INTRODUCTION

“Trial Transcripts for Fairy Tales" was generated to provide mock trialsituations over familiar material. Students have heard these stories many times, but have failed to recognize the criminal activity in some cases.

The transcripts can be used with students in Grades 5 to 8 and will showthem how trials are conducted.

If the trials are to be presented to the rest of the class or another class,costuming, although not essential, does increase the effectiveness of the trials.

A special thanks to the 1995- 1996 Civics classes of the "We, the People"team at Abe Hubert Middle School, whose input helped create these transcripts.

OBJECTIVES

The trial transcripts can be used to meet many curriculum objectives.

1. Learning about courtroom procedure and the justice system.2. Exposure to using a script.3. Learning life skills and problem solving.4. Making good choices.5. Seeing events from another point of view.6. Identifying conflicts: man vs. man, man vs. self, man vs. nature. 7. Opportunity for participating in a dramatic activity.8. Career studies: judge, lawyer, bailiff, clerk of the court, etc.

TEACHING SUGGESTIONS

1. Read the original story to the students. Try to find an edition that has the original version.Note that there is significantly less violence than in more modern versions: the woodsman in Little Red Riding Hood cutting open the wolf.

A Venn diagram ( page 5 ) could be used to compare and contrast thedegree of violence in the old and new versions.

2. Identify the conflicts in the tales. Are they man against. man, man against nature or man against himself?The students could use the work sheet on page 6 to identify the variouskinds of conflict.

3. Approach the mock trial as a drama. Assign the parts and allow time forthe students to familiarize themselves with the material in the transcripts. If possible have the students memorize them. This makes dramatizationeasier. Use tables and chairs to create the courtroom scene. Most parts can be assigned to either boys or girls. Gender specific comments may need to be modified: for example, sir.

4. The trial, after rehearsals, can be presented to other classes. Have someoneact as “Grandma”, seated in a rocking chair who will read the original story to the audience. Announce that this is a grave wrongdoing that cannot go unpunished, then present the trial.

5. Obtain a State Sentencing Guideline and list of crimes defined from your local county attorney or the State Attorney General's office.

6. Have the students write trial transcripts for other fairy tales: Cinderella, Sleeping Beauty, etc.

7. Present other versions of the fairy stories: The Other Tale of Mr. Wolf.

8. Use the trials to do career studies in the legal system: judge, lawyer, bailiff, clerk of the court, etc.

9. These trials can be integrated with other subject areas: social studies - the law and court system. language arts - different types of conflict, comparing and contrasting characters and events. creative writing - writing other trial transcripts. drama - presenting trials to an audience.

Judge: (to the defendant) You are charged with criminal trespass, misdemeanor theft and criminal

damage to property, damage of property greater than or equal to 500.00, but less than $25,000.00. Do you understand these charges which have been brought against you?

Ms. Goldilocks: Yes, sir.

Judge: How do you plead?

Ms. Goldilocks: Not guilty, Your Honor.

Defense: The Defendant asks for a jury trial.

(The jury has been selected and seated)

Judge: The Clerk will swear in the Jury.

Clerk of the Court: (Talking to the jury) Would you please rise? Raise your right hand. "You and each of you do solemnly swear that will serve as a juror in this trial to the best of your ability and a true verdict render

according to the evidence; so help you God."

Jury: (together) I do.

Clerk of the Court: You may be seated.

Judge: (to the Prosecutor) Are you ready to proceed?

Prosecutor: Yes, Your Honor.

Judge: You may make your opening statement.

Prosecutor: Ladies and Gentlemen of the Jury: I am ____________________, representing the people in the case the People versus Ms. Goldilocks. I

am prepared to prove that the defendant committed the crimes for which

she is charged. The evidence and testimonies that you will hear today will

clearly show that Goldilocks illegally went into the Bear's home, broke an

heirloom chair, ate the bear's porridge, and even slept in their beds. I ask

you this, when confronted did Goldilocks try to make right her crimes?

