How to Flag Cayman: A Summary
031 General1.1 Types of Ship Registration
Cayman offers five vessel registration options: Full; Interim;Provisional; Under Construction;and Demise (Bareboat) Charter.
1.2 Main Elements of Ship Registration
Flagging into Cayman involves five main sets of activities; theapplicability of each set depends upon the vessel registrationoption pursued. These are:

1.3 Registration of Mortgages
Mortgages on vessels may also be registered; prohibitions mayalso be recorded where there exists a duly completed mortgagedocument. Mortgage Priority Notices can be recorded prior toreceipt of an executed mortgage document.
1.4 Additional Requirements and Certification for Commercial Vessels
For Commercial Vessels (merchant ships and commercial yachts)there is a set of parallel activities (i.e., parallel to the registration
process) consisting of safety and operational complianceinvolving the issue by a Cayman surveyor/auditor (or by one ofthe seven Classification Societies2authorised to act on behalfof Cayman) of the relevant Convention or statutory certificates.A Glossary of the Key Certificates is provided onpage 24.
The absence of such certificates does not necessarily prevent aship from being registered (e.g. the ship may legitimately be laidup at the time of changing to the Cayman flag or may not yetbe ready to sail for whatever reason) but a commercial vesselcannot operate without them. Under normal circumstances, thesurveys and audits for these Convention and statutory certificatesare dealt with during the registration process so the vessel
can continue operating as soon as registration is completed.
1Establishing whether the owner as presented qualifies to own a Cayman-flagged vessel as evidenced by copies of the relevant passport(s) pages, if an individual(s) or a Certificate of Good St anding or equivalent, ifa company or other shipping entity registered in a qualifying coun try or in a dependency or overseas country or territory of a qualifying country. Qualifying c ountries include the 30 members of the EEA or EuropeanEconomic Area, comprising the 27 EU or European Union countries of Austria, Belgium, Bulgaria, Cyprus (Greek sector), Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland,Italy, Latvia, Lithuania, Luxemburg, Malta, Netherlands, Poland, Portugal, Romania, Slovak Republic, Slovenia, Spain, Sweden, UK, plus Iceland, Liechtenstein and Norway. Additionally, countries included in theThird Schedule of the Money Laundering Regulations (2006 revision), as may be amended from time to time. At the time of publication these included (in addition to some already listed above) Argentina, Australia,The Bahamas, Bahrain, Barbados, Brazil, Canada, Israel, Japan, Mexico, New Zealand, Panama, Singapore, Switzerland, Turkey, the United A rab Emirates, and the USA. Therefore, even though a vessel may meet all ownershiprequirements for registration and all supporting documentation isprovided, registration of the vessel may be declined for safety andoperational reasons.
1.5 Transfer of Registration to Cayman from Other British Registers
Where a vessel is transferring from another British Red EnsignGroup (REG) Register1(e.g. Isle of Man), Cayman may issuenew statutory certificates with the same expiry dates withoutnecessarily undertaking the underlying Convention andstatutory surveys at flag-in.
1.6 Submitting Documents, etc.
All forms and supporting documentation may be provided eitherin originals or electronically. If provided electronically, it must beaccompanied by an Undertaking (see Form CISR 856, [5iii]) todeliver the originals/certified hard copies within 7 days, which canbe submitted to any of the Cayman Registry locations (please visitwww.cishipping.com ).
The signatures may be witnessed by a Registrar of British Ships, aJustice of the Peace, a Notary Public, or the equivalent.
2 Specific Steps Towards Full RegistrationProvided below is a 5-step summary illustration of the key steps
and decisions involved in flagging-in a vessel to Cayman. Pleasenote, however, that these steps are not necessarily sequential asmultiple steps might be undertaken simultaneously or in advanceof each other despite sequential numbering.
2.1 Step 1 - Qualifying Vessel and Vessel Name
a Merchant Ships and Commercial Yachts
For existing commercial vessels (merchant ships orcommercial yachts) it should first be established if thevessel would be accepted for registration by contacting:[email protected]. The applicant should clearly statethe name, age and IMO number of the vessel
b Private Yachts
For pleasure yachts in private use not engaged in trade,there are minimum Convention and statutory requirements.These include but are not limited to the appropriate sectionsof SOLAS, MARPOL 73/78, COLREG (Annex 1, page 11).
Pleasure yachts in private use not engaged in trademay, however, opt to voluntarily comply with the LargeCommercial Yacht Code (LY2).
c Qualifying Vessel Name - All Vessels
Establish whether the vessel name or proposed name is
available by conducting a name check at www.cishipping.comor by contacting [email protected]. Onceestablished that the name is available, approval may begranted by the Registrar and the name reserved.

