आवश्यक ह,ै के िलए उपबंध ह ग े।


(7) आंचिलक महायोजना सभी िव मान पूजा स् थल , ाम और नगरीय बंदोबस्त , वन के कार और िकस् म , कृिष क्षे , ऊपजाऊ भूिम, हिरत क्षे जैसे पाक और उसी कार के स् थान, उ ान कृिष क्षे , फलो ान , झील और अन्य जलाशय का मानिच की मदद से अभ्यकंन करेगी और योजना का मानिच ारा िव मान और

स्तािवत भूिम के उपयोग का ब्यौरा दतेे हुए समथर्न िकया जाएगा ।

(8) आंचिलक महायोजना पािरिस्थितक संवेदी जोन म िवकास को, स् थानीय समुदाय की जीिवका सुरक्षा के िलए पािरिस् थितक अनुकूल िवकास को सुिनिश् चत करते हुए िविनयिमत करेगी ।

(9) आंचिलक महायोजना इस अिधसूचना के अधीन अपने मानीटरी काय को करने के िलए मानीटरी सिमित के िलए एक संदभर् दस्तावेज तैयार करेगी ।

3. राज्य सरकार ारा िकए जान ेवाल ेउपाय.—राज्य सरकार इस अिधसूचना के उपबंध को भावी करने के िलए िन िलिखत उपाय करेगी, अथार्त्:--

(1) भू-उपयोग –

पािरिस् थितक संवेदी जोन म वन , उ ान-कृिष के्ष , कृिष के्ष , आमोद- मोद के योजन के िलए िचिन्हत िकए गए पाक और खुले स्थान का वािणिज्यक और औ ोिगक ि याकलाप के िलए उपयोग या संपिरवतर्न नह होगा और मानिच के साथ आंचिलक महायोजना म स्प रूप से क्षे को िनधार्िरत िकया जाएगा:

परंतु पािरिस्थितक संवेदी जोन के भीतर कृिष भूिम ऐसे और अन्य भूिम का संपिरवतर्न मानीटरी सिमित की िसफािरश पर और राज्य सरकार के पूवर् अनुमोदन स,े जो स्थानीय िनवािसय की आवासीय जरूरत को पूरा करने के िलए ह,ै अनुज्ञात िकया जाएगा जैसे:-

(i) िव मान सड़क को चौड़ा करना और उन्ह सुदढृ करना तथा नई सड़क का सिंनमार्ण;

(ii) बुिनयादी ढांच और नागिरक सुख सुिवधा का संिनमार्ण और नवीकरण; (iii) दषूण उत्प न करन ेवाले लघ ुउ ोग; (iv) कुटीर उ ोग िजसके अंतगर्त ामीण उ ोग; सुिवधाजनक भण्डार और स्थानीय सुिवधा का समथर्न करने वाले वासगृह सिहत पािरिस्थितक पयर्टन भी है; और (v) पैरा 4 म यथा सूचीब संविधर्त ि याकलाप:

परंतु यह िक राज्य सरकार के पूवर् अनुमोदन तथा संिवधान के अनुच्छेद 244 और तत्समय वृ िविध के उपबंध के अनुपालन के िबना, िजसके अंतगर्त अनुसूिचत जनजाित और अन्य परंपरागत वन िनवासी (वन अिधकार की मान्यता) अिधिनयम, 2006 (2007 का 2) भी ह,ै वािणिज्यक या उ ोग िवकास ि याकलाप के िलए जनजातीय भूिम का उपयोग अनुज्ञात नह होगा:

परंतु यह और िक पािरिस् थितक संवेदी जोन के भीतर भू-अिभलेख म उपसंजात कोई ुिट, मानीटरी सिमित के िवचार ा करने के प ात् राज्य सरकार ारा त्येक मामले म एक बार संशोिधत होगी और उ ुिट के संशोधन की सूचना क ीय सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मं ालय को दनेी होगी ।

परंतु यह और िक उपयुर् ुिट का संशोधन म इस उप पैरा के अधीन यथा उपबंिधत के िसवाय िकसी भी दशा म भू-उपयोग का पिरवतर्न सिम्मिलत नह होगा ।


परंतु यह और िक िजससे हिरत के्ष म जैसे वन क्षे , कृिष क्षे आिद म कोई पािरणािमक कटौती नह होगी और अन युक् त या अनुत् पादक कृिष क्षे म वनरोपण और आवास पुनरु ार ि याकलाप के साथ पुन: वनीकरण करने के यास िकए जाएंगे ।

