DEAR TIPS FRIENDS:

I am looking forward to welcoming you back to California as we wind down the celebration of TIPS’ 80th anniversary - this time in beautiful San Francisco for the ABA Annual Meeting. Perennially dubbed as America’s favorite city, the kickback lifestyle of San Francisco is contagious and the food and music scene is second to none. We hope that you can enjoy all that San Francisco has to offer: from the towers of the Golden Gate Bridge to the clattering cable cars on Powell and Lombard Streets. Enjoy Fisherman’s Wharf, Alcatraz, Marina District, Financial District, Haight-Ashbury and Chinatown. We are fortunate to be housed at the wonderful Westin St. Francis, the epicenter of the wonderful shopping and restaurants of Union Square.

The meeting kicks off on Thursday, August 8th with Section business meetings and the TIPS Council and Past-Chair’s Dinner. On Friday, August 9th, we will have a full day of Section business meetings. In the evening, we will have our Welcome, Pursuit of Justice and Liberty Achievement Award Reception at the beautiful Law Offices of Sedgwick, LLP. Saturday, August 10th is packed with Section business meetings and a free night of exploring the culinary trends, nightlife and clubs of San Francisco. On Sunday, August 11th, you will have some free time to explore San Francisco. Sunday night, we will have our James Carroll Leadership and Awards Dinner followed by the Section’s Hospitality. Monday, August 12th will conclude our meeting after the Leadership Breakfast.

TIPS has a remarkable schedule and a vast variety of CLE programs that will run from Friday, August 9th to Sunday, August 11th , planned by the Products Liability, Title Insurance, Ethics and Professionalism, Toxic Torts and Environmental Law, Insurance Coverage Litigation, Aviation and Space Law, International Law, Media Privacy and Defamation Law, Professionals’ Officers’ & Directors’ Liability Law, Trial Techniques, Alternative Dispute Resolution, Automobile Law and Staff Counsel Committees at the ABA CLE Centre in Moscone West. This year, we have been selected to provide a Show-case program on Saturday, August 10th that the Animal Law Committee will present. Please review all of our CLE offerings and plan on attending these excellent programs.

Our schedule is filled with opportunities to learn from the best, enjoy one another’s company, and network with corporate counsel and insurance company representa-tives from all over the country. Many thanks to our major sponsors who have helped to support our meeting and its programming. Also, a personal thank you to my An-nual Meeting Program Co-Chairs, David Reif and John Buckley, my Annual Meeting Arrangements Chair, Ron Richman, and Annual Meeting Committee members Sue Farina, Grant Law and Jim Riddle.

Finally, it is with great privilege that I was honored to serve as the Chair of TIPS in 2012-2013. The year was simply epic (both personally and professionally) and my gratitude to all of you for the incredible work you do to benefit our profession. Your dedication to the pursuit of justice is unmatched. We truly have a great Section and Staff, and together we do wonderful things to better us all as lawyers and as a society - thank you for making it all happen.

I look forward to seeing you all in San Francisco.

Best Regards,

Dick Semerdjian Chair, Tort Trial & Insurance Practice Section Schwartz Semerdjian Ballard & Cauley, LLP San Diego, CA

Dear TIPS Member,

Welcome to San Francisco. We hope you do not leave your heart here but you can leave your CLE worries behind.

We have a fabulous array of CLE Programs for lawyers of all backgrounds, skills and CLE requirements. We start on Thursday with our commitment to diversity. Attend our Women in the Law program, Beyond a Seat at the Table, co-sponsored by the ABA Commission on Women in the Profession, where you can watch and listen as some of our outstanding women lawyers help you successfully navigate the challenges facing women in practice today and how to overcome those obstacles. We follow up on Friday with an obstacle that affects us all equally across every diverse boundary — addiction. For thousands of practic-ing lawyers, the bar they cannot pass is the corner tavern or the party next door. The Directors of the Legal Professionals Program at Hazelden, along with the former Clinical Director of the Lawyer’s Assistance Program in Illinois, join a lawyer in recovery and a parent whose son is in recovery to share insights on how to recognize, intervene in, and manage a loved one’s addiction. On Saturday, we highlight Civility in the Courtroom, a perspective on the changes in practice over the 80-year history of TIPS. Find out whether the “Good Old Days” were that good. And we finish on Sunday with an interactive program on Ethical Dilemmas and Race and Gender Challenges. Test yourself and find out how you can uphold the highest standards of our profession.

