US APPEALS PANEL AGREES GOVERNMENT CAN DEMAND TWITTER ACCOUNT INFO INWIKILEAKS PROBE

A federal appeals court ruled Friday that prosecutors can demandTwitter account information of certain users in their criminalprobe into the disclosure of classified documents on WikiLeaks.

The three-judge panel of the 4th U.S. Circuit Court of Appealsalso said the government’s reasons as to why it is seeking theinformation can remain sealed.The case involves three Twitteraccount holders with some connection to the secret-bustingWikiLeaks website. They had argued that forcing Twitter tocooperate with the investigation by turning over data amounts toan invasion of privacy and has a chilling effect on the free speechrights of Twitter users.

The federal panel in Richmond rejected their appeal and affirmeda magistrate’s court order that Twitter must turn over limitedaccount information to prosecutors. The court said it weighed theright of public access against the need to keep an investigationsecret. The appeals court agreed with the magistrate that thegovernment’s interest in keeping the documents secret outweighthe right to public access.

Prosecutors have said federal law specifically allows them toseek account information as a routine investigative tool.Specifically, the Stored Communications Act allows them toobtain certain electronic data without a search warrant or ademonstration of probable cause. The government must onlyshow that it has a reasonable belief that the records it seeks arerelevant to an ongoing criminal investigation.

“This is essentially a reasonable suspicion standard,” the courtwrote.

Under the Stored Communications Act, the government can alsokeep sealed documents related to their investigation from thesubscribers. The appeals panel concluded the subscribers had noFirst Amendment right to access the documents. Prosecutorssubmitted their rationale for seeking the Twitter information toU.S. Magistrate Judge Theresa Carroll Buchanan but it was keptsecret and sealed also.

The court wrote that the “government’s interests in maintainingsecrecy of its investigation, preventing potential subjects frombeing tipped off, or altering behavior to thwart the government’songoing investigation, outweighed” the subscribers’ claims.

The American Civil Liberties Union and the Electronic FrontierFoundation, representing the Twitter users, said the governmentcan use those IP addresses as a sort of virtual tracking device toidentify a specific computer used by an account holder and withit the user’s physical location.

The appeals panel also allows the government to keep secret anysimilar orders it sought from other social media sites.

“This case shows just how easy it is for the government to obtaininformation about what people are doing on the Internet, and ithighlights the need for our electronic privacy laws to catch upwith technology,” said ACLU attorney Aden Fine. “Thegovernment should not be able to get private information like thiswithout getting a warrant and also satisfying the standardrequired by the First Amendment, and it shouldn’t be able to doso in secret except in unusual circumstances”

The original order issued in December 2010 at prosecutors’request also sought Twitter account information from WikiLeaksfounder Julian Assange and Pfc. Bradley Manning, who faces lifein prison if he’s convicted of indirectly aiding the enemy byleaking U.S. secrets while working as an intelligence analyst inBaghdad in 2009 and 2010.

Neither Assange nor Manning was a party in the lawsuitchallenging the legality of the Twitter order.

RAYS’ REBOUND BIG IN 6-2 WIN OVER ODESSA

Luke McDiarmid scored his first NAHL goal and Beau Walker picked up three points as the IceRays took down Odessa6-2 inside the Ector County Coliseum on Saturday night.

Rudy Sulmonte scored 3:43 into the game on a great pass from Mike Economos while on the man advantage to put theRays’ up 1-0.

Just ten seconds later, Luke McDiarmid scored his first goal in the NAHL to put Corpus Christi ahead 2-0 with an assistfrom Brandon Berkley.

With a power-play goal and an even strength goal, Emil Romig beat Nick Deery on a two-on-one short-handed rush at8:50 of the first period unassisted moving the IceRays up 3-0.

In the second frame, Wayland Williams took a pass from Eric Purcell and rifled a shot over the left shoulder of newlyinserted goaltender Erick Majerle just 3:46 in giving Corpus Christi a 4-0 lead.

Odessa started a comeback courtesy of Taylor Portner who fired a shot behind Ben Myers at 15:11 to pull the Jackalopeswithin three goals.

Just 49 seconds later, Matt Volonnino wristed a shot from the left wing circle and beat Myers on the short-side withassists to Matthieu Audet and Corey Hoffman to split the lead in half 4-2.

In the final period, Rudy Sulmonte walked around the defender and hit a wide open Beau Walker for a tap-in goal, his 5thof the year moving the lead out 5-2.

Brandon Smith tacked on an empty net goal with three seconds left in the game assisted by Walker as Corpus Christi won6-2. Ben Myers stopped 19 of 21 shots in the win, his 8th.
