TENDER NOTICE

        Sealed offers / Tenders are invited from the interested parties / agencies preferably Delhi/NCR for the renovation & interior decoration works of R.K. Puram Branch, Shop No-1, Sec-8, R. K. Puram, New Delhi. The gross area of R.K. Puram Branch is 400 sq ft.       

      The detailed eligibility criteria, technical capacity, scope of work, mode of selection, EMD etc. and other terms and conditions are given in the tender document.  The tender document may be purchased from Office of the Khadi Gramodyog Bhavan, Khadi and Village Industries Commission, K Block, Chaudhary Building, Connaught Circus, New Delhi from 19.03.2018 to 02.04.2018 on any working day between 10.00 am to 04.00 pm by paying  Rs 1000/- (Rupees one thousand only) . The last date of submission of bid in the K- Block, Chaudhary Building, Connaught Circus, New Delhi is fixed on 03.04.2018 up to 2.00 p.m. and the tender will be opened at 3.00 p.m. in the same Office. The tender document can also be downloaded from KVIC's website www.kvic.org.in. However, the Tender document cost of Rs. 1000/- (Rupees One Thousand only) have to be paid through by Cash or through D.D. drawn in favor of Khadi Gramodyog Bhavan payable at New Delhi, which should be enclosed along with technical bid at the time of its submission. 

      Interested bidders may submit two separate sealed envelopes, first envelope containing the technical bid along with Demand Draft of EMD amounting to Rs. 50,000/-(Rupees Fifty Thousand only) in favour of Khadi Gramodyog Bhavan payable at New Delhi and second envelope containing Financial Bid.

BACKGROUND

Khadi & Village Industries Commission (KVIC) is a statutory body created by an Act of Parliament working under the administrative control of Ministry of Micro, Small & Medium Enterprises, Govt. of India. The main object of KVIC is providing & generating of employment opportunities in the Country, producing of saleable articles and creating self –reliance amongst the general people and building up a strong rural community spirit.

Khadi Gramodyog Bhavan a unit of KVIC having main showroom at 24, Regal Building, Connaught Circus, New Delhi & its other branches , Godowns are working in the Delhi & NCR. KVIC desires to execute through specialized Agencies the renovation and interior decoration works of R.K. Puram, a branch of KGB, New Delhi at Shop No.1, Sec-8, R.K. Puram, New Delhi.

ELIGIBILITY CRITERIA

(I) The interested agency must have proven track record and having minimum of 3 years experience in Renovation, Interior works and civil works etc.

(II) They should have similar area experience in working in Government, Public or Private Sector Organization. It is mandatory for the bidder to have registered office, branches and operation based in New Delhi & NCR.

(III) TECHNICAL CAPECITY : The bidder shall have completed successfully from start to finish similar work during the past 3 years proceeding (ending last day if month previous to the one in which applications are

invited) (a) Three similar completed works costing not less than the amount equal to 40% of the estimated cost or(b) Two similar completed works costing not less than the amount equal to 50% of the estimated cost or (c) One similar completed works costing not less than the amount equal to 80% of the estimated cost. Documents to be submitted in this regard alongwith technical bid.

(IV) The bidder should submitted client certificate in support of such completed work.

(V) Financial Turnover: Minimum average annual turnover of the bidder during last three years ending 31st March 2017 and Income Tax in similar area should be at least Rs. 1 Crore annually duly supported by the CA’s certificate.

Scope of work-  

The scope of work involves civil construction, furniture, electrical, painting and glass partitions/doors etc. The store should look as per drawings provided and must also be very customer friendly. The details of estimated cost and drawings & designs are placed an Annexure-1.

MODE OF SELECTION

The Tender committee will open the technical bids of the organization / companies/ firm and do preliminary scrutiny to find out whether the applicant fulfill the minimum eligibility prescribed in the tender document Based on which further short listing will be done and financial bids will be opened in respect of short listed parties only before the committee at Delhi. The final selection will be based on lowest financial quote i.e. L-1

The selected fabricator/Contractor shall have to enter in to an agreement with KVIC which shall contain the specific terms and conditions governing the contract.

The decision of KVIC with regard to selection of the fabricator/Contractor will be final binding and no communication in this regard will be entertained.

The bidder shall quote the price as per schedule of rates (financial bid). Evaluation shall be done on the basis of total price quoted by the bidder for entire scope of work.

EMD

Earnest money of Rs. 50000 /- ( Rupees Fifty Thousand only) by Demand Draft in favour of “Khadi Gramodyog Bhawan, New Delhi” should be enclosed with the

technical bid. The EMD deposited shall be refunded in case the work is not awarded. In case the work is awarded, the same will be kept as security deposited till the satisfactory completing of work. The EMD can be forfeited in case of non performance by the vendor bids without EMD shall be rejected outright.

