A varsity boundby obligation to give back to society

The 8th academic session at UPES started with a rejuvenating passion. Noteworthy placements of theprevious batches, enrollments full to the brim, new courses, newer faculty members, additions in theinfrastructure and a renewed road map for the research projects gave a propitious start.

While focusing on the core academic activity, we did not ignore the CSR front. On the heels of ourdaughters meeting with the Governor of Uttarakhand Her Execellency, Mrs. Margaret Alva (August 2010issue), UPES team planned a bigger exposure for them. The girls got a chance of their lifetime to visit thehigh dome seat of authority, the Rashtrapati Bhawan in New Delhi and meet the President Her Execellency,Smt. Pratibha Devi Singh Patil, the First Citizen of India.

young girls between the age group of 11-15 yearsfrom five villages around Bidholi in Pondha Valleyand the campus of University of Petroleum &

Energy Studies, Dehradun met the President of IndiaHer Excellency, Smt. Pratibha Patil at RashtrapatiBhawan at a function held recently in New Delhi onChildren’s Day.

These girls are the adopted daughters of UPES andsupported for their education and development by theUniversity. These young girls, for whom allopportunities are being provided by the University togain self-confidence, went out of their villages let aloneDehradun for the first time! Lotus Temple. Their excitement was uncontrollablewhen their wish list of Barbie dolls and teddy bears wasfulfilled during an outing to a shopping mall in Gurgaon.

They visited the Rashtrapati Bhawan and met theFirst Lady of the country in the ceremonial Ashoka Hallof the President House. The President spent few minuteswith them and also provided a photo opportunity. Thiswas a life time opportunity for them and a matter ofenvy for the others back home. Later the children wereserved with snacks.

During their three days stay in Delhi, they were takenon site-seeing trips. They also spoke to their parentsthrough a video conference where they excitedlydescribed their experience of the trip. The newconfidence in them was vividly visible.

The empire of law is expanding as definitely as thedemands and motions of democracy and opensociety. A contemporary historian of ideas and

institutions may well begin with the upheavals ofthoughts and social movements of the past twocenturies, the great appeal of communist ideology andalongside, the opposite, freedom and liberty. She maynarrate chronicles of supremacy of individual freedoms– catalogued in national and transnational instrumentsand write footnotes on the enormous unleash of humancreativity, the new forms of human resources and theneed for order and equality. The course of this narrativeperhaps cannot escape noticing the challengesemerging from new frontiers of knowledge, and humanendeavours to create new resources and products, andthe political processes endeavouring to secure thesecloser to the needs of all humanity – obliteratinginequalities and disparities.

All of earth’s resources and the potential of theuniverse to the extent accessible to human reach arenow open books of knowledge. The march of scienceand technology has made possible rapid additions ofnew chapters of knowledge and product making.Correspondingly globalization has impacted and willcontinue to impact several dimensions of our lives, byway of “generating transcontinental or interregionalflows and networks of activity, interaction, and theexercise of power”.1 Financial markets and theirintegration, intrusive technologies, economic and legalintegrations, profound changes in the nature and formsof work, have pushed human relationships and thelocation and exercise of power into new dimensions andfrontiers.

The object of this brief glimpse is not to undermineor negate the eternal importance of survey and critique

of human interactions, resources command – in privatehands or State instrumentalities – and the ultimate endsof creating a just and equitable social order –domestically and worldwide. No flags are raised inhonour of exclusivity of any economic or politicalsystem. Yet the un-diminishable value of all freedomsand their relevance to human well being and peacecannot be lost sight of. It is in this total context that theneed to comprehend and take stock of exciting areas oflaw, and their manifold relevance deserves to benoticed.

An expanding genre of legal writing on issues andsubjects of alphabetical stretch tell us about the silentand quiet revolution of human activity and ideas, worldwide. The new subjects of human activityproduce corresponding subjects of rights, responsibilities, regulation, control and ultimatelyjustice. Writing on the impact of internationalizationof law, a recent study observes thus:

“Some legal fields, including the study of legalprofession, have always been more internationalizedthan others. Areas of law most closely connected withinternational trade and multinational companies, suchas international business contracts, anti trust law andcompetition policy, financial markets, intellectualproperty, the internet and new technology, cyber crime, national security, labour and social law, labourregulation and new forms of work, and nowenvironmental law and public interest law, have beenaffected more than family law and property law. Buteven discounting for our lack of empirical knowledgeof the effects of globalisation of many areas of law, it isclear that the internationalized sector has tended togrow, despite national and local diversity.”2

Let me illustrate: The study of company law is nolonger a matter of mere internal management. Ittranscends the borders of private law of obligations ofshareholders and stretches into public law andobligations to and compliances with several societaldemands. The study of taxation is not merely the studyof accounting and computation in terms of tax liabilityprovisions, but also a compendium of benefits, exemptions, concessions and thus a study of law,

economics international and Trans border trade andcommerce and promotion of industry and innovations. The study of intellectual property is today a study ofprivate appropriation of, inventiveness, novelty andoriginality among other matters in respect of chemicals,Pharmaceuticals, Bio-technology, designs, packing, advertisements, apparels and more that relate to severalfields of human activity. Space law invites debates onregulation and responsibilities; Energy laws may entailquestions about equitable distribution and the impacton existing notions of private and public obligationsetc.3 Thus the engineer of law is today called upon tounderstand the role and relevance of engineering; thescientist of law is called upon to deal with the integration

of science and its position in key areas of life.

Aboriginal Art is also a contender for intellectualproperty rights; Traditional medicine systems arehealthy competitors in the health care arena; Alternateforms of energy and their technological innovations areslowly attaining greater visibilities; Environmentalconcerns are propelling sustainable technologymovements. It may thus not be an exaggeration to statethat niche segments of contemporary human activitycall for exalted roles for law and lawyers – as policymakers, as explorers, as science and technologycollaborators, as mediators and conciliators, and thusin advancement of humanity and justice.