(2) ाकृितक जल ोत.—आचंिलक महायोजना म सभी ाकृितक जल ोत की पहचान की जाएगी और उनके संरक्षण और पुनरुद्भूतकरण के िलए योजना सिम् मिलत होगी और राज् य सरकार ारा ऐसे क्षे पर या उनके िनकट िवकास ि याकलाप ितिष करने के िलए ऐसी रीित से मागर्दशर्क िस ान्त तैयार िकए जाएंगे ।

(3) पयर्टन.—(क) पािरिस्थितक संवेदी जोन के भीतर नये पयर्टन पािरिस्थितक संवेदी जोन के िलए ि याकलाप या िव मान पयर्टन ि याकलाप का िवस्तार पयर्टन महायोजना के अनुसार ह गे ।

(ख) पयर्टन महायोजना पयर्टन िवभाग, ारा पयार्वरण और वन िवभाग, मध्य दशे सरकार के परामशर् से तैयार होगी ।

(ग) पयर्टन महायोजना आंचिलक महायोजना के एक घटक के रूप म जाना जायेगा ।

(घ) पयर्टन सबंंधी ि याकलाप िनम् निलिखत के अधीन िविनयिमत ह गे, अथार्त् :-

(i) वन्यजीव अभयारण्य की सीमा से एक िकलोमीटर तक या पािरिस्थितक संवेदी जोन के िवस्तार तक इनम जो भी िनकट ह,ै नये वािणिज्यक होटल और िरसोटर् अनुज्ञात नह ह गे। परन्तु वन्यजीव अभयारण्य की सीमा से एक िक.मी. की दरूी से आगे नये होटल और िरसोटर् का स्थापना पयर्टन महायोजना के अनुसार पािरिस्थितक पयर्टन सुिवधा के िलए पूवर् पिरभािषत और पदािभिहत वग के िलए अनुज्ञात िकया जाएगा;

(ii) पािरिस्थितक संवेदी जोन के भीतर सभी नए पयर्टन ि याकलाप या िव मान पयर्टन ि याकलाप का िवस्तार क ीय सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मं ालय के मागर्दशर्क िस ातं के ारा तथा राष् ीय व् या संरक्षण ािधकरण, ारा जारी पािरिस्थितक पयर्टन (समय-समय पर यथा संशोिधत) मागर्दशर्क िस ांत के अनुसार, पािरिस्थितक पयर्टन, को महत्व दतेे होगा; (iii) आंचिलक महायोजना का अनुमोदन िकए जाने तक, पयर्टन के िलए िवकास और िव मान पयर्टन ि याकलाप के िवस्तार को वास्तिवक स्थल िविन दर् संवीक्षा तथा मानीटरी सिमित की िसफािरश पर आधािरत संबंिधत िविनयामक ािधकरण ारा अनुज्ञात िकया होगा ।

(4) नसैिगर्क िवरासत.—पािरिस्थितक संवेदी जोन म महत्वपूणर् नैसिगर्क िवरासत के सभी स्थल जैसे सभी जीन कोश आरिक्षत क्षे , शैल िवरचनाएं, जल पात , झरन , घाटी माग , उपवन , गुफाएं, स्थल , मण, अ रोहण,

पात आिद की पहचान की जाएगी और उन्ह संरिक्षत िकया जाएगा तथा उनकी सुरक्षा और संरक्षा के िलए इस अिधसूचना के अंितम काशन की तारीख से छह मास के भीतर, उपयु योजना बनाएगी और ऐसी योजना आंचिलक महायोजना का भाग होगा ।

(5) मानव िनिमर्त िवरासत स् थल.—पािरिस् थितक संवेदी जोन म भवन , संरचना , िशल्प-तथ्य, ऐितहािसक, कलात्मक और सांस्कृितक महत्व के क्षे की पहचान करनी होगी और इस अिधसचूना के अंितम काशन की तारीख स ेछह माह के भीतर उनके संरक्षण की योजनाएं तैयार करनी होगी तथा आंचिलक महायोजना म सिम्मिलत की जाएगी । (6) ध् विन दषूण.—पािरिस्थितक संवेदी जोन म ध् विन दषूण के िनयं ण के िलए राज् य सरकार का पयार्वरण िवभाग या राज् य दषूण िनयं ण बोडर्, वायु ( दषूण िनवारण और िनयं ण) अिधिनयम, 1981 (1981 का 14) के उपबंध और उसके अधीन बनाए गए िनयम के अनुसरण म मागर्दशर्क िस ांत और िविनयम तैयार करेगा ।


(7) वाय ु दषूण.—पािरिस्थितक संवेदी जोन म, वायु दषूण के िनयं ण के िलए राज्य सरकार का पयार्वरण िवभाग या राज् य दषूण िनयं ण बोडर् वायु ( दषूण िनवारण और िनयं ण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयम के उपबंध के अनुसार म मागर्दशर्क िस ांत और िविनयम तैयार करेगा ।

