Minister’s foreword I am delighted to introduce the Treasure Act Annual Report 2012, which provides a report on the operation of the Treasure Act 1996 during 2012. The Treasure Act 1996 is a continuing success, ensuring that museums are able to acquire the most significant archaeological discoveries for the benefit of all. 2012 saw a modest increase in the number of potential Treasure finds reported in England, Wales and Northern Ireland (990); 21 more than the number reported in the previous year. Of these items, 367 have been (or are to be) acquired by museums. Many museum acquisitions have been made possible only through the kind assistance of funding bodies, particularly the Art Fund, Headley Trust, Heritage Lottery Fund, National Heritage Memorial Fund and the V&A Purchase Grant Fund. We are thankful to these organisations for their recognition of the importance of archaeological finds and their support of museums’ efforts to acquire them. This year also saw the launch of a new funding stream from the Art Fund called ‘Treasure Plus’ which enabled museums that had already acquired Treasure to increase the public’s engagement with it by facilitating new displays, exhibitions and learning activities. I also applaud the large number of interested parties waiving their right to a reward for Treasure cases, with individuals foregoing their share in 93 cases this year. These donations have allowed 52 museums to acquire finds that may otherwise have not been available for the public to study and enjoy. There are many bodies and people who deserve praise for the ongoing success of the Treasure Act, in particular the Portable Antiquities Scheme (PAS) and its local network of Finds Liaison Officers (FLOs), to whom almost all finds of Treasure are reported. The FLOs’ role is vital in disseminating information about the Act and archaeological best practice to finders of treasure and landowners. They are indispensable in facilitating the administration of Treasure cases and providing the logistical means for the Act to function. Together with curators, scientists and conservators at the national museums of England, Wales and Northern Ireland, they also provide expert reports on Treasure finds for Coroners, who, along with their staff, are also owed thanks for their diligence in holding Treasure inquests. The Department of Britain, Europe and Prehistory at the British Museum, which coordinates the PAS, also supports coroners in England and serves as the secretariat for the Treasure Valuation Committee and I am grateful for their continued excellent work. In order to ensure the long-term success of the Act, and that it reflects current practice and works as efficiently as possible, the Government began this year a process to conduct a Review of the Treasure Act Code of Practice. This will also consider the definition of Treasure, and whether that should be amended. Finally I would like to acknowledge the invaluable contribution of the Treasure Valuation Committee, chaired by Lord Renfrew of Kaimsthorn, which considered 359 treasure cases during 2012. Introduction Under the Treasure Act 1996, finders have a legal obligation to report all finds of potential Treasure. For a summary see finds.org.uk/treasure or the leaflet Advice for Finders of Archaeological Objects, Including Treasure. The Act allows a national or local museum to acquire Treasure finds for public benefit. If this happens, a reward is paid, which is (normally) shared equally between the finder and landowner, though the interested parties may wish to waive their rights to a reward, enabling museums to acquire such finds at no or reduced cost. Rewards are fixed at the full market value of the find, determined by the Secretary of State on the advice of an independent panel of experts known as the Treasure Valuation Committee. Although Treasure finds account for a relatively small proportion of archaeological finds found in England and Wales by the public, finders are encouraged to record all archaeological finds with the Portable Antiquities Scheme: this data is published on the online database at finds.org.uk. The Scheme and its network of local archaeologists – experts in recording small finds, known as Finds Liaison Officers – play an increasingly important role in the operation of the Treasure Act, advising finders of their legal obligations, providing advice on the process and writing reports on potential Treasure finds for local coroners. Organisation The administration of the Treasure Act is undertaken by the Department of Britain, Europe and Prehistory at the British Museum, which employs a Treasure Registrar and four Assistant Treasure Registrars, one of whom is part-time. This work involves the preparation of Treasure cases for inquest (at a Coroner’s Court), the handling of disclaimed cases, acting as the secretariat of the Treasure Valuation Committee, and the payment of rewards to finders/landowners. Treasure Valuation Committee The Committee’s terms of reference are detailed in the Treasure Act 1996 Code of Practice. In short, it is tasked to recommend to the Secretary of State the value of Treasure finds, to recommend abatements of rewards in the case of misbehaviour on the part of the interested parties, and to recommend an apportionment of the reward when there is a disagreement among the parties. The Committee is made up of independent experts appointed for their knowledge of the antiquities trade; its membership also includes someone to represent the interests of finders, a museums’ representative, and an expert in cultural property law. Membership of the Committee at the time of publication consisted of Lord Renfrew of Kaimsthorn (Chairman), Professor Ian Carradice, Dr Tim Pestell, Ms Marian Campbell, Ms Harry Bain, Ms Hetty Gleave, Mr Peter Clayton and Mr Jim Brown. Treasure cases 2012 Number of Treasure cases and geographic distribution The number of Treasure cases reported in 2012 was 990 (Table A), an increase of 2.2% on 2011. This is a 393% increase on the first full year of the Act (1998).

The high level of the reporting of Treasure reflects a wider understanding on the part of finders of their obligations under the Treasure Act, through the education and outreach work of the Portable Antiquities Scheme and its Finds Liaison Officers.

