know, the storm on Wednesday afternoon was nothing compared to

what would hit on Thursday. Thursday was definitely a "bad day at

blackrock". I'm sure you've all seen the video clips and still images of

the destruction wrought by 75 mph winds and a tornado touching down

amidst all the aeroplanes and displays at Sun 'N Fun. There is no sense

reiterating here that sad sight.

Those who did get a real Cuban sandwich and cold drink as part of the

Under The Wing Thing said the Cubans were very good. Maybe next

year we'll be able to take advantage of the full spread that Susan and

Bobby had planned for this function. This was to be one of the largest

gatherings we've ever had. The Wyatts will be eating Cubans from now

until next year as they planned for about 100 and 25 showed up this

year.

RRRAAADDDIIIAAALLL EEENNNGGGIIINNNEEESSS &&& TTTEEELLL IIINNN AAAVVVGGGAAASSS

Our old radial engines absolutely require TEL in the gas they burn. If

you don't believe this, just try to burn autogas without ethanol in them

as a regular diet and see what happens. Trust me when I tell you that

these old engines require TEL in the gas. I've paid that tuition.

Most of the radial engines we fly behind don't require the 100 octane

rating offered by the 100LL. Octane is not the major issue for us.

Avgas, in general, makes up a minute percentage of the total gas sold.

So small it is virtually unrecognizable as a market. Certainly not a

major market in the realm of the oil companies. The annual U.S. usage

of avgas was 186 million gallons (704 million liters) in 2008, and was

approximately 0.14% of the motor gasoline consumption. That's 1.4

tenths of a percent. From 1983 through 2008, U.S. usage of avgas

declined consistently by approximately 7.5 million gallons (28 million

liters) each year.

These very facts are what is so interesting. Why is the FAA and EPA

even worrying about reducing the lead to zero in this product when it is

such a small segment of the total market and shrinking each year?

The fact is that the FAA is joining the EPA to gang up on us to do away

with TEL in avgas. Without the TEL in the avgas, vital engine

components in our radial engines will be compromised and render the

engines non airworthy.

This is just another example of our government at work, making

decisions for us with unintended consequences resulting and in the

process reducing our freedoms and net worth little by little. Are you

in Galesburg, IL. The organizers are shooting for 200 Stearmans in

What started as a simple FOIA request on 08-22-02 became a protracted

legal battle that has wound its way up through the US Supreme Court

and back to the lower courts. But it is finally over. A summary

judgment, by US District Court Judge Ricardo M. Urbina, could

foreshadow easier access to Approved Type Certificate (ATC)

drawings/data held by the FAA, for those restoring antique/classic

aircraft.

This particular case involved AAA Executive Director Brent Taylor's

FOIA request for the Fairchild 45 drawings/data. That request was

denied by the FAA and lead to legal action against the FAA and the

Fairchild Corporation (now defunct) in the pursuit of access to those

drawings/data.

That legal action against Fairchild and the FAA was undertaken for

Brent Taylor by AAA member Michael J. Pangia, a former FAA legal

counsel now in private practice. Mike has written an authoritative

account of that legal battle titled "A Quest for Secret Plans: A Journey

Into the Land of Oz".

However, even after a unanimous decision in Brent Taylor's favor by the

US Supreme Court in 2008, the legal wrangling continued as the case

was remanded back to the US District Court.

Then on Wednesday, January 19th a summary judgment was made in

favor of Brent Taylor bringing the matter to an end (we hope).

Judge Urbina decision holds that:

1. Once manufacturer authorized disclosure of its materials, they

were no longer secret for purposes of FOIA's trade secrets

exemption.

2. Secret status of the materials was not restored when manufacturer

revoked its authorization to disclosure.

3. The materials were not commercially valuable, and, thus, did not

fall within FOIA's trade secrets exemption.

This decision should help pave the way for easier access (via FOIA) to

the approved data/drawings that owners/restorers of antique/classic

aircraft need to help in complying with the FAR's in the restoration and

maintaining airworthiness of said aircraft.

It's been a long and expensive road but if it helps to "Keep the Antiques

Flying", then it will have been well worth it.

FFFLLLYYYIIINNNGGG OOOPPPPPPOOORRRTTTUUUNNNIIITTTIIIEEESSS You may have noticed that I've been sending out notification for various

flying opportunities around the state. The objective is to keep our

members apprised of other flying opportunities as I hear about them in

an attempt to keep people flying. With the price of avgas and the

general high cost of flying, we'd like to do all possible to keep folks in

the air. Local flying opportunities are

a good way to do that. If there is a fly

in destination that is less than an

hour away (preferably maybe less

than that) folks may participate and

keep flying. If you are aware of these

flying opportunities, please advise

and I will forward this information to

the general membership. A flyer

produced by the folks who are hosting

the event would be a great way to

alert our members. Here is an

example of a function we just

attended and another for an

upcoming flying opportunity.

Aero Acres - Ft. Pierce, Florida

It was a beautiful day for aviating in South Florida. Maybe a tad too

windy for the crosswind landing on asphalt we negotiated at Aero Acres

but otherwise a wonderful way to spend an afternoon with fellow

aviators. This well organized and attended annual event is always

worth the trip. The quantity and variety of food was awesome and

dining in the shade of the pine trees with a good breeze keeping us cool

was delightful. Our membership accounted for about 1/3 of the total

airplanes in attendance. There were 30 aeroplanes of all types on the

flight line.
