Open to all It’s the skate park that some children are already using that has led to ward councillor Nas Abrahams calling for youth in the area to accept that it is a facility for “ALL” in the community to use. “It saddened me to hear that there were youngsters in the immediate area of the park who threatened children from nearby areas who came to enjoy themselves,” he said. “This is not why we are building this facil- ity, to separate people, the days of apartheid are dead and we cannot allow our young peo- ple to start practising it in their own way. “I am appealing to them to take ownership of the facility when it comes to caring for the facility, but that ownership does not mean keeping people from not using it in the prop- er manner.” Abrahams pointed out that spaces like these are conducive to families spending time together outdoors and provide a con- structive atmosphere for children, so they have an alternative to spending time on the streets with negative activities. As part of this approach, the city’s Urban Design Drive sees a partnership between the directorates of Economic, Environmental and Spatial Planning; Community Services; and Human Settlements to improve the de- sign in urban areas which were previously neglected. Six learners from Range High are going forgold as part of a unique leadership pro-gramme at the school in Elsies River.Since the start of this year they have been

enrolled in Equilibrium’s Allstar Leader-ship Academy at the school as part of aproject to receive Gold level status for thePresident’s Awards programme.One of the facilitators, Neldene Kleins-

midt, said that they will be receiving theirgold badges and certificates in October andwill be the first to do so in Elsies River.“They will then become the first alumni

group of the Allstar Leadership Academywho will mentor and motivate the nextbatch of participants,” she said.“Part of their recent objectives was to

complete a community project over fivedays and they had the privilege to travel toRobertsonwhere theyworkedwith studentsfrom Ghana and the Netherlands at Lange-berg High School helping paint 11 class-rooms.“Thiswas also a fantastic learning experi-

ence for them to learn about different cul-tures from across the world and having anopportunity to showcase South Africa andteach foreign students about our culture.”

Role modelsDuring August nine more learners who

are part of the project at the schoolwere alsoinvited to the leading youth television pro-gramme Hectic Nine 9, discussing topics ofsibling rivalry and role models that are en-countered in communities.Equilibrium is a registeredNon-ProfitOr-

ganisation, dedicated and determined to ad-dress social, crime andmoral issues that re-strain growth within the Cape, with input

and involvement of key role players and theendorsement of the Department of SocialDevelopment, Department Cultural Affairsand Sport, as well as the City of Cape Town.The services and programmes are de-

signed to contribute towards alleviation ofHIV and Aids, substance abuse, and crime.“As a community based organisation in

Elsies River the need arose for positive rolemodels in our communities,” continuedKleinsmidt.“However, due to the overwhelming de-

gree of poverty in this previously disadvan-taged community, unemployment, gang-sterism and crimewere the order of the day.“In the light of these issues the idea for

Ravensmead cops are gunning for guns intheir area.“We are making inroads in our fight

against gangs, drugs and the proliferationof firearms inourprecinct,” saidColonel Pi-eter Gallant, station commander when hecommended his staff, after they retrievedthree illegal firearms this weekend.“Our men in blue are committed to con-

tinue the fight of eradicating the evil of ille-gal firearms and the use of it as a means ofcontrol and thereby holding the communityto ransom.”Gallant explained that on Sunday at

about 02:30 the sector manager for Uitsig,Const Sihle Mkhwanazi and MonwabisiMdokwe were on patrol when they heardshots being fired in the area.“They scouted the area and noticed a sus-

picious vehicle, a Silver Toyota bubble

shape, speeding off at high speed.“When they attempted to stop the vehicle

they noticed one suspect opening the driv-er’s side door and throwing what was be-lieved to be a firearm out of the vehicle.”Within minutes other units arrived on

the scene to assist them and they managedto stop the car arresting the four occupants,aged 22, 23, 25, and 32. Theywill face chargesfor the illegal possession of firearms andammunition.

PursuitIn a similar bust, two hours later police

on crime prevention patrol duties heardshots being fired and pursued yet again an-other suspicious vehicle.This time however the suspects fled the

scene and pulled into a driveway while twosuspects fled the scene on foot.While police pursued the two suspects on

foot, the female driver ran into the house.