Analysis of Treasure finds by Geographical area Table B illustrates the geographic distribution of Treasure finds. This shows that in 2012 reporting of Treasure in England continued to be heaviest along the eastern half of the country, where Norfolk (123 cases) re-assumed its title of busiest county. It was followed by the other counties of East Anglia – Essex (67 cases) and Suffolk (62) – and Lincolnshire, which also had 62 cases reported. The number of Treasure cases reported from Wales (25) was slightly below the figure from the previous year (28). Wales has a single full-time Portable Antiquities Scheme post, though finds-recording work is also undertaken by the Welsh Archaeological Trusts, and Finds Liaison Officers in the bordering areas of England. The overall number remains significantly less than the number of finds reported from England (962). Northern Ireland, which is not covered by the Portable Antiquities Scheme, had three finds of Treasure reported in 2012. Analysis of Treasure finds by period and type Table C provides the dispositional outcome of Treasure cases according to period and type. Overall, of the 990 cases reported as potential Treasure, 37.2% (368) were acquired (or are in the process of being acquired) by museums. In 25.3% (93) of those cases, one or more parties waived their right to a reward under the Act, thereby enabling museums to acquire the finds at reduced or no public expense. In several cases this involved considerable sums of money. Leicestershire County Council Museums Service was the grateful recipient of two large donations – a late medieval gold ring (case 2012 T605) was valued at £3,500 and the landowner Ian Nourish donated his share of the reward; a hoard of 25 medieval silver coins (case 2012 T586) was valued at £1,302 and all the finders and the landowner forewent their rewards. The Salisbury and South Wiltshire Museum was able to acquire a large late Bronze Age hoard (case 2012 T46) valued at £4,500, when both the finder and the landowner generously waived their rewards. The DCMS maintains a policy of proactive encouragement of interested parties to consider waiving their right to a reward, which has borne dividends in recent years. Table C demonstrates that, as in previous years, the majority of Treasure cases involve objects – jewellery, dress fittings, weaponry, etc. As one moves forward in time from the Bronze Age through to the Post-Medieval period, not only do the number of finds from each period increase (except when transitioning from the Bronze Age to the Iron Age), but, generally speaking, lower percentages of finds from each period are acquired by museums. The majority of Treasure finds dating to before the Norman Conquest of 1066 are acquired by museums, but finds which date from 1066 or after are much more likely to be disclaimed and returned to the finder/landowner. Overall, 33.7% of Treasure objects were acquired by museums. For Treasure cases involving coins, it is a different story. Over 55.4% of these cases were acquired by museums, including all but one Early Medieval coin case. Even among Roman coins, which make up some of the most common items recorded with the Portable Antiquities Scheme, the acquisition rate among museums is quite high (61.2%). Table D: Method of discovery for 2011 Treasure finds
Table D gives the method of discovery of finds reported as Treasure in 2012. As in previous years, metal-detecting accounts for the vast majority (91.82%) of Treasure cases reported in England and Wales. Archaeological finds accounted for 3.13% of 2012 Treasure finds. 30 finds (3.02%) are awaiting confirmation of the circumstances of their discovery. activity like gardening, make up 1.41% of all finds. Several people made finds (4, 0.4%) whilst looking for them with ‘eyes only’ in the course of fieldwalking or searching the Thames foreshore. Exactly 100 museums or museum services across the country acquired or are in the process of acquiring finds of Treasure that were reported in 2012. Table E lists all of the museums acquiring Treasure along with the number of cases they have acquired. This clearly shows that although the national museums acquire some of the finds reported as Treasure, the large majority are acquired by local museums. Perhaps unsurprisingly, the museums of East Anglia and Lincolnshire have acquired the most Treasure – this is where the majority of finds are made. What is good to see is the strong collecting interest throughout the country. The following map shows the number of cases acquired by each museum on the above list (circles) and the number of treasure cases reported in each county of England and Wales (squares). It illustrates the above point, that the museums in the eastern part of the country, where the largest number of finds are made, also acquire the largest number of Treasure cases. It is worth noting that the cases by county are mapped on the geographic centre of the county, while the museum acquisitions are mapped on the precise location of the institution. This is easy to see in Cumbria, where museums on the extremity of the county have acquired several Treasure cases each. It is promising to see that local museums in almost all of the counties of England are benefitting from the Treasure Act. In Wales, the majority of cases are acquired by Amgueddfa Cymru – National Museum Wales. Though based in Cardiff, it operates eight locations throughout the country.

Enforcement It is the aim of the Treasure Act to encourage people to report finds rather than pursue prosecutions. This is reflected in the fact that finders have 14 days to report Treasure from when they first know or have reason to believe the item they have found is potential Treasure. However, that is not to say finders who fail to report Treasure will not be prosecuted. The British Museum works closely with relevant colleagues in local police forces, HM Revenue & Customs, and the Arts Council England (ACE) Export Licensing Unit, as well as the Metropolitan Police Service’s Art & Antiques Unit and the Alliance to Reduce Heritage Crime. The British Museum’s Department of Britain, Europe and Prehistory continues to monitor eBay for items of potential Treasure, and questions vendors of such finds. In 2012, intelligence on 64 cases was logged and made available to the police. Since September 2007, the Deputy Head of the Portable Antiquities Scheme has been an Expert Adviser for export licensing applications of metal-detected finds. In several cases exporters of unreported potential Treasure were asked to report these items in accordance with the Treasure Act.