No, she ran. People with a guilty conscious run. People who don't want to

be caught run. This is a criminal case concerning willful destruction of

property. After you have heard all of the evidence, I'm sure you'll agree

that the defendant, Goldilocks, is guilty.

Judge:(to the Defense) Are you prepared to make an opening statement.

Defense: Ladies and Gentlemen of the Jury, I, ____________, am representing Ms. Goldilocks in the People versus Ms. Goldilocks. We, the defense, are

intending to show you that Goldilocks is innocent of wrong doing. She waslost in the wilderness. Lost! How devastating for a child! She knocked on thedoor of the Bear's cabin, and when no one answered, she entered the buildinglooking for refuge. I intend to show that Goldilocks had no criminal intend;instead, she was trying to find a safe haven when lost in the woods.

Judge: The prosecuting attorney may call his first witness.

Prosecutor: I call to the stand Papa Bear

Clerk: Raise your right hand. "Do you swear to tell the truth and nothing but the truth, so help you God?”

Papa: I do.

Clerk: You may be seated.

Prosecutor: State you name and occupation.

Papa: My name is Papa Bear and I'm a bee keeper.

Prosecution: Now, Papa Bear, I ask to remember that day when Goldilocks visitedyour home. When you left for your walk in the woods, did you lock your door?

Papa: I closed the door. I don't remember locking it. We only planned to be gone a few minutes.

Prosecutor: Had you given anyone permission to be in the house while you were gone?

Papa: Certainly not.

Prosecutor: What was different about the house when you came back?

Papa: First of all, the door wasn't quite shut. Then we noticed that the food on the table had been eaten, the cushions on the chairs were not fluffed, and baby bear's chair was broken.

Prosecutor: What did you do then?

Papa: Together we searched the house. We noticed the beds had been messed andthat's when we found Goldilocks in Baby Bears' bed.

Prosecutor: Can you identify the person that was in your house that day?

Papa: That's the girl, the defendant, Goldilocks.

Prosecutor: No further questions

Judge: (to the Defense) Do you wish to question this witness?

Defense: No questions at this time, but I reserve the right to call this witness later.

Judge: Do you wish to call another witness?

Prosecution: I call Baby Bear to the stand.

Clerk: Raise your right hand. "Do you swear to tell the truth and nothing but the truth so help you God?"

Baby Bear: I do.

Clerk: You may be seated.

Prosecution: How did you feel when you came home?

Baby Bear: I was hungry. I was going to eat but my food was gone. So then I decided to read and my chair was broken.

Prosecution: Did you help locate the culprit?

Baby Bear: I went with Mama and Papa to search the place. I found Goldilocks asleep in my bed.

Prosecution: No further questions.

Defense: Did you try to scare Goldilocks?

Baby Bear: Scare Goldilocks? I was afraid. I screamed. She ran. I've only seenone other human and we ate him.

Defense: That will be all.

Prosecution: I call Mama Bear to the stand.

Clerk: Raise your right hand. "Do you swear to tell the truth and nothing but the truth so help you God?"

Mama Bear: I do.

Clerk: You may be seated.

Prosecution: The incident as told by Baby, did this really happen?

Mama Bear: No

Prosecution: Why did Baby Bear say this?

Mama Bear: He believes it's true, but it was a nightmare he had not long ago.

Prosecution: Did you or any of your family do anything to endanger the life of Goldilocks?

Mama Bear: No, sir.

Prosecutor: No further questions. The prosecution rests.

Judge: (to the Defense) Do you wish to call a witness?

Defense: Yes, Your Honor, I call Goldilocks.

Clerk: Raise your right hand. "Do you swear to tell the truth and nothing but the truth so help you God?"

Defense: Where were you the night before you took refuge in the bear's house?

Goldilocks: Hiking in the woods.

Defense: Why did you go inside the cabin?

Goldilocks: I was lost, hungry, and afraid.

Defense: Did you ever say you'd not pay for the porridge or the chair?

Goldilocks: No, sir.

