The court holds today's hearing on Plaintiffs Emergency Motion for Relief(ECF No. 183 ).
IT IS ORDERED that Plaintiffs' Emergency Motion for Relief is GRANTED. The scheduled depositions are hereby VACATED and can be rescheduled after the parties have completed their mediation and after they have made substantial document production relative to those former employee/confidential witnesses.
In addition, the court finds that examination of the former employees/confidential witnesses at deposition may inquire about answers the deposition witness may have provided the plaintiff's investigator but not about the specific questions the investigator may have previously propounded to the witness. If defendants can demonstrate elements of a substantial need or otherwise undue hardship, pursuant to Fed. R. Civ. P. 26(b)(3), in discovering the basis of the allegations attributed to the
former employees/confidential witnesses, that argument can be made to the court in the future.
IT IS FURTHER ORDERED that defendants can take Mr. Slomnitsky's deposition before the filing of the motion for class certification. If there is an effort to take Mr. Slomnitsky's deposition for a second time, defendants will have to seek leave of the court and show good cause for doing so.