2.2 Step 2- Legal Title and Qualifying OwnershipStructure - All Vessels
Establish whether one (individual or joint-owner) has legal title tobe registered or can reasonably be expected to have such in theimmediate future and is qualified to own a Cayman-registeredvessel or, alternatively, establish what type of legal ownershipstructure (company or other shipping entity) one would need toform or already have formed to qualify to own a Cayman-flaggedvessel.
If the owner of the vessel (individual or joint-owners or companyor shipping entity) is not resident or incorporated in Cayman,then a Cayman Representative Person resident in Cayman mustbe appointed to act on behalf of the owner(s) on matters withinCayman. See Step 4 (below). This appointment must be made
as part of the vessel registration application. There are severalCayman maritime services providers that offer this facility. Seewww.cishipping.com.
2.3 Step 3- Dealing Directly with the Registry or Via a Third Party Service Provider
In the initial stages of registration, any shipping entity(individual(s), joint-owners or company) may deal directly withthe Cayman Registry or act through a third party with respect tothe submission of documentation. Depending on the ownershipstructure and location of the owner, owning company orother shipping entity, an Authorised Person and/or a CaymanRepresentative Person may be or may need to be appointed. Forfurther guidance see Step 4 (below).
2.4 Step 4- Registration Forms, SupportingDocumentation and Fees
This section highlights, in some detail, various proceduresrequired and forms and documentation to be submittedto complete a full registration. Various forms and requiredsupporting documentation are also explained. InterimRegistration is dealt with in Section 4.

a Forms Required
CISR 854
Vessel Name Proposal and ReservationComplete this form to reserve a vessel name. Once thename has been reserved, all other relevant forms belowshould be submitted if full registration is to be pursued atthis point. If full registration is not pursued at this point, thename may be held for 12 months initially, with an option torenew. This form may be signed by an Owner, AuthorisedPerson, Cayman Representative Person or other partiessubject to approval of the Registrar.
CISR 855Appointment of an Authorised Person
An Authorised Person is, by virtue of this appointment,authorised to complete, sign and submit the Declarationof Ownership for a company/body corporate, individualor joint-owners and all other forms and supportingdocumentation submitted in relation to the vessel. Theindividual/joint-owners must use this form if they wish toappoint an Authorised Person to act on their behalf. Note,however, that where there is an individual owner or jointowners (individuals) resident in Cayman, these parties mayact on their own behalf.
In cases where the ship is owned by a company/bodycorporate the form must have the seal of that company/body corporate affixed, or if not possible, the signature onthe form should be witnessed by a Notary Public or theequivalent in the relevant jurisdiction.
In cases of individual or joint-owners, the form must besigned by the owner or joint-owners and notarised. In thecase of joint ownership, however, the joint owners mayappoint by Power of Attorney one person to act on theircollective behalf, as an alternative. The Power of Attorneymust also be provided to Cayman as evidence of thisagreement. The Authorised Person may or may not beresident in Cayman and a company or a shipping entity mayappoint more than one Authorised Person.