(8) बिह ाव का िनस्सारण.—पािरिस्थितक संवेदी जोन म उपचािरत बिह ाव का िनस्सारण जल ( दषूण िनवारण तथा िनयं ण) अिधिनयम, 1974 (1974 का 6) और उसके अधीन बनाए गए िनयम के उपबंध के अनुसार होगा ।

(9) ठोस अपिश .—ठोस अपिश का िनपटान िन िलिखत रूप म होगा--

(क) पािरिस्थितक संवेदी जोन म ठोस अपिश का िनपटान समय-समय पर संशोिधत ठोस अपिशष् ट बंधन िनयम, 2016, जो भारत सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मं ालय की

अिधसूचना सं. का.आ. 1357(अ) तारीख 8 अ ैल, 2016 ारा कािशत िकए गए थे, के उपबंध के अनुसार िकया जाएगा ;

(ख) स्थानीय ािधकरण जैव िन ीकरणीय और अजैव िन ीकरणीय संघटक म ठोस अपिश के संपृथ न के िलए योजनाएं तैयार करगे ;

(ग) जैव िन ीकरणीय साम ी को अिधमानतः खाद बनाकर या कृिम खेती के माध्यम स ेपुनःचि त िकया जाएगा ;

(घ) अकाबर्िनक साम ी का िनपटान पािरिस्थितक संवेदी जोन के बाहर पहचान िकए गए स् थल पर िकसी पयार्वरणीय स्वीकृत रीित म होगा और पािरिस्थितक संवेदी जोन म ठोस अपिशष् ट को जलाना या भष् मीकरण अनुज्ञात नह होगा।

(10) जैव िचिकत् सीय अपिशष् ट.—पािरिस्थितक संवेदी जोन म जैव िचिकत्सीय अपिश का िनपटान भारत सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मं ालय की समय-समय पर यथासंशोिधत अिधसूचना सं.का.िन 343(अ) तारीख 28 माचर्, 2016 ारा कािशत जैव िचिकत्सीय अपिश बंध िनयम, 2016 के उपबंध के अनुसार िकया जाएगा ।

(11) यानीय पिरवहन.—पिरवहन की यानीय गितिविधयां आवास के अनुकूल िविनयिमत ह गी और इस सबंंध म आंचिलक महायोजना म िवशेष उपबंध अिधकिथत िकए जाएंगे और आंचिलक महायोजना के तैयार होने और राज् य सरकार के सक्षम ािधकारी के ारा अनुमोिदत होने तक, मानीटरी सिमित वृ िनयम और िविनयम के अनुसार यानीय गितिविधय के अनुपालन को मानीटर करेगी ।

(12) औ ोिगक इकाईया.ं—

(क) पािरिस्थितक संवेदी जोन के भीतर नए का आधािरत उ ोग के स्थापना की अनुज्ञा िविध के अनुसार स्थािपत िव मान का आधािरत उ ोग के िसवाए नह दी जाएगी ।

(ख) स्तािवत पािरिस्थितक संवेदी जोन के भीतर जल, वायु, मृदा, ध्विन दषूण कािरत करने वाले िकसी नए उ ोग की स्थापना की अनुज्ञा नह दी जाएगी ।


4. पािरिस्थितक सवंेदी जोन म ितिष और िविनयिमत ि याकलाप की सचूी.—पािरिस्थितक संवेदी जोन म सभी ि याकलाप पयार्वरण (संरक्षण) अिधिनयम, 1986 (1986 का 29) और उसके अधीन बनाए गए िनयम के उपबंध ारा शािसत ह गे और नीचे दी गई तािलका म िविन दर् रीित म िविनयिमत ह गे, अथार्त ्:-

चालन होगा ।

2. दषूण (जल, वायु, मृदा, ध् विन) कािरत करने वाले उ ोग की स् थापना ।

पािरिस्थितक संवेदी जोन नए या दषूण फैलाने वाले उ ोग के िवस्तार की अनुमित नह दी जाएगी । केन् ीय दषूण िनयं ण बोडर् वग करण हिरत या ेत के रुप म वग कृत उ ोग कृिष आधािरत लघु उ ोग सिहत को लागू िविनयम के अनुसार िविनयिमत िकया जाएगा।

