DIVISION 01 - GENERAL REQUIREMENTS DRAWINGS & SPECIFICATIONS

THESE DRAWINGS AND SPECIFICATIONS ARE INTENDED SOLELY FOR USE AS

INSTRUMENTS OF SERVICE TO THE CLIENT RETAINING CDG (CLARK DESIGN GROUP,

PC). ANY USE OR REPRODUCTION WITHOUT CDG’S CONSENT IS PROHIBITED. CDG

ASSUMES NO LIABILITY FOR UNAUTHORIZED USE OF THE DRAWINGS AND

SPECIFICATIONS NOR UNAUTHORIZED MODIFICATIONS OR SUBSTITUTIONS FOR THE

WILL ASSUME THE MORE STRINGENT REQUIREMENT APPLIES FOR THE PURPOSES OF

BIDDING. CONTRACTOR WILL THEN SEEK FROM CDG A DETERMINATION FOR THE

CORRECT INTERPRETATION OF THE DESIGN INTENT.

THE GENERAL CONTRACTOR IS NOT RELIEVED OF HIS RESPONSIBILITY TO ACQUIRE AN

UNDERSTANDING OF DESIGN INTENT FOR THE COMPLETED PROJECT AND ASSURE HIS

SUBCONTRACTORS PROPERLY ADDRESS THE FULL REQUIREMENTS OF THE CONTRACT

DOCUMENTS.

IF DOUBT EXISTS AS TO THE DESIGN INTENT, THE GENERAL CONTRACTOR & HIS

AFFECTED SUBCONTRACTORS SHALL CONFER TO EXAMINE AND ARRIVE AT AN

ASSESSMENT. IF DESIGN INTENT REMAINS UNCLEAR, THE GC WILL PREPARE A

WRITTEN REQUEST FOR DETERMINATION BY CDG WHICH INCLUDES EACH OF THE

FOLLOWING ACTIONS.

1. SUBMIT A DETAILED WRITTEN RECOMMENDATION TO SATISFY THE CONDITION IN QUESTION.

2. ROUTE IT PROMPTLY TO THE OWNER OR HIS REPRESENTATIVE FOR REVIEW AND DETERMINATION.

INTERPRETATION OF THE BID DOCUMENTS

IF THERE IS ANY DOUBT ABOUT THE TRUE MEANING AND INTENT OF THE BID DOCUMENTS, OR IF DISCREPANCIES OR OMISSIONS ARE DISCOVERED WHICH WILL SIGNIFICANTLY ALTER THE PRICE, PERFORMANCE, CODE COMPLIANCE, OR COMPLETION OF THE WORK, THE BIDDER SHALL REQUEST A WRITTEN INTERPRETATION IN WRITING FROM THE ARCHITECT, NO LATER THAN 7 DAYS BEFORE THE BID DATE. SHOULD ANY CONFLICT OR INCONSISTENCY OCCURE IN OR BETWEEN THE DRAWINGS AND THE SPECIFICATIONS, THE CONTRACTOR IS DEEMED TO HAVE ESTIMATED ON THE GREATER QUANTITY OF WORK, THE HIGHEST PRICED MATERIAL OR EQUIPMENT INDICATED, AND ON THE MOST SATISFACTORY WAY OF DOING WORK, UNLESS IT SHALL HAVE ASKED FOR AND OBTAINED WRITTEN DECISION BEFORE SUBMISSION OF ITS BID AS TO WHICH METHODS OR MATERIALS WILL BE REQUIRED. SUBMISSION OF A BID SHALL INDICATE TO THE OWNER THAT THE CONTRACTOR HAS COMPLETELY REVIEWED THE BID DOCUMENTS AND IS SUFFICENTLY FAMILIAR WITH THE PROJECT TO SUBMIT A PROPER BID. THE SUBMISSION OF A BID INDICATES THAT THE CONTRACTOR IS PREPARED TO PROVIDE ALL MATERIALS, LABOR, AND SUPERVISION NECESSARY TO COMPLETE THE PROJECT. BARRING ANY UNFORESEEABLE CONDITIONS, THE CONTRACTOR CAN BUILD THE PROJECT AS PRESENTED IN THE DOCUMENTS AND CAN OBTAIN THE REQUIRED OCCUPANCY AND USE PERMITS REQUIRED FOR THE OWNER’S USE OF THE BUILDING.

REQUIREMENTS OF THE GENERAL CONTRACTOR

SHALL BE LICENSED AND IN GOOD STANDING FOR THE LAWFUL EXECUTION OF THE

CONTRACT FOR CONSTRUCTION WITHIN THE JURISDICTION(S) GOVERNING THE

PROJECT.

SHALL LET SUBCONTRACTS FOR THIS PROJECT ONLY TO ENTITIES WHO COMPLY WITH

THE SAME LICENSE & STANDING REQUIREMENT.