Person may also be appointed as an Authorised Personunder form CISR 855 and may also complete, sign andsubmit the Declaration of Ownership for a company/bodycorporate, individual or joint owners and all other formsand supporting documentation submitted in relation to thevessel.
CISR 856 (4)Undertaking to act as a Cayman Representative Person
The Cayman Representative Person must sign this sectionof the Form as evidence of acceptance to act in the relevantcapacity.
CISR 856 (5i)Declaration of Private Use (Pleasure Vessel)
Complete this section of the form if the vessel is to be usedsolely for private use. This is used only for pleasure yachtsnot to be engaged in trade.
CISR 856 (5ii)Undertaking to Mark Vessel and Return Carving & MarkingNote
Complete this section of the form where a Certificate ofRegistry is to be issued prior to its receipt of a completedCarving & Marking Note. This is an undertaking to have thevessel marked with its Port of Registry, Official Number,IMO Number (if applicable) and Net Tonnage (for vessels 24metres and over in length) or Register Tonnage (for vessels
under 24 metres in length) within 21 days of the issue date ofthe vessels Certificate of Registry.
CISR 856 (5iii)Undertaking to Submit Original Documents within 7 Days
Where electronic documents have been accepted tofacilitate timely registration, complete this section ofthe form to undertake to deliver the originals of thesedocuments within 7 days of the issue date of the vesselsCertificate of Registry.
CISR 856 (1)Application for Registration in Cayman
Complete this section of the form to register a vessel. Thismust be signed by an Owner or Authorised Person.
CISR 856 (2a)Vessel Details
Complete this section of the form to provide vessel details(type of ship, measurements and tonnage.
CISR 856 (2b)Declaration of Ownership or Eligibility onBehalf of a Company/Body Corporate
The Owner or Authorised Person declares that the owningcompany/body corporate is qualified to own or may be
eligible to own a Cayman-registered vessel.CISR 856 (2c)Declaration of Ownership or Eligibility on Behalf of anIndividual
The Owner or Authorised Person declares the individualis qualified to own or may be eligible to own a Cayman-registered vessel.
CISR 856 (2d)Declaration of Ownership or Eligibility on Behalf of JointOwners
The Owner or Authorised Person declares the joint-owners
as a collective body are qualified to own or may be eligibleto own a Cayman-registered vessel. Qualified persons mustown the majority of shares (at least 33) out of the 64 sharesin a vessel. The remaining 31 shares may be owned bypersons not qualified to own a Cayman-registered vessel.
CISR 856 (3)Appointment of a Cayman Representative Person
This is necessary where the individual/joint-owners arenot Cayman nationals or permanent residents or whenowning companies have been incorporated in a qualifyingjurisdiction other than Cayman. The Cayman RepresentativePerson is, by virtue of this appointment, the owners officialrepresentative in Cayman. The Cayman Representative

CISR 856 (5iv)Undertaking to Provide a Bill of Sale andDeclaration of Ownership within 21 days
Complete this section of the form where an InterimCertificate of Registry valid for 21 days is to be issued,pending receipt of a Bill of Sale and Declaration ofOwnership. In the interim, the Owner or Authorised Personmust submit a Declaration of Eligibility for Ownership for thepotential new owner which may be form CISR 856 2a, 2b or2c, depending on ownership structure. See Section 4 (page08) for Guidance on Interim Registration.
CISR 857Application for Miscellaneous Services
Complete the relevant sections of this form for the particular
services being requested: Mortgage Registration, VesselDeletion, Transcripts of the Register, Change of Vessel Type(Pleasure Yachts to Commercial Vessels), etc. This form mustbe signed by an Owner or Authorised Person.
Note: Registration forms may be obtained from the CaymanRegistry or downloaded from www.cishipping.com.
b Supporting Documentation Required
To complete full registration the following supportingdocumentation is required:
Proof of Title (e.g. Builders Certificate or Bill of Sale)
Cayman Islands Certificate of Good Standing or CertifiedCopy of Passport(s)
An original Cayman Islands Certificate of Good Standing isrequired for vessels owned by either a Cayman companyor other shipping entity. Where the owning body isincorporated outside Cayman then proof of its goodstanding in accordance with the Laws of the relevantjurisdiction is required. For vessels owned by an individualor jointly-owned by individuals, a certified (or notarised)copy(ies) of the individuals or individuals passport pagesthat shows the individual or joint-owners photograph(s),nationality(ies), and signature(s), is/are required.
Certificate of Survey or Declaration of Particulars
A Certificate of Survey or Declaration of Particulars, in
the case of a vessel under 24 metres, will be requiredfor the registration of vessels with the Cayman Registry.Arrangements for the issue of the Certificate of Survey aremade between the Owner (or a Cayman RepresentativePerson) and a Cayman Registry surveyor, one of the sevenauthorised Classification Societies (see footnote 2, page03) or with another surveyor authorised by the CaymanRegistry. It is in the Owners interest to provide as muchinformation as available regarding vessel tonnage andparticulars.
Tonnage Certificate
For existing vessels, a copy of the International Tonnage
Certificate (issued under the International TonnageConvention) is required for all vessels 24 metres in lengthor more.

