REPAIR, MAIN'ENANE AND U??LITY HOOK-UP EXCLUSIONS FRCM PERMIT REQuEZMEXCS (~dopted by the California Coastal Commission on September 5, 1978) NOIIE: This guideline applies only to exclusions established in subsections (c) and (e) of Section 30610. For other exceptions to the permit reqdrements, see Section 13250 of the Commission Regulations (additions to existing singlefamily houses), Sections 13200 through 13210 ( vested rights), Sections 13211-13213 (pedts granted under the 1972 Coastal A&), Sections 13215-13235 (urban land), Sections l32& 13249 ( categories of developmerrt) , Sections 13 136- 13 14.4 ( emergency p e d t s) and Sections 13 145-13 154.5 ( administrztive pexmits) . General Provisions. Section 30610 of the Coastal. Act states in part: . . .no coastal development permit shall be required for.. . ( c) Repair or maintenance activities that do not result in an addition to, or enlargement or expansion of, the object of such repair or mainten- ance activities; provided, however, that i f the Commission determines that certain extraordinary methods of repair and maintenvrce that involve a risk of substantial adverse errvironmental impact, it shall, by regulation, require that a pe~lnit be obtained under this chapter. (e) The icstallation, testing, and placement in service or the replacement of any necessary u t i l i t y connection between an dsting service facility and any development approved pursuant t o this division; provided, that the Commission may, where necessary, require reasonable conditions to mitigate any a h r s e impacts on coastal resources, including scenic resources. This guideline i s intended to detail the types of development activities the Commission considers repair, maintenance or utility hook-ups related to the o+going work of various types of public and private agencies. Such lists ob- viously cannot be exhaustive and the exclusions also apply to activities camparable to those listed. Where a proposed activity is not included in this guideline, the Regional Commission Executive Director, after consultation with the State Colrmrission Esecutive Director, i f necessary, will determine whether a permit i s required. The standards for these exclusions are stated in Section 30610 of the Coastal Act: they do relate to the environmental impact of the proposed activity. The repair and maintenance exclusion is irrtended t o allow corrtinuation of &stir* developments and activities which began before the effective date of the Coastal Act. The u t i l i t y hook-up a c l u s i o n exempts utilities from obtaining p e d t s for work t o serve developments because Commission review uf such work is included ia the review of the development itself. 11. General Provisions.

Section 30610 of the Coastal. Act states in part:

. . .no coastal development permit shall be required for.. . (e) The icstallation, testing, and placement in service o r the replacement of any necessary u t i l i t y connection between an d s t i n g service fac i l i ty and any development approved pursuant to this division; provided, that the Commission may, where necessary, require reasonable conditions t o mitigate any a h r s e impacts on coastal resources, including scenic resources.

B. Public Uti l i t ies.

1. Natural Gas, Chilled Water and Steam Faci l i t ies .

a. Service Connections. Install, t e s t and. place in serr ice the neces- sary piping and related components t o provide natural gas, chilled water and/or steam service t o development ei ther exempted or approved under the Coastal A c t , including:

(1) Extend underground gas, chilled water and/or steam mains, except; in marshes, streams or r ivers, from termirrus of &sting main piping t o proper location i n front of customer's property, Break and remove pavement as necessary, open trench o r bore, fo r ins ta l la t ion of main piping, install mains and appurtenances, pressure t e s t f o r leakage, backfill open cuts, purge air from piping and irrtrochrce gas, chilled water and/or steam in to newly ins ta l led piping. Restore pavement as necessary. Provide for cathodic protection as necessarg.

(2) Extend underground gas, chilled,'water and/or steam service piping f r o m the main locations, except i n marshes, streams or r ivers, t o the meter location on the customer's property. Construction ac t iv i t i es are similar t o those in Item (1) above.

(3) Construct and install the-meter s e t assembly, generallg above ground, on the customerts property, including ins ta l la t ion of associated valves, pressure regulator, meter and necessary piping t o connect the gas, chilled water

and/or steam service t o the customer's piping system.