After several attempts to request accessto the house police had to force their wayinto thehousewhere they found the 23-year-old female driver hiding in her bedroom.Officers thenmade her unlock the vehicle

used in the offence and where they re-trieved aNorinco 9mmpistol, onemagazinewith eight rounds.The firearm had been reported stolen in

Elsies River in 2002.They also found a Petro Berretta pistol

under the passenger seat, containing onemagazine with 12 rounds.The firearm’s serial number had been

filed off.A 27-year-oldmale and the driverwere ar-

rested and will face charges for the illegalpossession of firearms and ammunition.CaptainAndreGeldenhuys, the shift com-

mander praised his shift members for a jobwell done and for walking the extra mile tosecure the safety of the community.

With the cold wet winter behind us thespring brings with it a new season of thecircle of life. Reptiles such as snakes arecoming out of hibernation to hunt for amuch-needed spring meal.Snakes are an important natural balance

in our environment controlling the verminrodents, and other disease caring pests. Asnake’s diet varies from species to speciessuch as rats, mice, birds, moles, slugs,snails or frogs, etc.Snakes are attracted into built up areas

due to the abundance of their food source.Humans unintentionally create snake-friendly gardens due to unkempt or over-grown gardens containing discarded build-ing material, rubble or compost. It in turnis a suitable habitat for those little pestslike rats, mice and exotic birds.Remembersnakes are attracted to neglected areas forfood and to avoid human confrontation.There is no real way of keeping snakes off

your property, but if you keep your grasscut short, trees well trimmed and clean upall your building rubble, just to mention afew, then there is less likelihood for snakesto reside on your property. In short keepyour garden tidy. Very, very few snake spe-cies can be considered a threat to humans,as most do not have venom glands. Snakesonly defend themselves against interfer-ence and never attack.Killing a snake is nothing to be proud of

as you are dealing with an animal that hasno arms, fingers, feet, legs, eyelids and along list of disadvantages over other ani-mals.Let’s not succumb to ignorance by de-

ComArt was giving their best when theyhosted their showcase at Artscape on Sun-day 1 September.The audience at the sold-out affair enjoyed

an afternoon of entertainment that provedthat the youngsters in this project are grow-ing into some top talents.Some 120 learners from Elsies River

schools dazzled with their talent and energyas they performed songs, from traditional topopular; danced the Riel, contemporary,Latin and hip-hop; as well as performingsome comedy sketches, poetry, and hostingan art exhibition.The event was the culmination of the sec-

ond annual Elsies Youth Arts Collective

which was established to provide an oppor-tunity for learners to nurture their artisticskills, celebrate their right to creative ex-pression and serve as a gateway tomaximisetheir potential and influence choices as wellas develop new audiences.Since April, the learners have been taking

part in workshops with professional artists,culminating in this showcase. The partici-pating schools also presented their ownitems for the programme.Good news is that there will be a repeat

Former learners from Arcadia Senior SecondarySchool in Bonteheuwel are calling on their class-mates to join them in forming an Alumni Associa-tion to help the school restore the high standards oflearning anddiscipline thatwere once its hallmarks.On Saturday 7 September some of themwere hard

at work in the grounds cutting grass and plantingtrees as part of the activities that they are planningto uplift the spirit of the school.“We want to create the proper atmosphere for

learning by restoring the school building,” saysalumni member Zelda Lategan.

“There has been a start inside with restoring andpainting of someof the corridors and classrooms, butwe need more ex-learners to give us their supportfor our future projects.“One of our first priorities is getting the communi-

ty in this neighbourhood to take ownership of theschool by taking pride in keeping the school safe andstop the destruction that takes place too often.”The official launch of the alumni association will

Badisa Peninsula Social Services in Elsies River isready to tackle another year of providing their care inthe community.They recently held their Annual General Meeting

(AGM) at the Rhenish church in Halt Road, and theyhave shown growth in the valuable services that theyprovide.Chairperson Shireen Horne pointed out that the year

started well and that there were many highlights.“One of them was when our job creation candidates

received awards at the end of courses,” she said.She also added that in a society that has a huge

amount of fathers who are absent in their children’slives they are starting to make a difference.“Wehave extended our services by introducingmedi-

ation and also acknowledging their rights and responsi-bility, especially to unmarried fathers.“Networking and participation from our community

stakeholders like the police, schools and day hospitalshave also improved dramatically.”