3. बृहत जल िव ुत पिरयोजना की स् थापना ।

लागू िविधय के अनुसार ितिष (अन् यथा उपबंिधत के िसवाय) ह गे ।

4. िकसी पिरसकंटमय पदाथ का उपयोग या उत्पादन ।

लागू िविधय के अनुसार ितिष (अन् यथा उपबंिधत के िसवाय) ।

5. ाकृितक जल िनकाय या सतही क्षे म अनुपचािरत बिह ार्व का िनस्सारण ।

लागू िविधय के अनुसार ितिष (अन् यथा उपबंिधत के िसवाय) ह गे ।

6. फम , कंपिनय , आिद ारा बड़े पैमाने पर वािणिज्यक पशु और पोल् ी फाम की स्थापना ।

लागू िविधय के अनुसार ितिष (अन् यथा उपबंिधत के िसवाय) ह गे।

7. आरा िमल की स्थापना । पािरिस्थितक संवेदी जोन के भीतर नई और िव मान आरा िमल का िवस् तार अनुज्ञात नह होगा ।


ख.िविनयिमत ि याकलाप

8. होटल और िरसोटर् का वािणिज्यक स्थापन ।

पािरिस्थितक पयर्टन ि याकलाप के अस्थायी सरंचना के िसवाय संरिक्षत के्ष की सीमा से एक िकलोमीटर तक या पािरिस्थितक संवेदी जोन के िवस्तार तक इनम जो भी िनकट ह,ै नये वािणिज्यक होटल और िरसोटर् अनुज्ञात नह ह गे।

परंतु, संरिक्षत क्षे की सीमा से एक िकलोमीटर से परे और पािरिस्थितक संवेदी जोन के िवस्तार तक इनम से जो भी िनकट हो सभी नए पयर्टक ि याकलाप या िव मान ि याकलाप का िवस्तार पयर्टन महायोजना और यथा लाग ूमागर्दशर्क िस ांत के अनुपालन होगा।

9. सिंनमार्ण ि याकलाप । (क) सरंिक्षत क्षे या पािरिस्थितक संवेदी जोन जो भी िनकट हो की सीमा से एक िकलोमीटर के भीतर िकसी भी कार का नया वािणिज्यक संिनमार्ण अनुज्ञात नह िकया जाएगा: परंतु स्थानीय ि य को उनके उपयोग के िलए उनकी भूिम म संिनमार्ण िजसके अंतगर्त पैरा 3 के उपपैरा (1) म सूचीब ि याकलाप भी ह, को करने के िलए अनुज्ञात िकया जाएगा ।

(ख) लघु उ ोग जो दषूण उत् पन् न नह करते ह, स ेसंबंिधत संिनमार्ण ि याकलाप िविनयिमत िकए जाएंगे और लागू िनयम और िविनयम , यिद कोई ह , के अनुसार सक्षम

ािधकारी की पूवर् अनुमित से ही न् यूनतम पर रखे जाएंगे ।

(ग) एक िकलोमीटर से आगे आंचिलक महायोजना की अनुसार िविनयिमत ह गे ।

10. दषूण उत्प न करने वाले लघु उ ोग ।

पािरिस् थितक संवेदी जोन म दशेीय माल से उत्पाद का उत्पादन करने वाले गैर दषूण, गैर पिरसंकटमय, लघु और सेवा उ ोग, कृिष, कृिष उ ान या कृिष आधािरत उत्पाद का उत्पादन करने वाले उ ोग सक्षम ािधकारी ारा अनुज्ञात िकए जाएंगे ।

11. ईंट भ की स् थापना। लागू िविधय के अनुसार िविनयिमत (अन् यथा उपबंिधत के िसवाय) ।

12. वृक्ष की कटाई । (क) राज्य सरकार म सक्षम ािधकारी की पूवर् अनुमित के िबना वन, सरकारी या राजस्व या िनजी भूिम पर या वन म कंही वृक्ष की कटाई नह होगी ।

(ख) वृक्ष की कटाई, संबंिधत क ीय या राज्य अिधिनयम या उसके अधीन बनाए गए िनयम के उपबंध के अनुसार िविनयिमत होगी ।

13. वन उत्पाद और गैर का वन उत्पाद का सं हण ।

लागू िविधय के अधीन िविनयिमत ह गे ।


14. िव ुत और दरूसंचार टावर का पिरिनमार्ण और केबल िबछाना और अन्य बुिनयादी ढांचे ।

लागू िविधय के अधीन िविनयिमत ह गे। भूिमगत केबल को बढ़ावा िदया जाएगा।

15. नागिरक सुख-सुिवधा सिहत बुिनयादी ढांचे।

लागू िविधय , िनयम और िविनयमन और उपलब्ध मागर्दशर्क िस ांत के अनुसार न्यूनीकरण की उपाय के साथ िविनयिमत ह गे।

16. िव मान सड़क को चौड़ा करना और उन्ह सुदढृ करना तथा नई सड़क का सिंनमार्ण ।

लागू िविधय , िनयम और िविनयमन और उपलब्ध मागर्दशर्क िस ांत के अनुसार न्यूनीकरण की उपाय के साथ िविनयिमत ह गे।