Don’t miss our Presidential Showcase Program on Saturday, on Food Labeling, Advertising, and Fraud, sponsored by our Animal Law Committee. Do you Re-ally Know What You Are Eating? Find out! Food fraud is a $49 billion industry. What is real and what is not will surprise and enlighten you, but only if you watch this mouth-watering program.

In between these highlights, we have a terrific line up of programs on Lawyers as Corporate Directors; How to Mediate a Complex Products Case; Title Insur-ance Limits; Insuring Against Heinous Risks; NTSB investigations; Libel on the Internet; and Class Action Developments.

Take a look at our CLE Schedule in this brochure and join us and our colleagues who have worked very hard to put together an array of programs that is as diverse in scope and as long on practical information as our great TIPS Section. There is something in our lineup for everyone. Enjoy!

For boating enthu-siasts, San Francisco is hosting the 2013 Louis Vuitton Cup and America’s Cup, world class yacht racing. The Louis Vuitton Cup semi-final races will be held in San Francisco Bay August 6-14. Spend an afternoon by Fisherman’s Wharf, enjoying a steaming cup of clam chowder or fresh, local Dungeness crab and watching the races. For baseball fans, head over to AT&T Park and see the 2012 World Champion SF Giants.

During the Annual Meeting, we are offering a wealth of top notch CLE programs covering a wide spectrum of current hot topics such as managing the risks inherent in heinous crimes, transportation/accident scene investigations, internet libel, ethics and our Showcase Program: Do you really know what you are eating? Contemporary issues you should know about in food labeling, advertising and fraud.

San Francisco is an amazing family friendly city. While you are here, be sure to check out Alcatraz (but you must buy your tickets in advance, they sell out early), Chinatown, Union Square and North Beach. Take a ride on the famous cable cars. Not-to-miss museums include the SF Museum of Modern Art, Asian Art Museum, California Academy of Sciences in Golden Gate Park and Contemporary Jewish Museum. All but the California Academy of Sciences are within easy walk-ing distance from the Westin St. Francis Hotel.

Restaurants in San Francisco are bountiful. Sure to please restaurants include Alioto’s at Fisherman’s Wharf, Sam’s Grill, B44 (incredible paellas) and Café Tiramisu, all on Belden Alley downtown, and the amazing waterfront restaurants along the Embarcadero including The Slanted Door, Waterfront Restaurant, Waterbar Restaurant and Butterfly. Although they don’t take reservations, if you show up early for lunch or dinner, one of San Francisco’s most famous and historic restaurants, dating back to 1849, is the Tadich Grill. It’s worth the walk and the wait.

Take in all that San Francisco and the Bay Area have to offer. I look forward to welcoming you all to San Francisco.

Women in the Law: Beyond a Seat at the TableCLE CenterTIPS Committee Main Sponsor: Products Liability CommitteeSponsoring Sections, Divisions, Forums Business Law Section, ABA Commission on Women in the Profession & Asian American Bar AssociationDescription:While efforts to ensure that women have a level playing field to advance in the legal profession have yielded much progress and promise in recent years, there is still much room for improvement. In this opening program for the ABA’s Women in the Law day, this panel of distinguished women corporate counsel will engage in a conversation about the advances made toward ensuring a level playing field for women, the obstacles they see and have faced, how to effectively confront those obstacles, and what companies and law departments can do to remove them. The discussion will also address the business case for ensuring a level field, the value of diversity of viewpoint, and how corporate counsel can lead by example by mentoring, encouraging change in the profession both in their companies and outside by ensuring that law firms achieve concrete and measurable results.

Whether you work in a law firm, a company, or a governmental office, this program will provide you with insight into a persisting challenge. The program will also provide you with practical ideas for addressing the obstacles that keep women from moving beyond a seat at the table.