Horne said that volunteers also played a very impor-tant role in the organisation but are very scarce dueto their family responsibilities or they’re not interest-ed.Drug activities with children at primary schools are

another concern with schools contacting them daily.“It is very challenging working in an area where

gangsterism is so rife and crises occur on a daily basis.Sometimes our staff are also threatened while tryingto do their work,” she said.“However, we still do our work but are still in need

of donations and resources to be able to achieve our ob-jectives and goals and to provide a more efficient serv-ice to the community.”The guest speaker for the day was Denzil Pedro Smit

from the Maxwell Leadership Institute who deliveredan inspirational talk.The event was well attended by all roleplayers and

promote the welfare of animals andprovide the framework for the city’sapproach to understanding and dealingwith domestic companion animals.

It will focus primarily on the welfareof domestic companion animals andworking equines (e.g. cart horses), apress release from the city reads.

LegislationThis policy is supported by the

legislation that the city is mandated toimplement and entitled to enforce, i.e.the city’s Animal Bylaw.However, the bylaw does not clearly

articulate the city’s approach to thecare and welfare of animals.In the absence of a policy, there is a

lack of clarity on the roles and responsi-bilities between and within governmentfor promoting animal care.The finalised draft will undergo a

public participation process from thisMonday (9 September) to 11 Octoberduring which stakeholders and interest-ed parties are encouraged to providetheir comments.

world when International Foetal AlcoholSpectrum Disorder Day was held on Mon-day.

The local Foetal Alcohol Spectrum Dis-order (FASD) task team were in actionraising awareness by unveiling two mosa-ics, one at the Vanguard health facility inBonteheuwel and another at the BishopLavis Day Hospital.

International FASD Day is held eachyear at 9 minutes past 9 on the 9th month

to draw attention to the fact that womenshould not drink any alcohol whilst preg-nant.

On all the different time zones aroundthe world bells are rung to create aware-ness.

When a woman drinks alcohol, the alco-hol enters the unborn baby’s bloodstreamcausing damage to the foetus.

Such damage is permanent and irre-versible. FASD children will have physi-cal and intellectual problems for the restof their lives.

Residents living in the City of Cape Townhave the right to protect themselves, butmost people don’t know what those rightsare.

Lt Col Patrick Jacobs of the Bothasig po-lice station says this issue should be ad-dressed immediately as more and more peo-ple become victims of crimes.

“Private defence is usually invoked inprotection of the victom’s life or physical in-tegrity, but in principle there is no reasonwhy it should be limited to the protectionof these interests. The law has recognisedthat one can also act in private defencewhile protecting property, dignity, life, bod-ily integrity, in preventing unlawful arrestor preventing attempted rape.

Rules applyBut certain rules apply Jacobs says.“The attack must be unlawful. Private de-

fence against lawful conduct is not possible.For this reason, a person acts unlawfully ifhe attacks a policeman who is authorised bylaw to arrest somebody. If the policeman isnot authorised by law to perform a particu-lar act, or if he exceeds the limits of his au-thority, he may lawfully be resisted,”Jacobs says.

Killing another in protecting one’s prop-erty only, is controversial.

According to law the attack must bethreatening or imminent but not yet com-pleted.

When automatic defence mechanisms areset up such as a shot-gun which will go offduring the night if the shop is entered bya thief, there is, at the time when the deviceis set up, no immediate threat of attack, butthe law recognises that to set up such mech-

anisms which will be triggered the momentthe threatened attack materialises may con-stitute valid private defence in certain nar-rowly-defined circumstances.

The defensive act must be necessary in or-der to protect the interest threatened, in thesense that it must not be possible for the per-son threatened to ward off the attack in an-other, less harmful way.