2.5 Step 5- Carving and Marking
A Carving & Marking Note (C&M Note) will be issued at the
appropriate juncture which will specify how the vessel is to bemarked. Once properly marked, an authorised surveyor will verifythis by signing and returning the C&M Note to the Registrar.
The vessel may be registered prior to the return of the C&M Noteunder the arrangement set out in the undertaking referred to onpage 6and in form CISR 856 5 (ii), providing all other registrationrequirements have been met.
2.6 Issuance of Certificate of Registry and Tonnage Certificate
Once Cayman has received all relevant forms, supportingdocumentation, information and fees, a Certificate of Registry isissued along with the relevant Tonnage Certificate (A previously
issued Tonnage Certificate may remain valid for up to 3 monthsafter registration).
3 Related Matters3.1 Ship Radio Station Licence (SRSL)
If the vessel is fitted with a radio transceiver, a Ship RadioStation Licence is required; this should be applied for with theInformation & Communication Technology Authority atwww.icta.ky.
3.2 Carriage of Emergency Position Indicating Radio Beacon(EPIRB)
SOLAS Convention passenger ships and cargo ships of 300GT and upwards are required to carry an EPIRB. These may beobtained from relevant suppliers and must be properly registeredbefore use. Other vessels may carry an EPIRB voluntarily but if so,similar requirements are to be met.
3.3 Registration of EPIRBs
Cayman does not maintain an EPIRB database; therefore all vesselowners should register their EPIRBs with either NOAA in the USA(www.beaconregistration.noaa.gov) or with HM Coastguardin Falmouth, UK ([email protected]). Both authorities acceptEPIRB registration information for Cayman-flagged vessels. It isthe sole responsibility of the vessel owner (or authorised Caymanrepresentative) to ensure proper registration of EPIRBs.
4 Interim Registration During Transfer ofOwnership
4.1 Circumstances Under Which Interim Registration May Be Utilised
This arrangement applies where an existing vessel is transferringinto Cayman involving change of owner from a non-qualified toa qualified owner. Under these circumstances the Interim processallows registration for up to 21 days under the Cayman Flagto proceed before a Bill of Sale has been submitted, providingcertain conditions are met.
4.2 Conditions To Be Met
To proceed with an Interim Registration the following conditionsmust be met:
a A written contract must exist between the current ownerand the transferee under which the current owner agrees:
to transfer the ship to the owner qualified to own aCayman ship; and
to provide the transferee with a Bill of Sale and a certificatestating that the ship is free from encumbrances;
AND
b The transferee must make a declaration:
confirming the transferees eligibility to qualify as theowner of a Cayman ship; and
stating that a written contract exists for the transfer of theship as agreed.
4.3 Documentation Required and Issue of Full Certificate ofRegistry
Notarised copies of the contract and the declaration referred toabove will need to be submitted to the Registrar. In addition allother forms, documentation and fees, etc., with the exceptionof the Bill of Sale and Declaration of Ownership, must have beensubmitted and satisfactorily processed as for full registration. AnInterim Certificate of Registration, valid for up to 21 days, will thenbe issued.