INCOME TAX ASSESMENT ORDER / RETURN and SERVICE TAX / GST REGISTRATION

Bidder shall submit Income Tax clearance certificate for the last Three assessment years on similar area. The bidder shall also submit the copy of registration certificate under service /GST Tax.  

VALIDITY OF TENDER

The tender offer should be valid up to three months from the date of submission of KVIC.

Submission of Audited Balance Sheet The bidding Organization/Company/Firm shall attach the copy of the audited Balance Sheet for the last three years including year ending 31st March 2017, duly certified by Chartered Accountant alonwith Income tax return having turnover of Rs. 1.00 crore and Income Tax paid thereon for last consecutive preceding three years in similar area only. 

Turnover of the Organization of the/Company/Firm

The bidder shall submit the detail of turnover and also enclose latest audited balance sheet duly certified by the Chartered Accountant. The bidding organization/company/firm must have achieved a Minimum average annual turnover during last three years ending 31st March of the previous financial year should be at least Rs 1.00 crore annually in the similar area for the last three consecutive years.

a. Second envelop will contain Financial bid super scribed as “ Financial bid”

Bid without EMD, Income Tax assessment order/copy of IT return/ copy of valid service tax certificate/GST, profile of the agency, minimum required experience and audited statement of accounts duly audited by chartered accountant will be summarily rejected.  

The short listed bidders will have to make power point presentation before the committee on the intimation by this office. Bids complete in all respects should be addressed to:

GENERAL TERMS AND CONDITIONS

1. Earnest money shall be forfeited in the case of :I. Revocation of tender to increase in rates after opening of the tender but

before validity of the quotation expires.II. Refusal to enter into contract after the award of contract.III. On verification of the credential of the successful bidder after the opening

the technical/ financial bid or during execution of the work, if it is found that the details furnished by the successful bidder regarding its location of the office etc. are false or incorrect, in that event the amount of EMD furnished by the bidder will reliable forfeited, apart from initiating other legal action, as deemed fit.

2. The EMD shall be returned to the unsuccessful bidders after the award of the contract.

3. The Contractor should fabricate the KHADI INDIA SALES OUTLET/ LOUNGE as per space allocated by KVIC.

4. The vendor should strictly follow the design details and specifications during execution and carry out work to the complete satisfaction of the Khadi Gramodyog Bhavan.

5. The Contractor should complete the work as per the schedule given in the tender document.

6. The Contractor should be systematic in work as well as in keeping the work place neat and clean. Quality will be of prime importance.

7. The rates should be quoted inclusive of all taxes and training and installation charges etc.

8. The contract shall be subject to the Indian Laws and the jurisdiction of the courts, located in New Delhi. Certificate on company’s letterhead mentioning that no case is pending in any court and no claims are made due to any previous job work dispute done by the company.

9. The Contractor has to abide by the designs of the Chief Architect appointed by KVIC. Every section of work need to be approved by the

architects firm. A pert chart for the time schedule needs to be made by the contactor along with the chief architect. The time lines need to be maintained very strictly and if the contactor is unable to complete the job by the given date/time a penalty of Rs.10, 000 will be levied for each day of delay.

10. All electrical works shall be executed and certified by electrical licence holder (Copy of the licence to be attached with the tender form)

11. All bills will be checked and verified by Chief Architect and without signature and stamp of their firm, payment will not processed by KVIC.

12. The scrap after dismantling the furnitures & fixtures and other equipments should be the property of the KVIC.

13. The KGB/KVIC shall not be responsible or accountable to engaged contractor for the employees, agents, technicians and labourers employed by contractor, fabricator / contractor shall be exclusively responsible for all such personnel engaged on the works for such matters as payment of salary, wages, bonus, compensation in the event of death and accident. Contractor shall keep KGB/KVIC indemnified against all claims and charges made by such personnel inclusive of legal fees.

The criteria for the selection will include understanding of design, specifications, infrastructure and manpower availability and past record in carrying out similar work.

14. The payment will be made in three installments:

A. Advance of 25% will be released along with the work order against bank guaranty of equal amount.

B. 50% payment will be made after satisfactory Renovation & Interior works of Branch of R.K. Puram, New Delhi.

C. Balance 20% payment will be made after handing over the site, clearance of site, and verification/certification of bill by Designer or Design agency.

D. Balance 5% payment will be made after 6 months of defect liability period.

15. The agency should make all arrangements to prevent and safeguard the site from any incident from starting of the work to the finishing of the site.

16. Suggestions given by the Designer during WIP of the sales outlet may be implemented. No extra payment will be made for such types of changes suggested by them.

