Amendment to Article I of the Con.vention on Prohibitions or Restrictions on the Use of Certain CODventional Weapons Which May Be Deemed to Be Excessively
Injurious or to Have Indiscriminate Effects (CCW)
The following dcx:ision to amend Article I of the Conventi r n in order to expand the scope of its application to non-international anned conflicts was made by tbe States Parties at the Second Review Conference held from 11 to 21 December 2001. This decision appears in the Final Declaration of the Second Review Conference, as contained in document CCW/CONF.TI12 .
"DECIDE to amend Article I of the Convention to read as follows:
" 1. This Convention and its annexed Protocols shall apply in the situations referred to in Article 2 common to the Geneva Conventions of 12 August 1949 for the Protection of War Victims, iucluding any situation described in paragraph 4 of Article I of Additional Protocol I to these Conventions.
2. This Convention aud its annexed Protocols shall also apply, in addition to situations referred to in paragraph 1 of this Article, to situations referred to in Article 3 common to the Geneva Conventions of 12 AUgust 1949. This Convention and its annexed Protocols shall not apply to situations of in ternal disturbances and tensions, such as riots. isolated and sporadic acts of violence, and other acts of a similar naturc, as not being armed. conflicts.
3. In case of 3m:led conflicts Dot of an international character occurring in tbe territory of one oe the High Contracting Parties, each PIId¥- to the confliet shall be bound to apply the prohibitions and restrictions of this Convention and its annexed Protocols.
4. Nothing in this Convention or its annexed Protocols shall be invoked for the purpose of affecting the sovereignty of a State or the responsibility of the Government, by all legitimate means, to maintain or re-establish law and order in the State or to defend the national unity and territorial integrity of the State.
5. Nothing in this Convention or its annexed Protocols shall be invoked as a justification for intervening. directly or indirectly, for any reason whatever. in the 3IUled conflict or in the inlernaJ or external affairs ofth~ High Contracting Party in the territory of which that con.llict OCCUIS .
6. The application of the provisions of this Convention and its annexed Protocols to parties to a conflict which are not High Contracting Parties th:n have accepted this Convention or its annexed Protocols. shall not c;hange thelT legal status or the legal status of a disputed territory. either explicitly or unphcltly.
7 The provisions of Paragraphs 2· 6 of this Article shilll not prejuwce additional Protocols adopted aftt!T I .January 2002, which may app ly. exclude Clr modify the- scope of their :lpplic:llion in rebtion to this Article:"

A leur deuxieme Conference d' examen, teoue du 11 au 21 decembre 2001 , les Brats parties a 1a Convention ont decide de modifier comtne su it l'artic1e premier de la Convention, afin d 'en etendre Ie champ d'application awe conflits armes ne revetant pas un caraeteee international. Cene decision figure dans 13 Dtklaration finale de la deuxieme Conference d' exarnen, telle que reproduite dans Ie document CCW/CONF.IIn .
«DECIDENT de modifier l'artic1e premier de la Convention, qui doit desormais se lire cornme suit:
1. La presente Convention et les Protocoles y annexes s'a,ppliquent dans Ies situations prevues par I'article 2 ~mmun 8llX Conventions de Geneve du 12 aoilt 1949 relatives a la protection des victimes de guerre, y compris loute situation deerite au paragraphe 4 de J'arricJe premier du Protocole additionnel I aux Conventions.
2 . La presente Convention et les Protocoles y annexes s 'appliquent. outre les situatio ns visccs au paragraphe 1 du present article. aux situations visees a l'article 3 commun a' Conventions de Geneve du 12 aout 1949. La prcsente Convention et les Protocole y annexes ne s'appliquent pas aux situations de tensions et detr.eu.bles interieurs. telles qu 'emeutes, actes de violence isoles et sporadiques et autres actes de carach~re similairc. qui ne sont pas des conflits armes .
3. Dans Ie cas de cOl1flits acmes qui ne reverent pas un caractere international et se produisent sur Ie territoire de rune des Hautes Parties contractantes. chaque partie au conflit est teoue d'appliquer Ies interdict ions et restrictions prevues par 1a presente Convention et les Protocoies y annex.es.
4 . Aucune di sposition de la presente Convention ou des Protocoles y annexes n' est invoquee pour porter atteinte a 1a souverainete d'un Etat ou a la responsabilite qu ' a Ie gouvernement, par tous Ies moyens h~g i t imes . de maint c:nir au de retablir l ' ordre public dans J''Etat ou de defendre \'unite nationa le et r mtegrite territoriale de rEtat .
5. Aucune disposition de 13 presente Convention au des Protocoles y annexes n ' est invoquee pour justifier une intervention., directe ou indirecte, pour quelque raiso n que ( soit , dans Ie conflit arme ou dans les affaires inrerieures ou extcrieures de la Haute Paroe contractante sur Ie territoire de laquelle ce conflit se produit.