The Bill of Sale and Declaration of Ownership must be submittedto the Registrar upon completion of the sale and within 21 daysof the date of issue of the Interim Certificate of Registry. Uponreceipt of these, the vessel can be permanently registered and afull Certificate of Registry issued.
5 Additional Requirements for CommercialVessels Other Than Passenger Ships
5.1 Application and Submission of Documents
a Request for Survey and Certification Services
Notification that the vessel requires the relevant surveys,inspections and certification should be made to theCayman Registry Survey Section, where such notification
has not already been addressed under the registrationapplication process. Relevant fees or an agreed depositshould be submitted to the Cayman Registry at this time oras otherwise agreed on a case by case basis with the surveysection via [email protected].
b Submission of Documents
Documents to be submitted include but are not limited to:
A General Arrangement Plan
Stability Information Booklet
An SMPEP/SOPEP manual (for approval)
A Ship Security Assessment & Ship Security Plan (for approval) A Continuous Synopsis Record (CSR) application together
with copies of previous CSRs
A Minimum Safe Manning Document application
Officers Endorsement application(s)
Copies of all Documents of Compliance (DOC) held by themanagement company or the ships managers
Letter from owners appointing managers at the company as per International Safety Management (ISM) Code 3.1.
Where possible, copies of all current statutory certificatesshould also be submitted.
5.2 Procedure
a Ship Surveys and Certification
Arrangements will need to be made regarding the timeand place the ship is available for flag-in. Depending onCaymans assessment of the vessel, flag-in surveys andinspections may be conducted by one of the Caymanauthorised Classification Societies (see footnote 2, page 03)
or by a combination of Class and a Cayman surveyor.b Manning & Crew Compliance
Number and Qualifications of Crew General
In the case of commercial vessels (merchant ships or yachts)establish whether or not the proposed manning levels andproposed crew qualify to serve on-board Cayman-flaggedvessels by contacting [email protected]. The ManningLevels atAnnex 2a-2c, pages 12-13, are used as a guide onlyin determining the appropriate manning for a Cayman ship.Caymans crew qualification endorsement procedures arebased on STCW 1995, as amended.
Master & Officer Certificates of Competencyand Cayman Endorsements
Crew members of Cayman-registered vessels may hold anynationality or residency. Masters and officers are requiredto hold Certificates of Competency issued by one of theSTCW 1995 White List countries recognised by Cayman1,

and for which, where appropriate, it issues Endorsementsattesting to the recognition of such Certificates. Cayman willconsider seafarer medical (fitness) certificates issued by mostcountries provided these are issued in accordance with therelevant International Maritime Organization/InternationalLabour Organization (IMO/ILO) Conventions.

Minimum Safe Manning Document (MSMD)
To ensure all vessels are sufficiently, efficiently and safelymanned with properly trained and certified personnel,Cayman issues a Minimum Safe Manning Document (MSMD)
under provisions of Chapter V (Safety of Navigation) ofSOLAS 1974, as amended, to all ships to which Chapter I ofSOLAS applies. For pleasure yachts engaged in trade, theMSMD is issued in accordance with the Large CommercialYacht Code (LY2 Code).
Cayman will issue the MSMD for each vessel as follows:
Merchant vessels over 500 GT (mandatory)
Merchant vessels under Caribbean Cargo Ship Safety Code(mandatory)
Pleasure yachts engaged in trade and over 500 GT(mandatory)
Pleasure yachts not engaged in trade and over 500 GT(voluntary)
Pleasure yachts under 500 GT (whether engaged in trade ornot) may be issued guidance by the Cayman Registry uponrequest.
To apply for an MSMD, complete either form CISR 750 orform CISR 750a, which may be obtained from the CaymanRegistry or downloaded from www.cishipping.com. Clientsmay also contact [email protected] for assistance.
Seamans Discharge Books
Every bona-fide seafarer on a Cayman-registered vessel is also
eligible to be issued (upon request and submission of the requiredsupporting documentation) a Cayman Seamans Discharge Book(SDB). An SDB is a seafarers official record of service and currentemployment status. However, this is not mandatory as an SDBfrom another Administration is acceptable.
To apply for an SDB, complete form CISR 513, which may beobtained from the Cayman Registry or downloaded fromwww.cishipping.com. Clients may also [email protected] request advice andassistance.
5.3 Ship Radio Station Licence (SRSL)
It is essential that owners or managers make timely applicationto ICTA for the issue of an SRSL, since the statutory Cargo ShipSafety Radio Certificate cannot be issued without a valid SRSL.(See SRSL on page 08 under Related Matters)
6 Passenger ShipsAll matters relating to internationally operated passenger vesselswill be dealt with on a case-by-case basis through consultationbetween the Cayman Registry and the owner or operator of suchvessels. Clients may also contact [email protected].

