The 8th of March is International Women's Day, a day to celebrate, and to make us all reflect on the importance of women in fisheries. One of the areas where women have achieved important advances is the social dimension, and, in particular, where women have been active promoting initiatives to improve working conditions and safety at sea.

In periods of crisis women have often protested against developments and policies that potentially threaten both the survival of artisanal fisheries and the livelihood of dependent coastal communities. Also, in most Member States, women's organisations encourage their members and other women in the community to participate in training and educational courses.

A good example of a successful women's network is Rosa dos Ventos. In this organisation, fishermen's wives started to gather together in small groups in 1988 with the purpose of defending better working conditions for their husbands, who were on board fishing vessels for long periods of time. Due to these long absences at sea, it was difficult for the fishermen to gather around their cause, so the role their women play has been essential to raise awareness of precarious working conditions and safety on board.

These women have also joined fishermen's wives groups in France to share common practices, exchange information, organise workshops and trainings. The network of fishermen's wives has nowadays a clear international dimension.

With their actions, they have contributed to humanise the work of the fishermen, dignifying it and requesting from the public authorities due respect to fishermen and their families. The role of women in fisheries deserves to be recognised in its full extent as it is an integral part of the human dimension of fisheries - fishing being a human activity.

It might appear obvious that fishing is indeed a human activity, but sometimes I am surprised to see the lack of the human dimension in our fisheries legislation. It is a human activity that has an impact on the environment in our seas, and it should therefore be the humane activity carried out in respect of the environment. In this way, the human dimension will become more evident and legislation will be more equitable and adjusted to the daily activities of fishing.

Fisheries MEPs pave the way for first discard ban in the EU

Fisheries Committee MEPs backed a proposed ban on discarding unwanted fish of 35 species caught in the Skagerrak (between the North Sea and the Baltic) in a vote on Tuesday. The ban, to take effect gradually between 2014 and 2016, would be enforced with a remote electronic monitoring system.

The discard ban regulation would oblige fishing vessels to land all caught fish in order to halt "discards" - the practice of throwing fish back into the sea, usually because they are of an unwanted species or size. Most discarded fish die, which is wasteful and aggravates overfishing.

At the same time, the proposals drafted by Werner Kuhn (EPP, DE), aim to fill a gap left by the revocation of an international fisheries agreement on the Skagerrak, inter alia by harmonising EU rules with those of Norway, where a discard ban is already in place.

Remote monitoring by CCTV

To enforce the discard ban, member states would be required to set up a remote electronic monitoring system to supervise fishing in the Skagerrak, which is bound by Denmark, Sweden and Norway.

For the system to work, boats over 12 metres long would have to be equipped with closed circuit TV (CCTV), GPS and transmitting equipment.

Financial aid for this should be granted from the European Maritime and Fisheries Fund, say MEPs, who also insist that the system should be automated and use image recognition software for better data protection.

Pilot scheme

Plans to ban discards in all EU waters were backed by the European Parliament in a plenary vote on the new Common Fisheries

Policy in February. Experience in the Skagerrak should provide useful lessons on how best to enforce the obligation to land all catches made in EU waters

As a previous international agreement on fishing in the Skagerrak no longer applies, boats must abide by the rules of the state in whose territorial waters they are fishing, and harmonising the relevant EU and Norwegian laws should facilitate compliance.

The new measures will apply to a l l EU member states which have fishing rights in the EU part of the Skagerrak, i.e. boats from Germany, Belgium and the Netherlands, as well as Denmark,, Sweden and Norway.

Next stepsThe draft report on certain technical and control measures in the Skagerrak is scheduled for a first reading vote at the April plenary session. The regulation will then need the member states' green light to enter into force from 2014, possibly after reaching a first-reading agreem

Main results of the Council

Concerning fisheries issues, ministers reached agreement on a general approach on the basic provisions of the common fisheries policy (CFP). The Council was then briefed on the state of play of the negotiations on the EU/Morocco fisheries partnership agreement.

Reform of the common fisheries policy

The Council adopted a second general approach on the proposal for a regulation on the common fisheries policy (CFP) (12514/11) replacing the basic provisions of the CFP as part of the CFP reform "package":

This political agreement on the CFP basic provisions is a completion of the first partial general approach agreed by the Council in June 2012 (11322/12). It specifies the Council position on the implementation of the discards ban and the possibility of by-catch quotas.

Dates for implementing the discard ban have been set:

– from 1 January 2014 for pelagic fish;

– from 1 January 2015 for species defining the fisheries in the Baltic (and until 2018 for

other species);

– from 1 January 2016 for species defining the fisheries in the North Sea, the North Western

waters and the South Western waters (and until 2019 for other species);

– from 1 January 2017 for species defining the fisheries in the Mediterranean, in the Black

Sea and in all EU waters and non-EU waters (and until 2019 for other species).