Defense: No more questions.

Judge: Does the prosecution wish to cross examine?

Prosecution: Yes, sir. (to Goldilocks) Were you invited into the Bear's home?

Goldilocks: No, sir.

Prosecution: Did you eat the porridge? Yes or no?

Goldilocks: I was starving.

Prosecution: I said yes or no.

Goldilocks: Yes.

Prosecution: Did you sit in Baby Bear's chair and break it? Yes or no.

Goldilocks: I refuse to answer that question on the grounds that it may incriminate me.

Prosecution: Why did you run away?

Goldilocks: I was afraid.

Defense: Defense calls Ranger Watson to the stand.

Clerk: Raise your right hand. "Do you swear to tell the truth and nothing but the truth so help you God?"

Watson: I do.

Clerk: You may be seated.

Defense: State your name and occupation.

Watson: I'm Ranger Watson. I'm a Ranger for these woods.

Defense: Ranger Watson, when people are in the wilderness and need shelter whatis the general rule regarding entering a home?

Watson: A man's home is always his castle, but strangers are allowed to enter cabins when in danger. They are also required to leave the place as found and replace anything used or broken.

Defense: Is it possible that the code of the wilderness fits this case?

Prosecution: I object

Judge: Overruled, you may answer the question.

Watson: The first part does. She sought shelter when in need. But, I'd have to sayshe fails on the second part-she didn't make good on the damages done.

Defense: Isn't it possible that Goldilocks would have paid the Bears if they hadn't chased her from their home?

Prosecution: I object. The answer would require speculation on the part of the witness.

Judge: Sustained.

Defense: No more questions.

Judge: (addressing the prosecution) Do you wish to question this witness?

Prosecution: Ranger Watson, could Goldilocks mail a check for the damages ifshe wanted to?

Watson: Yes, the Bears receive their mail through the Ranger Station.

Prosecution: Wouldn't you say that Goldilocks had plenty of time to make restitution if she was planning to?

Defense: I object. It requires speculation on the part of the witness.

Judge: Objection sustained

Prosecution: No more questions, your honor.

Judge: Do you wish to call any more witnesses?

Defense: Defense rests.

Judge: If there are no more witnesses, you (to Prosecution) may make your closing statement.

Prosecution: Ladies and gentlemen of the Jury: All the people that you have heardhere in the courtroom say the same thing. Goldilocks illegally entered theBears' house, ate the porridge, and did criminal damage to Baby Bear's antiquechair exceeding $500.00. When the Bears came home, she ran. If she wasafraid, she still could have written a letter of apology and offered to paydamages. I would also like to note the mental pain and anguish that Baby Bearsuffered through all of this. And if you will recall, the code of the wildernesssays that it is acceptable to stay at someone's cabin as long as you repay them,which Goldilocks did not do.

Judge: (to Defense) Are you prepared to make your closing statement?

Defense: (to judge) Yes, Your Honor. (to jury) We are here to decide the fate of Ms. Goldilocks. DidGoldilocks enter the cabin to commit a crime? I ask you, has theprosecution convinced you that Goldilocks in a criminal. Just look at her.She certainly made a mistake by not making immediate restitution to theBears, but she intended no harm. I asked that you find my client,Goldilocks, not guilty.

Judge: Members of the jury, it is your duty to decide the facts. The Prosecutionhas tried to show that Goldilocks is guilty of criminal damage to property,misdemeanor theft, and criminal trespass. The Defense has tried to show thatMs. Goldilocks had intended to use the cabin for a temporary refuge and tomake payment for the items used. Did Goldilocks intend to cheat the bears?In deciding, you must be guided by the law. When a person enters into a home

without permission, that would be criminal trespass. The misdemeanor theftinvolves the food that Ms. Goldilocks ate while in the cabin. Most importantlyis the charge of criminal damage to property. It is a felony crime. This crime isdefined as the destruction of property belonging to another. Did Goldilockscommit these crimes? You must decide.What is most important, you as a jury must remember that every person isconsidered innocent until proved guilty beyond a reasonable doubt. If youhave a reasonable doubt about the guilt of the defendant, you must find hernot guilty.The jury is instructed to select a foreman. You are dismissed to deliberate! Return to the courtroom when you have a decision.

and deserves a verdict of guilty. I ask you to picture your grandmother andchild inside this wolf. He has absolutely no value for human life. If it hadn'tbeen for this brave hunter, two people, one with her whole life before her,would have died.

