The way some people talk, you would think therecord business was on the verge of total collapse.All because of a bureaucratic interpretation of acodicil in the Federal Communications Act whichmight cost radio stations some ten or fifteen dollarsto audition most of the new releases in a singleweek, if they had to pay for each reocrd auditionedin that time.

To save that ten or fifteen bucks, we are expectedto believe that radio is going to lay down dead,and that the record business, like some ancientHindu bride, is going to cast itself into the graveout of sheer compassion, misery and helplessness.

But the picture is not quite as dark as it is pro-jected. It is only the screen that is blurred. Afterall, there is still a good deal of bounce and romancein an industry where Elvis Presley's first release intwo years ( despite the FCC interpretation )hasalready passed the one million mark. And CapitolRecords informs us that not since Tennessee Ernie'sSixteen Tons has the label had such an initial reac-tion to a record as to Jeanne Black's He'll Have ToStay. Old Town takes paid space in the trade pressto inquire if business is bad, and answers: "Nothere!"

And where else in modern American business cana few people get together to form a little recordcompany-and with its first outing beat one of thegiants in the industry all the way up the charts.This actually happened to The Madison on Amyvs. The Madison Time on Columbia.

With so much zest and life and opportunity inwhat is still a very much open industry-open fortalent and imagination and business acumen-thingscannot be so bad, after all.

As Archy's Mehitabel used to say, toujours gai,there's life in the old girl yet.

FCC Ruling Suspended1111 As predicted last week in Music Vendor,the FCC's interpretation of Section 317 ofthe Federal Communications Act has beenrescinded until further notice.

The FCC's announcement that the rulingis temporarily lifted now leaves the inter-pretation of the section solely in the handsof the radio stations.

Section 317 stipulates that "all matterbroadcast by any station for which serviceor money . . . is directly or indirectly prom-ised . . . shall at the time of the broadcastbe announced as paid for or furnished."

Since the Federal Communications Actwas passed in 1934, stations have interpret-ed this section broadly.

Jack Schwartz JoinsMusic Vendor Staff Jack Schwartz has left the Long IslandPress to join the staff of Music Vendor asnews editor. This is in keeping with MusicVendor's policy of sound news coverage asa corrective to so much of the puff stuffthat invariably finds its way into many ofthe trade publications. Schwartz, whoserved as a regional reporter for the Press,formerly was on the public relations staffof Grossingers. At The City College, ofwhich he is a graduate, he edited The Cam-pus, an undergraduate newspaper.

Mercury Leads In First QuarterII Mercury Records was the most success-ful label in the nation for the first quarterof the year, according to the Music Vendorcharts.

Mercury led the field placing 19 discsamong the top ten hits. It ran number onefor three consecutive weeks with JohnnyPreston's "Running Bear." This was follow-ed up with the lucrative "Baby," and therevamped version of "Harbor Lights."

Other labels scoring high on the chartsfor the first three months this year wereColumbia, MGM and ABC -Paramount.

MINNEAPOLIS-Adoption of a Code ofEthics by the Disc Jockey Association whichspecifically spelled out that no memberswould accept favors or allow anyone to in-fluence them on record -playing and an offerto the National Association of Broadcastersfor DJA to help NAB in recommendingchanges of Section 317 to the FCC werethe highlights of the first official member-ship meeting of the group held here at thePick-Nicollet Hotel April 8-10.

This was stressed to allay any fears onmanagement's part about the status of DJA.In fact, several top management representa-tives attended the meeting including ToddStorz, head of his five -station radio group;Chuck Blore, vice president of the Crowell -Collier group of stations including KFWB,Hollywood; and Lionel S. Baxter, executiveof the Storer Broadcasting System, Miami.Additionally, other top executives expressedtheir regrets at their inability to attend. JohnF. Box, Jr., managing director of the Bala-ban group of stations, wired his regretsfrom St. Louis stating that union negotia-tions prevented him from coming to Min-neapolis for the conclave but wishing theDJA best success and promising to workwith the group in every way possible. Gil-bert McLendon, too, was unable to attend,being in Europe at the present time.

No record company executives were in-vited to attend the DJA meet and nonewere in attendance. Storz' presence was in-terpreted by many that he himself wouldnot sponsor any more dee-jay conventionsbut that should DJA eventually work out

some arrangement whereby record firmsmight legitimately exhibit their wares atfuture meetings, he (Storz) would supportsuch a move.

Section 317 of the Communications Act

came in for considerable discussion at themeeting. Originally, it was planned to senda two paragraph resolution to the FCC ad-vocating the continued practice of stationsreceiving promotional records but callingfor support of the FCC interpretation where-by record giveaways would be forbiddenat hops or for prizes.

After considerable discussion it was de-

cided to forward any DJA comments to theNational Association of Broadcasters, who

as management representatives, could thenstudy the DJA recommendations and for-ward them on the FCC.

Additionally DJA thought it might behelpful to the NAB if the disc jockeys could"sit in" with the NAB when Section 317discussions were being held and sought per-mission to do so.

The DJA resolution, stated in part, "Themembers of the DJA agree that the receritFCC interpretation of Section 317 needsrevision and offers its complete support tothe NAB resolution seeking relief since theruling vitally concerns the disc jockeys ofAmerica and their association as well asmanagement and as we may be able to offersuggestions in areas where we are, perhaps,more knowledgable, we respectfully solicitan invitation to be represented and contrib-ute whatever and whenever possible to thismatter."

Questions of raising money for the organ-ization were discussed. Turned down wasthe proposal to increase annual dues film$10 to $20, the feeling being that thehigher dues would keep many smaller -towndisc jockeys from joining. President JimHawthorne said that, while temporarily ta-bled, Producer Robert Lippert, releasingthrough 20th Century -Fox, was still inter -

MGM RecordsExpands Staff

MGM Records, in a move to expand itsrecording, sales and sales promotion depart-ments, has added two new members to thestaff and has reassigned two other staffersto new posts.

Sol Greenberg, who had been in chargeof the sales division of the Lion label, nowmoves into single record sales. Greenberg,a veteran with thirteen years' experience inthe record business, has been on the salesstaff of RCA Victor's Newark distributorand with All State, MGM Records' distribu-tor in Newark. He also has a backgroundof retail store experience.

Ed Heller, who has been working on bothsales promotion and A&R, has been assignedto handle A&R work only with particularemphasis on special album tie-in projects.

Harry Anger, Jr., who was formerly asso-ciated with the record divisions of WarnerBrothers and RCA Victor, moves into thepost of sales promotion manager with spe-cial concentration on album sales promotionon the distributor, dealer and consumer lev-els. In this area he will work closely withSol Handwerger who heads advertising,publicity and public relations.

Frank Luther, long active in the recordindustry as writer, director, producer andperformer, joins MGM Records' A&R divi-sion in a special capacity, bringing with himnew concepts of album recording.

Jaro Releasing5 LP's This MonthIII Len Levy, director of Sales for Jaro In-ternational, a division of Rank Records ofAmerica, announced today that Jaro will re-lease five LP's in April. The slogan "SaleInto Spring" will be the theme of the la-bel's merchandising program.

The five albums set to be issued in Aprilare "Hawaii On The Rocks" by GeorgieAuld, "The Message" by J. R. Montrose,"Flaming Guitar" by Jose Motos, "Heart-aches" by Ted Weems and "The Arrival ofKenny Dorham."