In addition, management tools have been introduced to help the fishing industry to adapt to the obligation to land all catches. The level proposed for de minimis exemptions through management plans should reach 7% in the final phase with adegressive rate (9% the first two years; 8% the two following years). Theses exemptions apply under strict conditions, in particular that all such catches should be fully recorded.

A possibility also has been introduced of using for charitable purposes catches of at least the minimum conservation size landed in the framework of the discard ban.

In addition, the discussions also addressed definitions and responsibilities for implementing environmental obligations that impact on fishing activities.

The proposal's general objective is to ensure fisheries and aquaculture activities that provide long-term sustainable environmental, economic and social conditions, and contribute to the availability of food supplies. New elements concern in particular:

– a landing obligation,

– maximum sustainable yield (MSY) as a compulsory reference for fisheries management,

– regionalised decision-making,

– individually transferable fishing quotas,

– EU measures accompanying member state obligations under environmental legislation.

The European Parliament voted on its position at first reading for this proposal on 6 February 2013. Now, on the basis of the general approach reached in the Council, the discussions between the Parliament and the Council will begin soon.

EU/Morocco fisheries agreement

The Council was briefed by the Commission on the state of play of the EU/Morocco bilateral negotiations to conclude a new protocol to their fisheries partnership agreement.

The Commission recalled that it negotiates in line with its mandate, CFP reform principles and in the light of the European Parliament resolution.

Some member states pointed out the need to conclude an agreement on a new protocol as soon as possible because of the difficult situation of certain segments of their fleet which have been tied up since the interruption of fishing activities in December 2011. However, many delegations underlined the need for a protocol containing a human rights clause and complying with international law. In addition, they emphasised that thisprotocol should ensure the sustainability ofthe resource.

The current fisheries partnership agreement between the EU and Morocco entered into

force in 2007. The first protocol to this agreement ran until 27 February 2011 and provided for a financial contribution of EUR 36.1 million, of which EUR 13.5 million was dedicated to support for Morocco's fisheries policy. Vessels from 11 EU member states could obtain fishing authorisations from Morocco under the agreement and this protocol.

A second protocol, extending its predecessor by one year under essentially the same terms, was negotiated in February 2011 and provisionally applied until December 2011, when the European Parliament decided not to consent to its conclusion. Following that rejection, the Council decided in February 2012 to grant the Commission a mandate to open negotiations for a new protocol withMorocco. Negotiations were opened in early November 2012 in Rabat.

The 5th round of negotiations between the EU and Morocco took place in Rabat (Morocco) on 11 and 12 February 2013. The parties agreed to meet again for a 6th round in Brussels at a later stage. The first rounds essentially dealt with technical conditions that would apply to the EU fleet under the new protocol, while the last discussion dealt with financial aspects and political issues. On the financial aspect, the Commission seeks an agreement representing better value for money than the previous protocol.

Conservation of fishery resources -technical measures for the protection of juveniles

The Council adopted an amendment to regulation 850/98 concerning the conservation of fishery resources through technical measures for the protection of juveniles of marine organisms and repealing regulation 1288/2009 (64/12), following a first-reading agreement with the EuropeanParliament.

"Technical measures" is a general term for rules governing how and where fishermen may fish as opposed to how much they may fish (fishing effort) and/or catch (total allowable catches or TACs and quotas). In this case, these measures encourage selective fisheries targeted at the protection of juveniles in order to minimise the damage to the resource. Juveniles are defined as immature fish that have not reached sexual

maturity, regardless of size or age. The existing technical measures for the protection of juveniles are important for sustainable fishing, and their continuity needs to beensured.

Following the entry into force of the Treaty on the Functioning of the EU (TFEU), technical conservation measures could no longer be included in the annual regulation on fishingopportunities, as these technical measures would have to be adopted via co-decision.

Joint Committee EU-Mauritania

(21/02/2013) The EU-Mauritania Joint Committee, under the current EU-Mauritania Fisheries Partnership Protocol, took place on 19-20 February in Paris.

Both parties agreed to convene rapidly a Joint Scientific Committee with the aim of updating the status of a l l fish stocks, including cephalopods, as well as examining other technical measures for various fisheries. Technical conditions have been improved with the aim of making the Protocol more economically viable, including the increase of by-catch for the shrimps category and the extension of the southern pelagic zone. Moreover, a number of clarifications were introduced and agreed upon on various issues, aiming to ensure more efficient fishing operations.

The Commission welcomes the fact that good progress has been made without deviating from the main principles of the Protocol, such as sustainability and the respect of scientific advice. This outcome will definitely have a positive impact on the future implementation of the Protocol.

