Add the following to Item 8.2.D — List of Subcontractors Form:

“For the Marine Subcontractor Work Type, Bidders shall name only pre-qualifiedMarine Subcontractor. Naming multiple Marine Subcontractors in the Bidder’s List ofSubcontractors for the Marine Subcontractor work type will not be permitted and willresult in a non-compliant bid. Entering “OWN FORCES” shall only be permitted forBidders (General Contractors) also prequalified to perform Marine Construction work.Entering “OWN FORCES” if the Bidder is not prequalified to perform MarineConstruction work will result in a non-compliant bid.

TheContractor shall obtain an exemption to the noise By-law for Construction beyond thisdate range as necessary to suit the Contractor’s site activities and working hours.”

IV. QUESTIONS

01 In order to prepare a considered, meaningful and competitive quotation werequest an extension to the tender period of 4 weeks making the submission date19 July.

Al Refer to Section I — EXTENSION TO CLOSING DATE in this addendum.

Q2 We submitted a package last year to become a supplier of Precast ConcreteTunnel Liners for the City of Toronto. We were approved for manufacturing PCTLfor the Coxwell Bypass Tunnel. We would like to get on the list to be amanufacturer for the Ashbridges Bay Treatment Plant Outfall Tunnel. Do we needto resubmit an application?

A2 Non-named alternative equipment or suppliers will not be considered prior to the Orderto Commence Work. Refer to Section 5A — Specific Conditions of Contract, Clause 23and Section 4— Scope of Work, Section 01035 - Alternatives.

03 Due to the complexity of the Ashbridges Bay Outfall scope of work and itsenvironment, and in view of the limited time for preparing a detailed andresponsible proposal that complies with all the tender requirements, we kindly buturgently request the City of Toronto to grant a 4 weeks’ time extension for bidsubmission.

A3 Refer to Section I — EXTENSION TO CLOSING DATE in this addendum.

04 <<company name>> respectfully requests a tender extension of at least 30-45days. The current schedule does not allow sufficient time to sufficiently analyzethe tender documents nor present the most competitive bid possible.

05 The drawings index note a prefix ‘M’ for mechanical drawings but no mechanicaldrawings have been issued. More particularly no details are provided for the gatesother than the requirements noted in Page 7 of Specs Section 11282. Pleaseprovide details showing the general arrangement for the gate and liftinginstallation.

A5 No mechanical drawings have been issued. Bulkhead gates are shown on DrawingS208.

06 Can the City provide the 5 drawings listed below in CAD or similar drawing formatto precisely develop the Construction Methodology Lay Outs for tunneling andEffluents? 1001-2018-04-006, 1001-2018-04-024, 1001-2018-04-028, 1001-201 8-04-044 and 1001-2018-04-045.

A6 CAD drawings will not be issued to Bidders during the Tender period. Upon request fromthe successful Bidder, CAD drawings will be issued to the successful Bidder afterContract Award accompanied by a formal disclaimer letter that will limit the Contractor’suse of the CAD drawings.

07 We are currently supporting the bidding contractors working on the above projectbid. However, we realised our supplier Dynamic Water Control Gates are notnamed for the supply of Bulk Heads under Section :11282 of Division 71).Dynamic Water Control Gates is one of the reputed Canadian Manufacturer

They are leaders in the Design and Manufacturing ofStainless Steel Water Control Gates, Bulkheads, Stop Logs, Mud Valves,Telescopic Valves, Diversion Gates etc. They have combined 66 years ofexperience and Dynamics products are designed, manufactured and tested inCanada. The gates are designed to meet and/or exceed the requirements ofAWWA C561 and are NSF-61 Certified. As representative of Dynamic WaterControl Gates we’d like to request you kindly considering including them thru’ anupcoming addendum to enable us work on this project. I’m enclosing a briefoverview of the products brochure for your perusal.

A7 Non-named alternative equipment or suppliers will not be considered prior to the Orderto Commence Work. Refer to Section 5A — Specific Conditions of Contract, Clause 23and Section 4 — Scope of Work, Section 01035 - Alternatives.

08 DRB - Section 5A, Specific Conditions, Attachment C, 7.6 - It is unreasonable tomake the Contractor solely responsible to compensate the DRB board for allclaims under $250k in value. It gives the Owner little incentive to reach anagreement during the good-faith negotiations which precede the DRB process.Please ammend to a 50:50 sharing of cost between the Owner & Contractor.

A8 Section 5A — Specific Conditions of Contract, Attachment C, Item 7.6 will not be revised.

09 Measurement & Payment - Specification Division 1 General Requirements, Section01025, Part 1, 1.4.4.2 Mobilisation - Please increase the allowed mobilisationpayment to 3%, which is more reflective of the mobilisation cost incurred by theContractor

A9 Percentages for mobilization payment as defined in Section 4 — Scope of Work, Section01025— Measurement and Payment, Item 1.4.4.2.1 will not be revised. The Contractorwill be required to provide a Lump Sum Bid Price Breakdown following Order toCommence per Section 4 — Scope of Work, Section 01025, Item 1.4.

