    handling means loading, unloading, packingor unpacking dangerous goods in a means of containment for the purposes of, in the courseof or following transportation and includesstoring them in the course of transportation;import [Repealed, 2009, c. 9, s. 1]

    inspector inspecteur

    inspector means a person designated as an in-spector under subsection 10(1);

    means of containment contenant

    means of containment means a container or packaging, or any part of a means of transportthat is or can be used to contain goods;

    means of transport moyen detransport

    means of transport means a road or railwayvehicle, aircraft, vessel, pipeline or any other contrivance that is or can be used to transport persons or goods;

    Minister ministre

    Minister means the Minister of Transport;

    organization organisation

    organization has the same meaning as in sec-tion 2 of theCriminal Code ;

    person personne

    person means an individual or an organiza-tion;

    (3) This Act does not apply to the extent thatits application is excluded by a regulation madeunder paragraph 27(1)(e) or by a certificate is-sued under section 31.

    Other exceptions (4) This Act does not apply in relation to

    (a) any activity or thing under the sole direc-tion or control of the Minister of NationalDefence, including in circumstances inwhich the regulations provide that it is under that Ministers sole direction or control;(b) commodities transported by a pipelinegoverned by the National Energy Board Act ,the Canada Oil and Gas Operations Act or the law of a province; or (c) dangerous goods confined only by the permanent structure of a vessel.

(1) The Minister may(a) with the approval of the Governor inCouncil, enter into an agreement with one or more provincial governments with respect tothe administration of this Act; and(b) subject to such terms and conditions asthe Governor in Council may specify in theapproval, agree to amendments to the agree-ment.

    5. No person shall import, offer for trans- port, handle or transport any dangerous goods

    unless(a) the person complies with all safety re-quirements and security requirements thatapply under the regulations;(b) the goods are accompanied by all docu-ments that are required under the regulations;(c) a means of containment is used for thegoods that is required or permitted under theregulations; and(d ) the means of containment and means of transport comply with all safety standardsthat apply under the regulations and displayall applicable safety marks in accordancewith the regulations.

    7.1 The Minister may, if the Minister be-lieves that doing so is necessary for the protec-tion of public safety,

    (a) direct a person with an approved emer-gency response assistance plan to implementthe plan, within a reasonable time as speci-fied in the direction, in order to respond to an

    actual or anticipated release of dangerousgoods to which the plan applies; or (b) authorize a person with an approvedemergency response assistance plan to im- plement the plan in order to respond to an ac-tual or anticipated release of dangerousgoods if the Minister does not know theidentity of any person required under subsec-tion 7(1) to have an emergency response as-sistance plan in respect of the release.

    contain dangerous goods;(c) for the purpose of analysis, take, or re-quest the taking of, a reasonable quantity of anything the inspector believes on reasonablegrounds to be dangerous goods;(d ) examine, or request the examining of, in-formation described in paragraph (1)(d ) or (e) that the inspector believes on reasonablegrounds is relevant to the purposes of thisAct and make, or request the making of,copies of any of it; and(e) ask questions of any person for the pur- poses of this Act.

    Advisorycouncils

    26. (1) The Minister may, by order,(a) establish one or more advisory councils

    to advise the Minister on matters concerningexisting or proposed safety marks, safety re-quirements and safety standards or on anyother matters specified in the order;(b) specify the period or periods duringwhich the councils are to serve; and(c) provide for any matters relating to thecouncils or their members as the Minister considers necessary.

    Regulations 27. (1) The Governor in Council may makeregulations generally for carrying out the pur- poses and provisions of this Act, including reg-ulations

    (a) prescribing products, substances and or-ganisms to be included in the classes listed inthe schedule;(b) establishing divisions, subdivisions andgroups of dangerous goods and of the classesof dangerous goods;(c) specifying, for each product, substanceand organism prescribed under para-graph (a), the class, division, subdivision or group into which it falls;(d ) determining or providing the manner of

    ( f ) respecting, for the purposes of para-graph (e), any quantities or concentrations of dangerous goods or ranges of them, respect-ing the manner of determining those quanti-ties, concentrations or ranges and respectingany circumstances or conditions including

    circumstances or conditions regarding premises, facilities or means of containment under which an activity is exempted un-der paragraph (e);( g ) respecting circumstances in which anyactivity or thing is under the sole direction or control of the Minister of National Defence;(h) respecting circumstances in which dan-gerous goods must not be imported, offeredfor transport, handled or transported;(i) specifying dangerous goods that must not be imported, offered for transport, handled or transported in any circumstances;( j) respecting safety marks, safety require-ments and safety standards of general or par-ticular application;( j.1 ) requiring safety management systemsto be established by prescribed persons or classes of persons with respect to specifiedquantities or concentrations of dangerousgoods or ranges of them, specifying thosequantities, concentrations or ranges, respect-ing the manner of determining those quanti-ties, concentrations or ranges and respectingthe content or requirements of those systems;( j.2 ) respecting, in respect of particular dan-gerous goods, or classes, divisions, subdivi-sions and groups of dangerous goods, themeans of containment to be used in import-ing, offering for transport, handling or trans- porting those goods;(k ) specifying quantities or concentrations of dangerous goods, or ranges of them, in rela-tion to which emergency response assistance plans are required to be approved under sec-tion 7, and respecting the manner of deter-mining those quantities, concentrations or ranges;(k.1) respecting the information to be pro-vided in an application for approval of theemergency response assistance plan referredto in section 7;