SHALL RETAIN ONLY EXPERIENCED TRADESMEN WITH A RECORD OF NOT LESS THAN 5

YRS EXPERIENCE IN MEETING OR EXCEEDING THE INDUSTRY STANDARDS FOR

PERFORMANCE AND WORKMANSHIP CITED IN THESE CONTRACT DOCUMENTS. WHERE

NO STANDARD HAS BEEN CITED, THE WORKMANSHIP SHALL CONFORM TO THE

STANDARD FO CARE APPROPRIATE TO THE TRADE IN THE REGION WHERE THE

PROJECT IN LOCATED.

PROVIDE ALL WORK IN FULL COMPLIANCE WITH FEDERAL, STATE, AND LOCAL

AUTHORITIES HAVING JURISDICTION OVER THE PROJECT.

SHALL NOTIFY THE OWNER’S REPRESENTATIVE OF ANY OMISSIONS OR DISCREPANCIES

UPON DISCOVERY, AND SHALL SUBMIT HIS RECOMMENDATIONS FOR MATERIALS &

METHODS FOR CORRECTION OR REMEDY WITH REPORT OF DISCOVERY.

SHALL PROVIDE ALL MATERIAL, EQUIPMENT, LABOR, TOOLS, AND SERVICES

NECESSARY TO COMPLETE THE WORK IN CONFORMANCE WITH THE CONTRACT

DOCUMENTS.

SHALL PROVIDE ONLY NEW AND SOUND MATERIALS FOR THE WORK DESCRIBED IN AND

BY THE CONTRACT DOCUMENTS. USE OR REUSE OF OLD OR SALVAGED COMPONENTS

IS AT THE SOLE DISCRETION OF THE OWNER OR AS DESCRIBED IN THE CONTRACT

DOCUMENTS. IF THE CONTRACTOR WANTS TO OFFER A SUBSTITUTE FOR A PRODUCT

CITED IN THE CONTRACT DOCUMENTS, HE SHALL SUBMIT A WRITTEN PROPOSAL

IDENTIFYING BOTH SUBSTITUTE & BASE-BID PRODUCT FOR REVIEW AND

DETERMINATION. UNREVIEWED, UNAUTHORIZED SUBSTITUTES ARE NOT PERMITTED.

ALL CONSEQUENCES OF REMOVAL, CORRECTION OR REPLACEMENT WILL BE THE

EXPENSE OF THE GC.

UNLESS OTHERWISE INDICATED, THE GENERAL CONTRACTOR WILL INCLUDE AS A PART

OF HIS SCOPE OF WORK AND EXPENSE:

1. ACQUIRING ALL BUILDING PERMITS, LANDFILL TAXES, USE TAXES, SALES TAX, INSPECTION FEES AND OTHER CHARGES ASSOCIATED WITH THE LAWFUL EXECUTION OF THE PROJECT.

2. BUILDER’S RISK (“ALL RISK”) INSURANCE TO COVER THE COST OF THIS WORK AND ALL COVERAGE AS DEFINED IN ARTICLE II OF GENERAL CONDITIONS (A201). PROVIDE THE OWNER WITH A CERTIFICATE OF CONTRACTOR’S INSURANCE.

3. PROVIDE LICENSE ENGINEERING SERVICES FOR: ROUGH CONSTRUCTION “STAKE-OUT” (FOR OWNER APPROVAL). FINAL CONSTRUCTION STAKING (APPROVED BUILDING

POSITION). 4. THE SERVICES OF AN INDEPENDENT TESTING FIRM, MUTUALLY

ACCEPTABLE TO CDG, FOR QUALITY ASSURANCE REPORTING ON SOLI CONDITIONS & COMPACTION, ROCK REMOVAL, & COMPLIANCE WITH SPECIFIED CONCRETE PERFORMANCE.

THE GENERAL CONTRACTOR IS RESPONSIBLE FOR WORKER & PUBLIC SAFETY

ASSOCIATED WITH THE EXECUTION OF WORK AT THE SITE. GC WILL COORDINATE THE

WORK OF THE TRADES AND COOPERATE WITH THE OWNER TO OBTAIN A SAFE SITE

WITH LEAST INTERFERENCE TO THE OWNER’S FACILITIES AND ON-GOING OPERATION.

COMPLY WITH SAFETY REQUIREMENTS & DIRECTIVES OF ALL AUTHORITIES HAVING

JURISDICTION OVER THE PROJECT.

MAINTAIN A CLEAN & ORDERLY CONSTRUCTION SITE AT ALL TIMES. CLEAR SITE OF

WASTE & DEBRIS AT THE CLOSE OF EACH WORK DAY. CONTINUE SITE MAINTENANCE

AND CLEAN-UP ROUTINES THROUGH SUBSTANTIAL COMPLETION TO ACCEPTANCE FOR

FINAL PAYMENT.

SUBMIT AT A MINIMUM THE FOLLOWING SHOP DRAWING INFORMATION (3 COPIES EACH)

TOGETHER WITH SUBMITTALS REQUIRED BY ANY OTHER SECTION OF THE ARCHITECT’S

OR ENGINEER’S SPECIFICATIONS.
