DOCTORA WHEREAS, pursuant to Article III, Section 458, Paragraph (5) (vi) of Republic Act 7160 otherwise known as the Local Government Code empowers the Sangguniang Panlungsod to regulate traffic on all streets and bridges, prohibit the putting up of encroachments or obstacles thereon, and, when necessary in the interest of public welfare, authorize the removal of encroachments and illegal constructions in public places; WHEREAS, there is a need to alleviate the traffic congestion, polluted air, unsafe roads and vehicles, the absence of car parks, sidewalks, and open spaces, and the realities of increases in the number of vehicles parking and traversing the downtown streets of Iloilo in the near future due to full urbanization and motorization; WHEREAS, pursuant to the priority investment plans of the City Government, the construction of a world-class parking building is a natural necessity in the redevelopment and revitalization of the Iloilo Central Market in making it an attractive place for investments and marketing of goods. NOW, THEREFORE, be it ordained, as it is hereby ordained by the Sangguniang Panlungsod of the City of Iloilo, that: SECTION 1. NOW, THEREFORE, be it ordained, as it is hereby ordained by the Sangguniang Panlungsod of the City of Iloilo, that:

SECTION 1. TITLE – This ordinance shall be known as “AN ORDINANCE STRENGTHENING ORDINANCE NO. 2009-216 AND FOR THE PURPOSE, CONSTRUCTING A WORLD-CLASS PARKING BUILDING AND APPROPRIATING FUNDS THEREFORE AND TO BE BUILT IN THE PLANNED REDEVELOPMENT AND REVITILIZATION OF THE ILOILO CENTRAL MARKET”

SECTION 2. DECLARATION OF POLICY – Transportation decisions taken now will affect how people will live in the city in the future. Conformably with the general welfare clause of the 1987 Constitution, the promotion of the general welfare is an essential enjoyment by all the people, to this end, the purpose of this act is the establishment of a parking building which comes as a price of economic growth and development concomitant with the exponential increase in the number of vehicles, and associated problems of traffic congestion and air and noise pollution.

SECTION 3. FUNCTIONS OF THE PARKING BUILDING – The building shall be exclusively used by privately owned vehicles, excluding trucks, willing to utilize the parking spaces as provided in the building subject to appropriate rates, which, will constitute as part of the income of the city.

SECTION 4. DEFINITION OF TERMS –

a) Privately owned vehicles shall include and only refer to an automobile or a motorcycle operated by an individual that is not owned or leased by a government agency, and is not commercially leased or rented under a government rental agreement for use in connection with official government business. Furthermore, it shall not include an employee’s own vehicle used on official business for which the employee is reimbursed by the government on the basis of mileage.

b) Trucks herein used shall refer only to motor vehicles of six wheels or more and those motor vehicles classified as “T” with the Land Transportation Office (LTO). It shall include both government and private trucks.

SECTION 5. PARKING RATES – The following shall be the prescribed parking rates:

a) Hourly rate – FIFTEEN (Php 15.00) PESOS;b) Overnight rate – THREE HUNDRED (Php 300.00) PESOS; Anything in excess of

twenty-four (24) hours will be computed on an hourly basis.c) During tourism events in the city, the rate of both hourly and overnight rates

shall be doubled.

SECTION 6. EXEMPTIONS – The mayor, in the interest of public safety and security, may grant exemption to any vehicles prohibited as described under paragraph A of Section 4 of this act.

SECTION 7. FUNDING – The amount necessary to carry out the provisions of this act shall be included in the budget of the concerned government agencies in the general appropriations act of the year following its enactment into law and thereafter.

SECTION 8. REPEALING CLAUSE – All other ordinances, executive orders, resolutions, regulations, or part thereof, in conflict with the provisions of this ordinance are hereby repealed and revised.

SECTION 9. SEPARABILITY CLAUSE – In the event that any of the provisions of this ordinance and application thereof is declared unconstitutional, the validity of the other provisions shall not be affected by such declaration.

SECTION 10. EFFECTIVITY – This ordinance shall take effect upon approval.

SECTION 11. WIDE INFORMATION DISSEMINATION – This Ordinance shall be published in at least two (2) newspapers of general circulation for everyone’s information and guidance.
