1 Kelsey Summey Draft 1 INTRODUCTION Thesis – I consider the NSA’s mass surveillance to be unethical on terms of the fourth amendment, plus it has not been proven effective, was kept a secret from Americans, and effects innocent people. The NSA’s mass surveillance program is entitled the Metadata Program. It is run solely through cell phone providers. It forces these providers to give the NSA all the calling records of clients. These records include the phone numbers that have been called by and the numbers that have this particular individual. The data is then stored in a large database in the middle of nowhere, where it is stored for five years. (Stone, 2014) This program would be fine if the NSA implemented a warrant for every citizen of the United States, but they didn’t and they won’t. This is obviously a violation of the Fourth Amendment, which states, “The right of people to be secure in their persons, houses, papers, and effects, against unreasonable searches and

This is obviously a violation of the Fourth Amendment, which states, The right of people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized. (insert citation of contitutionous.com) Since the NSA is not following the Constitution by means of incorporating warrants into their searches, it is unethical. Other departments, such as the FBI, are sure to get a warrant before searching the homes and/or belongings of Americans and so should the NSA. Another huge problem with the Metadata Program is that it is not proven effective. The NSA defends the program so much because they claim that it can be used to make valuable connections between callers, and these connections could be used to track down terrorists. That would make a lot of sense if there were evidence to show Americans that the program has successfully stopped a terrorist attack. But it hasnt.