6 . L' application des dispositions de la pn~sente Convention et des Protocoles y annexes a. des parties a un conflit qui ne sont pas de Hautes Parties contractantes ayant accepte k. presente Convention et les Proto coles y annexes ne modifie n.i explicitement ni implicitement leur statotjuridique ni celui d "un territoire contestc.

Los Estados Partes en la Segunda Conferencia de EXamen, cclebrada del 11 at 21 de
diciembre de 2001 , adoptaron la siguiente decisi6n de enmendar cI articu lo I de la Convenci6n
para amp liar el ambito de su aplicaci6n a los conflictos armados no intemacionales. Esta
decision figura en fa Declaraci6n Final de la Sc:gunda Cooferencia de Examen, que se publica
can la signatura CCW/CONF.W2.
"DECIDEN enmen.d.ar el articulo 1 de la Convencion como sigue:
1. La preseote Convenci6n Y sus Protocolos anexos se aplicanio a las situaciones
a que se reficre ei articulo 2 COffiu.n a los Convenios de Ginebra del 12 de agosto de 1949
relativos a la protecci6n de las victimas de los conflictos armadas, induidas cualesquiera
situaciones descritas en el parrafo 4 del articulo I del Protocolo Adicional I a esos
Convenios.
2 La presente CODvencion y sus Protocolos anexos se apli~ran, ademas de las
situaciones a las que se refiere el panafo I del presente articul6","1I: las situaciones a que se
refrere el articulo 3 comUn a los Convenios de Ginebra. del 12 de agoste de 1949.
La Conveneion y sus Pretecolos anexos no se aplicaran a las situaciones de tensiones
intemas y de disturbias interiores, tales como los motines, los aetas esporadicos de:
violencia y ouos actos an.iJogos que no son conflictos armadas.
3. En el caso de conflictos que no sean de caracter internacional que tengan lugar
en el temtorio de una de las Alta::; Partes Contratantes, cada parte en el conflicto estara
obligada a aplicar las prohibiciones y restricciones de la presente Convencion y de sus
Protocolos anexos.

4. No podra invocarse disposici6n alguna. de la presente Convenclon 0 de sus

defender la unidad naeienaJ y Ia integridad territorial del Estaclo pOT todos los medias
legitimos.
S. 1\:0 padrel invocarse disposicion alguna de La presente Convenci6n 0 de sus
PTOlocoios anexos para justificar la intervenci6n., direc;ta 0 indirecta, sea cual fuere 1a
raz6n, en un conflicto armada 0 en los asuntos internos a extemcs de la Alta Parte
Contratante en cuyo territorio tenga lugar ese conflicto.
6. La aplicacion de las disposiciones de Is presente Convenci6n y sus Protooolos
anexos a las panes en un c:;onflicto, que no sean Altas Partes Contratantes, que hayao
aceptado la presente Convenci6n y sus Protocolos anexos no modificara su estatuto
juridico ni la condici6n juridica de un territorio en disputa, ya sea expresa 0
implicitamente.
7 . Las disposiciones de los par-rafos 2 a 6 del presente artic;ulo no se interpret",·an
en perjuicio de los Protocolos adiciooales adoptados despucs .... ! .. de enero de 2002, que
pudieran aplicarse, ni exduinin 0 modificaran el ambito de su aplicaci6n en relaci6n con el