Is reasonable diligence in establishing title as insured enough? – an examination of the title insurer’s right to establish title as insured, including the history and meaning of “reasonable diligence” under the policies, the potential exposure for losses if title is not established with “reasonable diligence,” and practical aspects of trying these issues to a jury. What do you want to know about the claims process? – a behind the scenes look at the process from intake, the decision to retain counsel or not, and the handling and resolution of a claim. 2:00 PM - 3:30 PM CLE PROGRAM Were Those Shots I Heard? Managing and Insuring Against Heinous RisksCLE CenterTIPS Committee Main Sponsor: Insurance Coverage Litigation Committee Description:In recent years, our nation has endured many fatal shootings and similar tragic events on school campuses, in movie theatres, shopping centers, and places of worship. Indeed, no place seems safe from these atrocious acts. What steps can businesses take to protect themselves, employees, customers, and the general public from such apparently random acts of violence? Can business entities or employers be held liable for not adopting or following protocols set up to identify risks and prevent harm associated with these acts? Can liability attach to directors and officers? Are those who had previous contact with the perpetrator (schools, employers, mental health professionals) subject to liability? If such events do occur, can the financial risks of liability be adequately transferred to insurers? Are there exclusions or limitations in liability policies that should be examined as a part of a thorough risk review before an incident? All of these questions will be discussed by our panel of experts.

protection, government regulation, animal welfare, false advertising, and criminal law.

A panel of attorneys representing the government, industry, and consumers, will discuss recent high-profile civil and criminal litigation involving allegations of misleading food labeling, including the rising tide of class action litigation related to the use of “all natural” on labels. The panel will also analyze false advertising claims against producers of food, and will consider the value and limits of mandatory labeling. The topic is especially relevant in the wake of the introduction of the Egg Products Inspection Act amendments, a first-of-its-kind cooperative effort between the Humane Society of the United States and the United Egg Producers, which would impose mandatory federal labeling provisions on eggs. The panel will also discuss the “Happy Cows” case, which alleged false advertising by the California Milk Advisory Board, and the Mendes/Corcpork cases, which alleged misrepresentations by omission by producers of food that came from animals held in conditions of alleged cruelty.

In addition, the panel will address “Food Fraud”, the criminal implications of food fraud violations, including prosecutorial charging theories, available charging statutes, recent demonstrative prosecutions, and future trends. Food fraud generally describes the intentional adulteration of food with cheaper ingredients for economic gain or the otherwise misbranding or mislabeling of food. The counterfeit food industry is estimated to generate approximately $49 billion a year. Common food fraud products include, for example: pomegranate juice, honey, maple syrup, olive oil, fruit juice, apple juice, orange juice, milk, coffee, vanilla, saffron, cognac, champagne, goat cheese, fish, shrimp, and other seafood. Some experts estimate that approximately 5 to 7% of the U.S. food supply is affected by food fraud. Victims range from consumers at the local supermarket to multibillion dollar corporations. The rise in food fraud has not gone unnoticed by law enforcement. In recent years, federal authorities have cracked down on food fraud perpetrators, obtaining convictions in a series of significant food fraud prosecutions.

If you want to learn more about what you are really eating and how it ends up on your plate, this program is must-attend CLE.

People tend to wax poetic in reminiscing about the “good old days,” and we, as attorneys, are no exception to bemoaning the decline of ethics and the profession from their perceived pedestal of years past. In this program, however, we will look back to the past, examine whether ethics and the profession have changed so much over the years, and to the extent there have been changes, explore whether such changes are a decline in the profession, or instead, a cure of the ills of our predecessors. We will also examine what we can learn from the changes, if any, and from the time-honored canons that remain the same.

Finding Your Own Voice – Ethical Dilemmas, Race and Gender Challenges and the Pitfalls of PracticeCLE CenterTIPS Committee Main Sponsor: Ethics and Professionalism Special Standing CommitteeSponsoring Sections, Division, Forums Center for Professional Responsibility (CPR)Co-Sponsor: DecisionQuestDescription:Video clips introduce 15 scenarios, followed by interactive audience response device choices for resolution and panel discussion.

Race and gender issues continue to plague American society. Lawyers are part of that society. As a consequence, lawyers, too, are confronted by race and gender bias. The approach we take, the way we respond, and the degree to which we participate impacts our reputations and image in the bar every bit as much as it happens with the ethical choices we make. Are we satisfied with our decisions? Are we happy with what we’ve done? Or, do we harbor regrets at who we have become? In 10 years (or 30) will we be proud of our accomplishments and the path we took along the way?

This program is designed to help you “Find Your Own Voice,” recognize ethical dilemmas, face up to race and gender challenges and the pitfalls of practice that can make or break your reputation – and undermine your self-image. Learn to respond in ways that advance your cause, build your reputation, and enhance your self-esteem. As you establish your persona as a litigator, be proud of who you are and the way you practice. Build a reputation worthy of respect and admiration by being a lawyer in whom others have confidence, and to whom others turn when they have ethical or moral questions. When you uphold the highest traditions of our profession, you reap the rewards for a lifetime.