( 4 ) When necessary, instal l gas, chilled water and/or steam pres- sure regulation equipment and related componerrts, t o control pressure where the source of the supply i s a t a higher pressure than the pressure in the district distribution main system. Construction includes necessary excavation, installation of piping, valves, regulators, below ground vaults and related components,

(5) Ins ta l l necessary cathodic protection fac i l i t ies for main and service extensions t o new and existing customers,

b. Distribution and Transmission Facilities. . - --

( 1) Operate, inspect and maintain distribution and transmission mains, services, meter set assemblies and d is t r ic t regulator stations. Conduct leakage surveys, repair leaks, handle emergency or hazardous incidents, maintain supply pressure, inspect and adjust pressure regulators, operate valves, locate and mark fac i l i t ies t o help prevent damage t o them and t o provide for public safety.

(2) Install , replace, alter, relocate o r remove piping and cathodic protection fac i l i t ies as necessarg due to corrosion, Werference with other under ground or surface construction, franchise requirements, mechanical damage, reinforce- ment t o &sting distribution systems t o provide for increased usage such usage is to provide service t o development either exempted o r approved under the Coastal Act). Isolation of piping segments or systems t o pmvide emergency control - and the restoration of service t o a customer.

c. Production and S to ra~e Facilities, Perform necessary maintenance, replacement, repair, relocation, abandonment and removal work to gas storage facili- t ies , chilled water and/or steam plant faci l i t ies , mechanical equipment including prime movers and pumping equipment, chilled water and/or steam production faci l i t ies , gas and o i l processing faci l i t ies , pollution control faci l i t ies , cooling towers, electric equipment, controls, gas injection and withdrawal w e l l s , and other m i + cellaneous plant and pipeline structures. Installation of any required new safety devices and pallution control fac i l i t ies within existing structures or equipment or where land coverage, height, or bulk of existing structures w i l l not be incx-eased.

d. Miscellaneous. Perform necessary maintenance, repair, replacement, relocation, abandonment and remwal work t o pipeline roads, rights-of-way, fences and gates, sprinkler systems, landscaping, odorizing stations, telemetry equipment, lighting faci l i t ies , mechanical and electrical equipment, cathodic protection fac i l i t ies and environmerrt a l control equipment.

e. Grading and Clearing. Maintenance activit ies shall not extend t o the construction of aqy new roads t o the s i t e of the kork. A permit i s required for grading an undisturbed area of greater than 500 sq. ft., remwal of trees ex- ceeding 12 inches dbh or clearing more than 500 sq, f t . of brush o r other vegeta- t ion unless the Executive Director of the Regional C d s s i o n determines the activity does not involve the removal of major vegetation,

No p e d t i s required for minor modifications of existing structures required by governmental safety and environmental regulations, where necessary t o maintain existing production capacity, where located within existing structures, and where height or bulk of existing structures will not be altered.

E. Other Structures. 6, Pavement Deline,ation Program. The pavement a l l work necessary t o place and maintain distinctive

delineation program involves roadway markings on the travel-

ed way. This includes- layout, removal of old str ipe, painting of n& or &sting s t r ipe including str iping for bike lanes, ins ta l la t ion and/or r e m o v a l of raised pa- ment markers including cleaning of such markers and the use of'thermoplastic, tape or raised bars fo r pavement markings. Changing of striping fo r more lanes i s not includ- ed i n this program,

7. Sign Promam, The sign program includes a l l work performed on existing signs fo r the purpose of warning, regulating or guid ing t r a f f i c including bicycle t r a f f i c using bike lanes, The work consists of manufacture, assembly and install* t ion of new signs t o replace existing signs and the repair, cleaning and painting of signs. - -

8. Electr ical Program, This program includes a l l work performed on b p l a c e highway elect r ical f a c i l i t i e s used t o control t r a f f i c with signal systems, provide safety and sign lighting, illuminate maintenance building and grounds, generate standby power, operate bridges,. pumps and automatic watering systems, Certain navigational Lighting instal led on bridges and bridge fenders or pi l ing are included i n this program.

