Introduce the session- There is funding available for active transportation projects in New Mexico. There are a few years between the announcement for the call for projects managed out of NMDOT Statewide Planning Bureau so we hope to make the connections about what you should be doing today to get ready for future calls for projects, or if another funding source is announced. Maggie and Sky will describe their respective funding programs and Cerrise will describe the role and resources of an RTPO in helping small municipalities (T/LPAs) prioritize community needs, access to funding opportunities

From the most recent call for projects report, give you a sense of the timeline once the call for projects does out. If you are interested in participating in these programs we implore you to start planning now. Attend planning meetings, review state and local plans for your communities priorities, identify needs in your community, assess capacity, what is your timeline, when do you want to get this work done? look at all funding opportunities, federal state local and federal. Which funding source is the best match for what you want to accomplish for your community. After the awards are announced the TLPAs work with NMDOT to get agreements in place, once that happens and other requirements are met, money can then be obligated for FFY2020, which started on Oct 1, 2019 and ends on September 30, 2020. If you don’t obligate your funds by September 20, 2020 then those funds are lost.

Its important to remember where this money comes from, Congress authorized the FAST ACT back in Dec 2015 and the President Obama signed the bill into law. This will expire in 2020, so we are waiting on Congress to enact new legislation to reauthorize these programs. If anyone in here can predict what that will look like I have a million dollar check in the car. Last year at this time we were headed into the longest government shutdown in history. We move forward under the assumption that congress will act. I also want to talk about another element of the program, the money has to be spend around the state by population. Not surprisingly in New Mexico, the program is most competitive in the mid-range population category 5,001 to 200,000, where most communities fit in population wise. If your community is in the lower range population 5,000 or less you have a competitive advantage based on past calls, we see fewer applications in this area. Is it a bigger lift for small entities, yes, but if you have Mid Region MPO in Albuquerque and to a much smaller degree El Paso MPO received a direct allocation for TAP Large Urban that they program. Generally about 1.3 million for ABQ and $50,000 for El Paso.

The MPOs and RTPOs were responsible for submitting all eligible and complete applications to NMDOT; NMDOT did not accept late and/or incomplete applications. By the stated deadlines, NMDOT received thirty-eight (38) TAP applications, fifteen (15) RTP applications and seventeen (17) CMAQ applications, requesting over $71 million in federal funds in total. See Chart 1. After a rigorous review, a multidisciplinary team of NMDOT staff deemed nine (9) TAP, three (3) CMAQ, and three (3) RTP applications ineligible. All remaining eligible applications were rated and ranked by their respective scoring committees (see below) on potential economic impacts, safety improvements, increased accessibility and environmental enhancements, among other scoring factors detailed in each program Guide. So what happened. Contracts are signed money is obligated and the design costs alone come in $230,000 more than estimated. Have to narrow the scope, they end up designing 1.4 miles of pathway and still have to move $89,713 in their construction money into PE to cover the extra costs. Get through design, which includes paying for and obtaining all 5 required certifications, (NEPA, ITS, ROW, Utilities and Railroad) With pretty constant coordination these generally take a year to acquire, but can take twice as long depending on the project. Construction low bid is $891,823 – narrow scope to .9 miles – when you are setting your scope you have to consider origin and destination, the trail has to begin somewhere, in this case the high school and end somewhere else, the middle school Also due to cost overruns and complications we moved construction from FFY17 to FFY18. That FFY17 money is lost (unless we can find another project that needs the money in FFY17.

Note, that when you sign an agreement for $1,000,000, you are responsible for any additional costs. You can request additional funds through NMDOT but it is not a great way to plan. Also once your funds are obligated by FHWA, meaning they are ready to spend, you have 10 years to begin construction on that project or FHWA may claw back the money.

Big, take away is that even with a great application and ¾ baked project, unanticipated funding, design and construction issues made project cost more and take longer to build. Lesson is we cannot anticipate everything, be flexible, be committed and keep coordinating with NMDOT and we will get this work done.

Justification for the Project• The Pueblo of Jemez village is bisected by NM Hwy 4.

Tribal community members must currently walk along a narrow, unsafe foot trail, or along the shoulder of NM 4, to access the health clinic, tribal administration building, post office, library, senior center, fitness center, employment areas, schools and residences. Children must cross Hwy 4 where there are no designated crosswalks or traffic warning signs. It is so dangerous that many parents will not allow their children to walk or bike to school. The lack of safety poses a serious threat to the health and safety of the youth and community as a whole.

• 11 crashes, 3 injuries, 1 fatality (2012-2016)• 6,000-7,500 speeding and traffic tickets/year
