Officer Narcotic Control Bureau, JT 1999(5) SC.  It was held that: “It is well settled that at the stage of framing charge,  the court is not expected to go deep into the probative  value  of   the  material  on   record.     If   on   the  basis  of  material   on   record,   the   court   could   come   to   the  conclusion that the accused would  have committed the  offence, the court  is obliged to frame the charge and  proceed with trial.   Our known Hon'ble High Court in  case titled as Sapna Ahuja Vs. State 1999 (5) AD Delhi  407 has observed that at the time of framing of charge  FIR   and   the   material   collected   by   the   investigating  agency cannot be sieved through the call ender of the  finest gauzes to test its veracity.   A roving inquiry into  the pros and cons of the case by weighing the evidence  is  not expected or warranted at   the stage of   framing  charge.”

    In the present case,  perusal  of charge sheet,  statement of witnesses recorded U/s. 161 Cr.P.C and other material available on record shows prima facie case against the accused for the offence charged. Hence charge under Sections 354­D/506 IPC is framed against the accused to which he  pleaded not guilty and claimed trial.

Delhi in the case of Manjeet Singh Vs. State Crl. M.C. 4485/2013 and Crl. M.A No. 16055/2013, the vehicle bearing no. UP14BQ-8286 be released to the applicant on furnishing of indemnity bond/security bond in the sum of Rs. 2,50,000/- (2.5 lakhs) before the SHO/IO of the concerned police station that in case somebody else is found to be rightful claimant/owner of the said property, the applicant would indemnify him.

The SHO/IO is further directed to ascertain and satisfy himself about the ownership of the vehicle in question and also to take the photographs of the case property/vehicle from different angle and its engine number alongwith the negatives duly authenticated and certified and a detailed punchanama be also prepared of the property before such release. It is also directed that the investigating officer shall keep on record the permanent address of the applicant, his identity proof, his address proof as well as his phone number.

It is further directed that the applicant shall join the investigation/trial as and when directed to do so and will also undertake that he will intimate to the Court any address which he may change during the course of time.

Photographs shall be placed on record alongwith the Negative/CD. If the photographs are taken from digital camera, there is no need to place negatives on record.

All these documents shall be filed by the investigating officer alongwith the final report as and when the same is filed. Application is disposed of accordingly.
