The Oregon State Legislature in 1993 modified state law in order to provide guidance in the EFU Zone generally. ORS 215.780 designated that any EFU Zone should not have a minimum lot size lower than 80 acres. Because of the new law change Umatilla County informally discontinued recognizing these smaller minimum lot sizes since these were in conflict with state statutes. The County noted the necessity for an update to these zoning designations but did not make the needed changes through a formal ordinance update until now.

The EFU-10, 20 and 40 zones will be replaced by the EFU zone. The zoning will remain agriculturally oriented, but with a 160 acre minimum parcel size. That means that when NEW parcels are created the size must be 160 acres or larger unless otherwise allowed. All other uses (permitted, conditional) and development standards will remain the same.

Part 3: Farm Exempt PermitsPart 3: Farm Exempt PermitsUmatilla County currently has provisions for
certain structures to be permitted as “Farm Exempt”. Currently, if the proposed structure meets the definition of “agricultural building” as found in ORS 455, the UCDC does not require a Zoning Permit. Planners sign the Building Codes Division “Farm Exempt” Permit; no land use permit (ministerial decision) is required. Under the proposed changes, a Zoning Permit would be required. Farm Exempt permits will continue to be available; however applicants will obtain a Zoning Permit first, and then proceed to the State BCD for the “Farm Exempt” building permit.

Type IV, Review II Criteria Type IV, Review II Criteria proposedproposed(C) Review II. The following review and approval
standards of a Type IV, Review II Land Division application is for the creation of parcels equal to or greater than 80 acres, within the EFU zone and/or identified Critical Winter Range. Parcels less than 80 acres may be established if located within an approved “go below” area pursuant to OAR 660-033-0100(1)-(9).(1) The technical standards for submittal of the Type IV,
Review II Land Division application shall be the same as that for a Type II Land Division application, and are therefore subject to §§ 152.680 through 152.683 and §§ 152.685 and 152.686.
(2) The procedure for processing a Type IV, Review II, Land Division application shall follow the standards set forth in § 152.643(D) and § 152.645(B).

(a) The partition will preserve and maintain farm use consistent with Oregon Agricultural Land Use Policy found in ORS 215.243.(b) Is for the purpose of farm use as defined in § 152.003.(c) Meets the minimum frontage and access requirements.(d) All parcels created will be 80 to 160 acres in size, in accordance with ORS 215.780, or, parcels shall be the minimum parcel size as established by an approved “go below”.