17. पयर्टन से संबंिधत ि याकलाप जैसे गमर् वायु गुब्बार , हलेीकाप्टर, ोन, माइ ोलाइटस् आिद ारा पािरिस्थितक संवेदी जोन क्षे के ऊपर से उड़ना जैसे ि याकलाप करना।


18. पहाड़ी ढाल और नदी तट का संरक्षण ।


19. राि म यािनक पिरवहन का संचलन । लागू िविधय के अधीन वािणिज्यक योजन के िलए िविनयिमत ह गे ।

20. स्थानीय समुदाय ारा चल रही कृिष और बागवानी था के साथ पशुपालन, पशुपालन कृिष, जल कृिष और मछली पालन ।

स्थानीय उपयोग के िलए लागू िविधय के अधीन अनुज्ञात ह गे ।

21. ाकृितक जल िनकाय या सतही क्षे म उपचािरत बिह ार्व और ठोस अपिश का िनस्सारण ।

लागू िविधय के तहत बिह ाव का िनस्सारण िविनयिमत ह गे।

22. सतह और भूिमगत जल की वािणिज्यक िनकासी ।


23. खुले कुआ, बोर कुआ, आिद के िलए कृिष और अन्य उपयोग ।

लागू िविनयिमत के अधीन िविनयिमत ह गे और संबंध उपयु ािधकारी ारा ि याकलाप की सख्ती से मानीटरी की

जाएगी।

24. ठोस अपिश बंधन । लागू िविधय के अधीन िविनयिमत ह गे ।

25. िवदशेी जाितय को लाना। लागू िविधय के अधीन िविनयिमत ह गे ।

26. पािरिस्थितक पयर्टन। लागू िविधय के अधीन िविनयिमत ह गे ।

27. प् लािस् टक थैल का उपयोग । लागू िविधय के अधीन िविनयिमत ह गे ।

28. वािणिज् यक साइनबोडर् और होिडग । लागू िविधय के अधीन िविनयिमत ह गे ।


ग. संविधर्त ि याकलाप

29. वषार् जल संचयन । सि य रूप स ेबढावा िदया जाएगा ।

30. जैिवक खेती । सि य रूप स ेबढावा िदया जाएगा ।

31. सभी गितिविधय के िलए हिरत ौ ोिगकी को हण करना ।

सि य रूप स ेबढावा िदया जाएगा ।

32. कुटीर उ ोग िजसके अंतगर्त ामीण कारीगर आिद भी ह।

सि य रूप स ेबढावा िदया जाएगा ।

33. नवीकरणीय ऊजार् ोत का उपयोग । जैव गैस, सौर काश आिद को बढावा दनेा होगा ।

34. कृिष वािनकी । सि य रूप स ेबढावा िदया जाएगा ।

35. कौशल िवकास । सि य रूप स ेबढावा िदया जाएगा ।

36. मरम्मत भूिम/ वन/ वास की बहाली । सि य रूप स ेबढावा िदया जाएगा ।

37. पयार्वरणीय जागरुकता। सि य रूप स ेबढावा िदया जाएगा ।

5. मानीटरी सिमित.—(1) क ीय सरकार, पािरिस्थितक संवेदी जोन के भावी मानीटरी के िलए एक मानीटरी सिमित का गठन करती ह ैजो िन िलिखत स ेिमलकर बनेगी, अथार्त् :-

(i) भागीय आयु , सागर- अध् यक्ष;

(ii) पयार्वरण के क्षे म कायर् करने वाले गैर सरकारी संगठन (िजसके अंतगर्त िवरासत संरक्षण भी ह)ै का तीन वषर् की अविध के िलए मध्य दशे राज्य सरकार ारा नामिन दर् एक ितिनिध

सदस्य;

(iii) मध्य दशे सरकार ारा तीन वषर् की अविध के िलए नामिन दर्ष् ट पािरिस् थितक और पयार्वरण क्षे का एक िवशेषज्ञ

सदस्य;

(iv) मध्य दशे दषूण िनयं ण बोडर् का ितिनिध सदस्य;

(v) मुख्य वन संरक्षक, छतरपुर सदस्य’

(vi) िजला कलेक्टर, टीकमगढ़ सदस्य;

(vii) आयु , नगर िनगम, सागर सदस्य;

(viii) अधीक्षण अिभयंता, लोक स्वास्थ्य िवभाग, टीकमगढ़ सदस्य;

(ix) मुख्य कायर्कारी अिधकारी, िजला पंचायत, टीकमगढ़ सदस्य;

(x) शहर एवं ाम योजना िवभाग के िजला अिधकारी - सदस्य;

