WHAT ARE THE BILL OF RIGHTS??

• Before many of the 13 states would ratify (approve) the Constitution, they believed there needed to be a protection of our basic human rights.

• The first ten amendments to the Constitution are known as the Bill of Rights and were added in 1791.

• AMENDMENT 3: no quartering of soldiers in private homes without the owner’s permission

• AMENDMENT FOUR: protects against unreasonable searches and seizures– Search warrant: court order granting

authorities permission to search a specific location

– Arrest warrant: court order granting authorities to seize individuals suspected of a crime

WHAT DO THE BILL OF RIGHTS PROTECT: FIFTH AMENDMENT

• Due process of law: right of every citizen to be protected from arbitrary action by the government

• Protection against self-incrimination• Protection against double jeopardy• Indictment by a grand jury

– Indictment: formal list of criminal charges against an individual

• Protection in cases of eminent domain (power of the government to take private land for public use with fair compensation)

• AMENDMENT SIX: guarantees the accused an attorney and a trial by a jury of his/her peers

• AMENDMENT SEVEN: guarantees a jury trial in civil cases

• AMENDMENT EIGHT: protects against cruel and unusual punishment and excessive bail and fines

• AMENDMENT NINE: people have more rights than what is stated in the Constitution

• AMENDMENT TEN: reinforces federalism