Issued to indicate compliance with the relevant parts of ChapterIII and Chapter V of the International Convention for Safety ofLife at Sea, SOLAS, 1974, as amended. This specifically covers theprovision of life saving equipment, such as life boats, life rafts, lifejackets, etc. and also covers equipment for safe navigation, suchas radars, compass, echo sounders, etc.
Cargo Ship Safety Radio Certificate
Issued to indicate compliance with Chapter IV of SOLAS, 1974, asamended, and covers radio communications to comply with therequirement of the Global Maritime Distress and Safety System,which is essentially a global communication system to aid withdistress and search and rescue functions.
Certificate of Compliance for Large CommercialSailing and Motor Vessels
Issued to indicate compliance with the Code of Practicefor Safety of Large Commercial Sailing and Motor Vessels,introduced in 1998 and revised in 2004. The Code of Practice,with the appropriate cross references provides a one stopshop to address the requirements of the various InternationalConventions as defined above, in a yacht-specific and above allyacht-compatible manner.
Certificate of Good Standing
A certificate issued by a Companies Registry attesting to the factthat a company is in good standing and has filed all necessaryreturns and fees.
Certificate of Survey
This Certificate is not strictly speaking a survey document but itcontains the tonnage and other particulars of the vessel whichwill be entered in the Register, therefore registration cannotnormally proceed without it.
International Air Pollution Prevention Certificate
Issued to indicate compliance with Annex VI of the InternationalConvention for Prevention of Pollution from Ships, MARPOL 1973,as amended. Annex VI introduces measures to reduce damageto the environment through control of emissions generated byexhaust gases and refrigerant materials. This includes provisionof fuel-efficient and low-emission engines and restrictions in thesulphur content of fuels.
International Load Line Certificate
The International Load Line Certificate is issued to indicate
compliance with the requirements of the InternationalConvention on Load Lines, 1966, as amended. The Load LineConvention essentially covers water-tight and weather-tightintegrity, protection of personnel on deck, and the marking offreeboards to prevent overloading; with freeboard being definedas the distance between the deck and waterline in the deepestloading condition.
International Oil Pollution Prevention Certificate
Issued to indicate compliance with Annex I of the InternationalConvention for Prevention of Pollution from Ships, MARPOL1973, as amended. Annex I introduces measures to controlthe risk of environmental damage specifically caused by oil.The Annex provides for the retention, filtering and controlleddischarge of oil and oil-contaminated water on board ships toapproved reception facilities rather than the worlds oceans.
International Sewage Pollution Prevention Certificate
Issued to indicate compliance with Annex IV of the InternationalConvention for Prevention of Pollution from Ships, MARPOL 1973,as amended. Annex IV introduces measures to reduce damageto the environment caused by the discharge of sewage fromships. This provides for the retention and treatment of sewageproduced on board ships and by introducing strict controls onthe discharge of treated and untreated sewage.

International Ship Security Certificate
Issued to indicate compliance with Chapter XI-2 of SOLAS 1974,
as amended, and the International Ship and Port Facilities Code.This introduces procedures to protect the ship from terrorist orpiracy attacks or similar security threats and also to protect thePorts in which they operate from such identified threats.
Safety Construction Certificate
Issued to indicate compliance with Chapter II-1 and ChapterII-2 of SOLAS, 1974, as amended. This essentially covershull and machinery construction, vessel stability and sub-division requirements, and passive and active fire protectionrequirements.
Safety Management Certificate
Issued to indicate compliance with Chapter IX of SOLAS 1974,as amended, and the International Safety Management Code.This introduces procedures for the effective management,safe operation, emergency preparedness and preventativemaintenance to ensure safe ships and cleans seas.
Key TermsAuthorised Person
Under Section 4 of the Merchant Shipping Law (2008 Revision),the individual authorised is required to sign and make adeclaration of eligibility, whether for himself or on behalf of a
body corporate, that he or the body corporate is in fact qualifiedto be registered as owner of a Cayman ship. The AuthorisedPerson may also sign other forms and provide supportingdocumentation on behalf of the owner, as may be required fromtime to time. See also Cayman Representative Person.
Bareboat Charter
A private agreement between two parties, individual or bodycorporate, whereby the shipowner leases an entire ship to thecharterer for a particular reason (e.g. conveyance of goods). Theshipowner effectively gives the whole possession, operationand control of the ship over to the charterer. The charterer thenbecomes for the time the owner of the vessel, allowing him to
register with a flag state of his choice. See also Demise Charter.
Bill of Sale
A contract for the sale of a vessel which includes the vessels
description, sales price, buyers name, original signature of seller,and date.
Builders Certificate
A certificate signed by the builder of a ship and containing atrue account of the particulars of the ship, as estimated by him,and of the date and place where it was built, and of the name ofthe person, if any, for whom, the ship was built, or name of theperson to whom it was delivered.
Cayman Representative Person
Under Section 5, as amended, of the Merchant Shipping Law(2008 Revision) a ship owned by a non-resident individual or
company may only be registered if a Representative Personis appointed locally for the purpose of receiving notices andother documents pertaining to the non-resident shipowner.A non-resident company is defined as a company that is notincorporated locally and does not have a place of business inCayman. Charterer
A person or firm who enters into a contract with a shipowner forthe transportation of cargo or passengers for a stipulated periodof time. Also includes a Bareboat or Demise Charterer. See alsoDemise Charteror Bareboat Charter.
Charterparty
A contract or agreement by which a shipowner agrees to lease, anda charterer agrees to hire, an entire ship, or all or part of the cargospace to carry cargo for an agreed sum under certain conditions.