(xi) राज्य जैव-िविवधता बोडर् का सदस्य सदस्य; और

(xii) वन्यजीव वाडर्न, ओरछा वन्यजीव अभयारण्य सदस्य सिचव।


6. िनदश िनबंधन

(1) मानीटरी सिमित इस अिधसूचना के उपबंध के अनुपालन को मानीटर करेगी ।

(2) मानीटरी सिमित का कायर्काल तीन वषर् का होगा।

(3) पािरिस्थितक संवेदी जोन म भारत सरकार के तत् कालीन पयार्वरण और वन मं ालय की अिधसूचना सं. का.आ. 1533(अ) तारीख 14 िसतंबर, 2006 की अनुसूची म के अधीन सिम्मिलत ि याकलाप और इस अिधसूचना के पैरा 4 के अधीन ितिष गितिविधय के िसवाय आने वाले ऐस ेि याकलाप की दशा म वास्तिवक िविन दर् स्थलीय दशा पर आधािरत मानीटरी सिमित ारा संवीक्षा की जाएगी और उ अिधसूचना के उपबंध के अधीन पूवर् पयार्वरण िनकासी के िलए केन् ीय सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मं ालय को िन दर् की जाएगी ।

(4) इस अिधसूचना के पैरा 4 के अधीन यथा िविन दर् ितिष ि याकलाप के िसवाय, भारत सरकार के तत् कालीन पयार्वरण और वन मं ालय की अिधसूचना संख्यांक का.आ. 1533(अ) तारीख 14 िसतंबर, 2006 की अिधसचूना के अनुसूची के अधीन ऐसे ि याकलाप , िजन्ह सिम्मिलत नह िकया गया ह,ै परंतु पािरिस्थितक सवेंदी जोन म आते ह, ऐस े ि याकलाप की वास्तिवक िविन दर् स्थलीय दशा पर आधािरत मानीटरी सिमित ारा संवीक्षा की जाएगी और उस ेसंब िविनयामक ािधकरण को िन दर् िकया जाएगा ।

(5) मानीटरी सिमित का सदस्य-सिचव या संब कलक्टर या संरिक्षत क्षे का भारी ऐस े ि के िवरू , जो इस अिधसूचना के िकसी उपबंध का उल्लंघन करता ह,ै पयार्वरण (संरक्षण) अिधिनयम, 1986 की धारा 19 के अधीन पिरवाद फाइल करने के िलए सक्षम होगा।

(6) मानीटरी सिमित मु के आधार पर अपेक्षा पर िनभर्र रहते हुए संब िवभाग के ितिनिधय या िवशेषज्ञ , औ ोिगक संगम या संब पणधािरय के ितिनिधय को अपने िवचार-िवमशर् म सहायता के िलए आमंि त कर सकेगी ।

(7) मानीटरी सिमित त्येक वषर् की 31 माचर् तक की अपनी वािषर्क कारर्वाई िरपोटर् राज्य के मुख्य वन्यजीव वाडर्न को उपाबंध VI म उपबंिधत रूप िवधान के अनुसार उक् त वषर् के 30 जून तक स्तुत करेगी ।

(8) केन् ीय सरकार का पयार्वरण, वन और जलवायु पिरवतर्न मं ालय मानीटरी सिमित को अपने कृत्य के भावी िनवर्हन के िलए समय-समय पर ऐस ेिनदश द ेसकेगा, जो वह ठीक समझे ।

(9) इस अिधसूचना के उपबंध को भाव दनेे के िलए क ीय सरकार और राज् य सरकार अितिरक् त उपाय, यिद कोई ह , िविन दर्ष् ट कर सकगे ।

7. भारत के माननीय उ तम न्यायालय या उ न्यायालय या राष् ीय हिरत ािधकरण ारा पािरत कोई आदशे या पािरत होने वाले िकसी आदशे, यिद कोई ह , के अधीन, इस अिधसूचना के उपबंध ह ग े।

S.O. 1700(E).—The following draft of the notification, which the Central Government proposes to issue in exercise of the powers conferred by sub-section (1), read with clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is hereby published, as required under sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be affected thereby; and notice is hereby given that the said draft notification shall be taken into consideration on or after the expiry of a period of sixty days from the date on which copies of the Gazette containing this notification are made available to the public;

WHEREAS, the Orchha Wildlife Sanctuary spreads over an area of 45.36 Square Kilometers is located in Tikamgarh district in the State of Madhya Pradesh and is connected with Orchha territorial range and babina range in Uttar Pradesh;

AND WHEREAS, the Orchha Wildlife Sanctuary is extremely rich in flora and fauna.Orchha Wildlife Sanctuary are rich in biodiversity.

