This user guide provides information on how the Mackay Region Planning Scheme 2017 applies to Centres and Commercial development. This user guide provides information on how this development is defined, whether an application or referral to Council is required and key planning scheme requirements.

Mackay region planning scheme 2017The planning scheme is the primary instrument for managing development in our local government area. The planning scheme:

• outlines a 20 year vision for the region • identifies zones and overlays over land • defines various forms of development • determines the level of assessment for each type of

development; and • sets codes for the assessment of development

Upon coming into effect on 24 July 2017, the planning scheme replaced three previous planning schemes based on the former Mackay City, Sarina Shire and Mirani Shire local government areas.

Centre zonesWhile there is scope to provide commercial development in a range of locations, the planning scheme intends that commercial development is predominantly accommodated in centre zones.

Centre zones are based on a preferred Centres Network:

What are centre activities and community activities? With a few exceptions, centre activities and community activities are supported in the Principal, Major, District and Local centre zones (Neighbourhood centre and Specialised centre zones support a more limited range of uses). Centre and community activities comprise of the following uses:

In many centres, new centre and community uses can establish in existing buildings without triggering a development application if certain criteria are met.

intent of each zone & Supported usesThe intent and intended uses for each centre zone is summarised as follows:► Principal centre zone

• Intent - to provide for a large variety of uses and activities in the Mackay City Centre to:

- form the core of an urban area; and - service the local government area.

• Supported uses include: - centre activities, including:

~ full range of retail - including department stores

~ large headquarter offices - including. Commonwealth, State and Local Government as well as private

~ highly developed entertainment and leisure facilities and services

- regional & local community activities - major exhibition / event and sport facilities - high density residential and major short-term

accommodation - other compatible uses.

► Major centre zone

• Intent - to provide for a large variety of uses and activities to service sub-regional areas.

• Supported uses include: - centre activities, including:

~ retail - up to discount department stores & full size supermarkets (no department stores)

~ small scale and low intensity offices and professional and service businesses

~ entertainment and leisure facilities and services

- sub-regional community activities - medium-high density residential and short term

accommodation - recreation activities & Major sport recreation and

entertainment facility - other compatible uses

► District centre zone

• Intent - to serve multiple adjoining suburbs and, for Walkerston and Marian, surrounding rural areas.

• Supported uses include:

- centre activities, including:

~ retail - Full size supermarkets, specialty stores and personal services

~ limited entertainment and leisure facilities and services

~ showrooms over 500m² not supported

- local community activities

- medium density residential development (where premise also supports centre or community activity) and short-term accommodation where need exists

- other compatible uses

► Local centre zone

• Intent - to provide for:

- a limited variety of commercial, community and retail activities to service local residents, and

- other uses and activities that integrate with, and enhance, the local centre, including, for example, entertainment, shopping or residential uses.

Local centres should serve the surrounding suburb and, for Mirani, surrounding rural areas.

• Supported uses include:

- centre activities, including:

~ retail - medium size supermarkets, limited specialty stores and personal services, small scale and low intensity offices.

~ showrooms not supported.

- local community activities, hospitals are not supported

- limited medium density residential (if premise also supports centre or community activity) and short-term accommodation at Mackay Marina

- port services (only at Mackay Marina)

- other compatible uses

► Neighbourhood centre zone

• Intent - to provide for:

- a small variety of uses and activities to service local residents;

- other small scale uses and activities that directly support local residents, including, for example, community services, convenience shops or offices

- Supported uses include:

- some small scale and low intensity centre

activities: convenience stores, limited specialty stores, boutique cafes and personal services.

- some community activities, including: childcare centre, club, community care centre, community use, educational establishment, emergency services, place of worship

- dwelling houses or Multiple dwelling activities are allowed where non-residential uses have ceased

- other compatible uses

► Specialised centre zone

• Intent - to provide for unique and single-purpose centres as follows:

~ large-format showrooms hardware stores and outdoor business activity developments in SC1 precinct

~ taverns in SC2 precinct

• Supported uses - Showrooms and hardware precinct (SC1):

- showroom, hardware and trade supplies, outdoor business activities

- some food and drink outlets are allowed where ancillary to the above uses, and where sharing the same opening hours

- centre activities, community activities and multiple dwelling activities are not supported

• Supported uses - Tavern precinct (SC2):

- hotel, market and utility activities.

- ancillary dining and entertainment facilities must be integrated with hotel use

- centre activities and community activities are not supported

- dwelling houses and multiple dwellings are supported in some instances

► Mixed use zone

• The Mixed use zone, Amenity and convenience precinct (MX1) provides for centre and community activities where combined with a residential use.

• The Fringe commercial precinct (MX2) provides for small scale centre and community activities which transition to medium density residential development or low impact industry (depending on the area) over time.

Where centre activities are proposed outside designated centres, it will need to be demonstrated that the development:

• is needed, and will not impact on the viability of existing and provided for development in designated centres

• is not in close proximity to designated centres• is located on a sub-arterial or collector road that is

also a public transport route• mitigates adverse amenity impacts• is only at ground level

The Planning Act 2016, Planning Regulation 2017 and the Development Assessment Rules set out the requirements for the development assessment process.

You can also contact a building certifier, consultant town planner, surveyor or other appropriately qualified professional who can provide advice and, if necessary, prepare and lodge a development application on your behalf.
