    SUMMARY

    The purpose o f the Trench 31 81 34 Mixed Waste Disposal Facility Compliance Matrix is to provide objective evidence of implementation of all regulatory and procedural-institutional requirements for the disposal facilities, This matrix provides a 1 isting of the individual regulatory and procedural-institutional requirements that were addressed. Subject matter experts reviewed pertinent documents that had direct or indirect impact on the facility. Those found to be applicable were so noted and listed in Appendix A. Subject matter experts then extracted individual requirements from the documents deemed applicable and listed them in the matrix tables. The results of this effort are documented in Appendix B.

    REQUIREMENT

    Any person who generates, t ranspor ts , o f f e r s f o r t ranspor t , o r t rans fe rs a dangerous waste, o r who owns o r operates a dangerous waste TSD f a c i l i t y s h a l l have a current EPA/state i d e n t i f i c a t i o n number (EPA/state ID#). To determine whether o r no t a waste i s designated a person s h a l l check t h e waste against t he fo l l ow ing sections, and i n the fo l l ow ing order:

    I f the designation procedures i d e n t i f y a waste as both EHW and DW (e.g., a waste may be DW f o r c o r r o s i v i t y and EHW f o r t o x i c i t y cha rac te r i s t i c ) , t he waste must be designated EHW.

    For the purpose o f determining i f a s o l i d waste i s a dangerous waste as i d e n t i f i e d i n WAC 173-303-080 through 173-303-100, a person sha l l e i t he r : (1) Test the waste according t o the methods, o r an approved equivalent

    method, set f o r t h i n WAC 173-303-110; o r (ii) Apply knowledge of the waste i n l i g h t o f t he mater ia ls o r the process

    used , when: (A) Such knowledge can be demonstrated t o be su f f i c i en t f o r determining

    whether o r no t i t designated and/or designated properly; and (B) A l l data and records supporting t h i s determination i n accordance w i t h

    When a person is reporting or keeping records on a dangerous waste, he shall use all the dangerous waste numbers which he knows are assignable to his waste from the dangerous waste 1 ists, characteristics, or criteria.     A solid waste is a dangerous waste if it meets one or more of the dangerous waste criteria described in subsections (5), (6), and (7) of this section. If a person’s solid waste meets one or more of these criteria then he shall be a dangerous waste generator (and may not be considered a small quantity generator as provided in WAC 173-303-070(8) if the quantity of the waste exceeds the following quantity exclusion 1 imits:

    (a) For toxic dangerous wastes designated as EHW (WTOl), the quantity exclusion limit is 2.2 lbs. per month. NOTE: To be designated as EHW (WTO1) toxic dangerous wastes must be generated above a specified quantity, which varies dependent upon the degree of toxicity, and which may be greater than 2.2 lbs.

    (b) For all other wastes designating under this section the quantity exclusion limit is 220 lbs. (100 kg) per month or per batch.

    Except as provided in WAC 173-303-070 (4) or (5), a person shall determine if a solid waste meets the toxicity criteria under this section by following either the instructions for book designation, when his knowledge of the waste is sufficient, or by testing the waste using the biological testing methods adopted under WAC 173-303-llO(3).     Waste acceptance criteria shall be established for each low-level waste treatment, storage, and disposal facility, and submitted to the cognizant field organization. Generators of waste shall implement a low-level waste certification program to provide assurance that the waste acceptance criteria for any low-level waste treatment, storage, or disposal facility used by the generator are met. Generators and facilities receiving the waste are jointly responsible for assuring compliance with waste acceptance criteria. Generators are financially responsible for actions required due to nonconformance. Generator low-level waste certification programs shall be subject to a periodic audit by operators of facilities to which the waste is sent by the generator. The waste acceptance criteria f o r storage, treatment, or disposal facilities shall address the following issues:

    Each package of low-level waste must comply with the labeling requirements of DOE 1540.1. Low-level liquid wastes, or wastes containing free liquid, must be converted into a form that contains as little freestanding and noncorrosive liquid as is reasonably achievable, but, in no case, shall the liquid exceed 1 percent of the volume of the waste when the waste is in a disposal container, or 0.5 percent o f the volume o f the waste processed to a stable form. Low-level waste must not be readily capable of detonation or o f explosive decomposition or reaction at normal pressure and temperatures, or of explosive reaction with water. Low-level waste must not contain, or be capable of generating, quantities of toxic gases, vapors, or fumes harmful to persons transporting, handling or disposing of the waste.