If, on the termination of the lease, the les-see refuses to leave the house, the lessor isnot entitled to forcefully expel him from thepremises.

The lessor can protect his right and inter-ests by availing himself of the ordinary le-gal remedies, which involve obtaining aneviction order from a court, and possibly al-so claiming damages.

ProtectionThe basic concept underlying private de-

fence is that a person is allowed to “take thelaw into his own hands”, as it were, only ifthe ordinary legal remedies do not affordhim effective protection. He is not allowedto assume to himself the functions of a judgeand a sheriff.

There must be a reasonable relationshipbetween the attack and the defensive actJacobs adds.

“The act of defence may not be moreharmful than necessary to ward off the at-tack. It follows that there must be a certainbalance between the attack and the defencebecause a person is not entitled to shoot andkill someone who is about to steal hislunch,” he says.

A man escaped death on Saturday whenSymphony Way in Delft became a shootingscene.

At about 15:30 the 25-year-old Sidney Hill,from Awasi Court in Leiden stared death inthe face when he was accosted by unknownsuspects.

Hewasdrivingdown the roadand the inci-dent happened when he had to stop at a red

traffic light behind a truck.While waiting for the lights to change five

occupants in a white Nissan Sentra pulledup next to him.

One of the occupants immediately startedfiring shots at him injuring him in the back.

In the process he then rode into the backof the truck, in front of him.

Luck was on his side as he was saved by

the presence of a passing police vehiclewhich then became the target of the attack-ers.

The five suspects then fled the scene onfoot through bushes next to the road leavingtheir vehicle behind.

It was later ascertained that the vehiclewas reported stolen in Bellville earlier thismonth.

The incident caused disruption to peakhour traffic and police searched the bushesfor hours.

The victim refused to lay criminal charg-es, but the suspects are sought on chargesrelating to the stolen vehicle, charges underthe Firearms and Ammunition Act and at-tempted murder of the police officials. The Bothasig police say residents gettingthe terms of crimes wrong when they callin to report them, not only confuses the po-lice but slows down response time and athorough investigation.

“It would be very helpful if people couldreport the crime for what it is,” says Lt ColPatrick Jacobs of the Bothasig police.

According to Jacobs housebreaking iscommitted by apersonwhounlawfully andintentionally breaks into a building or sim-ilar structure, used for human habitationand enters or penetrates it with part of hisor her body or with an instrument withwhich he or she intends to control some-thing on the premises. It also involves theintention to commit a crime there.

Robbery on the other hand has differentcategories and can be classified as follows:

V Robbery of a motor vehicle is the un-lawful and intentional forceful removaland appropriation of a motor vehicle be-longing to another.

V Cash-in-transit robbery is unlawfuland intentional forceful removal and ap-propriation of money or containers for theconveyance ofmoney being transported bysecurity companies on behalf of the ownerthereof.

V Bank robbery is the unlawful and in-tentional forceful removal and appropria-tionofmoneywhichbelongs to abank fromthe bank, during the office hours of thebank.

V House robbery is the unlawful and in-tentional forceful removal and appropria-tion of property from the residentialpremises of another person.

V Business robbery is the unlawful andintentional forceful removal and appropri-ationof property fromthebusinesspremis-es of another person.

Jacobs says robbery is done by suspectsforcefully where a person gets threatenedwith any weapon or by force.

When the house is broken into and thethief is still inside, the owner of suchpremises must contact the police immedi-ately to apprehend such a thief or the own-er can apprehend the thief if nobody’s lifeis in danger. A person can protect his orher family any way that is lawful. As longas such person will be able to justify his oractions to the authorities. Thiswill includeprotecting yourself with pepperspray or astun-gun.