17. Tenders not properly filled, mutilated, with incorrect calculations or generally not complying with the conditions may be rejected.

18. Any permission/approval needed to be taken from the Govt. Organization /authority, the same shall be obtained by the contractor/bidder

19. TERMINATION OF CONTRACT:

a. If at any time Khadi Gramodyog Bhavan, Khadi & V.I. Commission (KVIC) finds that the work of the Civil Contractor is not satisfactory as per the approved design or the progress of the work is very slow and not of the required speed, Khadi Gramodyog Bhavan can terminate the contract and award the same to one or more parties in the panel to complete the assignment within required time. In such an event, Civil Contractor who has failed in the performance shall be liable for penalty.

b. All instructions, notices and communications etc. under the contract given in writing and if sent to the last known place of the business, shall deem to have been served on the date, even in ordinary post, these would have been delivered to the party.

c. Khadi Gramodyog Bhavan (KVIC) will have the right to reject or accept any offer without assigning any reason thereof and under no circumstances, will be bound to accept lowest offer.

20. ARBITRATION If dispute arise out of or in connection with this contract/agreement, the parties agrees either to seek an amicable settlement of that dispute by cancelation under the ICADR conciliation Rules, 1996 or to submit that dispute to arbitration under the ICADR Arbitration Rules, 1996.

21. PERFORMANCE GUARANTY/ LIQUDATED DAMAGES FOR DAY The EMD of Rs. 1,00,000.00/- will be converted into performance guaranty in case of failure/delay in implementation / completion of work as per schedule.

22. DEVIATION The party must comply with the tender specification and all terms and condition of contract. No deviation shall be entertained unless specifically mentioned by the party i.e KGB/KVIC.

23. TAX DEDUCTION AT SOURCE Income tax and other taxes shall be deducted at source from the running bills as per applicable tax Rules. The tender shall remain valid for acceptance for a period of 30 days from the date of the opening of the tender.

24. Civil Contractor Rates Contractors' Rates   The contractors' rates must include the cost of transportation of material to the site, storage at site, all taxes such as Sales Tax, Service Tax, VAT, GST Excise duty and Octroi etc. and the fixing or placing in position for which the items of work is intended to be operated and dismantling of structure. The Civil Contractor rates must include the cost of all taxes such as sales tax, service tax, VAT, GST excise duty and octori etc.

25. SITE INSPECTION

Every bidder is expected to inspect the site of the proposed work before quoting his rates.  He must also go through all the documents.  It will be construed that the contractor has inspected the site and satisfied himself, at his own cost, and the quoted rates shall hold good in all conditions. 

26. COMMENCEMENT OF WORK / PERIOD OF COMPLETION The Civil Contractor shall commence work on site from the date of award of work or from the date of possession of the site, whichever is earlier and it should be completed within a period of 40 days. Time shall be essence of the contract.

27. Contract signing After acceptance of the tender, the Civil Contractor shall sign the necessary contract papers within seven days of the intimation. Expenses for the agreement including cost of stamp papers etc. shall be bon by the Civil Contractor. In case of delay the Earnest Money’ may be forfeited.

28. Acceptance of Tender The acceptance of the tender will rest with the employer, who does not bind himself to accept the lowest tender and reserves to himself the authority to reject any or all of the tender’s received, without assigning any reason(s). The employers reserves the right of accepting the whole or any part of the tenders received and the contractor shall be bound to perform the same at their quoted rates.

29. Escalation

No escalation on labour, material or any other statutory levy/tax will be paid to the contractor during the execution of the project. No alteration in this Clause will be acceptable. 

The contractor shall execute the contract, aforesaid with best quality of material and workmanship to the fullest satisfaction of KVIC or his authorized representative. 

The contractor shall be responsible for site clearance after the completion of work as well as after end of the fair. 

The contractor shall also do all subsidiary works connected with the principal work, no material service, power (electricity or otherwise) energy, light, water, tools, plants, equipment shall be provided by KVIC for the purpose of execution of the work under this contract. 

The contractor shall create a time line chart and adhere by it and get them approved from Architect/, KVIC or his authorized representative. 

The contractor shall also have Insurance of all his workers and employees, in case of any accident KVIC will not be responsible of any loss. However KVIC will extend all help if there does arise any need at any point of time.

If additional items executed on demand of the department (which is mandatory to be executed) other than the agreement in course of execution it will be paid on the basis of prevailing market rate,

manufacturer’s /seller’s price list allowing 10% of executor profit after adding labor component. 

The work should be executed as per the norms of Lump-sum tender for the works covered under scope of offer and payment would be made in four installments in form of running bills.