Fisheries: Commission announces deductions to Spanish mackerel quota

(05/03/2013) Further to overfishing by Spain of its mackerel quota in 2009, the European Commission has decided on a deduction scheme for future Spanish quotas.

Following a detailed investigation, Spain is to pay back a total of 65 429 tonnes of mackerel over 11 years, i.e. by 2023. This scheme takes into account both environmental and socio-economic aspects of the fishery in a balanced manner.

Commissioner for Maritime Affairs and Fisheries, Maria Damanaki, said: "Enforcement of fisheries rules is the flipside of sustainability. When overshooting happens, the damage done to the stocks must be repaired. This should happen, whenever possible, without ruining fishermen, in particular those who complied with the rules".

The new regulation, adopted under the EU's Fisheries Control Regulation, is the result of detailed investigations. The Commission had serious doubts about the true levels of mackerel fishing registered in Spain in 2009, following inconsistencies between the data collected regarding catches and the sales of mackerel.

Beyond today's decision, the Commission is cooperating closely with the Spanish administration to put in place the necessary mechanisms to prevent any such overfishing from arising again in the future. The Commission highlights, in this perspective, the adoption of an Action Plan to bolster control measures and catch registration in particular, as agreed with Spain in July 2012. This Action Plan is now in its first phase of implementation.

The EFCA adopts its Annual Report for 2012

The EFCA has adopted its annual report for 2012 at the meeting of the Administrative Board held on 5 of March. The annual report comprised all the

activities undertaken by the EFCA during that year and marks a consolidation and strengthening of the core activities on which the success of the Agency has been constructed to date.

Within its mandate, the EFCA will be deeply involved in the effective implementation of the new rules of the reformed Common Fisheries Policy to be adopted, and in particular the key feature of the regional approach. This will be a year of great challenges in this respect.

2012 results

During 2012, five JDPs were successfully implemented: Cod fisheries in the North Sea and Western Waters, Cod and salmon fisheries in the Baltic Sea, Pelagic Fisheries in Western Waters, NAFO & NEAFC and Bluefin Tuna in the Mediterranean Sea and Eastern Atlantic Ocean. The EFCA has focused on improving the quality of the cooperation by fully taking on board the move towards the regional control areas. During the last three years, the days of activity of JDPs have been reasonably constant. In 2012 the slight increase of days of activity was followed by a more significant increase of number of inspections at sea. The total number of inspections coordinated in theframework of the JDPs during 2012 is approaching 9,000 in the JDPs coordinated by EFCA. Overall, there has been a decrease in the ratio of suspected infringements detected per inspection made, with the exception for the cod and salmon in the Baltic Sea JDP and pelagic in Western Waters JDP. The Administrative Board decision of creating two focus groups for assessing compliance levels will help EFCA better assess these figures as well as the general trends in compliance with the Common Fisheries Policy in the EU.

There have also been advances in the pursuit of a level playing field. Training is a key aspect in this regard and it also contributes to improvements in the quality of the coordination and of the inspections. During 2012, a total number of 295 inspectors from Member States participated in EFCA training actions. Beyond the regional workshop training actions, the Agency coordinated and facilitated the elaboration of Core Curricula courses for the training of trainers of national

fisheries inspectors and Union inspectors. With respect to training workshops in support of regional cooperation, 13 training workshops were organized by the EFCA with Member State officials.

The assistance to the Member States and the Commission has been of special importance this year especially in the area of data monitoring and networks. Much progress has been made in the development of the EFCA information management systems with the enhancements of the EFCA Vessel Monitoring System (VMS), the development of the EFCA Electronic recording and Reporting System (ERS) and the definition of the EU Electronic Inspection Report (EIR).

Moreover, during the Bluefin Tuna Joint Deployment Campaign, and in close cooperation with the European Maritime Safety Agency (EMSA), a pilot project was set up with regards to Maritime Surveillance. It assessed the added value of enriching the existing global picture of the EFCA-VMS system with additional layers of information with a view to create an integrated maritime picture.

Proposed Draft Budget for 2014

The proposed draft budget for 2014 is the same as the final budget for 2013: €9,216,900

Successful first round of negotiations for the renewal of the Protocol to the EU –Seychelles Fishing Partnership Agreement (FPA)

(12/03/2013) The first round of discussions for the renewal of the

Protocol of EU – Seychelles Fishing Partnership Agreement was held in

Victoria, Seychelles on 6-8 March 2013.

Both sides agreed on the need for continuity of the current Protocol so that fishing activities could continue in the Seychelles Exclusive Economic Zone without interruption. The current Protocol expires in January 2014.The second round of discussions which will be held in Brussels in mid-April, will focus on issues such as fishing opportunities and financial compensation.The Agreement with the Seychelles is the most important tuna agreement in the Indian Ocean in terms of financial compensation from the EU and fishing opportunities offered to the EU by the Agreement.