AND WHEREAS, Orchha Wildlife Sanctuary contains 4 tortoises species, 16 fish species, 97 bird species and 4 vulture species in Orchha Wildlife Sanctuary and the flora and fauna details are as follows:-

Cheetal (Axis), Blue Bull (Boselaphu stragocamelus), Jackal (Canisa ureus), Barking Deer (Muntiacus muntijak), Indian Fox (Vulpes benglensis), Wild boar (Susscrofa), Hyena (Hyaena hyaena), Indian hare (Leupus nigricollis), Porcupine (Hystrix indica), Black faced monkey (Presbytis entellus), Red faced monkey (Macaca mulata), Bat (Cynopterus sphinx pteropus ginganteus) Mangoose (Herpestes edwardsi), Indian field mouse (Rettus refescena), Chinkara (Gazell gazelle), Five striped palm squirrel (Funambulus pennanti), Jungle cat (Felis chaus), Bigoos (Melivora capensis);

AND WHEREAS, it is necessary to conserve and protect the area,the extent and boundaries of which are specified in paragraph 1 of this notification, around the protected area of Orchha Wildlife Sanctuary as Eco-sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone;

NOW THEREFORE, in exercise of the powers conferred by sub-section(1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent two kilometers periphery of Orchha Wildlife Sanctuary, except at residential area of Orchha town (100 meters periphery) and excluding area of Uttar Pradesh as Orchha Wildlife Sanctuary Eco-sensitive Zone (hereinafter referred to as the Eco-sensitive Zone), in the state of Madhya Pradesh details of which are as under, namely:—

1. Extent and boundaries of Eco-sensitive Zone.—(1)The extent of Eco-sensitive Zone is two kilometres periphery of Orchha Wildlife Sanctuary, except at residential area of Orchha town (100 meters periphery) and excluding area of Uttar Pradesh and the Eco-sensitive Zone is speed over an area of 24.84 square kilometres and boundary description of the said Zone is given at Annexure-I.

(2). The co-ordinates of the Wildlife Sanctuary and Eco-sensitive Zone are given in Annexure-II and III respectively.

(3) The list of 17villagesand their co-ordinates falling under the said Eco-sensitive Zone is annexed as Annexure-IV.

(4) The map of the Eco-sensitive Zone along with boundary details and latitudes and longitudes is appended as Annexure-V.

2. Zonal Master Plan for Eco-sensitive Zone.—(1) The State Government shall, for the purpose of the Eco-sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification.


(2) The zonal master plan shall be approved by the Competent Authority in the State Government.

(3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.

(4) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:—

(i) Environment;

(ii) Forest and Wildlife;

(iii) Agriculture;

(iv) Revenue;

(v) Urban Development;

(vi) Tourism;

(vii) Rural Development;

(viii) Irrigation and Flood Control;

(ix) Municipal;

(x) Panchayati Raj;

(xi) Public Works Department

for integrating environmental and ecological considerations into it.

(5) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the said Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.

(6) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.

(7) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies with supporting maps and the Plan shall be supported by Maps giving details of existing and proposed land use features.

(8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone so as to ensure eco-friendly development for livelihood security of local communities.

(9) The Zonal Master Plan shall be a reference document for the Monitoring Committee for carrying out its functions of monitoring under the provisions of this notification.

3. Measures to be taken by State Government.—The State Government shall take the following measures for giving effect to the provisions of this notification, namely:—

(1) Land use.—

Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for major commercial or industrial activities and such areas shall be clearly defined in the Zonal Master Plan along with maps:


Provided that the conversion of agricultural and other lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of the local residents such as—

(i) widening and strengthening of existing roads and construction of new roads;

(ii) construction and renovation of infrastructure and civic amenities;

(iii) small scale industries not causing pollution;

(iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and

(v) promoted activities as listed in paragraph 4:

Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):

Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:

Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph:

Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.

(2) Natural springs.—The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas as which are detrimental to such areas

(3) Tourism.—(a) All new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.

(b) The Tourism Master Plan shall be prepared by Department of Tourism in consultation with the Departments of Environment and Forests, Government of Madhya Pradesh.

(c) The Tourism Master Plan shall form a part of the Zonal Master Plan.

(d) The tourism activities shall be regulated as under, namely:—

(i) no new construction of hotels and resorts shall be allowed within One kilo-metre from the boundary of the Wildlife Sanctuary or upto the extent of the Eco-sensitive Zone whichever is nearer:

Provided that beyond the distance of One kilometre from the boundary of the Wildlife Sanctuary till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be permitted only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan;

(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism;


(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee.

(4) Natural heritage.—All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc., shall be identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the date of publication of the final notification and such plan shall form part of the Zonal Master Plan.

(5) Man-made heritage sites.—Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of the final notification and incorporated in the Zonal Master Plan.

(6) Noise pollution.—The Environment Department of the State Government or the Madhya Pradesh State Pollution Control Board shall draw up guidelines and regulations for the control of noise pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981(14 of 1981) and the rules made thereunder.