Judge: (to Mr. Wolf's Attorney, the Defense) Are you prepared to make an opening statement.

Defense: I, ____________, am representing Mr. Wolf in the People versusMr. Wolf. I sincerely believe Mr. Wolf's actions are misunderstood. I intendto show you that Mr. Wolf was just trying to survive. Judge him consideringthat he is a wolf and these people were the closest meal. He was hungry. Ifyou were a wolf you would probably do the same.

(The Defender seats himself beside his client.)

Judge: The Prosecuting Attorney may call his first witness.

Prosecution: I call to the stand the Little Red Riding Hood.

Clerk: Raise your right hand. “Do you swear to tell the truth and nothing butthe truth so help you God?”

Ms Hood: I do.

Clerk: You may be seated.

Prosecution: State your name and occupation.

Ms Hood: My name is Little Red Riding Hood and I'm unemployed.

Prosecution: What were you doing that day on a path, all alone, in thedangerous woods?

Ms Hood: I was taking cake and wine to my sick grandmother.

Prosecution: Do your parents normally allow you to walk in the woods unescorted?

Ms Hood: Yes, but...

Prosecution: But what? Ms. Hood. Why would your parents allow this?

Ms Hood: Well, they say it isn't dangerous if you stay on the path.

Prosecution: You didn't do that did you Ms. Hood? Why did you leave thepath?

Hood: Mr. Wolf suggested I pick flowers for my grandmother.

Prosecution: Weren't you afraid of the wolf?

Ms Hood: Well, I've never been near one before and he was acting so nice.

Prosecution: Exactly what else did you talk about?

Ms Hood: Well, I told him where grandmother lived and that she was sick.

Prosecution: So the wolf knew exactly were you were going, didn't he?

Ms Hood: Oh yes, I told him how to get there the way my mother tells people.

Prosecution: No, more questions your honor.

Judge: (to the Defense) Do you have questions for this witness?

Defense: Yes, your Honor. Ms. Hood, did you say it was not safe to leave the path?

Ms. Hood: Yes, my mother warned me to stay on the path.

Defense: Then you left the path knowing it could be dangerous?

Prosecution: I object

Judge: Over ruled. Get to the point of this questioning.

Defense: Did you not put your own life in danger by leaving the path?

Ms. Hood: Well I guess.

Defense: A simple yes or no, please.

Ms. Hood: (head down) Yes.

Defense: Did you speak to the wolf even though you knew that wolves are dangerous to children? Yes or no?

Defense: How do you perceive a wolf?

Ms. Hood: Before this happened I was not afraid, but now I am.

Defense: Weren't you responsible for these actions that put your life in danger?

Prosecution: I object. The Defense is badgering the witness.

Judge: Sustained. (looking at the Defense) May I remind you that Ms. Hood is a minor and consideration should be made for her age.

Defense: No more questions. (Ms. Hood steps down.)

Judge: You may call your next witness.

Prosecution: I now call Grandmother to the Stand.

(Grandmother comes to the stand.)

Clerk: Raise your right hand. “Do you swear to tell the truth and nothing butthe truth so help you God?”

Grandmother: I do.

Prosecution: Please state your name and occupation.

Grandmother: My name is Grandmother and I am retired.

Prosecution: What happened that day when you were eaten by a wolf?