9, Traffic Safety Devices Program. Work performed under this program includes replacement of guide posts, markers, skid resistant grooves, and also replacement, cleaning and/or painting of guard rails, The repair of median barrier cable chain link fence and portland cement concrete w a l l s ; the repair and maintenance of energy dissipaters such as water type bumpers, sand traps or other devices ins ta l led fo r the purpose of absorbing vehicle energy are included in this program.

10. Public Service Facil i ty Program, Public Serrice Fac i l i t i es consist of roadside rests , v i s ta points, map stops, h is tor ical monuments, roadside fountain areas and vehicle inspection stopse work t o be performed under this program consists of a wide variety of custodial maintenance i n connection with existing restrooms, fountains and picnic areas.

11. Landscape Program, This program refers t o the treatment maintenance and replacement of all vegetative material planted within the State Highway rightrof- way. Work includes watering, fer t i l iz ing, plant replacement, weed control by hand and mechanical means and t r ee trimming.

12. Brice and Aurrp Maintenance Prog;ram, The Bridge and Pump Maintenance Program includes work performed on all structures which provide fo r passage of highway t r a f f i c over, thmugfi o r under obstacles and/or qudlify for bridge numbers as assigned by the Division of Structures.

13. Tubes, Tunnel and Ferry Maintenance Promam, ' The Tubes, Tunnel and Ferry Maintenance Program includes maintenance and repair of tunnels, tubes, fe r r ies and - docks or sl ips, Tunnel or tube maintenance includes washing, cleanin& t i l e r s pai r and the maintenance of elect-mechanical equipment. Tunnel structural repairs w i l l be performed under this program when covered by approved Division of Structures reports of work needed. . .

14. Bridge P a i n t i n g Promam. This program involves bridge maintenance painting performed in conformance with the requirements of air pollution control and water quality control agencies haxirig jurisdiction.

15. Miscellaneous Safety Projects. Elimination of hazards within the operat- areas or the operating right-of-way or projects modifying existing features such as curbs, dikes, headwalls, slopes, ditches, drop inlets, signals and lighting, etc. , within the right-of-way t o improve roadside safety.

16. Major Damage Maintenance, Repair and Restoration. Provides temporan road openings and related maintenance and returns highway fac i l i t i e s t o serviceable states-as rapidly as possible following major damage from storms; earthquakes; t i d a l waves; ship, t ra in o r vehicle collisions; gasoline truck f i res; aircraft crashes, - --

and a l l other kinds of physical violence. (NOTE: These items may be developments rather than repair o r maintenance activit ies, but would be subject to the emergency permit provisions of the Coastal A c t . Inquiries should be directed t o the Regional Cormnission staff if a t all possible, prior t o commencement of construction.)

17. Miscellaneous Alterations,

a. Instdllation, modification or removal of regulatorg, warning or info- t i o n a l signs, according t o the standards of the State Department of Transportation Uniform Sign Chart.

b. Traffic channelization - improvements t o local service and safety by delineation of t r a f f i c routes through the use of curbs, dikes, striping, etc., including turn pockets, where construction i s performed by State Department of Transportation Maintenance Department or equivalent activit ies by local road depart- ment s.

c. Maintenance of existing bicycle faci l i t ies .

d. Modification of t r a f f i c corrtrol systems and devices including addition of new dements such as signs, signals, controllers, and lighting.

e. Devices such as g lare screen, median barrier, fencing, guard rail safety barriers, energy attenuators , guide posts, markers, safety cable, ladders, lighting, hoists, paving grooving.

f . Alteration or widening of &sting grade separation structure where the primary function and u t i l i t y remains unaltered.

g. Minor operational improvements such as median and side ditch drainage faci l i t ies , where not subject t o review under Section 1601 of the Fish and Game Code or involving excavation o r disposal of f i l l outside of the roadway prism.

h. Modification, upgrading, alteration, relocation, or remova of railroad grade crossings, railroad grade crossing protection, and the construction of bus and truck s t o p lanes a t railroad grade crossings.