010 Measurement & Payment - Specification Division 1 General Requirements, Section01025, Part 1, 1.4.4.8.5 TBM Payment - Please reduce the percentage payable after1 km of tunnelling to 5%. The TBM will have been fully procured/paid at that stageand the proposed payment milestone of 10% will create unnecessary financingcost for the supplier/contractor.

AlO Refer to Section III — REVISIONS, Item 6 in this addendum.

011 Section 2: 8.2.D - please clarify if the names of the subcontractors have to besubmitted with the bid submission or five business days after the proponent hasbeen contacted by the city.

Al 1 Bidders shall be responsible for providing a List of Subcontractors with the completedTender Package Submission as described in Section 3 - Tender Package Submission.

012 As specified in Addendum 2. Section III - Answer A4: “It is the sole responsibilityof the Bidder to liaise with qualified Marine Subcontractors in support to theirTender Submission.” Considering that: (a) the General Contractor has to provide aLump Sum Price as per Section 3 page 3-12, including all the marine work pricesquoted by a selected marine subcontractor; (b) the General Contractor has toprovide Provisional Items and Cash Allowances also for Marine Works (Section 3— Page 3-1 5, Items 17 to 22); (c) the details of all the information related to theMarine Works, as per Section 2-8.2.H.v dot #8 (marine construction bid basisparameters) as to be included in the Escrow Bid Documents; (d) the Marine

Subcontractors need an appropriate time to prepare their studies and to submit tothe General Contractors a competitive offer; (e) the General Contractors need anappropriate time to receive, analyze and incorporate in their offer the informationand data received by the Marine Subcontractors, in order to provide their bestpossible competitive offer; ff) the general contractors need an appropriate time toincorporate the construction schedule of the Marine Subcontractors in their mainconstruction schedule, with all consequent potential impacts on their direct andindirect cost analysis and optimization. Therefore we kindly ask for an extensionof the submission date of 4 weeks.

013 Please kindly confirm if it possible to indicate in the Subcontractor List (Section 3— Page 3-18) more than a Subcontractor for each Work Type.

Noise Regulations and Exemption

Toronto Municipal Code Chapter 591 Noise, provides standards for noise and applies to all properties within the City of Toronto, with the intention of reducing the impact of unwanted sound on the residents of the City. It prevents persons from making, causing or permitting any noise, which is likely to disturb the quiet, peace, rest, enjoyment, comfort of City inhabitants.

Who needs to apply?

Noise exemption permits can be requested for special events, events in parks and/or construction outside of permitted hours. Requests for permits are forwarded to the affected ward Councillor for approval.

Applicants must apply for a permit at least three weeks before the event or activity is to occur.

Fees

1. Application fee: All applicants must pay the $100 application fee, which must be

submitted with the completed application to the District Office servicing the ward where the permit is being requested. All locations accept cash, cheques and money orders. The Toronto and East York Office at 433 Eastern Avenue also accepts Visa, MasterCard and debit. Please make cheques and money orders payable to "City of Toronto Treasurer".

2. Monitoring fee: This is an additional fee separate of the application fee. Some events may require noise monitoring by city staff. Upon review of a permit application, should the City deem noise monitoring to be a condition for permit approval, the applicant shall be notified. Payment of the assessed monitoring fee must be received prior to permit issuance. The monitoring fee is $60 per hour per officer plus applicable taxes. Events occurring after 7 pm will require two officers.

The ABTP Outfall project involves construction of a new tunnelled outfall that will convey treated effluent from theABTP into Lake Ontario. Outfall components to be constructed include concrete conduits; an 80 m deep on-shoreshaft; a 3,500 m long tunnel beneath the lakebed; and 50 risers extending from the tunnel to the lakebed.Additional details are provided in the attached drawings and project Executive Summary.

A noise exemption permit is required to allow for 24 hour a day construction to facilitate construction activitiesnecessary to meet the project schedule for this important City of Toronto infrastructure project. The project will be tendered by the City of Toronto and will be constructed by a contractor to be selected in thefuture. The City is applying for this permit in advance of contract award to provide assurance to biddingcontractors that a noise exemption permit will be granted. The City will transfer the exemption to the Contractoronce one is selected.

The nature of work is such that constructionequipment changes regularly. A Noise Impact Assessment was conducted for the project and activities completed as part of thisexemption will not exceed levels stipulated in Chapter 591-10D. The contract includes a noise specification which requires thecontractor to: use construction equipment that complies with maximum noise levels; prepare a noise monitoring plan; conductnoise baseline monitoring and conduct continuous monitoring during the course of the work to ensure that noise levels stipulatedin Chapter 591-10D are not exceeded.

By submitting this application for a Noise Exemption permit, the Applicant shall at all times observe and comply with, and endeavour to ensure strict observance of and compliance with all statutory requirements, rules, regulations, by-laws, terms and conditions, or other authority which in any manner affect or related to this permit, including without limitation, the by-laws of the City of Toronto. Please note that an exemption permit is not guaranteed; an exemption permit is issued pending approval from the area Councillor and all applicable fees paid. The application fee is non-refundable.
