Variance Application - 6317 NW 1 Place

A Variance is a relaxation of the terms of the Zoning Ordinance where such action will not be contrary to the public interest and where owing to conditions peculiar to the property and not the result of actions of the applicant, a literal enforcement would result in unnecessary and undue hardship on the property . As used in the Zoning Ordinance, a Variance is authorized only for height, area, size of structure, dimensions of yards, other open spaces, off-street parking and/or loading requirements (see Article 19 of the Zoning Ordinance) .

(a) Special conditions and circumstances exist which are peculiar to the land, structure, or building involved and which are not applicable to other lands, structures, or buildings in the same zoning district in that :

This property is located in an older neighborhood which was platted many years ago. These lots are smaller than standard lots and further restricted by zoned rights of way.

(b) The special conditions and circumstances do not result from actions of the petitioner in that : These special conditions are the result of platting and right-of-way zoning decisions made by the CitylCounty prior to acquisition of the property by Habitat for Humanity.

(c) Literal interpretation of the provisions of the Zoning Ordinance would deprive the applicant of rights commonly enjoyed by other properties in the same zoning district under the terms of the Zoning Ordinance and would work unnecessary and undue hardships on the petitioner in that: Development of an affordable single family home would not be possible .

(d) Granting the Variance requested will not confer on the petitioner that special privilege that is denied by the Zoning Ordinance to other lands, buildings, or structures in the same zoning district in that : No special privilege will be conferred.

(e) The Variance, if granted, is the minimum Variance that will make possible the reasonable use of the land, building or structure in that : Miami Habitat builds standard model homes; the variance requested is the minimum necessary for development of a standard Miami Habitat house.

(f) The grant of the Variance will be in harmony with the general intent and purpose of the Zoning Ordinance, and will not be injurious to the neighborhood, or otherwise detrimental to the public welfare in that : Granting this variance will provide an opportunity to enhance this neighborhood with new construction of an affordable owner-occupied home on a lot that has been vacant for many years.

when due . In the event that the Property is ever declared to be "immune" or "exempt" from the payment of ad-valorem taxes, the Grantee and Grantee's beneficiaries agree, for themselves and any successor in interest, to pay to the City an annual payment which shall be in an amount equal to the amount the City would have received as ad valorem taxes based on the valuation method employed by the county property appraiser pursuant to Chapter 193 Florida Statutes, as amended from time to time ; and

Title to the Property shall immediately and automatically revert to and vest in the Grantor in the event that : (a) the Grantee has not commenced construction, to the satisfaction of the Grantor in its sole judgment, of one (1) single family home on the Property within twelve (12) months from the date hereof, and/or (b) such single family home has not been completed (as evidenced by the issuance of a Certificate of Occupancy) and sold to a qualified Low Income homebuyer (as defined in the HOME Investment Partnerships Program Regulations, 24 C.F.R. Part 92) within thirty (30) months from the date hereof, or such later date as may be approved by the City Commission of the City of Miami .

To Have and To Hold, the same together with all and singular tenements, hereditaments and appurtenances thereto belonging or in anywise appertaining, and all the estate, right, title, interest, lien, equity, and claim whatsoever of the Grantor, either in law or in equity, to the use, benefit and behalf of the Grantee forever.

WHEREAS, there is a pressing need for decent, affordable housing in the City of Miami ("City") ;

WHEREAS, the City recognizes the need to develop affordable housing for low and moderate income families and individuals ; and

WHEREAS, Habitat for Humanity of Greater Miami, Inc. has extensive experience in housing development; and

WHEREAS, said agency has built more than four hundred and fifty homeownership units for first-time, low income homebuyers since its opening in 1989;

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA :

Section 1 . The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section .

Section 2 . The City Manager is authorized{1} to convey, with parcel reverter provisions, nine (9) City-owned vacant parcels of land, described in "Exhibit A," attached and incorporated, to Habitat for Humanity of Greater Miami, Inc. for the development of affordable housing opportunities for eligible low and moderate income persons.

Section 3. The City Manager is further authorized{1} to execute all necessary documents for said purpose {1}.

Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor (2).
