The BWB Employment team focuses
on delivering our clients’ desired
outcomes in a straightforward and
cost-effective way. We pride ourselves
on our “can do” approach.
Contents
We have a thorough understanding of the law and
apply it in a pragmatic fashion. The majority of our
work involves helping clients to resolve workplace
disputes, in which we are able to add value by
drawing on our judgement and considerable
experience. We have a strong reputation for
negotiating excellent outcomes.
Unusually, we routinely conduct our own advocacy,
which enables the same expert lawyer to manage
and articulate a case from start to finish, providing
a seamless “telephone to tribunal” service.
We are highly experienced in conducting cutting
edge cases in the higher courts and tribunals,
both domestic and European. Our extensive
advocacy experience, for which we are renowned,
enables us to adopt a consistent strategy,
which we deliver seamlessly.

We provide tailor-made training on all the legal aspects of managing staff.
We believe that training should not only be about theory, but about the practical
application of the law to everyday situations. Our sessions are fully interactive
and draw on our extensive day-to-day experience in advising clients about
handling difficult workplace situations.
We can train your staff on new internal policies
and procedures, explaining them within the legal
context, and work through how they would apply
to practical scenarios. Sometimes a specific staff
training need is identified as a result of a grievance
or a tribunal claim - we can work within whatever
framework you require to meet this.
Our training packages cover a wide range
of essential topics focused on developing
management skills. Areas of focus include
recruitment; conducting disciplinary and
grievance hearings; handling investigations;
and equal opportunities within the workplace.
We also offer training on topical areas of
employment law, from age discrimination
and unfair dismissal to whistleblowing.
In addition to topic specific training, we also
run mock employment tribunals. Our “mock
employment tribunal” provides a realistic insight
into the running of a tribunal, illustrating how
best to manage a contentious situation In addition
to topic specific training, we also run mock
employment tribunals.
Our costs are not charged per head, but are
calculated on the basis of the length of the
session. A half-day session starts from £1000
(exclusive of VAT) – which for 20 people is just
£50 per head.

might meet your training needs (and budget),

/TUPE Whether considering what happens to employees
on an outsourcing or retendering of a service
contract, or assessing the employment-
related liabilities associated with the sale of a
business, the TUPE regulations have far reaching
implications.
The commercial consequences of misapplying the
law can be extremely damaging. Equally, a strong
understanding of this area can present profound
strategic and financial advantages.
A clear and practical understanding of TUPE is
widely considered to be one of the most valuable
skills a HR professional can possess. This half-
day masterclass will provide delegates with the
understanding, confidence and materials required
to effectively manage and oversee a full range of
TUPE transactions.
The law governing the transfer of undertakings
has significant practical, commercial and financial
implications for employers of all sizes and in
all sectors.

Pre-employment checks are a vital part of an
employer’s recruitment process. Employers must
conduct all necessary checks appropriately,
to ensure that they make the right recruitment
decision and comply with any governing legal
requirements.
Immigration compliance in particular has become
increasingly burdensome on employers. Employers
are increasingly tasked with ‘policing’ immigration,
and it is therefore now even more important for
employers to undertake the right to work checks
for employees.
This two hour seminar will focus on when and
how to make pre-employment checks (including
criminal records, reference and health checks, as
well social media screening), and what employers
can and cannot do with the information revealed.
The seminar will also focus in detail on the
pre-employment right to work checks, the follow
up checks and the best practice for conducting
the checks.
/ This seminar will cover the following issues:
__When and how should pre-employment
checks be done?
_What can be done with the information revealed?
__What are the pre-employment right to work checks?
__When are follow up right to work checks required?
__How to conduct the right to work checks?
__What are the repercussions for failure to conduct the right to work checks?
/ Why choose this course?
___Delegates will receive:

/Difficult conversations and negotiations
Dismissing an employee is an extremely difficult
experience for all concerned. Many managers
dread the prospect and feel a great deal of
uncertainty about the legal framework governing
termination discussions. Since July 2013,
employers and employees have been able to
engage in confidential “off the record” discussions
and negotiations about parting ways. However,
there are strict limitations as to when employers
can embark upon these types of discussions on
a confidential basis.

/Taking the stress out of reasonable adjustments
Stress, depression and anxiety are now the most
common causes of long-term sickness absence.
These conditions pose unique difficulties for
employers. Very often employees will seek to
conceal the nature and extent of their condition
until issues come to a head. Even where a
diagnosis is available, it is frequently far from
clear what adjustments ought to be made and how
far an employer should go to accommodate and
support an employee.