Convention on International Regulations for Preventing Collisions
at Sea.Demise Charter
Also called a bareboat charter in which the bare ship is charteredwithout crew with the charterer, for a stipulated sum, taking overthe vessel with a minimum of restrictions. See also BareboatCharter.
DWT
Deadweight tonnes is a measure of the total weight a vessel cancarry when loaded down to its marks, including the weight ofcargo, fuel, stores, water ballast, fresh water, crew, passengersand baggage. See also GT.
EPIRB
Through the use of satellites, an Emergency Position IndicatingRadio Beacon is meant to help rescuers locate marine vessels inan emergency situation. These satellite-linked EPIRBs broadcasta unique, repeating distress signal that can be detected fromvirtually any point on earth. When properly registered, the signalincludes a description of the vessel as well as its location. Anactivated EPIRB will send critical information via satellite thatis routed directly to rescue units thereby reducing search timedramatically. See also MMSI.
Flag State
The common legal understanding of flag state is theadministration or government of the State whose flag a ship isentitled to fly.
GT
Gross Tonnage is the total volume of all enclosed spaces of aship usable for carrying cargo or passengers measured in cubicmeters using a standard formula under the International TonnageConvention for vessels 24 metres and above or under nationalregulations for ships under 24 metres in length. The International Labour Organization is the United Nations
specialised agency which formulates international labourstandards in the form of Conventions and Recommendations,setting minimum standards of basic labour rights.
IMO
The International Maritime Organization is the United Nationsspecialised agency responsible for prescribing internationalstandards for safety of life at sea, marine security and protectionof the marine environment.
ISM Code
The International Safety Management Code requiresdevelopment and implementation of a safety management
system which addresses all of a companys activities onshoreand on board its ships. The Code places the responsibility forthe safety of ships and the prevention of pollution where it trulylies, within the company management structure. This means thewhole organisation is responsible for safety, not just the shipsmaster or shore-based manager. This code is mandatory and fallsunder SOLAS Chapter IX.
Large Yacht Commercial Code (LY2)
Large means 24 metres and over in load line length and the Codeof Practice applies to yachts which are in commercial use forsport or pleasure, do not carry cargo, and do not carry more than12 passengers.
MACI
An acronym for the Maritime Authority of the Cayman Islands,a statutory corporation formed as a separate legal entity underthe Maritime Authority of the Cayman Islands Law (2005) whichcame into effect on July 1, 2005. MACI is wholly-owned by theGovernment of the Cayman Islands but governed by a Boardof Directors. It is the parent organisation of the Cayman IslandsShipping Registry, established in 1903 in the port of George Town.These are the legal structures that are today referred to simply asCayman Maritimeand Cayman Registry.

MARPOL
The International Convention for the Prevention of Pollution
of Ships, 1973, as modified by the 1978 Protocol, is the maininternational convention covering prevention of pollution ofthe marine environment by ships from operational or accidentalcauses and governs the design and equipment of ships;establishes a system of certificates and inspections; and requiresstates to provide reception facilities for the disposal of oilywaste and chemicals. It combines two treaties adopted in 1973and 1978, respectively, and has been updated by amendmentsthrough the years. MARPOL currently includes 6 technicalAnnexes dealing with oil, noxious liquid substances, harmfulsubstances, sewage, garbage, and air pollution, respectively.

Maritime Mobile Service Identity is a unique 9-digit numberassigned to a ships radio station. This radio technology allowsenhanced distress radio messages to be sent digitally.
