4 . Businessman X was P r e s i d e n t o f Company Y, an Ohio
c o r p o r a t i o n , h a v ing i t s p r i n c i p a l p l a c e o f business i n Dayton, i s
engaged i n t h e purchase, r e p a i r , and r e s a l e o f s u r p l u s m i l i t a r y
e q u ipment . Defendant DARROLD RICHARD CRITES was S e c r e t a r y o f
Company Y. Businessman X and Company Y were domestic concerns as
t h a t t e r m i s d e f i n e d i n t h e F o r e i g n C o r r u p t P r a c t i c e s Act, 15
U.S.C. § 78dd-2 (h) (1) .
5. From December 1993 t h r o u g h February 1996, a B r a z i l i a n
A i r F o r c e L t . Colonel (BAF/Lt . C o l . Z) was the Foreign L i a i s o n
O f f i c e r f o r t h e A i r Force o f t h e R e p u b l i c o f 3 r a z i i and was
s t a t i o n e d a t Wright P a t t e r s o n A i r Force Base i n the Southern
D i s t r i c t o f Ohio. 3AF/Lt. Col . Z was a " f o r e i g n o f f i c i a l " as
t h a t t e r m i s d e f i n e d i n t h e F o r e i g n C o r r u p t P r a c t i c e s Act, 15
U.S.C. § 78dd-2(h) ( 2 ) . BAF/LT. Coi . Z was a u t h o r i z e d t o make
p u r c h a s e s o f m i l i t a r y equipment on b e h a l f o f t h e B r a z i l i a n
A e r o n a u t i c a l Commission (BAG) , t h e p u r c h a s i n g agent of the

Command C o u n t r y Manager ("Country Manager") f o r B r a z i l . As such,
he was r e s p o n s i b l e f o r r e p r e s e n t i n g t h e U n i t e d States A i r Force
i n d e a l i n g s w i t h 3AF / Lt . C o l . Z.

d e f e n d a n t DARROLD RICHARD CRITES met w i t h the Country Manager and
w i t h 3AF/Lt. Col. Z and agreed t h a t t h e Country Manager would
l o c a t e s u r p l u s m i l i t a r y equipment f o r purchase, r e p a i r , and
r e s a l e by CSS t o the B r a z i l i a n A e r o n a u t i c a l Commission, an
i n s t r u m e n t a l i t y of the Government o f t h e Rep u b l i c of B r a z i l .

10 . I t was f u r t h e r a p a r t o f t h e c o n s p i r a c y t h a t , t h e
C o u n t r y Manager agreed t o p r o v i d e d e f e n d a n t DARROLD RICHARD
CRITES w i t h s u r p l u s p a r t numbers, model numbers, and U.S.
m i l i t a r y sources of s u r p l u s p a r t s i n exchange f o r the promise o f
payments o f money, u s i n g i n f o r m a t i o n he would o b t a i n t h r o u g h h i s
p o s i t i o n as a c i v i l i a n employee o f t h e U n i t e d S t a t e s A i r Force.
1 1 . I t was f u r t h e r a p a r t o f t h e c o n s p i r a c y t h a t d e f e n d a n t
DARROLD RICHARD CRITES would t h e r e a f t e r purchase t he s u r p l u s
e q u i p m e n t i d e n t i f i e d by t h e C o u n t r y Manager, r e c o n d i t i o n i t , and
r e s e l l t h e same t o the BAC. A c c o r d i n g t o t h e i r agreement,
3AF/Lt . Col . Z would approve t h e BAC's purchases from CSS i n
exchange f o r payments of money.
12. I t was f u r t h e r a p a r t o f t h e c o n s p i r a c y t h a t , i n t h e
f a l l o f 1994, defendant DARROLD RICHARD CRITES, a f t e r c o n s u l t i n g
w i t h t h e Country Manager, s t a r t e d t o p r e p a r e and submit b i d s t o
t h e BAC t h r o u g h BAF/Lt. C o l . Z. T h e r e a f t e r , defendant DARROLD
RICHARD CRITES p a i d BAF/Lt. C o l . Z a s e r i e s o f b r i b e s , d i s g u i s e d
as " c o n s u l t a n t fees," f o r each b i d a c c e p t e d by BAF/Lt. Col Z on
b e h a l f o f t h e BAC.

1994 and 1996 defendant DARROLD RICHARD CRITES, as p r e s i d e n t o f
d e f e n d a n t CSS , and defendant DARROLD RICHARD CRITES and an
u n i n d i c t e d c o - c o n s p i r a t o r , Businessman X, as o f f i c e r s of Company
Y, a r r a n g e d n o t les s t h a n f o r t y - f o u r purchases of s u r p l u s U.S.
m i l i t a r y equipment f o r r e p a i r and r e s a l e t o the BAC. Seme o f t h e
s u r p l u s equipment was o b t a i n e d by t h e BAC thro u g h t h e Defense
R e u t i l i z a t i c n and Marketing S e r v i c e (DRMS) under t h e F o r e i g n
M i l i t a r y Sales (FMS! Program and t h e n p r o v i d e d t o defendant CSS
o r Company Y f o r r e p a i r . O t h e r equipment was purchased d i r e c t l y
by CSS o r Company Y, r e p a i r e d , and t h e n s o l d t o the SAC. I n a l l
cases, a f t e r each purchase was e f f e c t e d , 3AF/Lt. Col Z was p a i d
f o r h i s a p p r o v a l of the t r a n s a c t i o n .
15 . I t was f u r t h e r a p a r t o f t h e c o n s p i r a c y that; between
1994 and 1996 defendants DARROLD RICHARD CRITES and CSS and
o t h e r s p a i d a t o t a l o f S 99,000 t o t h e Country Manager and a
t o t a l o f S 257,139 t o BAF/Lt. C o l . Z.