Grandmother: I had been ill for several days. I was waiting for my precious grandchild to bring me my daily food. I was just too ill to get out of bed. Iheard a knock and the person at the door said it was Little Red RidingHood. I probably should have caught the change in voice, but I'd been so ill.Anyway, the door was unlocked and I ask my granddaughter to come in. I'mnot really clear what happened next. 1,1, I only know that my nextconscious thought occurred inside some animal. Not long after, Red RidingHood was there, too. It was such a horrible place. I couldn't breathe and itwas so crowded.

Grandmother: Please, I just want to get this over.

Prosecution: What happened next?

Grandmother: The Hunter carefully sliced into the animal and released my granddaughter and me.

Prosecution: Did you then get a good look at your attacker?

Grandmother: Indeed I did.

Prosecution: Can you identify him?

Grandmother: I can and will. It's the defendant, Mr. Wolf.

Prosecution: No more questions.

Judge: (Looking at the Defense) Do you wish to question the witness?

Defense: No questions, Your Honor.

Judge: (to the Prosecution) Do you wish to call another witness?

Prosecution: Yes, I call Mr. Hunter to the stand.

Prosecution: Please give your name and occupation. Mr. Hunter: I'm Mr. Hunter and I work in the woods as the hunter.

Prosecution: How did you happen on the scene?

Mr. Hunter: I make it a point to check on Grandmother regularly. She isgetting on in years. It's the way of the woods to help each other.

Prosecutor: In your own words will you share the events of that incident.

Mr. Hunter: As I said before, I make a point of passing by Grandmother's as Igo to hunt. I heard loud snoring noises. I knew that Grandmother didn'tsnore like that. So I quietly entered the cabin. It was dark; the curtains weredrawn. I walked over to the bed and spotted Mr. Wolf dressed inGrandmother's bed clothes. I drew my gun, but then I thought maybeGrandmother was inside. Imagine my surprise as I opened up Mr. Wolf andfound not only Grandmother, but Little Red Riding Hood as well.

Prosecutor: And in what condition were the victims?

Mr. Hunter: Well, Ms. Hood jumped right out. Grandmother, who had been ill anyway, could barely breathe. I called 911 and asked for an ambulance andEMT's for both Grandmother and Mr. Wolf then I called for the sheriff.

Prosecutor: I have no more questions.

Judge: Does the Defense wish to question this witness?

Defense: Yes, your honor, just one question. Mr. Hunter, by what right did you take a knife and carve on my client?

Mr. Hunter: If I hadn't, your client would be facing two counts of murder.

Defense: I move that the remark be stricken from the record.

Judge: Let the remark be stricken from the record and I ask that the jurydisregard this statement from Mr. Hunter.

Mr. Wolf: My name is Mr. Wolf and I am a predator of the woods.

Defense: Would you say that your job is important?

Mr. Wolf: Yes, you see my job is to make sure that the small animals are culledand that helps keep a balance in nature.

Defense: What has happened to your job?

Mr. Wolf: Well, I'm being phased out. Man has destroyed so much of the wildand animals of all kinds may face extinction.

Prosecution: I object. This line of questioning is not relevant to the case athand.

Defense: Your Honor, I wish to show you that due to circumstances beyond Mr. Wolf's control, he faced not only the loss of his job but certainstarvation in those woods.

Judge: I caution you to keep to the facts. You can continue with this line of questioning.

Defense: Who is Mr. Hunter in relationship to you?

Mr. Wolf: He has been hired to kill me.

Prosecution: I object. Mr. Hunter is not on trial here.

Prosecution: Did you trick Ms. Hood into delaying her trip to herGrandmother's on the path by picking flowers?

Mr. Wolf: I did suggest that Ms. Hood bring flowers to her dear, sick grandmother. I didn't know that was a crime.

Prosecution: Just answer the questions please. Did you go to Grandmother's cabin, swallow her, dress as Grandmother, and wait for Ms. Hood?

Mr. Wolf: I refuse to answer that question! I'm taking the fifth. I refuse toanswer on the grounds that it may incriminate me.

Prosecution: Did you then invite Ms. Hood into her own Grandmother's cabin end swallow her?

Mr. Wolf: Again I refuse to answer that question.