(7) Air pollution.—The Environment Department of the State Government or the Madhya Pradesh State Pollution Control Board shall draw up guidelines and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.

(8) Discharge of effluents.—The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974) and the rules made thereunder.

(9) Solid wastes.—Disposal of solid wastes shall be as under:—

(a) the solid waste disposal in Eco-sensitive Zone shall be carried out in accordance with the provisions of the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357(E), dated the 8th April, 2016 as amended from time to time;

(b) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable components;

(c) the biodegradable material shall be recycled preferably through composting or vermiculture; and

(d) the inorganic material may be disposed in an environmentally acceptable manner at site(s) identified outside the Eco-sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone.

(10) Bio-medical waste.—The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Bio-Medical Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 343(E), dated the 28th March, 2016, as amended from time to time.

(11) Vehicular traffic.—The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master Plan is prepared and approved by the competent authority in the State Government, Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.


(12) Industrial units.—(a) No establishment of new wood based industries within the Eco-sensitive Zone shall be permitted except the existing wood based industries set up as per the law.

(b) No establishment of any new industry causing water, air, soil, noise pollution within the proposed Eco-sensitive Zone shall be permitted.

4. List of activities prohibited or to be regulated within Eco-sensitive Zone.—All activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder, and be regulated in the manner specified in the table below, namely:—

(a) All new and existing (minor and major minerals), stone quarrying and crushing units shall be prohibited with immediate effect except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses and for manufacture of country tiles or bricks for housing for personal construction.

(b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated the 4th August, 2006 in the matter of T.N. GodavarmanThirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated 21st April, 2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012.

2. Setting up of industries causing pollution (Water, Air, Soil, Noise, etc.).

No new or expansion of polluting industries in the Eco-sensitive Zone shall be permitted: Provided that the industries categorised as Green or White in the Central Pollution Control Board Classification including agro-based small scale industries, shall be regulated as per applicable regulations.

3. Establishment of major hydroelectric project.

Prohibited (except as otherwise provided) as per applicable laws.

4. Use or production of any hazardous substances.

Prohibited (except as otherwise provided) as per applicable laws.

5. Discharge of untreated effluents in natural water bodies or land area.

Prohibited (except as otherwise provided) as per applicable laws

6. Establishment of large-scale commercial livestock and poultry farms by firms, companies, etc.

Prohibited (except as otherwise provided) as per applicable laws except for meeting local needs.

7. Setting of new saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone. B. Regulated Activities

8. Commercial establishment of hotels and resorts.

No new commercial hotels and resorts shall be permitted within One Kilometer of the boundary of the Protected Area or up to the extent of Eco-sensitive Zone, whichever is nearer, except for small temporary structures for Eco-tourism activities: Provided that, beyond One Kilometer from the boundary of the


Protected Area or up to the extent of Eco-sensitive Zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.

9. Construction activities (a) No new commercial construction of any kind shall be permitted within One Kilometer from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer:

Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub paragraph (1) of paragraph 3 as per building byelaws.

(b) The construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any.

(c) Beyond one Kilometer it shall be regulated as per the Zonal Master Plan.

10. Small scale industries not causing pollution.

Non-polluting, non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent Authority

11. Setting up of brick kilns. Regulated (except as otherwise provided) as per applicable laws

12. Felling of trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.

(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder.

13. Collection of Forest Produce or Non-Timber Forest Produce (NTFP).

Regulated under applicable laws.

14. Erection of electrical and communication towers and laying of cables and other infrastructures

Regulated under applicable law (underground cabling may be promoted).

15. Infrastructure including civic amenities

Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.

16. Widening and strengthening of existing roads and construction of new roads.

Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.

17. Undertaking other activities related to tourism like over flying the Eco-sensitive Zone area by hot air balloon, helicopter, drones, Microlites, etc.

Regulated under applicable law.

18. Protection of hill slopes and river banks.

Regulated under applicable laws.


5. Monitoring Committee.—The Central Government hereby constitutes a Monitoring Committee for effective monitoring of the Eco-sensitive Zone, which shall comprise of the following namely:— (i) Divisional Commissioner, Sagar -Chairman; (ii) One representative of Non-Governmental Organisations working - Member; in the field of environment (including heritage conservation) to be nominated by the Government of Madhya Pradesh for a period of

three years (iii) An expert in the area of ecology and environment to be -Member;

nominated by the Government of Madhya Pradesh for a period of three years

(iv) Representative of Madhya Pradesh Pollution Control Board -Member;

19. Movement of vehicular traffic at night.

Regulated for commercial purpose under applicable laws.

20. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries.

Permitted under applicable laws for use of locals.

21. Discharge of treated effluents in natural water bodies or land area.
