Discuss election process and qualifications of the President and V. President. a. Qualifications: Article 2, Section 1:

35 years of age,U.S. Citizen by birth,Resident of U.S. for 14 years.

Term of 4 yearsState appoints electors who cast votes for President based on the votes of the people:originally, the candidate with 2nd highest # of votes became V. PresidentAmendment 12 changed this to require separate ballots for President and Vice President.If President dies, resigns, or is impeached, Vice President becomes President.

Commander in Chief of the Army and Navy and state militia.May require written opinion from heads of executive departments (this clause is the only mention of an advisory committee for the president mentioned in the Constitution.)

Power to grant reprieves and pardons, except in cases of impeachment.

Power to make treaties with advice and 2/3 consent of Senate

Power to appoint ambassadors, public Ministers and Consuls, Supreme Court Judges, and other officers not provided for with advice and consent of Senate(Congress MAY give sole power to the president to appoint lower officers in Courts of law or heads of departments.)

Power to fill vacancies during recess of Senate by granting temporary commissions

Power to issue executive orders: (a rule or command that has the force of law) these are issued as part of the president's duty to "take care that the laws be faithfully executed" and are often used during emergencies.

Article 1, Section 7; Article 2, Sections 2 & 3

a. Checks over Legislative Branch: may veto legislation (Article 1, Section 7)

may issue executive orders: (Article 2, Sections 2 & 3)

may convene both or either of the houses or adjourn them until such time as he deems necessary

may issue other orders that must be followed in case of emergency to make sure laws are faithfully executed