Prosecution: No more questions.

Judge: (to the Defense) Do you wish to call any more witnesses?

Defense: The Defense rests.

Prosecution: It is clear here that Mr. Wolf did pretend to be Little Red Riding Hood to gain entrance into the cabin in the woods. Secondly, he falselyimpersonated Grandmother to get Ms. Hood to enter the cabin. Heswallowed whole both Grandmother and Ms. Hood to later digest as hisdinner. Remember, there are three witnesses who can identify Mr. Wolf asthe perpetrator of this crime-Grandmother, Little Red Riding Hood and Mr.Hunter. I am asking that you find the defendant, Mr. Wolf, guilty on twocounts of false impersonation and two counts of attempted murder.

Judge: (to Defense) Are you prepared to make your closing statement?

Defense: (to Judge) Yes, your Honor. (to jury) Today we are here to decide the fate of Mr. Wolf. Do you believethat the prosecutor has proven beyond a shadow of a doubt the guilt of myclient? My client, Mr. Wolf, is indeed a predator. He has served our worldwell. I ask if you believe that he deserves to be incarcerated perhaps in a zoofor trying to survive the best way he knew? I believe that for his past servicein the balance of nature dilemma that, instead, Mr. Wolf deserves to bereleased. Yes, released into the wilds of the North where people are few andhis services to nature are still needed. If you were hungry and out in thewoods you might for instance kill a rabbit to provide for your needs. Wouldyou convict my client for just feeding himself because he was hungry? Hisintentions must be judged here. I ask that you find my client not guilty andthat he be given the opportunity to start over in the North Woods.

Judge: Members of the jury, it is your duty to decide the facts. TheProsecution has tried to show Mr. Wolf is guilty of two counts of falseimpersonation and attempted murder. The Defense has tried to show thatMr. Wolf is merely a victim of circumstance. You must decide if Mr. Wolfis guilty or not guilty of each crime separately.

In deciding, you must be guided by the law. It is my duty to explain it to you.

Under the law, the pretense of another identity with the goal of personalgain is false impersonation. When deliberate actions are taken that threatenthe life of a person, that is considered attempted murder. Did Mr. Wolf plan,

are unskilled in the ways of the woods, totally unprotected from those whomay harm them? When you listen to the testimonies and review the facts, thetruth will shine. And the truth is, ladies and gentlemen of the jury, that thedefendant did actively participate in the abandonment and abuse of hischildren.

Judge: (to the Defense) Are you prepared to make an opening statement?

Defense: Ladies and Gentlemen of the Jury, I, _____________, am representing Mr. Dad in the People versus Mr. Dad. We, the defense, are intending to showyou the loving father, the defendant, could not have committed these cruelcrimes against his children, but was himself the victim of his second wife'smanipulations. Hansel: I heard him two separate times plan with my step mother to leave us in the woods to die.

Prosecution: What did you do the first time?

Hansel: I went outside and put some shiny rocks into my pockets to mark the trail home.

Prosecution: What did you do once you were in the woods?

Hansel: After Dad and Step Mom left us alone, we heard what we thought wasthe chopping of wood. We ate and then went to sleep. When we woke up, we realized we were alone in the woods. We waited for the moon to rise and then followed the shiny stones home.

Prosecution: What happened?

Hansel: My step mom said we were bad for not coming home sooner. But, dad was happy.

Prosecution: Did this happen again?

Hansel: Yes, one more time. I threw down bread crumbs to follow in the moon light, but the animals of the woods must have eaten them. This time wewere lost.

Prosecution: What happened then?

Hansel: We walked. Then a singing bird led us to the delicious house owned by the witch. She heard us eating her home. When she came out, she acted friendly, we couldn't have known that she planned to eat us.

Prosecution: No more questions, Your Honor.

Judge: Does the defense wish to question this witness?

Defense: Yes, your Honor. What happened when you were with the witch?

Hansel: She tried to fatten me up for her table!

Defense: And, how did you get away?

Hansel: Gretel freed us.