Playingpool has becomeapositive sport-ingpastime in the communityanda localorganisation wants it to grow.The Cape Peninsula Pool Association

hosted its first Pool Tournament at theBelhar Indoor Sports Complex at the endof August and it showed that the sportis still growing.Tournament director Hilton Adams

said that there were 16 teams from vari-ous areas of the Cape Flats who partici-pated in the event.“The tournament was made possible

through us partnering with the City ofCape Town,” he said.“With this eventwewanted to promote

pool as a positive sport among our youthand to create unity in a fragmented sport

that’s not well supported by big corpo-rate.“We are the biggest pool association in

Cape Town and have embarked on an ex-tensive programme to provide the sportas an alternative to gangsterism anddrugs.“We were also very excited that our

mayor Patricia de Lille, has thrown herweight behind making pool cool.”The organisation was established in

The term botched-pregnancy took on awhole new meaning when two sup-posed “pregnancy-termination-spe-

cialists”were caught defraudingapregnantfirst-year university student last week.

The student’s desperation to terminateher pregnancy led Const Mokgethi Thomasto arrest twoalleged fraudsters on 3Septem-ber.

This, after the student went to policewhen the tablets shewas sold didnot inducean abortion as was promised.

According to Thomas, an 18-year-old stu-dent, who fell pregnant in her first year ofstudies, was already four months pregnantwhen she searched the internet for help toterminate the pregnancy.

A legal abortion can only be conducted inSouth Africa in the first three months ofpregnancy.

TabletsShe contacted the person in one of the ad-

vertisements she discovered online, and ar-ranged to meet with him.

The person apparently told her that theywould give her four tablets, the consump-tion of which would lead to the terminationof her pregnancy.

She was also told that the four tabletswould cost R2 000.

Theyarranged tomeet at a public parkingarea in Bellville, where the exchange wasmade.

“The man she met gave her two tablets inexchange for R1 000, instructing her todrink the first two and get the second twolater.

“She was supposed to consume themwhen she got home later,” Thomas said.

When she did arrive at her home she tookthe tablets, but when no change occurred inher condition she googled the name of thetablets she consumed and found that theywere in fact only headache tablets.

When she called themanwho sold her thetablets and told him about this, he allegedlyclaimed that he had given her the wrongprescription and promised to give her theproper one the following day.

ArrestsThey arranged to meet at the same park-

ing area in Bellville, but this time the girldid not trust him enough to go alone.

She went to the Bellville police station

and reported the incident.Thomasaccompaniedher to thismeeting,

but this time a differentmale showed up forthe meeting.

The officer then arrested the 26-year-oldman on a charge of fraud after a search ofhis car uncovered two tablets, which havesince been sent to a laboratory for analysis.

After police interrogated the allegedfraudster, they were able to locate his al-leged partner-in-crime and arrested him ona similar charge.

Both men are said to be Ugandan nation-als.

According to Bellville police spokesper-son, Captain FienieNimb, the swindled stu-dent is enrolled at a reputable local univer-sity, studying with a bursary, and used thebursary money to pay for the botched abor-tion.

“We’ve dealt with many illegal abortionsin the past, but this is the first time we’vehad a scam of this nature reported. Thesefraudsters prey on the desperation of younggirls, who are scared and confused whenthey fall pregnant, for the mere purpose ofexploiting them financially,” Nimb said.

She says girls need to be reminded thatabortion is legal in South Africa.

“According to the law you are entitled tohave a free abortion at a government hospi-tal or clinic during the first three monthsof pregnancy,” she said.

Mark van der Heever, from the WesternCape health department, echoed this andadvised women to go for safe, legal abor-tions rather than “backstreet” abortionsthat are likely to endanger their health.

Act quickly“Anygirl orwomancanask for a termina-

tion of pregnancy in the first three months(12 weeks) of pregnancy.

“It is important to act quickly if an un-wanted pregnancy is suspected,” Van derHeever said.

He however cautioned:“If you are three to five months (13-20

weeks) pregnant, a different set of rules ap-ply for an abortion.

“In this case the doctor, will carry out thetermination of pregnancy only if there is arisk to the physical or mental health of thewoman or foetus; having the baby willcause major social or economic problemsfor the mother; or the woman is pregnantfrom rape or incest.

“The service, however, must still be re-quested at a primary healthcare clinic.” hesaid.
