The EPA has reviewed Chevron Mining Inc. - Questa Mine's (CMI's) February 24, 2010 letter and attached Table 1 requesting the inclusion of sixty-two (62) documents to the EPA's Administrative Record for the Proposed Plan. After considering CMI's request, EPA has decided not to reopen the Proposed Plan Administrative Record to include the listed documents. The basis for such decision is provided in the attached table and summarized as follows:

• Ofthe 62 documents identified by Chevron, several were already found to be part ofthe Administrative Record.

• Several others were not included because they were not used in forming the basis of EPA's preference for remedial action. Several of these documents were Molycorp, Inc. or Chevron Mining Inc. response to EPA comments on draft RI/FS documents. Most draft RI/FS documents were not included in the Administrative Record, as well as the responses to EPA comments on those draft documents.̂ The approved fmal RI/FS documents and the EPA comments requiring revision to complete such documents form the basis for EPA's preference for remedial action and are part of the Administrative Record.

It is noted that most draft fmal documents submitted to stakeholders fof review and comment are included, as well as draft documents on risk assessment. EPA has included draft EPA documents on risk assessment because ofthe role Chevron Mining Inc. and its consultants had in participating in the Technical Coordination Group process outlined in the AOC and the Statement of Work attached thereto.

• Other documents were not included because EPA did not actually have a copy and,, therefore, the documents could hot be used in forming the basis for EPA's preference. Some of these are historic documents that were apparently not obtained by EPA or just misplaced. Others prepared by Molycorp, Inc. pursuant to state permitting requirements for reclamation were never provided to EPA, In 2003 and 2004, copies of such documents were not being distributed to EPA and its oversight contractor on a consistent basis, resulting in a written request to the New Mexico ^ Energy, Minerals, and Natural Resources Department's Mining and Minerals Division (MMD) for documents in 2004. The EPA letter requesting such documents is part of the Administrative Record.

• One document listed by CMI was actually prepared after EPA closed the Administrative Record for the Proposed Plan.^Therefore, it cannot be used in forming the basis for the preferred remedy.

Although EPA has elected not to reopen the Administrative Record for the Proposed Plan to include these documents, CMI has submitted them during the public comment period and, therefore, they will be added to the final Administrative Record file for the Record of Decision (ROD), as will Chevron's February 24, 2010 transmittal letter. As part ofthe ROD Administrative Record, they will help form the basis for final decision-making by EPA.