Gretel: I had to work like a slave for the witch. She made me feed Hansel, too.

Prosecution: Were your lives in danger?

Gretel: Yes

Prosecution: How?

Gretel: The witch was fattening up Hansel so she could eat him, and then she wasplanning to do the same thing to me.

Prosecution: How did you get away?

Gretel: When the witch was checking the hot oven, I shoved her into the ovenand latched it tightly. Then I released Hansel.

Prosecution: But you were still lost. How did you find your way?

Gretel: The ducks on the pond helped us.

Prosecution: Isn't your father responsible for this incident?

Gretel: Well, I don't think so.

Prosecution: Would you have been lost in the forest if your father had protected you? Yes or no.

Gretel: (quietly, sadly with head down) No.

Defense: How much do you get paid?

Dad: I trade the wood for things that we need. Usually there is enough demandfor wood in the village to live well enough.

Defense: And recently?

Dad: When the economy was bad, many of the villagers cut their own wood, and we were close to starving.

Prosecution: Did you not plan with your wife to lead the children into the woodsand leave them there for the wild animals to eat?

Dad: I won't answer that question. I fear it may incriminate me.

Prosecution: Did you wife give an ultimatum? Did she insist that you help her dispose of Hansel and Gretel?

Dad: I again refuse to answer the question because it may incriminate me.

Prosecution: Do you believe that a father rules his house?

Dad: Yes, I believe the father should rule the house.

Prosecution: Did you rule your house?

Defense: I object. The prosecution is badgering the witness.

Judge: These incriminating questions are fruitless. Do you have any more questions?

Prosecution: No more questions.

Judge: (to the Defense) Do you wish to call any more witnesses?

Defense: Defense rests.

Judge: If there are no more witnesses, you (to Prosecution) may make your closing statement.

Prosecution: Ladies and gentlemen of the Jury: I need to tell you one last time what this man has done. When faced with making a choice between his wifeand his children, he chose his wife and took his children to the woods to beripped apart by the wild animals or eaten by the wicked witch. Instead ofrunning through all the facts that have been proven here, I want you to think, ifthis man has done these things twice, will he not do them again when times aretough?

Judge: (to Defense) Are you prepared to make your closing statement?

Defense: (to judge) Yes, your honor. (to jury) We are here to decide the facts of the case against Mr. Dad. Do you believe that the prosecutor hasproven beyond a shadow of a doubt the guilt of my client? In life, people makemany mistakes. In this case somebody made a mistake. That mistake was notcaused by my client. We should examine the intent. If Dad wanted hischildren to die, he could have killed them without going into the woods. Ibelieve he was trying to give his children a chance to survive. Dad did what hedid because his wife convinced him they would all probably die anyway fromstarvation. Maybe being in the woods is what saved these children's lives. I'masking that you find Mr. Dad not guilty. He needs a chance to rebuild hisfamily and restore the loving care that has existed in the past.

Judge: Members of the jury, It is your duty to decide the facts. The Prosecution has tried to show Mr. Dad is guilty of four counts of aggravated abandonmentof a child, two counts of abuse of a child, and two counts of non-support of achild or a spouse. The Defense has tried to show that Mr. Dad was merely abystander in the actions against his children. You must decide if Mr. Dad isguilty or not guilty of each crime separately.In deciding, you must be guided by the law. It is my duty to explain it to you.Under the law, when children are left on their own without guidance from aresponsible adult, that is abandonment. When the health of the children isinvolved, then it becomes aggravated abandonment. Abuse of a child couldinvolve several factors-mental and physical. And finally, the non-support of achild or spouse-this means that the needs of the children were not being met bya responsible party. Did Mr. Dad plan and execute the above crimes? You as ajury must remember that every person is considered innocent until provedguilty beyond a reasonable doubt. If you have a reasonable doubt about theguilt of the defendant, you must find him not guilty.The jury is instructed to select a foremen. You are dismissed to deliberate! Return to the courtroom when you have a decision.
